Abstract

This paper explains that the development of BUMN (state owned enterprises) as a corporation that carries out social and business missions is facing constitutional juridical problems and facing the challenges of globalization. Factually, at this time legal development cannot be separated from the influence of globalization. Globalization in the economic field has affected various fields of the business sector in the world.  This globalization is followed by the globalization of law, which causes substantially various laws and agreements to spread across national borders, which causes the merging of legal principles (especially in the economic sector) from one country to another . For Indonesia, the logical consequence of this development is the demand to harmonize the principles of economic law in Indonesia, with the principles of economic law in the international world. Without harmonization, Indonesia can be ostracized in international business activities, because there is no certainty for legal protection for business and investment activities that are commonly carried out globally. The Constitutional Court in case number 48 / PUU-XI / 2013 and case No. 62 / PUU-X1 / 2013 dated May 22, 2013 decided that management  BUMN  must use the principle of Business Jugment Rule. In the ruling, it was also stated that state owned finances were state finances. As a result, this ruling brings legal certainty about the position of finance of BUMN.

Abstract

Perempuan Siladang is an ethnic minority that dwells in Mandailing Godang (Gross Mandailing) in the designation of the Dutch colonial government. This ethnicity has a patrilineal kinship system. The area is now in Mandailing Natal District and precisely in the present Panyabungan sub-district. As a minority the Siladang people tend to be retarded. Compared to neighboring ethnic groups which have been more advanced since the colonial era. Siladang people also did not escape the dynamics of local politics in Mandailing Natal District, their most obvious involvement can be seen when regional elections took place and it was known that their level of understanding of democracy was still very low. Their motives in making choices and voting are still laden with interests in the form of direct material rewards and indirectly strengthened in return. It is known that there is freedom in determining the choice and voting for the pairs of regional head candidates by Siladang women even though there is a dynamic process with other family members in the election process.

To test this hypothesis the One way Analysis of Variance (ANOVA) statistics was computed which yielded p-value = .000 which was less than the alpha value α > 0.05 indicating that the differences in challenges facing ICT integration in boys, girls and co-educational schools were statistically significant. Therefore the null hypothesis was rejected. This led to the conclusion that challenges facing ICT integration from the three categories of schools were significantly different. From the findings of the study, it is recommended that there is need strengthen in service training of teachers in ICT and perform widespread upgrade of ICT software since these were the most serious challenges that faced integration of ICT in schools.
