Abstract

This research is motivated by the writer's anxiety regarding the Review of Islamic Economic Principles in Marketing of Salted Fish (Case Study in Lambur Luar Village, Muara Sabak Timur District). The purpose of this research is how are the factors that hinder the marketing of Salted Fish in Lambur Luar Village. What are the obstacles marketing Salted Fish in Lambur Luar Village. In general, the result is from the analysts, the practice of buying and selling salted fish in Lambur Luar village where a seller sells salted fish which is still wet and has damaged fish is also not in accordance with the initial words.  There are those who consider it a normal thing, but there are also those who feel disadvantaged.  Those who think it is normal are justified because their goal is for the buyer to eat and be delicious or satisfied. The view of Islamic law on the practice of buying and selling salted fish in Lambur Luar village has two legal conclusions.  Namely: first, the law is permissible because the buyer and seller have a willing heart, while the second is haram because in the heart, there is no willingness from the buyer of the salted fish Keywords: practice; marketing; salted fish

Abstract

Throughout my experience in tracking down and reading books on faith-based economics, in this case Islam, there are no books that specifically list the title of "Islamic economics". If there is, it is only initiated or introduced. Most books coming down to us still use the titles starting with the word, for example, system, concept, principle, or the doctrine of Islamic economics. Why do the authors of the book Islamic economics seem not dared to give his book title with label "science"? I presume that Islamic economics has not been considered as a science. In building a science, methodology is required. Islamic Economics also requires a well-established methodology to build the foundation of science. The study answers questions; how is methodology which is offered by Muhammad Akram Khan to build Islamic economics. The method used in this research is the study of literature with qualitative approach. The result of study concludes that Khan offers methodology of Islamic economics, if summarized, written as follows: First, Islamic economics uses a framework derived from the texts of divinity (revelation). Second, Islamic economics uses the inductive method, which gives witness to the truth or falsity assumptions and predictions about the two criteria of rationality and empirical evidence. Third, Islamic economy is built on ethical values such as justice, virtue, moderation, sacrifice, caring for others, in the analysis, as behavioral parameters. Fourth, Islamic economics is a normative discipline. Islamic Economics investigates ways and means to change the existing economy with Islamic economy. Fifth, Islamic economics ask different questions with conventional economics. Its attention is on welfare (falah) human and creating social and institutional conditions that maximize falah in society. Clearly, Islamic economics strongly supports research programs that help maximize falah. Furthermore, Khan elaborates several issues related to the methodology that often appears in the forum of Islamic economists. There are some problems that Khan proposes, they are the interaction with modern economics, the role of revelation, assuming ideal Islamic society, and the general theory of Islamic economics. Keywords:  Islamic Economics, Methodology, Muhammad Akram Khan

Abstract

Indonesia has crucial economic issue that has a very negative impact on other sectors. The problem is unemployment. The unemployment is an economic problem itself. The unemployment can also be a psychological burden for those concerned as well as being a social problem with the emergence of various kinds of social diseases; criminal and immoral acts. In addition, the unemployment also has a negative impact on the decline of the aqidah and moral, households, nations and countries. From an economic standpoint, the unemployment is a major problem that weighs on the economy as a whole, because unemployment is a waste of the valuable potential of human resources that impact on the disbursement of natural resources. Where appropriate natural resources can be optimally and maximally motivated, it turns out to be wasted, because the work ethic of the community is very low. Islam as a universal religion, encourages its adherents to work by producing and pursuing economic activities in all its forms as one solution to overcome unemployment. The work recommended by Islam is to work well (ihsan) full of perseverance and professionalism. Fulfillment of basic needs is the responsibility of each individual and the state must provide facilities and infrastructure that support the implementation of this. The decision and direction of government policies have an important role in suppressing the unemployment rate. Keywords: Unemployment, Solutive Bid, Islamic Perspective

Abstract

The main problem of social life in the community is about how to make the allocation and distribution of income well. Inequality and poverty basically arise not because of the difference of anyone’s strength and weakness in getting livelihood, but because of inappropriate distribution mechanism. With the result that wealth treasure just turns on the rich wealthy, which is in turn, results in the rich get richer and the poor get poorer. Therefore, a discussion on distribution becomes main focus of theory of Islamic economics. Moreover, the discussion of the distribution is not only related to economic issues, but also social and political aspects. On the other side, the economic vision of Islam gives priority to the guarantee of the fulfillment of a better life. Islam emphasizes distributive justice and encloses, in its system, a program for the redistribution of wealth and prosperity, so that each individual is guaranteed with a respectable and friendly standard of living. Islam recognizes private property rights, but the private property rights must be properly distributed. The personal property is used for self and family livelihood, for investment of the working capital, so that it can provide job opportunities for others, for help of the others through zakat, infaq, and shodaqoh. In this way, the wealth not only rotates on the rich, bringing on gap in social life. The problem of wealth distribution is closely related to the welfare of society. Therefore, the state has a duty to regulate the distribution of income in order that the distribution can be fair and reaches appropriate target. The state could at least attempt it by optimizing the role of BAZ (Badan Amil Zakat) and LAZ (Lembaga Amil Zakat) which has all this time been slack. If BAZ and LAZ can be optimized, author believes that inequality and poverty over time will vanish. This is because the majority of Indonesia's population is Muslim. Keywords: distribution of income, State’ role, Islamic economics

Abstract

One of Islamic financial sectors that attract much interest from the business community around the world is the global sharia obligation (sukuk) market. Sukuk has become an important instrument in sharia financial system, both as a financing instrument and investment. This instrument grew rapidly along with the growth and development of other conventional financial instruments. This estimation is based on the large number of infrastructure projects from the Gulf region and across the Muslim world seeking capital for development. This paper tries to answer the question: What are the factors that led to the issuance and development of sukuk in three countries, namely Indonesia, Malaysia, and Turkey? The result shows that government policy and agenda in order to develop sukuk can be concluded that the issuance of sukuk from three countries Indonesia, Malaysia and Turkey is influenced by several factors. However, the most dominant factor, even the factor that has always been the cause of the increased issuance of sukuk in three countries is the regulatory or policy factor, especially regarding the tax on sukuk and the existence of strong legal infrastructure as an umbrella of sukuk practice in a country. It can be said that the smaller the tax on the issuance of sukuk the more sukuk will be published. Then the second element of the regulatory factor is the existence of security guarantees in its implementation from the side of positive law imposed in a State. This factor is also very important especially in cases in Indonesia. With the legal clarity, there is no slit in the weakness of sukuk when compared with bonds. It is different from the two countries above, the advancement of sukuk issuance apart from being influenced by regulatory factors, Malaysia seems to be more benefited by the perception of the global community that Malaysia has become the Islamic economic and finance center in the world, so Malaysia is considered more experienced in this sector. This is a factor that may be considered by global investors, so that Malaysia is to be the right destination for sharia-based investment. Keywords: Sukuk Development, Indonesia, Malaysia, Turkey

Abstract

Islamic finance made its first appearance in the 1970s. Since its inception, Islamic finance has made phenomenal progress and progressed beyond its traditional market into a global phenomenon. The recent global financial crisis has also brought Islamic finance into navel attention. Regardless of the minimal impact accused on Islamic finance, the crisis offers an opportunity for introspection and evaluation. It is inevitable to determine whether it can be a viable alternative to conventional systems in global financial markets. Therefore, Islamic financial institutions must ensure that all transactions are in accordance with sharia, not only in the form and technical law, but more importantly, in their economic substance, which should be based on the objectives outlined by the sharia, also known as maqa>s}id al-shari>’ah. This article aims at examining the concept of maqa>s}id al-shari>’ah  of Islamic jurisprudence in order to appreciate its contribution toward more comprehensive, rational and realistic answers to contemporary financial issues and thereby to increase the awareness of the maqasid approach in structuring and developing Islamic finance products. For this purpose, the author examine the literal and conceptual meaning of maqa>s}id al-shari>’ah  and scrutinise its position in Islamic law. They also highlight the essential elements of maqasid al-shari'ah and explain how this approach may contribute to better solutions for various Islamic finance issues and challenge. Islamic finance as an institution based on the ethical and moral framework of Islamic law assumes a distinctive role in society. Furthermore, the maqashid al-shari’ah framework also implies that. The characteristics of Islamic finance institutions are shaped by higher Islamic legal objectives that emphasize overall social and economic goodness rather than infectious greed and infectious individualism. Productive benefits are commendable as long as they are in accordance with the principles of justice as determined in the sharia. Keywords: Framework, Maqashid al-Shari‘ah, Islamic Finance
