Abstract

The paradigm of productive waqf is contained in Waqf Regulation (Law Number 41 of 2004 Concerning Waqf). This regulation expands the scope of property in waqf which was previously only on fixed objects, now includes movable objects, both tangible and intangible. As an intangible movable object, IPR (Intellectual Property rights) is one of the waqf objects in this regulation. However, the forms of IPR waqf has not been explained on waqf regulations . So that, this paper will discuss the forms of IPR waqf as a part of productive waqf form. First, the absolute handover of IPR by the wakif to Nazir. In this form the nazir can manage IPR waqf by himself or licenses. Second, waqif can do his waqf of IPR for a certain period using a license or franchise

Abstract

Children with special needs or special health care needs (e.g., Down syndrome (DS), autism spectrum disorder (ASD), and cerebral palsy (CP)) are considered special because they require, in most cases, extraordinary long-term care in the hope of meeting developmental needs. In this regard, there is a systemic perspective of resilience in the ecology and development context, pursuing to identify for individuals to cope with persistent stresses. Based on this problem, “YAKUT” Special School type C-CI Purwokerto conducted a resourcefulness development program for mentally disabled students at “YAKUT” Special School type C-CI Purwokerto to increase the resilience of these students. In this study, the researcher used a qualitative type of research. The data collection process was carried out through observations at Yakut” Special School type C-CI Purwokerto, held from November to December 2021, and interviews with teachers at “YAKUT” Special School type C-CI. The entrepreneurial program programmed by “YAKUT” Special School type C-CI Purwokerto aims to help students remain competitive in the community. Students are trained to be tough and adapt to their limitations in this situation. Students who have resilience are willing to work hard to achieve their goals, adapt to changes to take advantage of new situations, and learn from their mistakes.

Abstract

This research is to uncover Zakiah Daradjat's thoughts on the concept of mental health and mental care. The research method used is library research with content analysis techniques. The results of the study show that as a religious psychologist, Zakiah Daradjat sees spirituality as mental therapy. Mental health is the ability to adjust to yourself, with other people and society and the environment in which he lives. To form a healthy mentality in addition to adjusting, as well as calmness of life, knowing psychiatric disorders / mental illness, spiritual and Islamic education which includes family education, school, society. In his opinion Indeed the peace of life, peace of mind or inner happiness, does not depend much on external factors such as social, economic, political, customary habits and as such; but more depends on the way and attitude to face these factors. So what determines calmness and happiness of life is mental health. Mental health is what determines a person's response to a problem, and his ability to adjust. Mental health is what determines whether people will have the excitement to live or be passive and lackluster. While mental care through creating a relationship between the consultant and the child, accepting the child seriously, forgiving the child (tolerance), knowing the feelings of the child and then reflecting his head, still respecting the child, the child who leads him in the treatment sessions, may not scramble for treatment, and limit restrictions.

Abstract

Waqf is one of the elements in Islamic teachings, as well as an instrument in Islamic economics. Hadiths that talk about waqf in particular are rarely found in the main book of hadith, but uniquely there are many hadith editors who have a meaning with waqf narrated by hadith narrators. The method in writing this article uses Takhrijul Hadith, while the approach uses descriptive qualitative. The results obtained are that there is a hadith narrator named Nafi’. This Nafi' narrated the hadith about waqf in two different sanad. After examining these two different sanad, they concluded that the quality of the sanad is Sahih. Besides that, that the use of waqf now is not only for mosques, prayer rooms, madrasas, Islamic boarding schools, cemeteries, but waqf can also contribute to agrarian matters.

Abstract

This study  aims  to  analyze  the  thoughts  of  Abdullah  Ahmed  an-Naim  related  of  constitutionalism,  human rights and citizenship based on justice in minority groups.  An-Naim’s thoughts on human  rights  can  be  accommodated  to  public  expectations  regarding  the  issue  of  the  Ahmadiyya  community  in  Indonesia.  Read an-Naim’s theory regarding women,  non-Muslim  status  and  apostasy. The issue of human rights initiated by an-Naim will be the basic foundation in the explicit explanation of this paper. Considering the existing social values based on the enforcement of human rights in Indonesia, the position of the Ahmadiyya community must be positioned equally in the law in terms of rights and obligations as  part  of  Indonesian citizens. The state must be neutral considering the Ahmadiyya community in responding to its religious existence.  The government must maintain neutrality in regulating religious life for every citizen in order to create an atmosphere of harmony and peace. This paper attempts to produce a peaceful religious discourse in the context of religious freedom in Indonesia

Abstract

This study aims to determine the factors that influence changes in the legal awareness of the community and nazhir in Bantul Regency towards the paradigm of fixed object waqf towards progressive waqf. The type of research is a field study. The method uses descriptive qualitative juridical data analysis. The primary data is conducted by interviewing the respondents with purposive sampling. The results showed that three determinant factors influenced the progressive waqf paradigm: 1) Public understanding of waqf property was limited to fixed objects (unmovable objects). 2) Public understanding of the allocation of waqf property is limited to educational and worship facilities. 3) Public understanding of the waqf reward is limited to education and worship.

Abstract

The study of disability is one of the most important studies in Islam. In the study of Islamic law, the problem of disability is seen as one of the conditions that can cause the perpetrators to get various conveniences and tolerances in carrying out religious rules. However, this perspective is seen as still not enough to be a solution to the problem of disability. This is because this perspective still positions people with disabilities in a powerless position and still does not have the same opportunity to receive their legal rights as legal subjects. This study aims to examine in depth the position and capacity of persons with disabilities as legal subjects in Islamic law. The conclusion of this study is that persons with disabilities are legal subject with full rights as the normal people. They have the right and are capable of receiving and acting legally. In terms of receiving rights, persons with disabilities are full legal subjects. As in the field of ibadah, persons with disabilities have the capacity as full legal subjects but with tolerance according to their abilities. Meanwhile in the field of muamalah, persons with disabilities are subject to certain limitations in their capacity as legal subjects.

Abstract

Questioning the issue of the minimum rules for marriage in Islam itself is not explained in detail about the minimum age for marriage. In jurisprudence, scholars of different schools of thought have different opinions regarding the minimum age limit for marriage, which in essence, someone who has reached the age of puberty can already get married. This article aims to discuss the minimum rules for marriage that are applied in every Muslim country in the world. The minimum marriage rules discussed are in Indonesia, Algeria, Bangladesh, Egypt, Iraq, Jordan, Lebanon, Libya, Malaysia, Morocco, Yaman, Pakistan, Somalia, Syria, Tunisia, Turkey, Afghanistan. The minimum age difference in some Muslim countries including Indonesia stems from the way each country determines the direction of their legislation, especially in marriage laws. Because in some countries it refers to the school of jurisprudence that it uses. Then, the purpose of the minimum age in marriage is to minimize the risks that will occur in marriage such as: Divorce caused by the immaturity of the child's mentality, difficulties in fulfilling family livelihoods, the potential for the birth of an unhealthy child caused by the biological immaturity of the child, and potential for maternal death due to pregnancy at an early age.

Abstract

This article I focus on the reasons for granting polygamy permission for a man as contained in the provisions of Article 4 of Law No. 1 of 1974 and Article 57 Compilation of Islamic Law using the approach of ushul fiqh. Polygamy is an issue in Islamic family law both in classical jurisprudence and in contemporary jurisprudence. Islamic marriage law allows husbands to commit polygamy with a maximum of four as in the QS. An-Nisa verse (3) among scholars have different opinions about the provisions of polygamy, there are those who allow it with loose requirements and there are also some scholars who require it strictly. The granting of polygamy permission is very relevant to the concept of sharia maqasid in the aspect of daruriyat, which is to protect the offspring (children) in article 4 of Law No. 1 of 1974 and article 57 KHI if a wife is unable to give birth or give offspring then the husband has the right to propose to marry more than one wife.

Abstract

This paper aims to explain the role of Rumaysho's matchmaking agency in helping the public in choosing their soul mate. This writing method is a qualitative research with a socio-normative approach. Rumaysho's matchmaking agency was established as a da'wah institution and helped the community in finding their soul mate. The role of the Rumasyho matchmaking agency is not only to find but to guide potential partners to marriage. Many people in the modern era have become less confident in choosing a mate, so the alternative is to come to the Rumasyho matchmaking bureau to register themselves.
