Abstract

The validity of a marriage in the Islamic Shari’a must fulfill harmony and the conditions that have been set. Beside that, there ia a provision stipulated by Allah Swt. as the obligation of prospective husbands in the implementation on the marriage contract, namely regarding or dowry or dowry. As explained in the Al-Qur’an letter An-Nisa ‘verse 4. Because the gift of dowry is an obligation on the basis of willingness, the rate of dowry is not determined by the number or amount. Regarding the maximum amount of dowry, the ulama or prist of the school of thought, it was agreed that there was no maximum limit, but they differed in their opinion about the minimum limit.According to Abu Hanifah the defination of marriage is a contract (agreement) exchange of benefits between husbend and wife so that the marriage contract is based on the contract of sale and considers the gift of dowry as a substitute for a woman’s virginity because Abu Hanifah himself is known as an expert in Kuffah city.Conclusions that can be taken in writing this journal, that Abu Hanifah in applying every law is based on the Al-Qur’an, hadits, fatwa of friends, ijma’ and if it is not there then kias, istihsan, and urf.

Abstract

Types of punishment provided for in the book the law of criminal law, namely criminal subject matter which consists of a criminal to death, imprisonment. As for the types of sanction or punishment in Islamic criminal law includes the law of jarimah adultery, penalty jarimah qadzaf, jarimah punishment of theft, jarimah punishment. Indonesia at the moment very much in need of a great variety of study on the concept of criminal sanctions in order to reduce islamic values through this Focus Group Discussion or conference, etc. Of a will can contribute to the renewal of a criminal law reform And there should have been a kind of work for punishment of the formulations in the form of social as well as the completion of matter outside the court (restorasi justice).

Abstract

Al-Qur'an as the main reference guide for the life of believers has set a reference in terms of worship and muamalah. In the field of muamalah, al-Qur'an also pays attention that this worldly affair is also valuable as worship by not violating sharia rules. One that relates to this is the Qur'anic guidance on ethics in the sale and purchase transactions contained in the An-Nisa letter (4) verse 29 which emphasizes that every believer must obtain assets in a way that is justified by sharia, one of the characteristics of things this is the passion between the seller and the buyer in the sale and purchase transaction.

Abstract

This study aims to determine the factors causing the emergence of public compliance with the law, through studies and analysis of a variety of literature both print and from various other social media. Community compliance with the law can essentially be interpreted as loyalty from the community as a legal subject that is realized through actions or behaviors that comply with existing law.Based on the results of the study, the authors conclude that there are two factors causing the emergence of community compliance with the law, namely internal and external factors. Internal factors are encouragement from within an individual that makes him obey the law without coercion from any party. Internal factors can be in the form of an individual's awareness of the benefits of the law, the belief that the law is made to realize a common goal, and other things that arise from the individual. While external factors can be interpreted as factors that encourage individuals to comply with laws that come from outside the individual self. External factors can include rewards, coercion, threats and other things that come from outside the individual.

Abstract

The objectives of this study included: a) To analyze the effect of profitability on ISR disclosures; b) To analyze the effect of company size on ISR disclosures; c) To analyze the effect of profitability, firm size, on ISR Disclosure simultaneously. The population in this study are all companies listed in the Jakarta Islamic Index (JII) for the 2014-2016 period. The variables used in this study include Dependent variable (Y) is Islamic Social Reporting (ISR) (Y) and the independent variable (X) is profitability (X1) and firm size (X2). The method of data analysis uses descriptive statistical analysis and multiple linear regression analysis. Haisl research shows that profitability has a statistically significant effect on ISR, meaning that any increase or decrease in profitability affects the increase in ISR; the size of the company statistically has no effect on ISR, meaning that any increase or decrease in the variable size of the company has no effect on the increase and decrease in ISR.

Abstract

This study aims to determine the implementation of Yasmin and Restaurant management in accordance with the National Sharia Council (DSN) Indonesian Ulema Council (MUI) Fatwa No. 108 / DSN-MUI / X / 2016 concerning Islamic hotels. This research is a qualitative research with a descriptive exploratory approach. The method used is an in-depth interview with the Manager of the Yasmin Hotel and Restaurant, accompanied by observation and documentation. The data analysis technique used is the James Spardley model of data analysis techniques through four stages, namely: Domain Analysis, Taxonomic Analysis, Componential Analysis, Cultural Theme Analysis. The results of this study indicate that the implementation of Yasmin hotel and restaurant management in West Bangka Regency is in accordance with the MUI DSN fatwa No: 108 / DSN-MUI / X / 2016.
