Abstract

Applications for permission to practice polygamy raise issues regarding the application of legal requirements and the principle of justice. This study analyzes Decision No. 49/Pdt.G/2023/PA.LK, as it represents a rejection of an application for permission to practice polygamy that is relevant to examine from the perspective of Western schools of legal philosophy. This study employs a normative legal methodology. The results show that the denial was based on the failure to meet legal requirements as well as the need to protect the wife’s rights. Based on the schools of natural law, legal positivism and utilitarianism, the decision reflects justice, legal certainty and utility. This study contributes to strengthening philosophical analysis and serves as a reference for judges in adjudicating cases involving polygamy permits to ensure legal protection that is effective, consistent and oriented toward justice. Furthermore, this study underscores the importance of a legal philosophy approach in understanding judicial reasoning, ensuring that the application of law is not merely based on statutory rules but also accounts for the moral and social aspects within society.

Abstract

Girik is not proof of land ownership rights but merely evidence of customary land control and tax payment; therefore, it cannot be equated with a land certificate. This study examines the legal status of girik as evidence, the legal protection of its holders against holders of Freehold Title Certificates and the legal reasoning of the Supreme Court in Decision Number 1559 K/Pdt/2025. The research employs a normative legal method with statutory and case approaches. The results indicate that girik serves only as preliminary evidence, while legal protection is both preventive and repressive. The Supreme Court emphasizes that girik lacking a clear administrative basis cannot outweigh the evidentiary strength of a land certificate and highlights the importance of orderly land administration in legal proof.

Abstract

Hibah is a legal act of transferring property rights recognized in both Islamic law and civil law. Issues arise when hibah is conducted over jointly owned property without the consent of all owners or exceeds the one-third limitation, potentially harming heirs. This normative study analyzes legal provisions, the legal consequences of hibah deeds and judicial considerations in the Sidoarjo Religious Court Decision Number 3937/Pdt.G/2021/PA.Sda. The results indicate that hibah must originate from fully owned property and is limited to one-third, as well as subject to the concept of legitime portie, so violations may result in partial or total annulment to protect the rights of entitled parties in accordance with principles of justice and legal certainty.

Abstract

This study aims to describe the level of taxpayer compliance in paying the Rural and Urban Land and Building Tax (PBB) in Pangkalpinang City in 2024. The study employed a quantitative descriptive method with an empirical approach. A total of 81 taxpayers were selected using purposive sampling. Data were collected through questionnaires and analyzed using descriptive statistics. The results showed that the mean taxpayer compliance score was 110, which falls into the high category based on the predetermined assessment criteria. These findings indicate that taxpayers in Pangkalpinang City demonstrate a high level of compliance in fulfilling their Land and Building Tax obligations, thereby supporting the increase in Regional Original Revenue (PAD).

Abstract

Artificial Intelligence (AI) has transformed business crime into algorithm-driven misconduct that challenges conventional criminal law in Indonesia. This study examines regulatory gaps in imposing corporate criminal liability for AI-assisted business crime using normative legal research with statutory, conceptual, comparative and case approaches. The findings reveal three major deficiencies: the absence of AI-specific criminal norms, limitations of the traditional mens rea doctrine and weak corporate AI governance obligations. This study argues that AI adoption in criminal law requires a shift from individual fault to algorithmic governance failure, particularly in determining corporate criminal punishment and strengthening accountability in AI-driven business crimes.

Abstract

This study aims to analyze the comparison of the regulation of persecution offenses in the Criminal Law Code of 1946 and the Criminal Law Code of 2023 and review it from a human rights perspective. This study uses normative legal research methods with legislation, conceptual and case approaches. The results showed that the 2023 criminal code retained the substance of the regulation of the offense of persecution in the 1946 criminal code, but updated the formulation of norms, the criminal system of fines and the orientation of punishment. In the perspective of Human Rights, the arrangement has protected the right to bodily integrity, but has not optimally accommodated the protection of psychological impact and recovery of victims.

Abstract

Electronic-Based Sexual Violence (EBSV) in higher education has continued to increase alongside the expansion of digital interactions and the normalization of locker room talk, which reinforces unequal power relations. This study aims to analyze the barriers to legal protection for victims arising from unequal power relations and to formulate a reconstructed model of legal protection that integrates institutional strengthening, digital evidence mechanisms and legal culture reform. The research employs a normative juridical method using statutory and conceptual approaches grounded in feminist legal theory. The findings reveal that unequal power relations and the culture of locker room talk undermine the effective implementation of Minister of Education, Culture, Research and Technology Regulation No. 30 of 2021 and Law No. 12 of 2022 on Sexual Violence Crimes. The novelty of this study lies in the formulation of an integrated legal protection model that extends beyond regulatory reinforcement by combining the institutional independence of the Sexual Violence Prevention and Response Task Force (Satgas PPKS), enhanced digital forensic capacity, optimization of electronic evidence and gender-responsive legal culture reform into a comprehensive victim protection framework within higher education institutions. This model is expected to strengthen the effectiveness of legal protection for victims of Electronic-Based Sexual Violence in higher education.

Abstract

Differences between civil law and common law systems affect the position, authority and role of notaries in the legality of international documents and contracts. Indonesia, as a country adhering to the civil law system, grants broad authority to notaries to prepare authentic deeds, perform legalization, waarmerking and certify documents. Furthermore, Indonesia became a Contracting Party to the Hague Apostille Convention on 5 October 2021 and the Convention entered into force on 4 June 2022, enabling Indonesian public documents to be authenticated through the Apostille mechanism for use in other Contracting States. In contrast, Malaysia, which follows the common law system, is not a Contracting Party to the Hague Apostille Convention as of 2026. Consequently, Malaysian public documents intended for use abroad remain subject to the conventional legalization process through the competent authorities. This normative legal research employs statutory, conceptual and comparative approaches. The results show that Indonesian notaries perform broader functions than Malaysian Notaries Public, whose authority is generally limited to the authentication and legalization of documents. Accordingly, Indonesian notaries play a more strategic role in ensuring legal certainty, formal validity and the evidentiary value of international documents and contracts.

Abstract

The validity of a deed of gift legalized by a Notary under coercion must be examined based on Article 1320 of the Indonesian Civil Code, particularly regarding the requirement of free consent. A study of the Decision of the Medan High Court Number 157/Pdt/2024/PT.Mdn in conjunction with the Decision of the Kisaran District Court Number 51/Pdt.G/2023/PN.Kis shows that legalization only guarantees formal aspects and does not eliminate defects of consent. A Notary may be qualified as committing a tort if they neglect their duties in accordance with the Law on Notary Position. The judges’ legal considerations are deemed appropriate as they are based on evidence of coercion and Notary negligence, resulting in civil, administrative and even criminal liability for the Notary.

Abstract

This study aims to analyze the compliance of forced marriage practices in Gunung Eleh Village, Madura, with Islamic law and positive law. The study employs an empirical legal method with a qualitative approach through field data collection to identify the causal factors, impacts and legal consequences of this practice. The results indicate that forced marriage is still influenced by the culture of arranged marriages, obedience to religious leaders (kyai) and the community’s low levels of education, economic status and legal awareness. This practice has legal consequences because it violates positive law, specifically Article 6(1) of Law No. 1 of 1974 on Marriage and Articles 16(1) and (2) of the Compilation of Islamic Law, which require the consent of both prospective spouses. Meanwhile, from an Islamic legal perspective, this practice also violates one of the essential elements and requirements of marriage. Consequently, the marriage may be annulled by a court. This research is important for contributing to rural communities regarding the consent of prospective spouses as a form of protection for women’s rights in the context of marriage.
