Abstract

This article examines the implementation of asymmetric decentralization and the constitutional design of the North Sulawesi Provincial Government’s paradiplomacy in Asia-Pacific border governance through normative legal research. The findings indicate that North Sulawesi’s strategic position as a border region requires a more adaptive distribution of authority. However, the centralization of foreign affairs powers continues to limit regional paradiplomatic initiatives. Therefore, strengthening the constitutional framework is necessary to support coordinated economic cooperation, security, and border area development within the framework of the Unitary State of the Republic of Indonesia.

Abstract

Asset forfeiture has become an essential legal instrument in combating crime by facilitating the recovery of state losses and depriving offenders of the economic benefits derived from criminal activities. Legal issues arise when the confiscated assets are owned or controlled by third parties who are not directly involved in the underlying offense, while the existing legal framework, particularly Law Number 8 of 2010 on the Prevention and Eradication of Money Laundering, as well as other regulations governing asset forfeiture, does not provide adequate legal certainty regarding the protection of bona fide third parties. Furthermore, the Draft Law on Asset Forfeiture is expected to address these legal shortcomings; however, it still requires clearer provisions concerning evidentiary standards and legal safeguards for good-faith third parties. This study aims to analyze the legal framework governing asset forfeiture involving third parties under Indonesian positive law and to evaluate the urgency of strengthening such regulations through the Draft Law on Asset Forfeiture. This research employs a normative juridical method using statutory, conceptual and case approaches. The findings indicate that the current legal framework lacks explicit provisions concerning the legal status of third parties, the standards for proving good faith and effective objection mechanisms against asset forfeiture, thereby creating legal uncertainty. Therefore, the Draft Law on Asset Forfeiture should explicitly regulate the criteria for bona fide third parties, establish proportional evidentiary standards, provide effective objection procedures and harmonize its provisions with the Anti-Money Laundering Law to ensure both effective asset recovery and equitable legal protection.

Abstract

In Indonesia, the legal relationship between doctors and patients is fundamentally constructed as a therapeutic contract based on the principles of civil law. However, in practice, doctors often provide medical services within an institutional framework, such as hospitals, so that their status can simultaneously be positioned as that of an employee or a professional based on a specific employment relationship. This dual position creates ambiguity in determining legal liability when medical disputes arise. Although various studies have addressed medical liability and patient protection, research that critically analyzes the ambiguity of doctors’ legal status within therapeutic agreements and its implications for legal protection in medical disputes remains relatively limited. This study aims to analyze the ambiguity of doctors’ legal status in therapeutic agreements and to examine its implications for legal protection mechanisms in the resolution of medical disputes. The research method used is normative legal research employing a statutory approach and a conceptual approach. Legal materials were systematically analyzed to identify inconsistencies between civil law, criminal law and medical practice regulations. The research findings indicate that the therapeutic agreement is essentially a contractual relationship between the physician and the patient based on trust and professional standards. However, when a physician acts within an employment relationship with a hospital, issues arise regarding the allocation of legal liability whether it rests with the physician personally, the hospital as the employer, or both jointly. This ambiguity has the potential to undermine legal certainty and affect the protection of both patients’ rights and the rights of medical personnel. Therefore, regulatory harmonization is necessary to ensure a balance of legal protection and uphold the principle of procedural justice in the resolution of medical disputes.

Abstract

This study critically examines the development of Indonesian labor law, particularly the two paradigms of termination: (constructive dismissal) (constructive layoffs) and (forced resignation) (forced resignation). Two main findings emerged from the data. First, the code of ethics (constructive dismissal) in the regulation reduces the value of severance compensation by 2 to 1 so as to eliminate the deterrent effect for employers. Second, there are some managers for employees to perform their practical obligations (forced resignation) through the scheme (forced resignation) through the scheme (quiet firing). The conclusion that the existing legislation creates an economic policy for companies to go along the path of least costly termination of employment, that is, the reform of the procedural law on payments and the creation of minimum Norms for the division of money.

Abstract

Flight cancellation is a disruption in air transport services that causes losses to passengers, including time loss, additional costs and travel uncertainty. This article analyses the legal protection of air passengers affected by flight cancellations and proposes a more effective protection model. This study employs normative legal research using statutory, conceptual and limited comparative approaches to passenger-rights regimes in the European Union and selected international practices. The findings show that air passengers are both consumers of services and parties to a contract of carriage; therefore, they are entitled to information, safety, comfort, compensation, refund, rerouting and complaint mechanisms. In Indonesia, such protection is based on the Consumer Protection Law, the Aviation Law and technical regulations issued by the Ministry of Transportation. Nevertheless, implementation is still constrained by insufficient transparency of passenger rights, delayed refunds, standard clauses limiting airline liability and weak supervision and dispute resolution. This article recommends strengthening cancellation-notice standards, digitalising compensation claims, clarifying rerouting duties and improving administrative sanctions against airlines that fail to fulfil passenger rights.

Abstract

The difference in regulations between the obligation to provide physical burial land and the compensation payment mechanism raises questions about the validity of the norms and the legal responsibility of the developer. This study aims to analyze the desynchronization of regulations on the provision of burial land and to examine the validity of compensation payments as a form of fulfilling the developer's obligations according to Hans Kelsen's perspective. This research is a doctrinal legal study focusing on the system of norms and legal rules governing the provision of burial land in housing development. The approach used is the legislative approach and the conceptual approach, utilizing primary and secondary legal materials, as well as interviews as supporting materials to clarify the results of the legal material review. The research results indicate a desynchronization of regulations between central and regional policies due to the expansion of the compensation mechanism from a specific instrument in lowincome housing to a generally applied instrument. The desynchronization is evident in the differences in regulations between the norm that emphasizes the physical provision of burial land and regional regulations that allow for a broader scope of compensation payments. Regulatory harmonization is carried out by reaffirming the provision of physical land as the primary obligation and integrating compensation payments with the cemetery land procurement system, recording, reporting and transparency in the realization of compensation fund usage. From the perspective of Hans Kelsen's theory, compensation payments retain validity and binding force as long as the norm governing them has not been revoked, thus not eliminating the developer's legal responsibility but rather transforming the form of its fulfillment into a reparative obligation.

Abstract

Cyber extortion under the guise of love scamming is a cybercrime that exploits false emotional connections to commit blackmail through electronic media. This study aims to analyze the workings and operational structure of cyber extortion syndicates under the guise of love scamming and the factors that contribute to the circulation of illegal communication devices in correctional institutions. The study used empirical legal methods with a criminological and legislative approach. Data were obtained through interviews and literature review, then analyzed qualitatively. The results indicate that the crime is committed through victimization, establishing emotional relationships, exploiting personal data, extortion, and concealing the proceeds of crime. Contributing factors include overcapacity, limited officers, the involvement of individuals, weak security technology, and external network support.

Abstract

This study aims to analyze law enforcement against perpetrators of fraudulent practices on the Shopee e-commerce platform within the jurisdiction of the Cirebon City Police and examine how the perpetrators are legally responsible for consumer losses incurred due to these fraudulent practices. The research method used is an empirical juridical method with a sociological approach through a case study in the Cirebon City Police area. The results of the study indicate that findings related to the law enforcement process by the Cirebon City Police are hampered, especially in terms of evidence, the use of electronic evidence and the application of provisions in the ITE Law and the Consumer Protection Law. In addition, law enforcement against e-commerce fraudulent practices requires synergy between law enforcement officials, consumer protection agencies, business actors and digital platforms to realize effective legal protection.

Abstract

This study aims to analyze the evidence of the element of "distributing and/or making accessible" online gambling content by endorsement recipients based on Article 27 paragraph (2) of the Electronic Information and Transactions Law and analyze their criminal liability. This study uses a normative juridical method with a statutory and conceptual approach. The results of the study indicate that the evidence must be based on the fulfillment of the elements of the crime, the element of intent, and valid electronic evidence. The criminal liability of endorsement recipients is analyzed based on the provisions of the ITE Law, the regulation of gambling crimes in the Criminal Code, and the concept of participation (deelneming), so that perpetrators who are proven to play an active role in promoting online gambling can be punished according to the provisions of statutory regulations.

Abstract

This study aims to analyze the legal protection and legal consequences of the practice of collecting voter personal data without permission by political parties in the political party information system (SIPOL). This study uses a normative legal approach using primary, secondary and tertiary legal materials. The results of the study found that the practice of collecting personal data without permission is rooted in the fragility of the verification mechanism in the Political Party Information System (SIPOL) which has not integrated comprehensive personal data protection standards as mandated by Law Number 27 of 2022 concerning Personal Data Protection. In addition to violating privacy. This data collection has an impact on hindering careers in the public sector such as civil servants, the TNI, the Polri and election organizers due to the forced loss of political independence status. Therefore, strengthening regulations, political party membership verification mechanisms and effective law enforcement are necessary to guarantee personal data protection and legal certainty for the public.
