Abstract

Recently, there was an accident caused by a tronton truck driver while doing his job. This accident in Balikpapan caused fatalities, injuries, and vehicle damage. Based on this, the author wants to examine the liability of the accident and the form of compensation for the victims. The result of the study indicates that the employer is liable for losses arising from unlawful acts committed by his employee while doing his job as regulated in Article 1367 (3) BW. In addition, victims of this accident can claim material and immaterial compensation which accordance with Article 1370 BW and Article 1371 BW.

Abstract

Recognition of the authority of creditors in filing applications for Suspension of Payment (PKPU) at the implementation level is often misused by creditors with bad intentions as a shortcut to bankrupt debtors. Therefore, the Constitutional Court through Ruling Number 23/PUU-XIX/2021 decided to open space for an appeal against PKPU whose reconciliation proposal was rejected by creditors. But on the other hand, the existence of decisions that are final, binding, and erga omnes a quo arises skepticism of the essence and principles contained in the payment suspension institution itself. Moving on from these problems, this study aimed to analyze the juridical implications of Ruling Number 23/PUU-XIX/2021 on the existence and essence of the PKPU institution in Indonesia. This type of research is doctrinal research that relies on secondary data. The findings in this study indicated that the opening of an appeal in PKPU due to the rejection of the peace proposal by creditors has the potential to cause uncertainty, and injustice to parties with good intentions, and distort the essence of the payment suspension institution itself. The basic problem that allowed distortion of the payment suspension institution is that the filing requirements were too simplistic, thus creating a high possibility for the bankruptcy of solvent debtors.

Abstract

The increasingly massive use of the internet is now affecting the world economy marked by the birth of E-Commerce. This E-Commerce mechanism that does not bring together sellers and buyers directly raises various problems over the subjective and objective terms of the sale and purchase agreement. Therefore, the article aims to analyze the urgency of using the concept of Smart Contract technology-based agreements in the sale and purchase transactions in E-Commerce. The result obtained is the use of Smart Contracts in the sale and purchase transactions in E-Commerce is considered very important to see the advantages in terms of security, verification, changes in the content of the agreement, and the strength of evidence.

Abstract

The Indonesian Civil Code still refers to Burgerlijk Wetboek (BW), a legacy from the Dutch colonial era which inaugurated from Staatsblad 1847 No. 23. Since then, BW has become the main reference for civil law in Indonesia and remains in effect even after Indonesia’s independence. Based on Article 1 Transitional Rules of Indonesian Constitution. However, until now there has not been a new Civil Code Act as a substitute for the Dutch East Indies Civil Code which has been ratified. As the main legal basis, there are several problems such as the lack of clarity regarding the status of the Civil Code, difficulties in translation, and several articles in it that are not in accordance with the times. This article argues that the renewal of the Civil Code in Indonesia is an urgent matter by combing through articles that are still relevant and in accordance with the times.

Abstract

The abolition of Articles 64, 65, and the revision of Article 66 of the Labor Law regarding the limitation of the outsourced work in the Job Creation Law have sparked conflict among workers. The reason is because the Outsourcing regulation in the Job Creation Law is considered to exploit and marginalize the humanitarian side of workers. The purpose of the research is to examine the problems of Outsourcing regulation after the Job Creation Law that will provide flexibility for employers to use outsourced workers that can trigger modern slavery practices, decreased certainty of permanent employment, and vulnerability of workers' rights.

Abstract

The dynamics of updating labor regulations need to be studied for the benefit of society in general, and workers/labourers in particular. Since the enactment of Law No. 11 of 2020, and Government Regulation No. 35 of 2021, there have been the deletion, renewal, and the insertion of new articles on labor law. Among these regulatory reforms, what is discussed in this study is focused on analyzing the rules for a Specific Time Work Agreement (PKWT) in the Job Creation Law. There is a change in the PKWT rules, namely that workers/laborers whose contract period has expired are entitled to receive compensation or severance pay. This is something new, so the purpose of this study is to analyze normatively the rules for providing compensation or severance pay, starting from the distribution of the amount, to the sanctions that the company gets if it violates it.

Abstract

The government of Indonesia released the Minister of Manpower Regulation Number 2 of 2022 concerning Old Age Security as social protection to ensure the life of workers in retirement, but this regulation lead to polemics in various circles. This study uses a normative juridical method with reference to secondary legal materials in the form of legislation and library materials. The results of the study indicate that the reason for the existence of this Law is because it is considered not included in the sociological requirements and the General Principles of Good Governance as attached in the Government Administration regulation. The government should be able to put forward the needs of the civil country so that it does not only fulfill the interests of a few people.

Abstract

Old Age Security (JHT) is a social guarantee program that provides cash benefits to participants when reaching retirement age, permanent disability, or death. The provision of JHT benefits is regulated in the National Social Security System Act (SJSN Act), and Government Regulation, and is carried out based on The Minister Of Manpower Regulation No. 2 Of 2022 (Permenaker Nomor 2 Tahun 2022). However, problems arise when there is a conflict regarding the arrangement of JHT benefit payments contained in the regulation. This is evidenced by the difference in arrangements between Article 37 paragraph (3) of the SJSN Act which allows disbursement of JHT funds with a minimum membership of 10 years, while in Article 5 of The Minister Of Manpower Regulation No. 2 Of 2022, the disbursement of JHT funds must wait until the age of 56 years. Therefore, this paper aims to find out the differences in the mechanism of payment of JHT benefits contained in the regulation and legal efforts that can be made related to this issue. The preparation of this article uses normative legal writing methods using a statutory approach (Statute approach) which refers to several relevant laws and regulations.

Abstract

The International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families provides protection for workers' rights that need to be harmonized with current developments. This convention guarantees respect and equality of position and status for migrant workers in the era of globalization. With the current urgency, the 1990 Migrant Convention which has been ratified into Law No. 6 of 2012 needs to be analyzed through normative legal studies so as to produce suggestions for optimizing some of the gaps in the 1990 Migrant Convention.

Abstract

Customary inheritance law is closely related to the kinship system adopted by an indigenous people. Indigenous Balinese adhere to a patrilineal kinship system with a majority inheritance system. So that the heirs in the Balinese customary law community are only boys, while girls are not allowed to inherit. To get her inheritance rights, a Balinese Hindu girl can get it in the form of grants or marriage gifts (spirit of funds), tetadan and bebaktan. Apart from that, it is also possible to change the status of women to men (sentana rajeg).
