Abstract

In the world, there are two legal systems that are widely used by countries, namely Civil Law or Continental Europe and Common Law or Anglo Saxon. The two legal systems have their own characteristics that result in advantages and disadvantages. Simply put, civil law requires legal certainty with the use of laws and regulations as the main reference. While Common Law demands the newness of the law in accordance with the conditions of the community by relying on the consideration of the judge's decision to the previous ruling. This, of course, provokes philosophical opposition and forces the mind to choose which system is most ideal to use. In this paper, the author attempts to comprehensively analyze the dilemma between the two legal systems.

Abstract

This research takes the object of customary law that grows, develops and is adhered to by the Tengger Indigenous Law Society. The viewpoint taken in understanding the evolving law in the Tengger Indigenous Law Society as law is not written in the legal context as a product of culture. Law is essentially a form of cultural expression of society that radiates from the results of the copyright, taste and work of the community. So that the law basically has characteristics that are social and localistic. Although no more strict than written law equipped with a definite sanctions mechanism, but customary law managed to make the community run by following the social order as expected by the legislator, which allows the author to explore the legal value of Tengger's local constitutional law.

Abstract

Adat law is a set of written and unwritten norms that have lived in communities since historical period. In some regions in Indonesia that are still thick with customs and culture, customary practices are often carried out which often results in inconsistent with positive Indonesian Law. The practice of Ngarorod Marriage is a tradition of the Balinese people could raise questions with Indonesian legal regulations, especially Law No. 1 of 1974 concerning Marriage. The kinship position and the difference of the female caste is higher than the men being, is one of the causes of the Ngerorod custom.

Abstract

The COVID-19 pandemic is still hitting several countries in the world, one of which is Indonesia. Various efforts have been made to prevent the spread of the COVID-19 virus by the Indonesian government. One of them is the launch of Peduli Lindungi application to track every possible transmission. The launch of this application is based on the Decree of the Minister of Communication and Informatics No. 171 of 2020 concerning the Determination of Peduli Lindungi Application in the Framework of Health Surveillance for The Handling of Corona Virus Disease 2019 (COVID-19). However, the use of this application still has the potential to jeopardize the security of users' personal data. The purpose of this research is to discover potential breaches of personal data protection and to present the concept of Privacy by Design to be applied in the protection of personal data in the Peduli Lindungi application. The research method used is the normative research method. The results showed that the use of Peduli Lindungi application has the potential to cause a breach of personal data security regulated in the ITE Act. Access to data stored in the user's mobile device data is not clear and notified to the user when starting to use this application. Besides, the application also does not explain who can access and process the data. Also, it is not yet clear whether the personal data in this application will be automatically deleted when the COVID-19 pandemic is over considering the Peduli Lindungi application is temporary. Potential violations arise because the protection of personal data has not been fully realized. To avoid potential breaches of personal data protection and realize complete protection of personal data, the government can apply the concept of Privacy by Design in regulations related to the protection of personal data both existing and future.

Abstract

Land acquisition is a problem that affects infrastructure development in Indonesia. Various issues about land acquisition can hinder economic development and add to the development gap in Indonesia. Various efforts have been made by the Government to continue to support and succeed the land acquisition program. The problem that is often faced in the land procurement process is land disputes in addition to legal disputes. Various disputes that exist have the potential to hamper the construction of an infrastructure project, even not infrequently the infrastructure project becomes abandoned for many years. This is where the further enforcement of Law No. 2 of 2012 on Land Procurement for Development in the Public Interest is expected to be a means of smooth land procurement process for development in the public interest, especially infrastructure. According to the law a quo, the procurement of land for infrastructure is determined by the Governor through a decree to designate a region as infrastructure development land. If there are objections, then there will be a lawsuit to PTUN. If there is the remaining land procurement that has not been released, it will return to the initial administrative cycle. This certainly makes the resolution of disputes longer and complicated so that it seems less effective. What's more, if an infrastructure to be built is a strategic government project. So that the author initiated a grand design in the form of an Integrated Agrarian Justice System that collaborates several legal realms, considering that agrarian law is difficult to categorize into the realm of civil, criminal, and admimistration law. The handling of agrarian law cannot be handled through the current event law, so it requires a more specialized and unified event law. The research method used is normative juridical, using a statutory approach and a concept approach. SPAT is a special integrated judicial system for adjudicating disputes in the field of agrarian law, which not only uses positive laws in laws and regulations, but also accommodates applicable customary laws. SPAT is implemented through the Agrarian Court by empowering special judges of agrarian law ecstasy. In agrarian disputes, especially the preparation of land procurement for land to be built infrastructure, the government applied for land determination. Then the court proved by conducting an empirical review of the land to be designated as infrastructure land. Because it applies to the community and indigenous peoples, so that the law used is not only a positive law but also the law that applies in the community of an area.

Abstract

Asgardia is a region that proves that the progress of human thinking is very visionary. It is a region in the space called capable and will be able to be a place to live for humans. The truth has not been fully proven, but the payment of regulation and implementation continues. Because it has the support of various parties and communities that can be said to no longer want to live on earth. The way of recruitment is also unique, the Asgardia team has formed an official website for registration to become prospective citizens in the region, the number is not small. But it still continues to be a concern for many parties to explore whether it is a hallucination or reality. While the regional engagement conference is also running, which can be seen and immortalized in videos uploaded on YouTube. They have also determined a kind of state emblem to form of government, but the official status of "statehood" still does not have legality that can make the public trust fully. Considering Asgardia is a region of form inspired by a story in a world-class film.

Abstract

The Law of the Sea divides a country's maritime territorial boundaries into sections, one of which is the Exclusive Economic Zone or EEZ. EEZ is a maximum distance zone of 200 miles that can be utilized by resources but cannot be controlled by a country because for purposes such as shipping and flight navigation that are required in general. But because of the nature of its free use can trigger conflict between countries because it is like a domino that has a correlation with each other. In this paper will be spelled out examples of the application of EEZ conflict resolution in imaginary cases of the State of Amalea and the State of Ritania as a simulation of the settlement of EEZ determination based on unclos sea law 1982. This simulation has a dynamic of interesting fictitious facts in terms of law with a conventional settlement that is the consensus of the parties. Referring to UNCLOS 1982, the utilization of marine aspects needs to be considered so as not to interfere with other countries.

Abstract

The opening of the Indonesian Constitution is a noble agreement of the Indonesian nation to live together (Modus Vivendi) in a plural one-nation bond. Vivendi's modus, has given birth to the ideal of the state, which is the identity and guidance of the nation in stepping. Thus, the constitution has mandated the State to take responsibility for the welfare of the people. Indonesia has the second-largest tropical forest in the world with high economic value that can be managed by the state and society. This allows for the establishment of different types of crops and the utilization of economic aspects of forest products. In managing forest products it is unfortunate that it is still not optimal both with intensive and with the many requests for deforestation or conversion of forest land. Both planned deforestation and unplanned deforestation. On the other hand, Indonesia recognizes the existence of the Village Government and empowerment regarding the empowerment of rural communities which is a process to make the community improve the quality of life of the weak community for the better. Thus, it is necessary to re-initiate the role of the village government in the processing of village forests as one of the rights of the village community. The type of research used is normative juridical. Therefore, the author initiated a grand design of Village Forest Management to complement the processing and utilization of forest products integrated with the role of the Village Government as a system that aims to optimize the production supply chain as one of the important indicators of development and resilience of the country's economy in each region that uses variable forest products as their main income.

Abstract

Hak menguasai dari desa atas tanah merupakan hak ulayat yang diatur di dalam Pasal 3 Undang-Undang Pokok Agraria (selanjutnya disebut UUPA), yaitu tanah bersama para masyarakat hukum adat yang bersangkutan yang didalamnya ada wewenang dan kewajiban masyarakat hukum adat di suatu wilayah tertentu. Wewenang dan kewajiban mengenai hak individual atas tanah dapat ditemukan pada Pasal 4, 6 , dan 9 UUPA yang dibagi menjadi hak individual primer dan hak individual sekunder yang telah mengalami konversi hak atas tanah swapraja yang semula tunduk pada sistem hukum lama menurut Kitab Undang-Undang Hukum Perdata Barat dan Hukum adat ke sistem baru yang diatur di dalam UUPA. Tujuan dari konversi ini adalah sebagai bentuk unifikasi dan mewujudkan kesederhanaan hukum pertanahan Indonesia guna mewujudkan perlindungan hukum dan kepastian hukum mengenai hak atas tanah bagi negara dan masyarakat, sehingga dalam pelaksanaan hak ulayat harus sesuai dengan kepentingan nasional dan peraturan perundang-undangan.

Abstract

The position of the Judicial Commission in the judicial institutions is now subject to degradation of the interpretation of authority in accordance with Article 24B Paragraph (1) of the Indonesia Constitution related to its role in selecting judges for the general judiciary, religion and state administration, through Decree No. 43/PUU-XIII/2015. The ruling changed the position and authority of the Judicial Commission into a judicial body that only functions in terms of oversight of ethical-professional issues against judges. The judicial commission's participation in the selection of judges with the aim of finding judges of integrity and professional integrity has been abolished. Based on these issues, the discourse on contestation of the authority of the Judicial Commission in the supreme court recusal process emerged as an urgency of discussion in the field of legal research on the Indepedency of External Auditors in judicial power in Indonesia.
