Abstract

This study examines legal vulnerabilities and the role of institutions in addressing sexual exploitation within mentor–mentee relationships in higher education. It highlights the power imbalances that make female students particularly vulnerable to becoming victims, the gaps within the existing legal framework, and the systemic challenges that perpetuate a culture of “silencing” around this issue. Although the Sexual Violence Crime Law (UU TPKS) provides a legal basis for victim protection, its implementation in universities remains largely ineffective. This article explores the importance of stronger institutional policies, improved reporting mechanisms, and awareness programs to prevent exploitation. The study emphasizes the crucial role of universities in creating a safe and ethical academic environment by ensuring that legal actions and internal policies align to protect victims and hold perpetrators accountable.

Abstract

Indonesia, as well as the global community, is striving to accelerate the energy transition, particularly through the development of New and Renewable Energy (NRE), to address environmental issues arising from climate change. However, the development of NRE is not an easy task; it requires comprehensive policy frameworks, regulatory support, and substantial long-term investment to achieve these goals. Based on research findings, the regulation of foreign direct investment is stipulated under Law No. 27 of 2007 concerning Investment, along with several regulations aimed at promoting the utilization of NRE as an energy source. Nevertheless, there remains no overarching legal framework that serves as the foundation for all policies related to NRE in Indonesia. Various challenges persist, particularly the need for stable and innovative long-term financing mechanisms to accelerate the country’s energy transition.

Abstract

The background of this problem arises from the importance of Raja Ampat as a world conservation area with abundant marine biodiversity, but faces various ecological threats due to human activities such as mining and environmental pollution. The research method used is a statutory approach to analyze national andinternational legal arrangements related to environmental protection and conservation in Raja Ampat, followed by a conceptual approach to understand the principles of sustainability and ecological crime. The case study approach to nickel mining activities in the region provides a real picture of implementation and law enforcement challenges, including the effectiveness of supervision and prosecution of environmental law violations. Data were obtained from official documents, interviews, and field observations to ensure the accuracy and validity of the analysis. Conclusions show that firm and consistent criminal law enforcement, supported by cross-agency collaboration and the participation of indigenous communities, is critical to reducing ecological damage and ensuring the sustainability of Raja Ampat's marine ecosystems in a sustainable and equitable manner.

Abstract

Cases of human trafficking involving Indonesian citizens in the online gambling sector abroad have been increasing, highlighting the urgency of more effective legal protection. This study aims to evaluate gaps in Indonesia's legal system, particularly in the implementation of Law No. 21 of 2007 and the effectiveness of international cooperation in handling cross-border cases. The research employs a normative juridical approach by analyzing regulations, court rulings, and related policies to identify weaknesses in victim protection mechanisms. It also examines the role of law enforcement agencies and relevant institutions in the investigation and repatriation process of human trafficking victims. The findings reveal that legal protection for victims of human trafficking in the online gambling sector under Law No. 21/2007 faces challenges related to jurisdiction, legal system differences, and corruption. The implementation of international cooperation remains suboptimal, leading to ineffective victim protection. Therefore, regulatory revisions, strengthened repatriation and rehabilitation mechanisms, and an anti-corruption oversight system are needed to ensure justice for victims.

Abstract

The enactment of the National Criminal Code, which recognizes 'living law' in Article 2, creates a direct normative antinomy with the Principle of Legality stipulated in Article 1. This conflict fundamentally threatens the principle of legal certainty for citizens and jeopardizes the right to a fair trial for the accused. The need to find a solution is particularly urgent given that the National Criminal Code will come into effect in January 2026, which could potentially create legal chaos in the absence of clear guidelines. Therefore, this research aims to analyze this problem and formulate a harmonization model that can bridge the two conflicting concepts. To achieve this objective, a normative juridical research method is employed, utilizing statutory and conceptual approaches to analyze relevant legal norms and doctrines. This research finds that the recognition of living law in the National Criminal Code creates a fundamental conflict with the Principle of Legality, risking the erosion of legal certainty and the violation of human rights. However, harmonization is achievable through a mutually reinforcing three-pillar model: systematic interpretation by judges, the application of strict material criteria in accordance with the law, and the establishment of implementing regulations to ensure procedural certainty. Therefore, the successful implementation of this norm depends entirely on the synergy of these three pillars to realize the ideal of legal pluralism without sacrificing the foundations of the modern rule of law.

Abstract

This research examines the effectiveness of law enforcement regarding child neglect crimes in Ciamis Regency, referring to Decision Number 238/Pid.Sus/2024/PN CMs. The analysis employs human rights theory, effectiveness theory, and law enforcement theory. Findings indicate that enforcement remains suboptimal due to structural, cultural, and substantive barriers, although the Ciamis District Prosecutor’s Office has made humanistic and child-centered efforts. The research highlights the necessity of harmonizing legal norms with human rights–based enforcement policies to ensure justice and protection for children.

Abstract

This study analyzes the effectiveness of implementing Restorative Justice (RJ), particularly through the Diversion mechanism, in addressing juvenile crimes in Indonesia, based on Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (UU SPPA). Restorative Justice demonstrates high effectiveness in achieving its main objectives, namely realizing justice oriented towards restoration and ensuring the best interests of the child, by reducing the risk of stigmatization and criminalization. This study aims to examine in depth the Effectiveness of Implementing Restorative Justice in the Resolution of Juvenile Crimes in Indonesia and the Implementation of Restorative Justice through Fulfilling Restitution for Victims of Juvenile Crimes. This research employs a normative juridical methodology, which involves the analysis and examination of secondary data. The research conducted by the author in relation to a normative juridical approach uses a literature review. Although the Child Protection and Juvenile Justice Law (UU SPPA) has provided a modern and humanistic legal framework, its implementation faces significant challenges. The success of restorative justice and the fulfillment of restitution heavily depends on the readiness of infrastructure (especially the Correctional Centers/Bapas), the improvement of facilitator quality, and a change in mindset of all stakeholders (officials and the community) to support solutions focused on recovery rather than retribution.

Abstract

This study analyzes the judges’ considerations in Decision No. 296/Pid.Sus/2021/PN Kdi and examines the relevance of the vicarious liability concept in corporate criminal liability for mining offenses. The case revealed that only the individual was convicted, while the corporation remained unaccountable. This research uses a normative legal method with statutory and case approaches. The results show that the judges’ considerations did not fully apply the principle of corporate criminal responsibility. Implementing vicarious liability is crucial to ensure justice and corporate accountability in mining crimes.

Abstract

This research is motivated by the urgency of protecting the right to a healthy environment as an integral part of human rights (HAM) guaranteed in the 1945 Constitution. In the context of the Green Constitution, a healthy environment is understood not only as an ecological necessity, but also as a prerequisite for fulfilling the rights to life, health, and well-being. The purpose of this research is to analyze the relationship between environmental rights and human rights, the implications of the green constitution for environmental law and policy, and the challenges of implementing and strengthening environmental protection in Indonesia. The research method used is qualitative with a normative-constitutional approach and descriptive analysis of articles of the 1945 Constitution, Constitutional Court decisions, and national environmental policies. The results of the discussion indicate that the right to a healthy environment has individual, collective, and intergenerational dimensions, so that the state is obliged to guarantee its fulfillment through legal instruments and policies that are ecologically just. The research findings emphasize the gap between constitutional norms and policy practices, weak law enforcement, low public environmental literacy, and the conflict between economic and ecological interests in the era of Society 5.0. The implications of this research are the need to strengthen the role of the Constitutional Court, update regulations based on sustainability, and public participation through digital technology so that the constitutional right to a healthy environment is truly implemented in real terms.

Abstract

The Constitutional Court (MK) should function as the final fortress of the constitution, yet this research reveals its paradoxical role: instead of mitigating political conflict, several of its controversial rulings have become catalysts for a legitimacy crisis and profound polarization. Through a critical study of pivotal decisions (including the Presidential/Vice Presidential Age Limit ruling, the KPK Law review, and the 2024 Presidential Election Dispute), this normative legal analysis highlights the failure of substantive reconciliation in Indonesia. The MK Ruling No. 90/PUU-XXI/2023, shrouded in conflict of interest and ethical sanctions, demonstrates the Court's vulnerability to constitutional manipulation. Similarly, the KPK Law ruling effectively legitimized the weakening of the anti-corruption body, and the 2024 Election Dispute was marked by judicial division (dissenting opinions). The implications are staggering: the emergence of tension between formal legal certainty and moral justice. The MK now stands at a crossroads, will it restore its integrity as a true guardian of the constitution or merely serve as a tool for legitimizing power?.
