Abstract

Climate change is a pressing global challenge, with Indonesia, the world's sixth-largest carbon emitter, facing pressure to reduce greenhouse gas emissions. This study analyzes Indonesia's carbon tax regulations as an environmental fiscal instrument in support of equitable sustainable development. The research objective is to analyze carbon tax regulations in support of equitable sustainable development and to assess the effectiveness of carbon tax regulations as an instrument for achieving sustainable development in Indonesia. This study uses a normative juridical method with legislative, conceptual, comparative, and limited empirical approaches. Primary legal materials include Law Number 7 of 2021 concerning the Harmonization of Tax Regulations and Presidential Regulation Number 98 of 2021 concerning the Implementation of Carbon Economic Value. The research findings indicate that the carbon tax system has adopted the polluter pays principle and social justice, but still faces structural weaknesses in the form of unclear formulation, low tariffs (Rp30,000/kg CO₂e), limited sector coverage (35% of national emissions), and the absence of adequate social compensation mechanisms. The effectiveness of carbon tax implementation is hampered by limited implementing regulations, an immature MRV system infrastructure, weak cross-sectoral coordination, and potential regressive impacts on low-income groups. This research recommends the development of a comprehensive carbon tax roadmap, strengthening the MRV system, establishing a fair social compensation mechanism, transparency in tax revenue allocation, and harmonization of cross-sectoral policies to ensure that the carbon tax can function effectively as an instrument of equitable sustainable development in Indonesia.

Abstract

Indonesia as a country of law means that all aspects of life must be based on law. The President has the prerogative to grant amnesty and abolition, but since the amendment to the 1945 Constitution, this must be considered by the DPR in accordance with Article 14 paragraph (2) of the 1945 Constitution of the Republic of Indonesia. This research was conducted to determine how the President's power to grant amnesty and abolition is exercised, as well as its impact on the legal and justice system in Indonesia. The results of the research show that the president should grant amnesty based on the consideration of the Supreme Court (MA) and not on the basis of consideration (DPR) because the government institution that plays a role in the legal field or realm is the MA while the DPR plays a role in the political field or realm.

Abstract

This research examines criminal liability of influencers who promote online gambling sites through live streaming on social media. The research method is normative juridical with statutory and case study approaches. Findings show influencers can be held criminally liable under Article 27 paragraph (2) in conjunction with Article 45 paragraph (2) of ITE Law and Article 303 in conjunction with Article 303 bis of Criminal Code if elements of actus reus and mens rea are fulfilled. Law enforcement is carried out through preventive approaches such as education and supervision, and repressive measures through judicial processes. Obstacles include substantive, structural, cultural, and technical aspects requiring regulatory strengthening and multi-stakeholder cooperation

Abstract

The Silver Man phenomenon involving minors demonstrates the failure of child protection and law enforcement. This normative legal study analyzes this phenomenon as economic exploitation of children from the perspective of Indonesian Criminal Law. Based on the 1945 Constitution, Law No. 35 of 2014, and legal doctrine, the results show that the involvement of children fulfills the elements of the crime of economic exploitation of children, in accordance with Article 76I in conjunction with Article 88 of the Child Protection Law. Criminal liability is dual in nature. Parents must be subject to strict criminal sanctions on the basis of fault (dolus or culpa) for violating legal and moral obligations. The state also bears systemic non-criminal responsibility for negligence (omission of duty) in protection.

Abstract

The Constitutional Court Decision Number 90/PUU-XXI/2023 concerning the age limit for presidential and vice-presidential candidates has raised an ethical controversy that shakes the integrity of the constitutional judiciary. This study discusses potential violations of the judicial code of ethics, conflicts of interest, and their implications for the principles of independence and impartiality as regulated in the Constitutional Court Law and the 1945 Constitution. The discussion results indicate deviations from the fundamental values of Sapta Karsa Hutama and the principle of constitutional justice, leading to a decline in public trust toward the Constitutional Court.

Abstract

Article 42 of the 2023Criminal Code creates fundamental ambiguity in accommodating economic duress as a reason for expunging criminal penalties. Through a comparative analysis with noodtoestand Article 40 of the Dutch WvS, economic duress is constructed as an excuse at the level of culpability, not justification. The perpetrator loses minimal freedom of will even though awareness of breaking the law remains. Article 54 paragraph (2) of the 2023 Criminal Code concerning judicial pardon has the potential to become a dead article due to the lack of technical guidelines and normative limitations. In contrast to the Dutch rechterlijk pardon which is binding with clear standards, the Indonesian provisions create the risk of disparity in decisions and dependence on the subjectivity of judges.

Abstract

The company has a legal and social obligation to treat employees fairly by fulfilling the normative rights inherent in the employment relationship. This responsibility can be realized through providing wages that are appropriate to the workload and time, providing social security such as health insurance and other benefits, and adjusting wages based on the inflation rate and the provisions of applicable laws and regulations. In the Banjar District Court Decision Number: 42 / Pid.B / 2025 / PN Bjr, the defendant's actions caused the Tunas Artha Mandiri Cooperative to suffer a loss of Rp. 87,294,000.00. This was done by creating fictitious data, marking up loans, and not paying member installments. As a result, the defendant was found guilty of committing the Crime of Embezzlement with his inherent position in accordance with Article 374 of the Criminal Code. In addition, the employment agreement between the two parties can be canceled because it does not comply with the valid conditions of the agreement as regulated in Article 1320 of the Civil Code, directly revokes the Rights and Obligations of both parties as regulated in Law Number 11 of 2020 concerning Job Creation.

Abstract

Digital technology advancement has prompted the exploration of digital signatures as alternatives to conventional signatures. This research examines the potential implementation of digital signatures in notarial deeds to achieve legal certainty in Indonesia. Using normative juridical methods with analytical-descriptive approach, this study analyzes secondary legal materials. The findings demonstrate that digital signatures possess legal validity under the Law on Information and Electronic Transactions (UU ITE), provided authentication, integrity, and non-repudiation requirements are met. However, implementation faces regulatory obstacles due to the Notary Position Law (UUJN) lacking explicit digital signature provisions. Harmonization among relevant laws, strengthened digital infrastructure, and enhanced legal literacy for notaries are essential. Consequently, digital signatures hold significant potential to increase efficiency, security, and legal certainty in notarial deed execution within Indonesia's digital era.

Abstract

In marriage, marital property (gono-gini) arising from valid marital bonds requires spousal consent for transfer. This study employs normative juridical methodology with descriptive analytical approach to examine Temporary Land Deed Officials' (PPATS) responsibility in facilitating marital property sales without spousal consent based on Supreme Court Decision Number 3325K/PDT/2020. Research findings demonstrate that PPATS bears administrative and disciplinary accountability, sales agreements are void under Article 1320 Indonesian Civil Code, good-faith buyers retain legal protection, and parties may file deed annulment suits or pursue mediation to ensure legal certainty and justice.

Abstract

The legal issues surrounding buildings on land with Land Use Permit (IPT) or Green Certificate status as fiduciary collateral objects pose serious problems in Indonesia's land law system. IPT, issued by local governments, has weak legal standing due to its temporary nature and revocable status, while buildings constructed on such land are often used as fiduciary collateral. This creates significant legal uncertainty for both creditors and debtors, particularly during collateral execution in cases of default. The research employs normative juridical methods through literature study to analyze primary, secondary, and tertiary legal materials. The study concludes that IPT faces juridical constraints as it is not classified as land rights under the Basic Agrarian Law, resulting in extremely low legal certainty for fiduciary collateral arrangements.
