Abstract

Restorative justice in the resolution of narcotics crimes in Indonesia is a more humane alternative to the retributive approach. This approach focuses on restoring relationships between perpetrators, victims, and the community, involving mediation and consensus-based resolutions. This study analyzes the implementation of restorative justice at the Central Sulawesi High Prosecutor's Office, which is expected to provide substantial justice for drug offenders who act as users rather than dealers. The results of the study indicate that this implementation is effective but faces challenges in terms of rehabilitation facilities and community acceptance.

Abstract

Mediation is an effort to accelerate dispute resolution with the assistance of a neutral third party who does not take sides with any of the disputing parties. In the era of legal modernization, dispute resolution is also carried out through the use of information technology, such as the possibility of conducting meetings online. The research method relies on normative legal research with a statutory approach and a conceptual approach. The findings show that mediation serves as an initial stage in dispute resolution. The Supreme Court has issued regulations governing mediation procedures to be conducted by mediators. As the key actors in the success of mediation, mediators are required to guide the parties more effectively in reaching a peaceful settlement, including through the use of information technology.

Abstract

Digitalization of public services is a crucial step in achieving good governance and fostering an inclusive, effective, accountable, and transparent government, particularly in the modern era. The government has shown its commitment to public service digitalization by issuing Peraturan Presiden Republik Indonesia Nomor 82 Tahun 2023 tentang Percepatan Transformasi Digital dan Keterpaduan Layanan Digital Nasional. This regulation aims to establish high-quality and reliable public services, an electronic-based government system, and an integrated One Data Indonesia system. Additionally, the government issued Peraturan Presiden Republik Indonesia Nomor 95 Tahun 2018 tentang Sistem Pemerintahan Berbasis Elektronik (SPBE), reflecting its effort to accelerate governance using updated information technology (e-government). According to Mochtar Kusumaatmadja, law serves not only to maintain order but also as an instrument for driving change toward a modern, dynamic, and advanced society. By applying the concept of law as a tool for development, societal values can evolve based on positive attitudes and modern perspectives. In the context of public service, the government’s primary focus should extend beyond technology and infrastructure to include enhancing human resource quality within government institutions. Such development must align with good values and modern thinking to ensure the effectiveness of digitalized services

Abstract

Legal professional ethics is a moral and normative foundation for maintaining the integrity and legitimacy of the judiciary. Modern society presents a dilemma between demands for public transparency and the need to safeguard judicial independence. This study examines the renewal of legal professional ethics as a bridge between transparency and independence, focusing on the Kudus District Court. Using a normative juridical approach supported by philosophical and sociological analysis, the findings show that ethics serves dual functions: ensuring public accountability through transparency and protecting judicial independence from external interference. The study concludes that adaptive, contextual, and progressive ethical renewal is essential to balance these interests.

Abstract

Indonesian legislation is frequently enacted in disregard of essential foundation, rendering the legislative process merely formalistic. This results in compromised quality and a lack of systematic evaluation regarding regulatory effectiveness, contradicting legal pragmatism which prioritizes practical utility and social impact. To bridge this gap, implementing a Sunset Review mechanism is highly necessary in Indonesia. This mechanism mandates the legislature to periodically review regulations within a spesific timeframe to determine their continued validity. Consequently, this ensures that Indonesia’s legal instruments remain responsive, accountable, and adaptive to societal dynamics.

Abstract

The Indonesian Notary Law (UUJN) stipulates that notaries may be held accountable administratively, civilly, and criminally. In District Court Decision Number: 209l/Pid.B/2023/PN.Sby, Notary DC was sentenced to imprisonment of nihil. The research method employed is normative legal research based on literature review, with qualitative analysis of legal principles The findings of this study indicate that Decision Number: 2091/Pid.B/2023/PN.Sby may serve as the basis for dishonorable dismissal of Notary DC, as the criminal acts committed constitute concursus realis in relation to previous court rulings. In sentencing, by applying the rule of the highest penalty plus one-third, namely 7 (seven) years + (A x 7) years = 9 (nine) years and 4 (four) months of imprisonment, the decision fulfills the elements stipulated in Article 13 of the UUJN. This study suggests the need for harmonization between the UUJN and the new Criminal Code regarding sanctions for notaries who commit criminal offenses, greater judicial prudence in sentencing, and clearer provisions within the UUJN on sanctions against notaries.

Abstract

Constitutional Court Decision Number 46/PUU-VIII/2010 brought significant changes to the legal status of children born out of wedlock in Indonesia. This ruling reinterprets Article 43 paragraph (1) of Law Number 1 of 1974 concerning Marriage by emphasising that children born out of wedlock not only have civil relations with their mother and maternal family, but also with their biological father as long as this can be proven based on science and/or other evidence according to the law. Consequently, children born out of wedlock have the potential to obtain civil rights, including inheritance rights, from their biological fathers. However, from an Islamic law perspective, the position of children born out of wedlock is different. This study uses a normative juridical method. The conclusion is that there is a normative tension between positive law and Islamic law regarding the inheritance rights of children born out of wedlock. Therefore, legal harmonisation is needed so that the Constitutional Court's decision can be implemented without negating the basic principles of Islamic law, while still guaranteeing the protection of children's rights in accordance with the mandate of the constitution and the principle of justice.

Abstract

The case of Kenny Sonda, an in house counsel who was criminalized for his legal opinion, highlights the ethical dilemma between professional independence and loyalty to the company. This raises concerns about the protection of the legal profession, especially for in house counsels. This research aims to analyze this conflict through the perspectives of deontological theory, which focuses on moral obligations, and teleological theory, which considers the consequences of decisions. Using a normative legal analysis method, this study evaluates the relevance of both theories in formulating legal opinions ethically and strategically. The results show that applying a combination of both theories can help in house counsels navigate ethical dilemmas without compromising professionalism or violating ethical codes. The conclusion emphasizes the need for stronger legal protection for the legal profession and the importance of companies creating policies that support the independence of internal legal advisors.

Abstract

ABSTRACT This article attempts to reveal and analyze the role of the House of Representatives (DPR) in formulating and passing laws that support gender equality in Indonesia, the challenges faced by the DPR in implementing gender equality laws, and the impact of pro-gender equality legislation on social enterprises in society. This study aims to analyze the role of the DPR in formulating and passing gender equality laws in Indonesia, examine the challenges of their implementation, and assess their impact on social enterprises and communities as agents of change. Specifically, this study seeks to explore the causal relationship between legislative design and its transformational impact, and formulate data-based policy recommendations to strengthen inclusive and gender-responsive legislation. This study uses a juridical-sociological approach with qualitative methods, combining legal analysis and field studies. Data were collected through document studies, interviews, and observations, then analyzed descriptively and thematically. The research findings indicate that the House of Representatives (DPR) has taken important steps in gender equality legislation, such as the ratification of the TPKS Law, which emerged from civil society support. However, the DPR's role remains reactive, with implementation challenges including cultural resistance, limited budget, weak apparatus, and suboptimal oversight. The TPKS Law has had a positive impact on social enterprises, although policy support and regulatory understanding remain limited. Conclusion: The DPR plays a strategic but not yet optimal role in promoting gender equality legislation. Existing legislation has shown progress, but implementation, oversight, and budget support still need to be strengthened. Social enterprises have the potential to be key partners, but require more concrete and applicable supporting policies. The study recommends that the House of Representatives establish a cross-faction Gender Equality Caucus, implement data-driven participatory legislation, strengthen oversight using gender indicators, and build strong partnerships with social enterprises and civil society. Further research is recommended to focus on the implementation of the law and incentives for social enterprises to strengthen the House of Representatives' role as a real agent of social change. Abstract

Under Balinese customary law, inheritance is based on a patrilineal system (kepurusa), in which inheritance rights are generally granted to male descendants, while daughters who marry out (ninggal kedaton) lose their status as heirs. In practice, however, wills particularly those executed before a notary are often employed to distribute inheritance to parties who, under customary norms, no longer possess inheritance rights. This creates normative issues regarding the legal status and binding force of wills, as their substance frequently conflicts with the principles of Balinese customary inheritance law. This study aims to examine, from a normative perspective, the position of wills in Balinese customary inheritance law and their implications for justice and legal certainty within the customary community.
