STAATSRECHT: Indonesian Constitutional Law Journal (ISSN: 2549-0915) is a national journal published by Center for the Study of Constitution and National Legislation (POSKO-LEGNAS) UIN Jakarta, INDONESIA. The focus is to provide readers with a better understanding of Constitutional Law and present developments through the publication of articles, research reports, and book reviews. STAATSRECH specializes in Constitutional Law and is intended to communicate original researches and current issues on the subject. This journal warmly welcomes contributions from scholars of related disciplines. It aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning Indonesian laws and legal system. Published exclusively in English, the Review seeks to expand the boundaries of Indonesian legal discourses to access English-speaking contributors and readers all over the world. The Review, hence, welcomes contributions from international legal scholars and professionals as well as from representatives of courts, executive authorities, and agencies of development cooperation. The Review basically contains any topics concerning constitutional law. Novelty and recency of issues, however, is a priority in publishing. The range of contents covered by the Review spans from established legal scholarships and fields of law such as privacy laws and public laws which include constitutional to various approaches to legal studies such as comparative law, law and economics, sociology of law and legal anthropology, and many others. Specialized legal studies concerning various aspects of life such as commercial and business laws, technology law, natural resources law and the like are also welcomed. It aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning constitutional law. Abstract

AbstractThis study aims to determine the legal considerations of the Constitutional Court judges in deciding the implementation of the re-voting in the election of the Mayor and Deputy Mayor of the City of Cirebon in 2018 by reviewing the theory of democracy, popular sovereignty, and the rule of law. In the Cirebon City Election in 2018, there was a fraud in the Election with the opening of the ballot box against the law, thus affecting the vote acquisition that harms the Candidate Pair, namely Candidate Pair Number One with a smaller vote than the Candidate Pair Number two. This research uses normative-juridical type and library research by conducting an assessment of the laws and regulations, books, journals, and sources from the related internet. The results showed that the Constitutional Court's Decision was in accordance with the laws and regulations related to the General Election, because the Petitioner had the legal authority to submit to the Constitutional Court and it was proven that there had been an election ballot box opening against the law, so a repeat vote had to be conducted, so that the results of the vote could be recognized by the Petitioner in accordance with the principles of a democratic Regional Head General Election.Keywords: Voting, Election, Constitutional Court

Abstract

Abstract:Human Resources is a very important factor and a driving force in an organization. Without qualified human beings who are capable of being the activator, an organization cannot run properly and it will even stop. To produce every product, creative and innovative people are needed. Behind the production of every product or service are human thoughts, efforts and human hours of work. The research method used in this research is a qualitative method with a literature approach. The data obtained were sourced from literature reviews, both from scientific journals and books. The result of the research states that Human Resources is an important thing in the government apparatus and must always be repaired and addressed.Keywords: Human Resources, Government Apparatus, Republic of Indonesia.

Abstract

Abstract:Presidential elections are part of the democratic party event. However, the presidential elections in 2014 and 2019 were unique elections and took a lot of public attention. In addition to only being followed by two candidates, they also formed two big camps of supporters who shared high fanatics with each candidate. In this study, the extent to which political communication theory was built by the two candidates was examined, so as to convince potential voters. In various ways carried out to attract public sympathy for the feasibility of each candidate to become the leader of the country. Some people provide positive perceptions by giving appreciation, but others provide negative perceptions and consider their acts of political communication to be limited to mere imaging. Therefore, this study wants to answer these problems.Keywords: Political Communication, Public Perception, Presidential Election Abstrak:Pemilihan umum presiden merupakan bagian dari ajang pesta demokrasi. Akan tetapi pemilihan umum presiden di tahun 2014 dan 2019 merupakan ajang pemilu yang unik dan menyita banyak perhatian publik. Selain hanya diikuti oleh dua kandidat, juga membentuk dua kubu besar pendukung yang sama-sama memiliki fanatik yang tinggi kepada masing-masing kandidat. Dalam penelitian ini, dikaji sejauhmana teori komunikasi politik dibangun oleh kedua kandidat, sehingga dapat meyakinkan calon pemilihnya. Dengan berbagai cara dilakukan guna menarik simpati publik akan kelayakan masing-masing kandidat untuk menjadi pemimpin negeri. Sebagian masyarakat memberikan persepsi positif dengan memberikan apresiasi, akan tetapi sebagian lain memberikan persepsi negatif dan menganggap tindakan komunikasi politiknya hanya sebatas pencitraan belaka. Oleh karena itu, penelitian ini ingin menjawab permasalahan tersebut.Kata Kunci: Komunikasi Politik, Persepsi public, Pemilu Presiden

Abstract

The enactment of Law No.1/PNPS/1965 concerning Prevention of Abuse and/or Religion Blasphemy impacts on the exclusion of sects of belief in Indonesia from the recognised religions in Indonesia. The existence of the cults has long become polemic and debates in Indonesia. As a result, native-faith followers have experienced discrimination, stigmatisation and exclusion in society. The issuance of the Constitutional Court Decision number 97/PUU-XIV/2016 at the end of the year at the end of 2017 became a momentum for adherents of the faith to get recognition of their identity.Believers have been equalized with official religions in Indonesia. This article discusses the reality related to the effect of the implementation of the Constitutional Court ruling on the religious identity of believers. Based on the data, it was found that some believers still chose not to change their religious identity on the KTP. They are still comfortable with their identity, and changing religious identities is not a priority.

Abstract

Abstrak. Benturan Kewenangan dan Kerjasama Pengawasan Hakim Antara Komisi Yudisial dan Mahkamah Agung. Perubahan undang-undang Komisi Yudisial (Undang-Undang nomor 18 tahun 2011 tentang Perubahan Undang-Undang nomor 22 tahun 2004) memiliki dampak pada diperluasnya kewenangan Komisi Yudisial dalam pola rekrutmen dan pengawasan hakim di Mahkamah Agung. Perubahan kewenangan Komisi Yudisial yang diatur dalam Undang-Undang Nomor 18 tahun 2011 kiranya pandangan Mahkamah Konstitusi yang dalam putusan nomor 005/PUU-IV/2006 masih sangat relevan untuk dijadikan rambu-rambu, dalam rangka Komisi Yudisial menjalankan fungsi pengawasan. Keberadaan  Komisi Yudisial ini diharapkan dapat menjadi simbol mengenai pentingnya infrastruktur sistem etika perilaku (good conduct) dalam sistem ketatanegaraan Republik Indonesia menurut UUD 1945. Selain itu, Komisi Yudisial sebagai lembaga auxiliary organ terhadap lembaga kekuasaan kehakiman diharapkan juga dapat ditumbuh-kembangkan dalam sistem etika perilaku baik dalam infrastruktur maupun suprastruktur di semua sektor sebagaimana mestinya dalam rangka mewujudkan gagasan negara hukum dan prinsip “good governance’ di semua bidang. Kata kunci: Benturan Kewenangan, Pengawasan Hakim, Komisi Yudisial, Mahkamah Agung.

Abstract

AbstractThe philosophy of Value-Added Tax (VAT) is a tax on consumption which is severely influenced by the development of business transaction and consumption pattern of society. In order to be the tool of social engineering and give legality of justice, Law Number 42 of 2009 should give certainty of law related to VAT imposition on transaction influenced intensely by business model growing in line with social development. Information technology development endorses the digital economy. Despite the fast growth of the digital economy in Indonesia, in line with the consistent growth of public and government consumption, the VAT revenue does not grow for consecutive three years. Law Number 42of 2009 does not prescribe explicit imposition VAT. Provision of VAT imposition on the digital economy makes VAT Law does not give justice legality and does not function as a tool of social engineering.Keywords: Value-Added Tax (VAT), Digital Economy, Justice Legality.

Abstract

Abstract.Every citizen has the right to get the same opportunity in government. Therefore, the state must facilitate the rights of its citizens, because it is regulated in the constitution. This study uses normative legal research methods and literature studies. The results showed that the existence of individual candidates in the political and democratic system occurred because Law No. 32/2004 on Regional Government only limited and facilitated candidates for regional heads who came from political parties only. Individual candidates in the post-conflict local election in Indonesia are insignificant because one of them is the regulation governing individual candidates considered burdensome for individual candidates, even though the individual candidates have been regulated in the 1945 Constitution and strengthened by the Constitutional Court Decision Number 5/PUU-V/2007 which is the political right of the community to be chosen as a form of democracy and human rights. Deparpolization is caused by a decrease in public trust in political parties, so that people look for other political channels and provide space for people who do not have political vehicles, which are expected to be able to answer the deadlock of political parties so that their political rights can run well.Keywords: Individual Candidates, Democracy, Political Parties, General Election.

Abstract

Guarantee the rights of every citizen for violations of constitutional rights by seeking to increase the authority of the Judicial Review Request by every justice seeker for violations of constitutional rights, but not at least the petition was granted.  The Mahkarnah of the Constitution, which checks what the petition is made of, often considers that what the Judicial Review proposes is not the subject of acknowledgment.  Constitutional Court Judges considered it to be a Constitutional complaint in which this constitutional complaint was not part of the Court's authority in accordance with the Constitution of the Republic of Indonesia and the applicable Law on the Understanding of the Constitution.  As a legislative body, the DPR is the one who has the right to change the Constitutional Court Law by including the authority of Constitutional complaint to the Constitutional Court. In this paper the author uses a research method in the form of quality data analysis with secondary sources of literature and deductive logic analysis.  Consitional Complaint to the Constitutional Court.

Abstract

Abstrak: Perppu Nomor 1 Tahun 2016 menjadi jawaban dari Presiden Joko Widodo atas maraknya kasus pelecehan seksual terhadap anak. Meski demikian, perdebatan kerap terjadi seiring ditetapkannya Perppu Nomor 1 Tahun 2016. Adanya ketentuan mengenai sanksi kebiri ditenggarai menjadi akar perdebatan tersebut. Beberapa kalangan menilai Perppu Nomor 1 Tahun 2016 berpotensi melanggar HAM. Sisanya berpendapat, sanksi kebiri dibutuhkan untuk memberikan ancaman terhadap pelaku kekerasan seksual terhadap anak. Hasil penelitian menyatakan bahwa aspek penegakan hukum patut dibenahi demi mengurangi kasus kekerasan seksual terhadap anak. Metode penelitian yang digunakan dalam artikel ini menggunakan metode yuridis normatif, penulis juga mengumpulkan data-data dari bahan kepustakaan dan melakukan dokumentasi dari berbagai media massa. Kata Kunci: Presiden, Perppu Nomor 1 Tahun 2016, Sanksi Kebiri

Abstract

The development of the association of modern states increasingly influences how the constitutional norms of the country are guarded and maintained. Inter-state relations in the economic, social, political, and security sectors established through various treaties have influenced the existence of the constitution because of the impact on multiple changes. Furthermore, it also affects the integrity of the country's sovereignty, especially when there is a conflict between the international legal system and the constitution. In this connection, the problem discussed is how constitutional changes occur through international treaties and how the impact of constitutional changes through international conventions on the existence of state sovereignty placed in the hands of the people. This study concludes, Firstly, the 1945 Constitution as a constitution has not only changed through formal changes in accordance with Article 37 of the 1945 Constitution but has also been changed in an informal manner through the ratification of international treaties. Second, amending the constitution through international treaties can reduce the existence of the constitution as the embodiment of the country's supreme power, which is placed by the people.
