Abstract

This article aims to describe and analyse the regulation of International Law relating to the protection of stateless people through the case of Rohingya in Myanmar. The types of approachment use in this article are statute, case and historical approaches. As a normative study, this article shows that the ethnic protection from discrimination and violence in International Law has been carried out by the United Nations through various international declarations and conventions. Myanmar should ratify Convention Relating to The Stateless Person 1954 and the Convention on the Reduction of Statelessness 1961 as part of its obligations and responsibilities to protect and ensure that Rohingyas have their citizenship.

Abstract

Budaya tidak berwujud merupakan warisan budaya dari leluhur yang diturunkan dari generasi ke generasi dimana sangat bernilai dan memiliki daya guna yang tinggi, oleh karenanya sangat penting untuk dilindungi. Penelitian ini bertujuan mengetahui bagaimana Perlindungan Hukum terhadap budaya tidak berwujud benda yang diatur dalam Convention for the Safeguarding of the Intangible Cultural Heritage 2003 serta mengetahui upaya yang perlu dirumuskan oleh Indonesia untuk melindungi budaya tidak berwujud tersebut dalam kerangka penerapan Convention for the Safeguarding of the Intangible Cultural Heritage 2003. Permasalahan terkait hal ini yaitu perlindungan hukum mengenai warisan budaya tak berwujud benda di Indonesia melalui sistem hukum yang berlaku positif di Indonesia belum mampu secara maksimal, belum optimal dan unikatif dalam memberikan perlindungannya. Penelitian ini merupakan penelitian yuridis normatif dimana penelitian yang dilakukan dengan cara meneliti bahan pustaka terkait Perlindungan hukum terhadap budaya tidak berwujud berdasarkan Convention for the Safeguarding of the Intangible Cultural Heritage 2003 dan Penerapannya di Indonesia. Berdasarakan hasil penelitian dapat disimpulkan perlindungan terhadap budaya tidak berwujud sudah diatur dalam Convention for the Safeguarding of the Intangible Cultural Heritage 2003 serta Peraturan Menteri dan Kebudayaan Nomor 106 Tahun 2013 Tentang Warisan Budaya Takbenda. Selain itu perlunya dibentuk sanksi dalam Convention for the Safeguarding of the Intangible Cultural Heritage 2003 bagi negara pihak yang tidak menjalankan kewajiban pelestarian dan perlindungan budaya tidak berwujud di tingkat nasional.

Abstract

West Papua as one of the regions in Indonesia that integrates with the New York Agreement between Indonesia and the Netherlands carries the right of self-determination in an effort to separate from Indonesia. This research discusses how the regulation of the right to self-determination as part of Human Rights and examines the basis of West Papua in carrying out the right to self-determination and declaring itself as a state. This type of research is normative, with statutory (statue) and historical approaches. This research concludes that the right to self-determination is part of human rights, while West Papua’s claim as part of the Indonesian State in demanding the right to self-determination is clashed with the Uti Possidetis Juris and Territorial Integrity.

Abstract

This study aims to determine and analyzes the arrangement of non-discrimination principles based on GATs and its implementation in Indonesia from the regulation on the National Payment Gateway. The research method used in this article is a normative legal research by using historical, statutory and case approaches. The research shows that the regulation regarding the principle of non-discrimination is set in the Article II of GATs on the principle of Most Favoured Nation and Article XVII of GATs on the principle of national treatment. The non-discrimination principle states that a country must not be treated differently from other countries that are members of the GATs-WTO as stated in the Schedules of Specific Commitments. Indonesia issues regulations regarding the National Payment Gateway where several articles in the regulation differ from the commitments registered and restrict market access from other countries' services.

Abstract

This article aims to find out and analyze the personality and responsibilities of multinational cooperation in international law. The type of research is normative studies by using statutory, conceptual and historical approaches. It is shown that the personality of multinational cooperation in international law is limited as a quasi subject of international law, which is applied in the context of: 1) party in the settlement of international disputes, limited to the cases of investment disputes through, international arbitration; and 2) party in the drafting of investment contracts using the principles of international trade law, in particular the principles of National Treatment and Most Favored Nations. The responsibilities of multinational cooperation in international law are based on soft law provisions yet applied through host country as the intermediary actor by the regulation in national legal provisions.
