Abstract

Ujung Jabung is a region located in the District of Sadu at Tanjung Jabung Regency, Jambi Province, Indonesia. The area strategically lies in the Indonesian Archipelagic Sea Lane 1 (ALKI 1), which is the international trading and shipping lane. It brings about an excellent opportunity for economic development in Jambi Province. With this in mind, the Government of Jambi develops the region into a strategic area that includes Ujung Jabung Port. Based on the 2011-2031 Region’s Spatial Plan (RTRW) of East Tanjung Jabung Regency, the regency designed it to be the main port with the name of Samudera Ujung Jabung Port. The international shipping routes at the port are Ujung Jabung-West Asia-East Europe and Ujung Jabung-Southeast Asia-East Asia. Due to its international nature, the construction of Samudera Ujung Jabung Port should follow the international measures on the security of the port, shipping, and facility. As a Member of the International Maritime Organization (IMO), Indonesia is subject to international law. It ratifies the United Nations Convention on Safety on Life at Sea (SOLAS) 1974 and the auxiliary instrument of International Ships and Port Facility Code (ISPS Code). Accordingly, the construction of Samudera Ujung Jabung Port should comply with the international safety standard as written in the ISPS Code.

Abstract

Internationally The United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) emphasizes respect for the local wisdom of indigenous legal communities. The selection of village heads is one of the regulatory concepts stipulated in Law No. 6 of 2014 on Villages. The selection of village heads in the concept of this law is conducted simultaneously stipulated by local regulations and the procedures are specifically regulated through government regulations as stipulated in Article 31 of Law No. 6 of 2014 on Villages. But it turns out that in practice, especially in indigenous peoples, the deability of the village head election often clashes with the arrangement of the village head election. So in this case the formulation of the problem in this writing is how the arrangement of the rights of indigenous peoples in The United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) and the value and concept of local wisdom that applies in the selection of village heads in 5 (Five) Villages Semerap Kedepatian. The method used in this writing uses empirical juridical methods. And in this case it is concluded that UNDRIP regulates matters relating to individual rights as well as very specific collective rights sourced from indigenous peoples. In this case the State is obliged to protect or fulfill the rights of indigenous peoples including cultural heritage and their cultural manifestations including human resources and genetics. And in the indigenous people of kedepatian semerap Kerinci regency there is a customary provision where the prospective head of the village must get customary recommendations and be appointed from Depati and Nenek Mamak. The provision is considered contrary to the local Paraturan in relation to the election of the village head. So given the provisions of UNDRIP and the 1945 Constitution, the State is obliged to protect and maintain these customs given the positive impact that arises from it. So in this case the customary provisions should be regulated in the Regulation including also about the recognition of indigenous peoples. In addition, the community needs to open a paradigm on human rights in the selection of village heads in addition to the paradigm of the enforcement of customary law there needs to be flexibility from the State as long as it is not contrary to national law.

Abstract

This study aims to identify the human rights (HR) violations experienced by Palestinian civilians in the context of international law and to evaluate the various conflict resolution efforts that have been undertaken. Based on an analysis of various forms of violations, such as killings, administrative detention without charges, movement restrictions, evictions, and disruptions to education and healthcare services, this research finds that HR violations against Palestinian civilians are widespread and systematic. The study also assesses the effectiveness of the resolution efforts made by the international community, such as the Oslo Accords and various UN resolutions. Although there have been some advancements, these efforts are often hindered by distrust, ongoing violence, and failures to address core issues. To achieve a fair and lasting resolution, this research recommends full respect for human rights, cessation of actions that violate international law, and a genuine commitment from all parties to meaningful negotiations. The type of research used is a library research method with descriptive analysis by collecting data, organizing or classifying it, compiling, and interpreting it. This method is used because it can clearly describe the object of the study.

Abstract

This research examines the effectiveness of international sanctions in maintaining global peace and security. International sanctions have become one of the main tools for the international community to deal with conflicts, threats and violations of global peace and security. However, its effectiveness is still limited among academics and policy makers. This research uses a qualitative approach by analyzing case studies of the implementation of international sanctions by the United Nations (UN) and other regional organizations. Data was collected through literature reviews from various sources such as journals, books and official reports. The research results show that the effectiveness of international sanctions is highly dependent on factors such as the type of sanction, the purpose of the sanction, compliance by the target country, coordination between countries, and the resulting economic and political impacts. Sanctions that are well designed, supported by a solid international community, and consider long-term consequences are likely to be more effective in maintaining global peace and security. This research provides meaning for policy makers to design and implement international sanctions more strategically and comprehensively, as well as increase international cooperation in implementing them. This is important to ensure the effectiveness of sanctions in maintaining global peace and security.

Abstract

This study explores the evolution of citizenship concepts in the digital era, influenced by globalization, information technology, and socio-political changes. Using an interdisciplinary approach, it identifies new patterns of citizenship, including transnational and digital citizenship, and the challenges in their application. Findings reveal that citizenship now encompasses complex identity networks that transcend national boundaries. The social and ethical implications of digital technology, such as the digital divide and privacy concerns, are analyzed to provide insights for inclusive and adaptive policies. This research enriches the citizenship literature and paves the way for further studies to build inclusive and sustainable societies in the digital age.

Abstract

The protection of citizens abroad has become an important issue in contemporary international law. Every country has an obligation to protect its citizens, both inside and outside its territory. However, the implementation of this protection often faces various challenges, especially related to state sovereignty and the principle of non-intervention in international law. This article aims to analyze the international legal basis regarding the protection of citizens abroad, as well as the practices carried out by countries in carrying out these protection obligations. The research method used is juridical-normative with a case study approach. The research results show that the protection of citizens abroad is based on the principles of international law, such as state responsibility, human rights and protection obligations. Countries have developed various mechanisms and legal instruments to realize the protection of their citizens, either through diplomacy, consular or other measures. However, its implementation still faces challenges related to the limitations of state sovereignty and the principle of non-intervention. This article concludes that the protection of citizens abroad is an international legal obligation that must be implemented by every country. Efforts are needed to strengthen the international legal framework and cooperation mechanisms between countries to ensure effective protection for their citizens abroad.

Abstract

Penegakan hukum internasional dalam konteks hubungan internasional saat ini memiliki isu-isu yang sangat relevan dan penting. Salah satu studi kasus yang menarik perhatian adalah konflik antara Iran dan Israel. Konflik ini melibatkan berbagai isu, termasuk penggunaan kekuatan, hukum humaniter internasional, pelanggaran kedaulatan negara, dan peran Dewan Keamanan PBB. Memahami isu-isu ini dapat memberikan wawasan yang lebih baik tentang tantangan dalam penegakan hukum internasional di dunia yang terus berkembang. Prinsip-prinsip hukum internasional yang mengatur penggunaan kekuatan, seperti prinsip non-intervensi, larangan penggunaan kekuatan yang melanggar Piagam PBB, penggunaan kekuatan yang proporsional, dan pertahanan diri yang sah, menjadi fokus utama dalam mengevaluasi tindakan Iran dan Israel. Selain itu, perlindungan terhadap warga sipil, fasilitas dan layanan mendasar, anak-anak, serta korban perang yang tidak bersalah juga menjadi isu yang harus diperhatikan dalam konteks hukum humaniter internasional. Pentingnya mematuhi kewajiban hukum internasional, termasuk resolusi Dewan Keamanan PBB yang terkait dengan konflik Iran dan Israel, juga tidak dapat diabaikan. Penelitian ini menggunakan metode penelitian deskriptif untuk menganalisis isu-isu tersebut. Dalam kesimpulannya, penelitian ini memberikan pemahaman yang lebih baik tentang prinsip-prinsip hukum internasional yang mengatur penggunaan kekuatan dalam hubungan antarnegara dan dalam situasi konflik, serta pentingnya perlindungan warga sipil selama konflik bersenjata.

Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan dan peran hukum internasional di Indonesia dalam konteks globalisasi dan interaksi antarnegara. Dengan menggunakan pendekatan kualitatif deskriptif, data dikumpulkan melalui analisis dokumen, wawancara dengan pakar hukum, dan studi kasus yang menggambarkan implementasi hukum internasional di Indonesia. Hasil penelitian menunjukkan bahwa Indonesia memiliki posisi strategis dalam komunitas internasional, namun perlu pemahaman yang lebih baik tentang hukum internasional untuk memperkuat implementasi dan pengaruhnya terhadap hukum dan kebijakan nasional. Studi kasus juga menunjukkan bahwa hukum internasional memainkan peran penting dalam pembentukan kebijakan nasional, terutama dalam bidang hak asasi manusia, lingkungan hidup, dan perdagangan. Rekomendasi praktis meliputi peningkatan kapasitas dan pemahaman tentang hukum internasional melalui pelatihan dan pendidikan yang terfokus bagi pejabat pemerintah, hakim, dan praktisi hukum. Diperlukan juga koordinasi yang lebih baik antarinstansi terkait untuk mempercepat proses implementasi hukum internasional di Indonesia. Studi lebih lanjut direkomendasikan untuk mendalami aspek-aspek spesifik dalam implementasi hukum internasional, seperti pengaruhnya dalam pembentukan kebijakan lingkungan hidup atau perlindungan hak asasi manusia.

Abstract

Artikel ini menganalisis serangan Amerika Serikat (AS) ke Suriah dari perspektif hukum internasional, termasuk prinsip-prinsip kedaulatan negara, hak untuk membela diri, dan intervensi kemanusiaan. Konflik Suriah, yang dimulai pada 2011 sebagai bagian dari Arab Spring, berkembang menjadi perang saudara dengan banyak aktor domestik dan internasional terlibat. AS memulai serangannya dengan alasan melawan ancaman ISIS dan mencegah penggunaan senjata kimia oleh pemerintah Suriah. Namun, banyak ahli hukum internasional berpendapat bahwa serangan tersebut melanggar hukum internasional karena tidak mendapatkan otorisasi dari Dewan Keamanan PBB dan tidak dapat dianggap sebagai tindakan pertahanan diri yang sah. Artikel ini juga menyoroti respon internasional dan dampak serangan tersebut terhadap tatanan hukum internasional, serta peran hukum internasional dalam konflik ini. Hasil dari serangan ini menunjukkan bahwa tindakan unilateral tanpa otorisasi PBB berpotensi menimbulkan ketidakstabilan lebih lanjut, mempertegas dilema dalam penegakan hukum internasional dan perlindungan masyarakat sipil. Kesimpulannya, penting bagi negara-negara untuk mengikuti aturan Piagam PBB guna menjaga tatanan internasional berbasis hukum.

Abstract

Sengketa perbatasan merupakan isu utama di Asia Tenggara yang dapat menimbulkan ketegangan dan konflik antar negara. Hukum internasional menyediakan prinsip-prinsip dan mekanisme penyelesaian sengketa, seperti negosiasi, mediasi, arbitrase, dan pengadilan internasional. Namun, terdapat tantangan dalam penerapannya, seperti perbedaan penafsiran terhadap ketentuan hukum internasional terkait delimitasi wilayah dan penentuan batas negara. Penelitian ini bertujuan untuk mengkaji peran hukum internasional dalam menyelesaikan sengketa perbatasan di kawasan Asia Tenggara, serta mengidentifikasi tantangan dan peluang dalam penerapannya untuk memelihara stabilitas dan keamanan kawasan. Metode penelitian yang digunakan adalah studi literatur, dengan menganalisis kasus-kasus sengketa perbatasan yang terjadi di kawasan ini.
