Abstract

This study aims to examine the application of the distribution of marital property after divorce through an analysis of Decision Number 1301/Pdt.G/2023/PA.Smn. The research focuses on the division of marital property and the extent to which theories of justice are applied in the adjudication process. This study is significant as the distribution of marital property constitutes a sensitive issue within society, where justice plays a crucial role in shaping judicial decisions. Accordingly, it is necessary to analyze the factors considered by the panel of judges in adjudicating disputes concerning the division of marital property. This research employs a normative legal research method by examining applicable laws and regulations, supported by primary, secondary, and tertiary legal materials. The findings indicate that existing statutory provisions governing the distribution of marital property have not fully fulfilled the criteria of justice for wives who bear a double burden within marriage. In this context, judges are permitted to depart from positive law by applying the principle of contra legem in order to achieve substantive justice for all parties to the marriage.

Abstract

Character education in higher education plays a strategic role in shaping a generation of the nation with integrity, democracy, and adherence to constitutional principles. In this context, Constitutional Law serves as a normative framework governing the implementation of national education, including the mandate to shape student character. This study aims to analyze how the principles of Constitutional Law—such as constitutional supremacy, good governance, and human rights protection—play a role in formulating and directing character education policies in higher education. This study uses a juridical-normative approach by examining the legal norms contained in the 1945 Constitution of the Republic of Indonesia, Article 31 paragraph (3) concerning the objectives of national education, Law No. 12 of 2012 concerning Higher Education, and Law No. 20 of 2003 concerning the National Education System. The results of the study indicate that State Administrative Law provides a strong constitutional foundation for the development of character education through the affirmation of moral values, public ethics, and citizen responsibility. In addition, higher education regulations mandate the integration of character in the curriculum, university governance, and the formation of a civilized academic culture. This study concludes that the role of Constitutional Law is not limited to normative aspects, but also encompasses oversight, institutional strengthening, and the guarantee of systematic character education implementation. Effective implementation requires regulatory harmonization, commitment from higher education institutions, and synergy between the state and society in shaping students' character as citizens based on the values of Pancasila and the constitution.

Abstract

Language behavior in everyday life often involves activities of criticizing and complimenting. This study aims to describe the forms, types, patterns of delivery, and language usage in the criticism and compliments that are accepted and rejected in the pesantren environment. The data for this study consists of sentences, and the sources of the data are the families of the Kiai in the pesantren community. This research is qualitative, using an anthropolinguistic approach and a communication ethnography method. The data collection method used is the simak libat cakap method. The researcher observed the utterances of criticism and compliments occurring among the members of the Kiai family at Pesantren Tapal Kuda, using recording and note-taking techniques. In addition, interviews were conducted with the Kiai, his family, administrators, teachers, and students to obtain more in-depth data. After the data was collected, the researcher transcribed the utterances into orthographic transcription. The data was then analyzed through reduction, classification, verification, and tabulation processes based on its type. The results of the study indicate that first, there is variation in the use of language adjusted to the context; criticism is often delivered with harsh words if intended to insult, while compliments always use polite language. Second, the forms, types, and patterns of delivering criticism and compliments among the Kiai family members include sarcasm, commands, reprimands, insults, accusations, praise, and motivation. The types of language used include Enjek-Iye (E-I) and Engghi-Enten (E-E), with delivery patterns occurring both directly and indirectly. Third, criticism and compliments that are accepted are generally delivered indirectly and use polite language, while criticism and compliments that are rejected tend to use harsh language, either directly or indirectly. These findings provide new insights into how cultural and religious norms influence the delivery and reception of criticism and compliments in the pesantren environment. The implications of this study emphasize the importance of understanding the social and cultural context in managing interpersonal interactions in the pesantren, as well as providing recommendations for educators and pesantren leaders to be more effective in delivering criticism and compliments in accordance with the prevailing norms.

Abstract

Translation and interpreting are often defined as the technical transfer of linguistic forms across languages, yet in contemporary contexts of globalization, mobility, and intercultural exchange they function as far more than mechanical processes. They operate as acts of mediation that bridge not only words but also cultures, identities, and emotions. This article situates translation and interpreting within a broader applied linguistics perspective, drawing connections with English language teaching (ELT), where educators face similar challenges of negotiating meaning, fostering intercultural awareness, and shaping learners’ identities. Both translators and teachers, rather than serving as neutral conduits, act as cultural mediators who must engage critically with the affective, social, and ideological dimensions of language. To illustrate this argument, the article draws on examples from research into nostalgia in migration discourses, humor in pedagogy, and the pragmatics of slang, which reveal how language embodies cultural memory, belonging, and emotional resonance that resist reduction to lexical equivalence. These cases highlight the limitations of narrow approaches centered on accuracy and equivalence while underscoring the value of reflexivity, empathy, and intercultural competence. The paper also explores the role of corpus-assisted discourse analysis as a methodological bridge that can enrich both translation and pedagogical practice by uncovering subtle discourse patterns and ideological cues. By integrating insights from applied linguistics, ELT, and translation studies, the article advocates for an interdisciplinary framework that reconceptualizes translation and interpreting as transformative acts of cultural mediation, contributing to more inclusive and dialogic forms of global communication.

Abstract

This study aimed to develop a Multicultural-Based Character Education Learning Module through the Tidi Lo Polopalo dance in the Nusantara Dance I course at the Department of Dance–Drama–Music Education, Faculty of Arts and Culture, Universitas Negeri Gorontalo. The study employed a Research and Development (R&D) method using Sugiyono’s stages, namely: identifying potentials and problems, data collection, product design, expert validation, design revision, limited try-out, product revision, and broader field implementation. A mixed-methods approach was applied: qualitative methods were used to explore character values and the multicultural context embedded in the Tidi Lo Polopalo dance, while quantitative methods were used to test module effectiveness through descriptive statistics and t-tests (independent and paired). The participants were students enrolled in the Nusantara Dance I course, divided into an experimental group using the module and a control group using conventional teaching materials. The results indicated that the developed module was rated highly valid by content, language, media experts, and cultural practitioners, with average scores above 85%. Practicality testing through lecturer and student questionnaires showed the module was “highly practical” (85–100%). Effectiveness analysis using a paired t-test yielded t = 10.16 > ttable = 2.093 (α = 0.05), indicating a significant improvement between pretest and posttest scores in the experimental group. Descriptively, the average learning outcome increased from 31.5 to 69.9 after module implementation. The module was proven valid, practical, and effective in enhancing students’ understanding of character values (discipline, cooperation, responsibility, religiosity, tolerance) and their multicultural awareness through the local cultural context of Gorontalo. The final product is a contextual dance learning module rooted in local wisdom as an implementation of culture-based character education.

Abstract

The rapid development of cryptocurrency as a digital financial asset has introduced new challenges for the prevention and eradication of money laundering crimes. While cryptocurrencies offer efficiency, decentralization, and borderless transactions, these very characteristics also create significant vulnerabilities for misuse, particularly in facilitating illicit financial flows. In Indonesia, the existing legal framework on anti-money laundering, primarily regulated under Law Number 8 of 2010, was formulated prior to the widespread adoption of cryptocurrency and therefore faces limitations in addressing technology-driven financial crimes. This article examines the challenges of law enforcement in combating cryptocurrency-based money laundering in Indonesia through a normative juridical approach. The study analyzes relevant statutory regulations, institutional authority, and enforcement mechanisms involving agencies such as PPATK, Bappebti, the Financial Services Authority, and law enforcement bodies. The findings indicate that law enforcement faces substantial obstacles, including regulatory fragmentation, jurisdictional complexities, difficulties in tracing blockchain-based transactions, evidentiary constraints, and limited technical capacity among enforcement institutions. Furthermore, the absence of comprehensive regulation concerning decentralized finance and non-custodial digital wallets exacerbates enforcement difficulties. This article argues that without regulatory harmonization, enhanced institutional coordination, and the integration of technological capabilities into law enforcement practices, the Indonesian legal system risks lagging behind the evolving landscape of financial crime. Strengthening adaptive legal frameworks is therefore essential to ensure effective anti-money laundering enforcement in the digital asset era.

Abstract

The main purpose of this study was to examine the impact of standardized salaries on teachers’ motivation and job satisfaction with implications for school administrators in Cameroon. The mixed method design was adopted for the study whereby by both quantitative and qualitative designs were employed. As instruments, Questionnaire and interview guides were used. Using the simple random and snowball sampling techniques, a sample of 254 teachers were selected from 6 schools. 15 secondary school teachers were selected for the study. Quantitative data was analysed using means and standard deviations while qualitative data was analyzed using thematic analysis. The findings prove that standardized salary system in Cameroon's education in spite it advantages in the education sector has created perceptions of unfairness and de-motivation among teachers which has led to lack of teacher commitment in curriculum implementation to a greater extend. Teachers who perceive their salary as being fair are motivated to work harder and vice versa. Based on the findings, recommendations were made to education stakeholders.

Abstract

This study analyzes the effectiveness of legal protection against the misuse of consumers' personal data in the digital financial services sector. The research is motivated by the increasing incidents of data breaches and misuse of personal data that harm consumers, while also examining the capability of existing regulations to provide adequate protection. This study evaluates the effectiveness of Law Number 27 of 2022 concerning Personal Data Protection (PDP Law). The research employs a normative legal research method with a statutory and conceptual approach. Primary data is derived from Law Number 27 of 2022 on Personal Data Protection (PDP Law), while secondary data comes from relevant legal literature. This research is important due to the growing problem of personal data misuse in fintech P2P lending services, which is rapidly expanding, thus necessitating more specific regulatory updates to keep up with technological developments in fintech in general. The purpose of this study is to analyze the effectiveness of the implementation of Law No. 27 of 2022 in regulating personal data protection and the sanctions imposed on parties involved in the misuse of personal data. This indicates that although legal instruments for data protection are available, their implementation still faces obstacles, particularly in terms of oversight and law enforcement, which remain weak. Therefore, this study concludes that regulatory harmonization, strengthening the role of supervisory institutions, and raising legal awareness are necessary.
