Abstract

Houses as a support for community livelihoods in water areas and places for the development of life are very much needed by people who live in water areas, so that people in the Sibolga Cityarea build houses on the coast and coastal borders. The research was conducted using legalresearch, namely normative juridical and empirical juridical, descriptive analytical research isresearch that aims to describe a situation or symptom or to determine whether there is arelationship between a symptom and other symptoms. Data collection techniques used areliterature studies and field studies in the form of data collection and interviews with the Head ofthe Housing, Settlement and Environmental Office of Sibolga City. The results of the researchand discussion show that the regulation of the use of coastal areas for community settlements inSibolga City is regulated in Law Number 1 of 2011 concerning Housing and Settlement Areas,Presidential Regulation Number 51 of 2016 concerning Coastal Boundaries and Sibolga MayorRegulation Number 16 of 2018 Regarding the Utilization of Coastal Areas and Coastal Borders inSibolga City. The legal status of control of coastal waters for residential areas in Sibolga City canbe granted for residential housing if based on Article 5 paragraph (2) of the Minister of ATR/BPNNumber 17 of 2016 is a land right according to Article 16 of the BAL. However, when viewed fromthe presence of houses built on water, not on land (land). The earth's surface referred to in theLoGA is land which includes the surface of the earth on land and also the surface of the earthunder water, including sea water. So, in this case the floating house can be given land rights. Theappropriate right to be given to the floating house is the right to use the land. The policy ofgranting land rights to coastal areas in Sibolga City is only to give use rights to fishermen wholive in the border of the orphanage and not property rights.

Abstract

In 2019 for the first time held simultaneous elections. Voter turnout in this election includes millennial. Some of the millennial are at university. Therefore, it is necessary to know the role of universities in the 2019 general election. The research was conducted with statute approach, case approach, historical approach, comparative approach, and conceptual approach. From this research, it can be found that universities have sought to increase millennial voter participation in the 2019 general election by including material on elections in courses as well as conducting public lectures.

Abstract

Penjualan agunan kepada kreditur khususnya bank mendapat pengecualian dari UU No.7 Tahun 1992 Tentang Perbankan Pasal 12A yang mengatur bahwa “Bank” dapat membeli agunan debiturnya sendiri dengan ketentuan agunan yang tersebut wajib dicairkan secepatnya selambat-lambatnya dalam jangka waktu (1) satu tahun. Selain itu, bank juga dilarang memiliki agunan yang telah dibeli. Ketentuan ini merupakan hukum memaksa (dwingendrecht) yang wajib (mandatory)  dijalankan oleh bank tetapi Undang-Undang tidak mengatur akibat hukum terhadap kedudukan Agunan apabila kewajiban menjaul terlampaui. Semantara daluarsa menentukan “adakalanya Undang-Undang memberikan haknya untuk suatu waktu tertentu. Apabila tidak dipergunakan dalam jangka waktu tersebut, maka gugurlah hak tersebut. Di sisi lain, bank telah membayar lunas harga agunan dan set-off kredit. Aturan pelaksanaan lelang keabsahan lelang tidak mengatur daluarsa terkait pembeli lelang AYDA. Maka berdasarkan asas Lex Superior derogat legi inferiori, aturan pelaksanaan lelang dalam hal bank menjadi pembeli lelang agunan debiturnya harus berpedoman pada Pasal 12A UU Perbankan selaku Undang-Undang yang lebih tinggi. Setelah bank membeli agunan tanah menggunakan mekanisme AYDA, Maka bank memperoleh hak menguasai/mengalihkan agunan selama dalam kurun waktu 1 tahun, Apabila hak menjual agunan terlampaui (daluarsa)/tidak digunakan, maka hak tersebut hangus karena daluarsa menurut Undang-Undang. Selain karena telah kehilangan hak, Agunan tanah yang dijadikan aset fixed asset batal demi hukum karena tidak memenuhi syarat sah perjanjian karena bertentangan dengan larangan pemilikan agunan yang diatur dalam Pasal 12A UU Perbankan. Karena itu kedudukan agunan kembali menjadi hak debitur/pemilik agunan dengan tidak mengurangi hak kreditur untuk menagih piutangnya.

Abstract

Abstract Notaries and PPATs are public officials authorized to make authentic deeds, as long as the making of certain authentic deeds is not reserved for other public officials. Making authentic deeds, some are required by legislation in order to create certainty, order, and legal protection. In practice, not a few Notaries/PPATs have experienced problems in connection with the deed that they have made which is canceled by a court decision as a result of finding legal defects in their manufacture, for example false statements. Purpose, Explaining the authority of a notary and PPAT in issuing power of attorney to sell and deed of sale and purchase. 43/PDT/2017/PT.BNA) and Explain the Civil Liability of Notaries/PPAT Against Authentic Deeds that are not in accordance with applicable laws (study of the Banda Aceh High Court Decision No. 43/PDT/2017/PT.BNA). This type of research is normative juridical, namely by reviewing legislation, legal theories and jurisprudence related to the problems discussed. The approach method in this research is used to analyze the liability of the Notary/PPAT to the deed issued which was canceled by the court. The authority of a Notary who is based on a product of Law Number 2 of 2014 concerning Notary Positions, one of the Notaries has the authority to make an authentic deed that is useful as evidence to carry out a legal act, in addition to a Notary there is a Land Deed Maker Official (PPAT) who also has the authority to make an authentic deed regarding land rights and apartment units based on a product, namely Government Regulation No. 24 of 2016 concerning Land Deed Maker Officials. The legal consequences that arise from an authentic deed made by a Notary and PPAT that cause harm to the parties and other parties, then the deed can be null and void based on a court decision. . Responsibilities of Notaries and PPAT in the decision of the Banda Aceh High Court No. 43/Pdt/2017/PT.BNA based on an unlawful act that has been committed by a Notary/PPAT, thereby harming other parties. Notaries and PPATs are responsible for their actions and provide compensation to the injured party based on Article 48 paragraph 3 of the Notary Position Act. Keywords: Responsibility, Notary, Deed, Power of Attorney Abstrak Notaris dan PPAT adalah pejabat umum yang berwenang untuk membuat akta otentik, sejauh pembuatan akta otentik tertentu tidak dikhususkan bagi pejabat umum lainnya. Pembuatan akta otentik, ada yang diharuskan oleh peraturan perundang-undangan dalam rangka menciptakan kepastian, ketertiban, dan perlindungan hukum. Prakteknya tidak sedikit Notaris/PPAT yang mengalami masalah sehubungan dengan akta yang telah dibuatnya dibatalkan oleh putusan pengadilan sebagai akibat ditemukannya cacat hukum dalam pembuatannya misalnya keterangan palsu. Tujuan, Menjelaskan kewenangan notaris dan PPAT dalam dalam menerbitkan Surat Kuasa menjual dan akta Jual Beli, Menjelaskan akibat hukum terhadap Notaris dan PPAT yang menerbitkan akta yang tidak sesuai dengan perundang-undangan dikaitkan dengan putusan Pengadilan Tinggi Banda Aceh No. 43/PDT/2017/PT.BNA) dan Menjelaskan Tanggung Jawab Perdata Notaris/PPAT Terhadap Akta otentik yang tidak sesuai dengan perundang-undangan yang berlaku (studi putusan Pengadilan Tinggi Banda Aceh No. 43/PDT/2017/PT.BNA). Jenis penelitian ini adalah yuridis normatif, yaitu dengan mengkaji peraturan perundang-undangan, teori-teori hukum dan yurisprudensi yang berhubungan dengan permasalahan yang dibahas. Metode pendekatan dalam penelitian ini digunakan untuk menganalisis tentang pertanggung jawaban Notaris/PPAT terhadap akta yang diterbitkanya yang dibatalkan oleh pengadilan. Kewenangan dari suatu Notaris yang didasari suatu produk Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris, salah satu Notaris berwenang membuat akta otentik yang berguna sebagai alat bukti untuk melakukan suatu perbuatan hukum, selain Notaris terdapat Pejabat Pembuat Akta Tanah (PPAT) juga mempunyai kewenangan untuk membuat suatu akta autentik mengenai hak atas tanah dan satuan rumah susun yang didasari dari suatu produk yakni Peraturan Pemerintah Nomor. 24 tahun 2016 tentang Pejabat Pembuat Akta Tanah. Akibat hukum yang timbul dari suatu akta autentik yang dibuat oleh Notaris dan PPAT yang menimbulkan kerugian bagi para pihak maupun pihak lain, maka akta tersebut dapat batal demi hukum berdasarkan putusan pengadilan Notaris/PPAT wajib mengganti kerugian atas apa yang diperbuatnya yang didasarkan pada pasal 1365 KUHPerdata. Tanggungjawab Notaris dan PPAT dalam putusan Pengadilan Tinggi Banda Aceh No. 43/Pdt/2017/PT.BNA yang didasari dari suatu Perbuatan Melawan Hukum yang telah dilakukan oleh Notaris/PPAT, sehingga merugikan pihak lain. Notaris dan PPAT bertanggungjawab atas perbuatanya dan melakukan ganti rugi pada pihak yang dirugikan yang didasarkan pada Pasal 48 ayat 3 Undang-Undang Jabatan Notaris. Abstract

Corruptions is a part of an unreliable moral attitude even reproached. Corruptions in a broad sense is not just in the form of misappropriating public money or state wealth, including corruptions loyalty. Loyalty to his family, wife, children, department and people of his electorate. Corruption by the regional head, for example, means not only making losses to the country so enriching it self but also directly affecting the distrust of its electorate population. The necessity of checking permits for regional officials, especially the head of the area suspected of being involved in corruptions is in fact a bizarre subject for investigators, so it is an obstacle for the prosecution and the Corruption Eradication Commission (CEC). The existence of the permit was actually narrowed down to the prosecution’s motion and the CEC investigated corruptions allegations.

Abstract

This study aims to determine the principle of prudence in providing credit at the Panitonga branch of Bank Rakyat Indonesia and to find out what causes credit whitening if the debtor dies at the Panitonga branch of Bank Rakyat Indonesia. The type of research used is Field Research (Interview) and Library Research (library) and materials related to the law regarding credit whitening due to the death of the debtor. The principle of prudence in lending to Bank Rakyat Indonesia Panitonga is to maintain the soundness of the bank with the provisions of capital requirements, asset quality, management quality, liquidity, profitability, solvency, and other aspects related to the bank with the provisions and implementation of the 5C principles and & 7P. Credit whitening carried out at the BRI Panitonga branch when the debtor dies due to a loan insurance which is in accordance with the provisions of the insurance policy, if the debtor dies, the insurance covers/pays the remaining credit from the side debtor, so that the debtor's heirs are not burdened with credit payments of the deceased debtor.

Abstract

This study aims to review the jurisdiction of the cancellation of the agreement during the Covid-19 pandemic in terms of the Civil Code. The focus. what are the legal consequences of canceling the agreement during the COVID-19 pandemic in terms of the Civil Code and what legal remedies can be taken by those who suffer losses due to the cancellation of the agreement based on the Civil Code. The type of research used in this study is normative legal research that utilizes literature as a data source. The object of research is based on written legal materials by exploring theories, concepts. and the legal and regulatory principles related to this research. The data collection method is the library research method, namely all efforts carried out to obtain information/data related to the problems studied and the data analysis used is qualitative data analysis methods. Based on the results of the study the legal consequences of canceling the agreement during the COVID-19 pandemic in terms of the Civil Code are: (1) Due to a defect of will, error/mistake/error (dawling), fraud (bedrog) and abuse of circumstances (misbruik van de omstandighenden), (2) Legal remedies that can be taken by those who suffer losses due to the cancellation of the agreement based on the Civil Code can be carried out by litigation and non-litigation based on Law no. 30 of 1999, namely by negotiation, consultation, conciliation, mediation can be done through the local court.

Abstract

Seeing the large number of misuses of personal data through Face Recognition Technology, it is necessary to protect every personal information. So far, Indonesia already has a Personal Data Protection Law. This regulation is considered insufficient to provide protection for the use of facial recognition. This research aims to determine the development of legal regulations for the use of FRT as well as the government's efforts to increase personal data protection. This research uses a normative juridical approach method with analytical descriptive writing specifications. The research results show that Indonesia does not yet have specific regulations governing the use of facial recognition. The regulations are included in the Personal Data Protection Law so further regulations are needed to provide regulatory specifications for the use of FRT technology.

Abstract

A finance company is a company that provides goods or capital needed by the community through cooperation with companies that provide goods referred to by a gradual payment mechanism. Therefore, finance companies have a great responsibility for the fulfillment of consumer rights when entering into agreements, for example in the use of consumers' personal data and information. PT Ovo Finance Indonesia, which is a finance company that has been revoked its business license by the Otoritas Jasa Keuangan in October 2021. This business license revocation event brought a serious polemic to the legal protection of the rights and obligations of its consumers. In an effort to provide legal protection, it will be divided into two types, namely preventive legal protection and repressive legal protection. In this study, we will discuss and understand the scope of the condition of the company PT Ovo Finance Indonesia after its business license is revoked by the Otoritas Jasa Keuangan and how to legally protect the rights and obligations of its consumers. Therefore, to answer this formulation, researchers conduct research using normative legal methods and descriptive qualitative. Researchers will trace and review laws regulations to then be able provide an overview of the subject matter that occurs.

Abstract

The explanation of Article 16 of the Banking Law is that anyone who carries out activities to collect funds from the public is basically an activity that needs to be monitored. This is in line with the many establishments of banks or cooperatives that do not have official permits from Bank Indonesia. This is a criminal charge for the implementation of the scope of business licensing in Indonesia which in Article 46 paragraph (1) of the Banking Law has been explained. Such as the case of decision No. 2896/K/Pid.Sus/2022/PN Tng. This research uses normative juridical research methods. By qualitatively processing primary legal and secondary legal materials. The formulation of the problem that the author raises, namely What is the form of legal protection for victims that can be provided due to collecting funds in the form of deposits without permission according to positive law and What is the basis for judges' considerations in imposing criminal penalties against perpetrators who collect funds from the public in the form of deposits without a business license from the Chairman of Bank Indonesia. The results of the study concluded that the defendant's actions violated the provisions of positive law in Indonesia related to banking and business licensing in line with the judge's consideration to try and decide the defendant's sentence both in Juridical and Non-Juridical terms.
