Abstract

The provisions for granting polygamy permits include facultative and cumulative requirements. The application in Case Number 28/Pdt.G/2021/PA.Ek needs to meet the facultative requirements. However, in their decision, the panel of judges granted the quo request. Research is required to dissect the significance of the arguments used by the Petitioner and the considerations used by the judge by placing them in the spectrum of Islamic thought regarding polygamy to find their relevance to granting permits. The approach used in this research is socio-legal. In this case, the ma?la?a? perspective in Islamic law and gender in social sciences will be used as theoretical tools to dissect the research object. Based on the theory of ma?la?a?, it is understood that the considerations in the quo case do not represent the meaning and concept of ma?la?a? and instead tend to illustrate the mafsada in the choice of legal basis used. Meanwhile, considering benefits in the quo decision is used to legitimize polygamy. From the gender analysis, it is understood that the considerations used by the panel of judges reflect the logic of oppression against women and legitimize the site of pressure through the ma?la?a? argument. The choice of legal basis by the Panel of Judges in the quo case reflects the situation of oppression where natural resources are domesticated and controlled as a reproduction machine.

Abstract

This research aims to explore the stages of marriage in the Mandar community in Polewali Mandar Regency, delve into the symbolic values contained in the Mandar traditional wedding symbols in Polewali Mandar Regency, and examine marriage in Polewali Mandar Regency based on the perspective of Hudud Theory by Muhammad Syahrur. The research method used is qualitative, with a phenomenological approach to the natural conditions found within the research object. The research instrument consists of a questionnaire given to informants, including Cultural Experts, Religious Figures, Community Leaders, and Youth Leaders in Polewali Mandar Regency. The data analysis includes data analysis, data reduction, and conclusion. This research indicates that the stages of marriage in the Mandar community in Polewali Mandar Regency consist of sixteen traditional practices still being practiced. These traditional practices include: Mambala'ba, Messisi, Mettumae, Pappasa'bi, Manjanno-janno, Mattandajari, Mappapeissang, Messou, Melattigi, Metindor, Sipacu, Sirusa'i, Suyu', Me'oro tosiala, Mande-ande Kaweng, and Massiarai ku'bur. The symbolic values contained in the Mandar traditional wedding symbols generally align with the principles of Islamic teachings, but certain aspects still require adjustments, such as the standing competition, which implies that the one who stands up first will have authority in the household. This contradicts the essence of the purpose of marriage. The perspective of Hudud Theory by Muhammad Syahrur in viewing marriage is divided into two parts: 1) Islamic marriage, where the Mandar community still adheres to the boundaries set by religion, and 2) Mandar traditional marriage, which remains within the boundaries of Mandar customary practices and does not contradict religious teachings.

Abstract

The hadanah regulation in the Compilation of Islamic Law (KHI) explains that children who are not yet mumayyiz are under the custody of their mother. Even though custody rights in Decision Number 566/Pdt.G/2021/PA.Prg is determined as stipulated in the KHI: the husband (reconvention defendant) is reluctant to carry out the contents of the quo decision, which results in one of the children being under his care. This is an anomaly in the general view regarding the dichotomy of men's and women's roles. Using a socio-legal approach, this research seeks to avoid the reductionist character that simplifies hadanah disputes into binary categories between compliance and non-compliance with legal provisions and judge's decisions, as well as placing the custody issue into the ongoing social context. Using gender theory and maqasid sharia, this research will dissect the judge's considerations in Decision Number 566/Pdt.G/2021/PA.Prg and their relationship to non-compliance with the quo decision. Based on gender theory, the meaning is that the quo dispute was born simultaneously as awareness of women's involvement in earning a living and of men's participation in caregiving. In its considerations, the assembly was trapped in the social construct of gender roles. The husband's disobedience can be understood as an implication of being disconnected from the judge's considerations from the ongoing social context, where the patriarchal family system, characterized by a dichotomous model of gender roles, is experiencing fragility. Meanwhile, from the analysis of maqasid sharia, it was found that the unequal distribution of happiness (maslahah) desired by maqasid sharia gives rise to a sense of injustice. The logical consequence is that the party who feels burdened with "pain," namely the husband, is reluctant to comply with the quo decision because it does not represent justice and benefit.

Abstract

Rat are a reservoir for bubonic plague, as well as a host for ectoparasites of the flea type (Xenopsylla cheopis) as the main biological vector that contributes to the transmission of bubonic plague. Traditional markets are one of the places where rats can be found in quite high numbers. This study aims to determine the density of rats and the presence of fleas (Xenopsylla cheopis) in rats at the Gorontalo City Central Market. The type of research used in this research is descriptive quantitative. The samples were rats caught using mouse traps which were spread at 10 points for 3 days and fleas (Xenopsylla cheopis) that lived on rats. The data is presented using tables and then analyzed descriptively The results showed that the density of rats at the Gorontalo City Central Market was 60%, meaning that it was classified as high density (exceeding the Environmental Health Quality Standards according to Permenkes No. 50 of 2017, namely > 5%). The density of fleas (Xenopsylla cheopis) at the Gorontalo City Central Market is 0.116, meaning that it does not have the potential to transmit bubonic plague (under the Environmental Health Quality Standard according to Permenkes No.50 of 2017, namely <1). It is suggested to market managers be able to control the rat vector using physical control in the form of setting traps and chemical control in the form of administering rat poison, as well as improving the environment around the market to reduce the rat population.
