Abstract

The application of awig-awig as written customary law which is still used and obeyed by the Balinese people, of course this does not rule out the possibility of deviation. Deviations or violations committed by the Balinese people are generally resolved according to the rules written in awig-awig. The research methodology carried out in this study begins with the identification of a variety of literature related to customary law in terms of problems that occur and challenges that must be faced by the community. Then arranged to come up with the right problem formulation which later can be comprehensively reviewed through field studies and direct observations especially related to the problem taken in this research namely the deviation from the application of awig-awig as written customary law. The results obtained in this study aim to determine the deviations that occur in the Balinese community and how the Balinese community to resolve them.

Abstract

The State Civil Apparatus (ASN) is an important element in carrying out the tasks of government and development in a country. In implementing governance and development, professional ASNs are needed, free from political intervention, free from corrupt, collusion and nepotism practices, able to provide public services to the community and able to play a role as the glue of national unity and integrity based on Pancasila and the 1945 Constitution. as a tool requires guidance to improve the quality of human resources to work effectively and efficiently in providing services. the services provided to the community must be fair and comprehensive, especially in terms of providing services based on community rights so that justice in Indonesia can be realized. The State Civil Apparatus (ASN) prospective judges in Indonesia who are competent in carrying out their duties and functions will create a great court without negative attitudes or arbitrary actions of an officer. The State Civil Apparatus (ASN) guidance for prospective judges is important to improve the quality of ASN's work. The purpose of this paper is to identify the ASN model for prospective judges in realizing a large judiciary in Indonesia. This study uses a literature review method which is a research method by studying the literature or primary data sources used in research. From the results of research and data analysis, it can be determined that The State Civil Apparatus (ASN) coaching for prospective judges in Indonesia uses a coaching model based on employee discipline through the level of punishment from severe, moderate, and mild. See the position of Judge more priority to integrity than intelligence. Intelligence can be increased through various education and training programs. While morality which is the nature and basic nature can not be formed and improved. So prospective judges who behave despicably must be fired in order to realize a great court in Indonesia.

Abstract

Permasalahan isu aborsi terus menjadi polemik yang tidak berkesudahan dalam ranah hukum dan sosial, baik di Indonesia maupun di berbagai negara lainnya. Persoalan ini diantaranya terkait dengan keseimbangan perlindungan hak hidup janin dan hak reproduksi perempuan yang dipengaruhi oleh faktor moralitas, kesehatan, ekonomi dan sosial budaya. Di Indonesia, pengaturan aborsi berbentuk prohibitive drafting, yaitu pelarangan dengan pengecualian yang terbatas, seperti kondisi kehamilan akibat perkosaan dan kedaruratan medis. Model regulasi yang ketat, ditambah dengan stigma sosial yang buruk mendorong naiknya angka praktik aborsi tidak aman yang berujung pada tingginya angka kematian ibu. Sebaliknya, Inggris menerapkan pendekatan yang berbasis harm-reduction dan lebih permisif. Penulisan karya ilmiah ini menggunakan metode yuridis normatif dengan pendekatan regulasi perundang-undangan dan perbandingan hukum untuk menganalisis dasar filosofis, sosiologis, dan yuridis dalam penyusunan substansi regulasi aborsi di kedua negara. Hasil kajian menunjukkan bahwa perbedaan sosial dan paradigma hukum menjadi faktor utama pembeda. Indonesia bertumpu pada nilai moral religius yakni Pancasila, sementara Inggris berorientasi pada kesehatan publik dan hak otonomi tubuh. Oleh karena itu, reformasi regulasi aborsi di Indonesia perlu diarahkan untuk lebih adaptif, responsif, dan operasional agar dapat menyeimbangkan antara hak reproduksi perempuan dengan hak hidup janin.

Abstract

This study examines the role of public participation in general elections as stipulated in Law Number 7 of 2017. Although the law recognizes the importance of public involvement, its provisions remain normative and do not provide clear operational mechanisms, resulting in conceptual ambiguity, weak legal protection, and barriers to substantive public involvement. The results of the study indicate that legal problems such as a lack of implementation standards, overlapping authority, limited access to information, and vulnerability of reporters impact the low effectiveness of public participation. Furthermore, political dynamics and structural challenges such as inequality in political literacy, the practice of money politics, and uneven infrastructure contribute to the deterioration of public participation in elections. Therefore, strengthening public participation requires regulatory updates, expanded access to information, stronger legal protection, and structural reforms so that the public can play a role as active observers and not merely passive voters.

Abstract

The highest authority in the land relies on court rulings, which must be as precise as possible in language to provide rechtssicherheit, or legal certainty. But the truth is that even legitimate Indonesian items might have spelling or grammar mistakes. The purpose of this study is to classify the language mistakes in Decision Number 111/Pdt.P/2022/PN.Pgp and to examine the effects of such mistakes on the certainty of the law. In this work, we use a descriptive-analytical methodology informed by forensic linguistics to show how misspellings, improper grammar use, and poorly constructed sentences may lead to ambiguities that compromise the verdict. The results highlight the fact that fluency in standard English is crucial to the legitimacy of law enforcement, and not only for its aesthetic value.
