Abstract

The implementation of criminal provisions for Road operators which resulted in accidents in South Halmahera District is not effective because until now there has been no complaints / reports and demands from the community to the South Halmahera Resort Police related to traffic accidents due to damaged roads. This is because the public does not understand the existing rules (criminal provisions in Article 273 of Law Number 22 Year 2009) due to lack of socialization and legal counseling to the public. Community ignorance of existing rules (criminal provisions in Article 273 of Law Number 22 Year 2009) and the non-proactive role of the police in following up on traffic accidents experienced by the community due to damaged roads and lack of socialization and legal counseling by the government to Public.

Abstract

The objective of this research is to know the level of financial health of Koperasi Swastisari Credit 2012-2016 based on the Regulation of State Minister of Cooperatives and Small and Medium Enterprises of Republic of Indonesia No.06 / PER / DEP.6 / IV / 2016 concerning capital aspect, earning asset quality, management, liquidity, efficiency, independence and growth as well as cooperative identity.This research is a type of descriptive evaluative research. The subject of this research is Credit Cooperative (Kopdit) Swastisari in which the object of evaluation is financial health Kopdit Swastisari. Data analysis techniques in this study using descriptive analysis. In this research data is collected through documentation and interview method. The results showed that the healthlevel of the 2012-2016 Swaddle Kopdit was in fairly healthy category with the average score of 78.06 with details: (1) the capital aspect was averaged 12.24 and was in the healthy category; (2) aspect of productive asset quality in the mean score 17,25 and in healthy enough category; (3) management aspect was score 13,07 and was in healthy category; (4) the efficiency aspect was averaged 15.00 and was in the healthy category; (5) liquidity aspect in the average score of 7.25 and is in the less healthy category; (6) aspect of independence and growth average score 6.25 and in the category of healthy enough; (7) the aspect of cooperative identity is averaged score of 7.00 and is in fairly healthy category. (8) the level of health of the Swedy Kopdit for 5 years(2012-2016) in a row obtained the total score of 70.35; 71.05; 72.45; 72.70; 72.50 and 78.06 are in fairly healthy categories.Using Trend Analysis least square method taken from the total health ratio of Swasti Sari Kopdit Period (2012-2016) obtained estimates of the results of the health ratio assessment in the coming year (2017-2020), the score obtained is 73.58; 74.17; 74.76 and 75.35 which indicate a good prospect for the next 5 year.

Abstract

Article 18 of Law Number 48 of 2009 concerning Judicial Power determines that judicial power is exercised by a Supreme Court and judicial bodies under it in the general court, religious courts, military courts, state administrative courts, and by an Constitutional Court. Each judicial environment has competence, both absolute and relative competence. The absolute competence of the judiciary is the jurisdiction of the judiciary in examining certain types of cases which are absolutely unable to be examined by other court bodies, either in the same judicial environment or in a different judicial environment. In connection with disputes involving sharia banking, until now it is still a matter of debate, which court has the authority to try them. Not to mention that until now there are still decisions of district courts that accept and grant claims which are disputes involving sharia banking. This means that internally the Supreme Court alone, in this case the judges in making decisions are still unable to provide legal certainty regarding absolute competence in adjudicating disputes involving sharia banking

Abstract

Legal protection of domestic workers in Indonesia currently does not have a legal regulation. The Manpower Law also does not accommodate legal protection for domestic workers who are not considered as a worker. The only one regulation related to domestic workers in Indonesia is a ministerial regulation with a legal force that does not accommodate all the fulfillment of rights and obligations that are unclear to domestic workers especially who are recruited directly. The government has not yet established a special agency/ institution to provide legal protection for domestic workers that make Non-Government Organization (NGO) involved more in handling this matter. The absence of a legal regulation for the protection of domestic workers is a major cause of rights violations for domestic workers itself. In dealing with these conditions, the authors propose the need for the establishment of special law of domestic workers who are recruited directly and manifested through the establishment of the Domestic Workers Handling Institution as a solutive step in realizing civilized justice for domestic workers as a worker. The formation can be done in several ways, first, providing legal certainty and guarantee through the establishment of a specially hired domestic labor law, which includes the rights, and obligations of workers and employers. Secondly, to establish an institute for Domestic Workers Handlings that have the competence such as data of domestic worker, training and protection for domestic worker as a worker. In this writing, the author uses primary, secondary, and non-legal material. Legal material is obtained through literature research method then the material obtained is analyzed qualitatively and presented descriptively. The expected outcome is the realization of legal protection for domestic workers as a worker who is recruited directly as mandated by the constitution.

Abstract

Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara memiliki peran penting dalam pengamanan kawasan pertambangan pada PT. Nusa Halmahera Mineral. Peran tersebut terdiri dari peran preemtif dan peran preventif yang merupakan peran sebagai upaya pencegahan serta peran represif sebagai upaya penindakan dalam hal ini penegakan hukum (law enforcement) bagi pelaku yang melakukan tindak pidana pada objek vital di kawasan pertambangan PT. Nusa Halmahera Mineral. Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara menghadapai berbagai kendala dalam melaksanakan pengamanan kawasan pertambangan pada PT. Nusa Halmahera Mineral. Tidak berjalan optimalnya peran Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara disebabkan karena masih kurangnya jumlah personil pada Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara serta masih terbatasanya sarana dan prasarana yang memadai dalam mendukung pelaksanaan pengamanan. Kemudian lemahnya pelaksanaan koordinasi oleh manajemen PT. Nusa Halmahera juga menjadi kendala bagi Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara dalam melaksanakan perannya secara optimal untuk  pengamanan kawasan pertambangan pada PT. Nusa Halmahera Mineral.

Abstract

Pretrial has the authority under the Criminal Procedure Code to order law enforcement agencies (KPK / Police / Prosecutors) to continue the legal process of someone suspected of committing a criminal act of corruption and this does not conflict with the legality principle of criminal procedure as affirmed in Article 2 and Article 3 of the Criminal Procedure Code. The pretrial judge's action is the application of the principle of judicial independence to resolve legal issues. Thus the pretrial judge's ruling does not conflict with the legal principles of procedural law in Article 2 and Article 3 of the Criminal Procedure Code

Abstract

The recognition and respect for the indigenous people along with their traditional rights is affirmed on the article 18B verse (2) of the 1945 Constitution of the Republic of Indonesia; that includes the indigenous people of Hibualamo in North Halmahera regency.  The spatial planning contect requires the involvement of the indigenous people to achive a balance between development and tenure rights so that it will be in line with the local wisdom to support sustainable development.

Abstract

Crime is a very anti-social act that consciously gets a reaction from the state in the form of giving suffering (punishment or action). Crime as a behavior is an act of deviance, is against the law or violates statutory regulations and is detrimental to the community in terms of decency, decency and order of community members. Crime can be defined juridically and sociologically. Crime is part of people's lives and is an everyday event. A philosopher named Cicero said Ubi Societas, Ibi Ius, Ibi Crime which means there is a society, there is law and there is crime. The benefit of studying criminology is that criminology contributes to the formulation of new legislation (the Criminalization Process), explaining the causes of crime (Criminal Ethylogy) which in turn creates efforts to prevent crime. Another issue regulated in the child protection law is how to punish adults who commit crimes against children and also the responsibility of parents, society and the state in protecting children. This research was conducted in North Maluku, precisely in the city of Ternate. This research will use a descriptive type of analysis with a qualitative approach. Abstract

Dengan di undangkannya Undang – Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum memberikan peluang untuk peningkatan demokrasi dengan memperhatikan adanya pelanggaran yang dilakukan dan menjadi tugas pokok dari Badan Pengawas Pemilihan Umum Kabupaten/kota. Efektifitas penegakan pelangaran administrasi oleh BAWASLU Kabupaten Halmahera Selatan berdasarkan Pasal 240 Ayat (1) Huruf (k) dan (m) Undang – undang Nomor 7 Tahun 2017 tentang PEMILU, belum maksimal dalam memberikan keputusan kepada Calon Anggota DPRD Kabupaten Halmahera Selatan Dapil II Makian Kayoa yang telah memenuhi unsur formil maupun materil dalam pemeriksaan Persidangan Pelanggaran Administrasi. Selain itu, Faktor yang mempengaruhi penegakan Pelanggaran Administrasi pada Pemilihan Umum serentak Anggota DPRD oleh BAWASLU Halmahera Selatan tahun 2019 yaitu jumlah personil dan sarana fasilitas penunjang dalam pemeriksaan persidangan tidak memadai, antara tugas dengan dana operasional tidak sebanding dalam penganan kasus pelanggaran Administrasi.

Abstract

Motorcycle riders in southern Halmahera Regency have not complied and obeyed the provisions of Article 293 paragraph (2) of the LLAJ Law concerning the obligation of motorcycle riders to turn on their lights during the day. This happened because in facing the disobedience of the driver, the South Halmahera Sat Lantas Police had not taken repressive measures such as giving a TOSS statement but the action taken was still limited to preventive action. The preventive measure is to disseminate information about the obligation to turn on lights during the day by motorcyclists. In addition, community ignorance and the low level of community discipline. Then the weak sanctions imposed by law enforcement.
