Decision of the Constitutional Court of the Republic of Indonesia Number 46/PUU-XIV/2016 which rejects the extension of meaning and scope of adultery, rape and fornication in Indonesian criminal law becomes polemic in society. This is because the acts are very contrary to the moral and religious values, and Pancasila as the ideology of the Indonesian nation. The limitation of judicial review authority by Constitutional Court of the Republic of Indonesia related to criminal provisions is the reason for not willing to take the exclusive authority of the legislator in the formulation of criminal provisions. On the other hand, the Constitutional Court itself often extends the meaning and scope of norms in laws unrelated to criminal provisions.

Indonesia is one of the countries with abundant natural resources, this can be seen from the abundant human resources that are able to improve the management of existing natural resources. This is also emphasized in Article 33 paragraph 3 of the 1945 Constitution of the Republic of Indonesia (UUD RI 1945). A different fact is faced by small communities in the border area between Nusa Tenggara Timur Indonesia and Timor Leste. The problem is that the small communities there are not unable to enjoy subsidy relief due to wrong targets but because of smuggling carried out to neighboring countries. In several criminal cases that occurred in the border area between East Nusa Tenggara and Timor Leste, one of them was the Indonesian National Armed Forces (Satgas Pamtas) RI-RDTL East Sector Border Security Task Force, Yonif Raider 408 / Sbh, thwarted the smuggling of thousands of liters of fuel oil. (BBM) in the RI-RDTL border area.There have been many efforts made by the government to improve the welfare of its citizens by utilizing existing natural resources, especially in the oil and gas sector, one of which is in terms of access to energy consumption through fuel oil (BBM) subsidies which are still being debated. Some are of the view that state assistance must be maintained, but on the other hand, they still think that fuel subsidies are still not on target. A different fact is faced by small communities in the border area between Nusa Tenggara Timur Indonesia and Timor Leste. In addition, at the opening of the International Convention on Indonesian Upstream Oil and Gas 2020, which was organized by SKK Migas, the Government also supported the improvement of the investment climate in Indonesia's upstream oil and natural gas (oil and gas) sector, amid a decline in national oil and gas production and sluggish movement of strategic industries due to the the Covid-19 pandemi.

Abuse of narcotics by children in Ternate City actually occurs and is used by children who are still minors, either the child is a user / user or the child is a dealer, if it is categorized as narcotics abuse by children in Ternate City then the most dominating the category is a child as a user or a user who is a victim. The legal area of the North Maluku Regional Police and its staff in Ternate City is often found by children as drug users / users who are victims, in 2017 there were 2 cases of children who were netted with drug cases, in 2018 there were 1 cases of children and in 2019 there were 3 cases of children as users drugs, from these figures it shows that in the jurisdiction of the North Maluku Regional Police and the number of crimes of trafficking of Narcotics by minors still occurs, from a number of reasons children use or use narcotics because they are influenced by invitations from friends, curiosity or trial and error. try, the influence of the older siblings who live in, then the family is not harmonious and the environment in which they live.

This research aims to compare the value of certainty and protection of protection of land law in Indonesia and Singapore which aims to provide certainty and legal protection. This type of legal research is normative legal research. The method of approach used is legislation, conceptual and comparative approach. Based on the research that is registration of land in Indonesia is regulated in Law of the Republic of Indonesia Number 5 Year 1960 Article 19 BAL (Basic Agrarian Law/ Undang-Undang Pokok Agraria), and in Singapore regulated in Land Titles Act (LTA) Chapter 157 Year 2015. There are similarities and differences in registration of land, among others, Indonesia and Singapore adopt the right registration system (Torrens). Indonesia adopts negative publication of positive tendency system that produces certificate as a strong evidence and existence of rechtsverwerking institution (Government Regulation of the Republic of Indonesia Number 24 Year 1997 Article 32) while in Singapore adopt positive publication system that generates certificate as absolute proof (LTA 157 Year 2015 Article 36) and the presence of caveat as a form of legal protection. It is expected that by changing the registration of land law in Indonesia can provide absolute legal certainty and legal protection in registration of land as in Singapore.

Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap Pejabat Lelang dalam kedudukan dan fungsinya. Penulis menganalisis suatu pelaksanaan lelang yang berujung pada penetapan tersangka, penangkapan, dan penahanan serta disidangkan dalam perkara pidana terhadap Pejabat Lelang Sdr. UAM sebagaimana tercantum dalam perkara pidana pada Pengadilan Negeri Denpasar Nomor 15/Pid.B/2016/Pn.Dps jo Kasasi Mahkamah Agung Nomor 1250K/Pid/2016. Disamping menganalisis perkara pidana dimaksud, penulis juga melakukan kajian terhadap bentuk perlindungan hukum terhadap Pejabat Lelang dalam kedudukan dan fungsinya dan faktor-faktor yang mempengaruhi.

The role of the shahbandar in the enforcement of shipping crime has the highest authority in conducting initial inspections of ship accidents with the aim of knowing the causes of ship accidents and / or determining whether or not there is an error or omission in the application of maritime professional standards carried out by the master or ship leader and / or Ship Officer in connection with a ship accident. The Role of Syahbandar in the Investigation of Sailing Crimes in the Case of Ship Accidents is not running optimally, this is due to inhibiting factors in terms of human resources in this case related to the limited number of personnel, education and training as well as facilities and facilities factors related to the minimal number of patrol vessels very significant in carrying out investigation of shipping crime in this case a ship accident in the waters.

Standard Agreement at PT Finansia Multi Finanse (A Review of Law Number 8 Year 1999 concerning Consumer Protection) This study aims first to determine the implementation of the Standard Agreement at PT Finansia Multi Finanse in Ternate City Second To find out the Standard Agreement Settlement in the event of default by parties Creditors This type of research is empirical normative, because what is being studied is a problem regarding matters that are juridical and the existing facts regarding empirical normative research methods, because what is being studied is a problem regarding matters that are juridical and the existing facts regarding juridical review of the implementation of the agreement. standard at PT Finansia. And the Standard Agreement Settlement in the event of default by the debtor party in Ternate City, while normative determines what is allowed and what cannot be regulated in the Civil Code. Based on the results of research and discussion, it can be concluded that First, the implementation of the Credit Agreement at PT Finansia Kota Ternate, from the last 5 months in 2020 there has been an increase, it can be seen that customers who make credit loans in the form of money or other electronic goods increase every month until the time This is because every customer who makes a credit loan at PT Finansia Kota Ternate is not convoluted so that from May to September 1743 customers made credit loans, or up to 98%. Second The legal consequence is that if there is default at PT Finansia Kota Ternate, the last 5 months in 2020 reached 10 customers or 0.5.5% of 1743 customers, the customer as a debtor has the authority to carry out and maintain the customer's credit loan items if PT Fainansia does default in accordance with the applicable law.

Putusan Hakim Pengadilan Negeri Ternate Nomor : 177/ Pid.B/2018/PN.Tte, yang amar putusannya tidak mencantumkan perintah supaya terdakwa ditahan adalah putusan yang hanya didasarkan pada “kebiasaan hakim†dan dasar pertimbangan hakim tersebut tidak memiliki kekuatan hukum yang mengikat untuk dieksekusi oleh Jaksa selaku eksekotor sebagimana ketentuan Pasal 30 ayat (1) huruf b UU. No 16/2004 tentang Kejaksaan Republik Indonesia. Akibat hukum dalam Putusan Hakim Pengadilan Negeri Ternate Nomor : 177/ Pid.B/2018/PN.Tte, yang amar putusannya tidak mencantumkan perintah supaya terdakwa ditahan merupakan putusan yang lemah dan berakibat fatal secara hukum sehingga putusan tersebut dinyatakan batal demi hukum sebagaimana ketentuan hukum yang diatur dalam Pasal 197 Ayat (1)Huruf a-ldan ayat (2) KUHAP serta Putusan tersebut juga telah menyimpangi prinsip-prinsip pokok dalam asas legalitas. Demokrasi desa akan membuka ruang bagi rakyat untuk menyampaikan aspirasinya kepada pemerintah desa. Aspirasi adalah fondasi kedaulatan rakyat yang sudah lama diamanatkan dalam konstitusi. Perluasan kewenangan Pengadilan Negeri dalam menangani sengketa pemilihan kepala desa merupakan gagasan yang sengaja penulis tawarkan dalam rangka perubahan Undang-Undang Nomor 6 Tahun 2014 tentang Desa, hal mana didasarkan pada fakta penanganan sengketa pemilihan kepala desa yang diselesaikan oleh pemerintah Kota Tidore Kepulauan dan Halmahera Selatan yang tidak pernah selesai bahkan Putusan Pengadilan Tata Usaha negara pun tidak berarti apa-apa oleh karena sifat putusannya yang tidak dapat dilaksanakan serta merta sehingga keadilan bagi para pencari keadilan tidak terpenuhi. Tulisan ini juga hendak menawarkan mekanisme peradilan yang semestinya mengenai perselisihan pemilihan kepala desa yang mencerminkan prinsip demokrasi hukum yang sebenrnya dari yang semula merupakan wewenang Bupati/Walikota kepada pengadilan negeri untuk menangani sengketa pemilihan kepala desa sebagai wujud dari aktualisasi prinsip negara hukum demukratis dan sekaligus menghindari konflik kepentingan antara pemerintah (eksekutif ) dan pemangku kepentingan dalam pemilihan kepala desa.Kata Kunci: Pemilihan Kepala Desa,Pengadilan Negeri,Sengketa
