Abstract

The principle of freedom of contract is a principle in the treaty law that cannot be understood absolutely for anyone who is involved in an agreement. In order to make a binding in the contract/agreement, the parties should still take into account the essence of the equilibrium value of the parties to an agreement to avoid the existence of contracts/standard agreements that would precisely eliminate the value of justice for the right that should be obtained for one of the contracting parties. for example, contracts/labour agreements made between employers and workers/labourers in the case of termination of employment due to the existence of inter-worker/labourer marriage ropes in one company as regulated in Article 153 paragraph (1) letter f of Law of the Republic of Indonesia Number 13 Year 2003 concerning Manpower. For the applicant a judicial review of the provisions of the article in the Constitutional Court of the Republic of Indonesia, to assess the provisions of that article is of constitutional harm if such provisions continue. The Constitutional Court of the Republic of Indonesia in its legal consideration of Decision Number 13/PUU-XV/2017 considers the principle of freedom of contract in the context of the article whose judicial review is no longer relevantbecause it does not meet the value of the balance in the process of contracting/agreement and eliminating the justice of one of the parties involved in the contract.

Abstract

This article was written with the aim of knowing and analyzing the policies of the Majalengka Regency Government in providing assistance to people who are self-isolating due to being exposed to or confirmed positive for Covid-19, besides that this paper will also try to describe about how the mechanism for providing assistance as well as analyzing weaknesses and solutions to these problems. This paper is a normative juridical writing made with two main approaches, namely the empirical approach and the case approach. The results of the study indicate that the policy of providing assistance for people who are self-isolating in Majalengka Regency is given by providing cash assistance worth Rp. 45.000,00 (forty five thousand rupiah) with details of 3 (three) meals/improvement of nutrition per day multiplied by Rp. 15,000.00 (fifteen thousand rupiah), wherein the amount is given for 10 days of self-isolation period. If it is calculated as a whole, then the total compensation given to residents/communities who do self-isolation is Rp. 45.000,00 X 10 days, which is Rp. 450,000.00 per one citizen identified as positive for Covid-19. However, the facts on the ground show that there are still many community members who do not and do not know about the program, this is due to the existence of a mechanism for providing assistance that focuses on managing the residents, not the government, so it is necessary to reconstruct/change the distribution mechanism which emphasizes the importance of government activities. in the distribution of assistance to the people of Majalengka Regency who were confirmed positive for Covid-19.

Abstract

Termination of Employment (PHK) is basically a complex problem because it is related to unemployment, crime and job opportunities. Along with the rate of development of the business industry and the increasing number of workforce working in employment relationships, the problem of termination of employment is a problematic topic because it involves human life. The government has issued Law Number 21 of 2000 concerning Worker Unions / Labor Unions, Law Number 13 of 2003 concerning Manpower and Law Number 2 of 2004 concerning Settlement of Industrial Relations Disputes (PPHI Law) which are the basis of reference in case of layoffs . One of the problems that occurred when the Panel of Judges of PHI PN Ternate stated that the demand for wages during suspension was legal according to the law, in accordance with the provisions of Article 155 paragraph (3) of Law Number 13 of 2003 concerning Manpower so that the Panel of Judges considered the provisional demands (interlocutory decision) appropriate to was granted and sentenced the Plaintiff (Entrepreneur) to pay suspension wages to the Defendant (Worker) since November 2014 until this case has permanent legal force. However, in reality and in fact the entrepreneur / company did not implement the interim decision.

Abstract

Abstract

Human longing for justice is essentially a longing for happiness, so efforts to fulfill various rights as witnesses of victims of theft crimes in Makassar City as a place of research have been conducted since 2017,2018 and 2019, actually show that the handling is carried out by the Police and the Prosecutor's Office especially in the victim's items found in the Police as well as the number of victim's items returned at the Prosecutor's Office, must be an important concern, but in fact, that victims of theft crimes are not like that .. This can be reflected in decisions by judges based on in the data in the last three years above, which convicted the perpetrators with imprisonment but none of the perpetrators were convicted to pay compensation to the victims. If the judge has the courage to make legal breakthroughs by punishing the perpetrator to pay compensation in the amount of the loss suffered by the victim, then, to be able to implement the legal objectives of justice related to the fulfillment of the victim's witness rights to personal property in a theft crime case can be realized

Abstract

Judge decision NO. 350 K/Pdt.Sus-BPSK/2016 and Judge decision NO.10/Pdt.Sus-BPSK/2016/PN.Plk are 2 (two) of the 127 (one hundred and twenty seven) verdicts of BPSK annulled by the Supreme Court (MA) on October 27, 2017. Where MA argued the two verdicts were not the authority of BPSK. Thus, problems arise whether the decision NO. 350 K/Pdt.Sus-BPSK/2016 and the decision NO.10/Pdt.Sus-BPSK/2016/PN.Plk are the competence of BPSK in resolving consumer disputes or not. To answer these problems, normative legal research methods are used, so that the conclusion is that the verdict NO.10/Pdt.Sus-BPSK/2016/PN.Plk is not the Palangkaraya BPSK competency in deciding because Sancho is not the final consumer protected by UUPK, so if the Supreme Court annulled the decision of the Palangkaraya BPSK is true. Meanwhile, verdict NO. 350 K/Pdt.Sus-BPSK/2016 is true Coal BPSK competency to decide consumer disputes because Dermasnyah Pane is the final consumer protected by UUPK, so if the Supreme Court annulled the decision of Coal BPSK is not true.
