Abstract

Criminal law is a sub-section of law that creates peace and order in society, because the existence of criminal law in society cannot be separated from the state's efforts to create order. To determine the penalty for a criminal act, it is necessary to pay attention to the doctrine of cause and effect and evidence of the occurrence of the criminal act. For this reason, the aim of this research is to analyze the teachings of causality and evidence of the crime in the cyanide coffee case committed by the defendant Jessica Wongso against the victim Wayan Mirna Salihin in 2016. This research uses qualitative research methods. The data collection technique in this research uses the literature study method. The data that has been collected is then analyzed through three stages, namely data reduction, data presentation, and drawing conclusions. The research results show that the doctrine of causality is very important because it relates to which actions should be considered as the cause of prohibited effects. The judge assessed that Jessica's actions, namely putting cyanide poison in the coffee that Mirna drank, were the direct cause of Mirna's death. This decision was based on several considerations, namely the discovery of cyanide poison in Mirna's coffee, no one else had put cyanide poison in Mirna's coffee, and the defendant had a motive to kill the victim. In this case, the judge relied on witness testimony, expert testimony and evidence to prove Jessica's crime. Based on the teachings of causality and evidence, the judge sentenced Jessica as the defendant to 20 years in prison. This circumstantial evidence has given rise to much controversy. However, despite the controversy, the coffee cyanide case shows the importance of the teachings of causality and evidence of criminal acts in criminal law.

Abstract

The climate change issue is authentic and recognized as the biggest threat to human life. Many actions should be taken to adapt to and mitigate climate change, one of which is to hold a Climate Village Program. This research aimed to describe the public participation process in developing Climate Village and the factors affecting it. The research was conducted in the Sekip Climate Village of Kadipiro of Surakarta City using ethnographic methods with Henry Lefebvre's social space reproduction. The urgency of Climate Village development in Sekip village is the environmental problem that has been faced since 2011, including flood, water puddles, drought, DBF, malaria epidemic, slump, and dirty village image. Production of knowledge and social space to develop climate villages was conducted through adaptation and mitigation activities. The program of adapting to climate change is the natural form of community action taken by constructing infiltration wells, repairing gutters, constructing retention basins, planting vegetables and fruits, and installing vertical gardens. The mitigation program included waste management, solar panel installation, bio-pore hole construction, and rainwater harvesting activities. The production of citizens' spatial space was conducted based on citizens' knowledge production concerning the effect of climate change and knowledge reproduction about adaptation and mitigation that can be accomplished in a participative manner. The factors affecting it, including ecology and social culture, became part of citizens' social learning process to mitigate the effect of climate change.

Abstract

The aim of writing this article is to obtain an overview of the role of madrasah supervisors in implementing the independent learning curriculum. Implementation of the Independent Curriculum is voluntary, gradual according to ability, and depends on the readiness of each educational unit. In its implementation it is certainly not easy, especially raising awareness of each madrasah (educator) in implementing the independent learning curriculum, so madrasah supervisors have a strategic role in influencing, encouraging, directing, guiding and mobilizing madrasah residents, therefore the role of supervisors is as regulated in GTK Director General Regulation No. 4831 of 2023 The Role of School Supervisors in the Independent Learning Policy, is the basis on which a supervisor plays his role in implementing the independent learning curriculum in educational units. The conclusion of writing this article shows that: (1) Madrasah supervisors carry out the role of supervisors and leaders of change in their educational institutions, (2) The independent learning curriculum is student-centered educational program planning, where educational units have autonomy in developing their curriculum, (3 ) Madrasah supervisors have a strategic role in the curriculum development process.

Abstract

This study analyzes the challenges and opportunities SMEs face in developing their culinary business in North Sumatra. The qualitative method used in this research involves interviews and observations of 15 participants who are SMEs in the culinary field. The study results show that SMEs in North Sumatra face several challenges in developing their culinary business. The main challenges faced are intense competition in the modern culinary industry, limited resources, and consumer changes. However, this research also found that there are opportunities that SMEs in North Sumatra can exploit. The main opportunities found are the developing tourism potential in this area, technology, and social media that are easy to use as promotional tools, and opportunities to work together and collaborate with other SMEs to develop modern culinary delights in North Sumatra. From this research, it is hoped that SMEs' courage, creativity, and ability to adapt to market changes will succeed in developing their culinary business in North Sumatra.

Abstract

The successful implementation of the policy of the Minister of Education, Research and Technology Regulation Article 18 Paragraph 9 Number 53 of 2023 is influenced by the delivery of information and communication by policy actors. By applying policy implementation theory, this research will examine the factors that influence the dimensions of communication, such as communication distribution, clarity of information, and consistency, and then provide a better understanding of the importance of communication in building cooperation in higher education programs, providing input and recommendations for legislators. Moreover,And other educational institutions are increasing information dissemination efforts and expanding the scope of their programs. This research aims to determine how implementers carry out information implementation, clarity, and consistency through communication studies. The research used is qualitative with a descriptive approach carried out through observations and interviews for three months at three universities in Sumbawa Regency with informants determined through purposive sampling, intended to provide an accurate picture of a particular situation or the relationship between various actual phenomena. Regularly. Information has been provided, but the implementation still needs to run optimally; this can be seen from the uneven delivery of information to technical implementers. The provision of information could have been better. Namely, the central institution still needs to conduct direct outreach to the targets or target objects by implementing technical UPTs. Meanwhile, academic parties at the University are waiting while studying the aims and objectives of the policy. It is hoped that central institutions will optimize the delivery of information and communication.

Abstract

The background of this research stems from an understanding of the crucial role job satisfaction plays in influencing employee performance and productivity. Job satisfaction fosters a positive work environment and motivates employees to contribute more effectively. Work motivation is also vital in achieving sales targets with sub-agents or salespeople. Incentives like bonuses support their enthusiasm. However, work-related stress also requires attention as it can negatively impact job satisfaction and performance. This study considers work-related stress as a factor affecting job satisfaction and views work motivation as a mediating variable linking work-related stress and job satisfaction. Through this analysis, the research aims to understand the intricate relationship between work-related stress, work motivation, and job satisfaction at PT. Windhu Sari Gas Batubulan Branch. This research employs a saturated sample determination method with primary data collected through interviews, questionnaires, and observations at PT Windhu Sari Gas Batubulan Branch. The analysis encompasses descriptive analysis and path analysis. The results indicate that 1) work-related stress significantly and negatively influences job satisfaction, 2) work motivation significantly and negatively affects job satisfaction, 3) work-related stress significantly and negatively influences work motivation, and 4) work motivation mediates the influence of work-related stress on job satisfaction. Based on these findings, the management of PT. Windhu Sari Gas Batubulan Branch is advised to enhance job satisfaction by considering work-related stress and work motivation.

Abstract

Study This aims To identify ( 1) taboo words, (2) forms of taboo words, and (3) references used in public Village Mundeh, Tabanan. Study This uses the qualitative descriptive. The data type uses primary data instrument study as a table sheet. The deep data collection study technique uses interviews with three original people, Villagin e Mundeh, with criteria that have been set. Procedure Data analysis begins with data collection, data reduction, data presentation, and writing a conclusion. Research data in the form of a taboo word in the environment Narayanan, pawing, palemahan, form taboo, and a reference from taboo the. Study This adopts a theory from Frazer (1955), which discusses taboo names and words, and a theory from Montagu (1973), which discusses oath swear. Results show that 5 data were found in the environment parhyangan, 5 in the environment palemahan, and 32 in the environment pawongan. For taboo Names, 6 data were found for words, 13 for swearing words, and reference to taboo is appropriate with theory from Laksana (2009) found data for 12 references. The conclusion from the study This shows that the most data found in the environment pawongan as many as 32 words.

Abstract

The writing of this scientific paper entitled "Legal Protection of Consumers Regarding the Distribution of Illegal Cosmetics Online given Law no. 8 of 1999 concerning Consumer Protection" aims to find out generally and broadly about cosmetics, why illegal cosmetics can circulate online, the distribution of illegal cosmetics according to applicable law. We need to know what illegal cosmetics mean. Considering the large number of Indonesian women's interest in using beauty products, online business people are flocking to produce their products in various ways, including online marketing. However, on the other hand, due to tight business competition, online business actors act in bad faith by illegally marketing cosmetic products. Just like women, men also use cosmetic products to increase their self-confidence. Many factors cause consumers to use beauty products without knowing the consequences they will get. One of the factors is the need for more consumer education and knowledge regarding illegal cosmetics sold online and sold freely through online sites based on the provisions of the Consumer Protection Law. This research aims to examine and analyze the problem of legal violations for naughty business actors regarding the distribution of cosmetics. This research was carried out normatively, namely library legal research, which refers to consumer legislation. This research focuses on determining legal protection for consumers who use illegal cosmetics sold online. Cosmetics are produced to beautify a person's appearance. However, recently, many cosmetics sold online do not have a circular from BPOM, thus endangering consumers who buy beauty products online.

Abstract

In Bugis culture, taboo language reflects the culture of Bugis society. This is part of the culture of the Bugis people, and the next generation really needs to understand these words. This research aims to identify taboo words, identify their forms, and analyze their references. This research was designed in the form of descriptive-qualitative research. This research was conducted in Tanjung Karang Village, Sebatik District, Nunukan Regency, North Kalimantan Province. Primary data in this research was collected using in-depth interview techniques. The researcher acts as the main instrument which is equipped with other instruments in the form of interview sheets. The data obtained was analyzed according to the research objectives. Taboo words, their forms and references were analyzed using the theories of Frazer (1955) and Montagu (1973). The research results show that the 45 taboo words can be grouped based on the use of taboo words about harmony with God (5 taboo words), the use of taboo words about harmony with humans (35 taboo words), and the use of taboo words about harmony with the environment (5 taboo words). Related to taboo in the form of 22 taboo names and taboo words, and 23 in the section on swear words, and related taboo references (12 references). Based on the list of taboo words above, it can be concluded that the term or name of taboo is often found and used in the Bugis language in the village of Tanjung Karang, especially in prohibitions which are called taboo in the sense that taboo is a word that when spoken contains magic, and prohibition. or an insult that makes someone offended if it is said.

Abstract

Almost every woman has experienced a gynecological condition in her life. Access to quality and adequate health services for women is one of the Indonesian government's national programs. The main aim of this study is to assess the number of procedures and referrals for gynecological cases at the Malingping Regional General Hospital (RSUD) from 2020 to 2022. This research is a retrospective descriptive study. The target population includes all gynecology patients in outpatient clinics. In contrast, the accessible population is all gynecology patients undergoing outpatient treatment at Malingping District Hospital during that period. Research shows that ovarian tumors dominate with 45% of a total of 140 cases, with various treatments such as surgery and referral, especially in cases of suspected malignancy. Malingping District General Hospital faces significant obstacles in patient referral, particularly in cancer cases involving long travel and long waiting times, which have the potential to worsen patient morbidity and mortality. Challenges such as limited anatomical pathology facilities, distance to referral hospitals, and the uneven distribution of specialist doctors underscore the need to improve infrastructure, services, and health policies to ensure better access for regional patients. Cases with gynecological problems can be managed observationally, medically, and operatively. Correct diagnosis is essential for successful treatment. Hospitals must have a unified system, human resources, facilities, and infrastructure to support this. The current problem at Malingping Regional Hospital is supporting examinations, the availability of which depends on the hospital's spending capacity.
