Modern international law in the last few decades has experienced very rapid development, this is characterized by the emerge of the State in a modern sense, as well as a legal system that regulates relations between countries and international legal entities with each other. Relations between countries are no longer limited by absolute sovereignty, for example in the case of war crimes, the international community could sue countries or even individuals to be responsible for these actions based on universal principles. Recently, State practices is shifting from the hard law legal system to soft law which can be an alternative solution in breaking the deadlock when international political compromises are difficult to realize. Various international law development shows that there is a need for the international community to form a legal system that is acceptable to all parties, especially the State as a subject of international law par excellence. Therefore, the Belli ac Pacis Journal presents the multifarious developments in contemporary international law as a study of current State practices. The Belli ac Pacis Journal encompasses Public International Law, International Law of the Sea, International Humanitarian Law, International Environmental Law, International Criminal Law, International Organizational Law, International Dispute Settlement Law, Diplomatic Law, Air and Space Law, International Trade Organization Law, ASEAN Law, and International Economic Law.

Abstract

Conflicts involving the group Islamic State of Iraq and Syria (ISIS) is a conflict that arise in Iraq and Syria. This conflict continues to result in victims of the conflict in line with the increasing intensity of clashes in the country for territory in Iraq and Syria. International humanitarian law is a legal framework that plays an important role in determining the status of the conflict and forms of legal protection for victims of the conflict. The discussion on whether there is an armed conflict is important before determining the status of the armed conflict. After knowing the status of the armed conflict, it can be seen the provisions of international humanitarian law which is applied to protect the victims of conflict. This method uses normative law research. Source of research material used in this paper is the primary legal materials and secondary legal materials. The collection of legal materials carried with a literature study or studies document. Then, the analytical techniques legal materials used syllogism deduction.

Abstract

This researchis aims to analyze the legality of use of drones crossing international borders under international law and based on the concept of state sovereignty. This research is normative. The sources of this research are secondary resources that collected by study documentation and interviews are analyzed by interpretation and content analysis. The results show there has been no specific regulations related to the operation of the drones. However, based on general international law, the operation of cross-border drone legal if there is a prior agreement, operated in accordance with the principle of general law, and operated by the combatants. A drone without permission does not violate state sovereignty when a state uses his self defense right and the use of the concept humanitarian intervention. Therefore there is a need a law that specifically regulate the operation of drones especially that  used to cross the borders of other countries.

Abstract

Preservation and protection of the whale population is one of the main focus of international law enforcement. The threat of illegal whaling and illegal frequent in the interests of commercial and cultural traditions of a society or indigenous people. One species of whale that has endangered the existence  is pilot whales continue to be hunted. Pilot whales diminishing its population due to hunting continuously by society Faroe Islands, the North Atlantic tradition carried to run each year, that tradition called Grindadrap tradition. Meanwhile , in fact there are International Convention For The Regulation of Whaling (ICRW) and the practical efforts undertaken by an international organization which is the International Whaling Commission (IWC). However, there is uncertainty existing regulations in the ICRW does not specifically regulate the ban on whaling and still allow the existence of a special permit (Special Permit) if the hunting and killing of whales deemed necessary. ICRW restore specific policies set by each country that Faroe Island authority of the state which is a region of Denmark. In fact Denmark has ratified ICRW in 1950. There is a failure to achieve an agreement between Denmark and the Faroe Islands led to Grindadrap tradition still occur which could threaten marine ecosystems until today.

Abstract

This research is conducted to get a legal argumentation related of the binding force in ASEAN Mutual Legal Assistance Treaty (AMLAT) for ASEAN member countries. The question will be answered by determining the norms and principles of international law binding force. The sources of this research are international conventions, doctrine, customary international law, national law in some countries and other publications related to the binding force in AMLAT. The legal sources collected by study documentation and interviews are analyzed by interpretation and content analysis. The result show that the binding force in AMLAT based on the theory of natural law and theory of positive law. There are some obligations set out in article 1 , 4 , 9 , 10 , 11 , 13 , 14 , 16 , 17 , 18 , 20 , 22 AMLAT which has jurisdiction closure and different legal systems that is not working as enforcement mechanism for transnational crimes.

Abstract

This research examines the concept of Maritime Safety Belt Indonesia expressed by the National Authority for State Border Management (BNPP) in an effort to protect territorial integrity Republic of Indonesia. This research is the normative nature of legal research peskriptif. Secondary data types include primary, secondary law materials. Data collection techniques used are using the approach of law and the study of librarianship. The results of this research show that the welfare and security of the development policy in Indonesia must be started from the border regions and the outermost small islands (PPKT) in an effort to protect the region's sovereignty and territorial jurisdiction of the (Maritime Safety Belt) Republic of Indonesia.

Abstract

The study aims to determine and explain the impact of anti-dumping policy of the United States on shrimp imports from China that calculated by zeroing method. This research is prescriptive normative research. Data were collected through library research. Analysis of the data used method of deductive reasoning. The results showed that zeroing policy results in margins of dumping shrimp imported products from China to be very high which affects the amount of antidumping duties paid by China to the United States. China did not get the rights to recalculate on import products from the United States as well as countries in the EU.

Abstract

War is one way to solve a problem from one country to another, and therefore the need for a rule that governs the war. Countries in antiquity had the rule of law governing the rules of war, but only limited in terms of fighting and different for each country. Starting from this it was made a universal rule that governs not only how to fight but from the beginning of the war, the procedure of the war, the setting of a weapon, to the treatment of civilians and prisoners of war. So from that emerging international humanitarian law governing matters more complex than an armed conflict. International humanitarian law also regulates the types of conflict and there are two types of fundamental conflict governed by international humanitarian law, namely international armed conflict and non-international armed conflict. The ongoing conflicts and interesting that the crisis in Ukraine. Conflicts arising from the desire Lugansk and Donbass city folk to liberate themselves from the Ukraine were assisted by Russia. Small demonstration was later developed, including the emergence of pro-Russian separatist movements in the eastern region of Ukraine. Ukrainian crisis of instability in the country which was originally grown increasingly worse until NATO down to secure the armed conflict.

Abstract

Penelitian ini bertujuan untuk mengkaji penanganan cyber crime di ASEAN dan peran Asean Regional Forum dalam mewujudkan regional cyber security melalui Treaty of Amity and Cooperation.Penelitian hukum ini adalah penelitian hukum normatif bersifat preskriptif dengan pendekatan penelitian melalui pendekatan undang-undang dan pendekatan konseptual.Bahan hukum penelitian inimenggunakanbahan hukum primer dan bahan hukum sekunder.Bahan hukum tersebutdikumpulkan melalui studi kepustakaan dan studi dokumen, yang selanjutnya teknis analisis yang digunakan adalah metode deduktif. Hasil penelitian menunjukkan bahwa penanganan cyber crimedi dalamAsean Regional Forum adalah melalui Confidence Building Measures, Preventive Diplomacy dan Conflicts Resolutions melalui konsep keamanan kawasan.Treaty of Amity and Cooperation dapat dijadikan landasan hukum bagi negara-negara anggota Asean Regional Forum guna mewujudkan regional cyber security selama masing-masing negara menghormati prinsip itikad baik dan prinsip persetujuan untuk terikat sesuai dengan Hukum Perjanjian Internasional. Negara-negara ASEAN juga dapat memanfaatkan keanggotaan negara-negara maju Asean Regional Forum dalam pembangunan regional cyber security di ASEAN melalui mekanisme kerjasama bilateral.

Abstract

The right to self-determination is one of the principles of international law that can be applied as a norm in various international agreements, notably on human rights law which state that all state or nation has the right to form political system and regulations by themselves which are free to develop economic, social and cultural rights using their own resources, but unfortunately the right to self-determination do not yet have the practical arrangements so that their use is often debated. The purpose of this research is to analyze the self-determination of the people of Crimea is in accordance with the rules of international law, the second to determine the legitimacy of the ballot by the citizens of Crimea which supports separation of Ukraine to join Russia, the third to know how the recognition of other countries on the outcome of the referendum of citizens Crimea. This case study discusses the principles of law and comparative law. Source of data used are primary and secondary data sources were obtained from literature. The conclusion from this study is self-determination are the principle embodied in international law, where such rights have been formulated in the UN Charter. The referendum conducted in Crimea produces option to secede from Ukraine and join Russia. The second, the implementation of the Crimean referendum is not in accordance with the principles of international law. Third, recognition in international law is a complex issue because it involves issues of law and politics, in the case of recognition of the Crimea it is reviewed by the declarative theory.

Abstract

This study aims to determine the legal significance of the establishment of Indonesian Sea and Coast Guard, analyze threats in Indonesian waters, overlapping law enforcement and maritime security in Indonesia and conventions issued by the International Maritime Organization relating to marine safety. This research is a normative  legal research that is prescriptive. Types and sources of materials used in this research is the primary legal materials and secondary legal materials. The data collection techniques by means of literature. While the analysis uses legal interpretation. Based on the conclusions generated discussion needs to establish Indonesian Sea and Coast Guard to conduct maritime security and implement IMO conventions concerning maritime safety and the safety of shipping.The establishment of Indonesian Sea and Coast Guard can be effective tools for implementation of IMO convention relating to marine safety.
