Abstract

abstract The position of daughters in Balinese customary law is traditionally weak in inheritance matters due to the patrilineal kinship system. To address this injustice, the Bali Customary Village Council issued the Third Great Assembly Decree of 2010 regarding the Position of Daughters. This study aims to analyze the implementation of sentana rajeg in Seminyak Customary Village and the factors affecting its effectiveness. This research uses empirical legal research with a qualitative approach. Data were obtained through interviews, Awig-Awig document studies, and observations in Seminyak Customary Village. The results show that normatively Seminyak Customary Village has synchronized the 2010 PHPB into Awig-Awig Article 76. However, empirically, during 2010-2025 there were only 5 sentana rajeg applications with a 20% success rate. The low effectiveness is caused by 5 factors: legal, law enforcement, facilities, community, and cultural factors. It is recommended to revise Awig-Awig, conduct regular socialization, and establish a customary social fund. The background of this research is the study of the legal status of women Bali weak in terms of inheritance, because according to the Customary Law Bali rightful heir only male offspring and the families of men and male foster child. Women in the Indigenous people of Bali are still suffering discrimination in terms of provision law. The Third Grand Assembly Decision of MUDP Bali in 2010, or PHPB 2010, equalizes the inheritance rights of daughters and sons through the sentana rajeg institution. However, 15 years after PHPB 2010, its implementation in Seminyak Customary Village remains suboptimal. This study aims to analyze the legal status of daughters as heirs under PHPB 2010 and the effectiveness of its implementation in Seminyak. The research uses an empirical juridical method with statute, conceptual, and sociological approaches. The results show: First, normatively, daughters have legal heir status if they are sentana rajeg. Second, the effectiveness of PHPB 2010 in Seminyak is not optimal due to three factors: a vacuum of technical pararem, disparity in prajuru capacity, and economic resistance from krama purusa. Abstract

Abstract Tempeh production in Parerejo Village, Purwodadi Subdistrict, Pasuruan Regency, has become the economic identity of the community, known as the “Tempeh Village,” involving more than 185 craftsmen with a daily turnover of approximately Rp200 million. However, in recent years the coordination between the village government and the tempeh Micro, Small, and Medium Enterprises (MSMEs) has weakened, with development activities increasingly carried out independently by the craftsmen's association (paguyuban). This gap between the ideal and factual role of the village government underlies this study, which aims to describe the role of the Parerejo Village Government in supporting the development of tempeh MSMEs and to analyze the supporting and inhibiting factors of that role. The research method used is a qualitative approach with a descriptive field research design. Data were collected through in-depth interviews with village officials, the head of the craftsmen's association, and six tempeh craftsmen, as well as through field observation and documentation, and were analyzed using Soerjono Soekanto's role theory across three indicators: norm, individual, and individual within the social structure. The results indicate that the village government's role has not been optimal: no village regulation specifically governs the tempeh MSME sector, budget and human resources remain limited, and facilitation activities have gradually shifted from the village apparatus to the craftsmen's association through the Omah Edukasi Tempe initiative. Supporting factors are largely informal, resting on individual initiative and social capital, whereas inhibiting factors are structural, including the absence of formal regulation, budget reallocation to national priority programs, and weak data synchronization between the village government and the association. This study recommends that the village government formulate a specific village regulation for tempeh MSMEs, increase budget allocation, strengthen coordination with the craftsmen's association, and design sustainable, structured mentoring programs. Abstract

Abstract Immigration plays a strategic role in safeguarding national sovereignty through its functions of public service, law enforcement, immigration control, and as a facilitator of community development. One of the preventive initiatives developed by the Directorate General of Immigration is the Immigration Fostered Village Program, which aims to enhance public legal awareness of immigration matters, prevent the Crime of Trafficking in Persons (TIP), and reduce the departure of Indonesian Migrant Workers (PMI) through non-procedural channels. Batam City, as a border area directly adjacent to Singapore and Malaysia, experiences high population mobility, making it particularly vulnerable to immigration violations and human trafficking. Therefore, the implementation of the Immigration Fostered Village Program serves as an important preventive strategy to strengthen community-based immigration supervision.This study employed an empirical legal research method with a socio-legal (empirical juridical) approach. The research was conducted at the Class I Special Immigration Office with Immigration Checkpoint (TPI) Batam using primary data obtained through interviews and observations, supported by secondary data derived from legislation, books, scholarly journals, and official documents related to immigration and the prevention of trafficking in persons. The collected data were analyzed qualitatively through data reduction, data presentation, and conclusion drawing by relating empirical findings to the applicable legal framework.The results indicate that the Immigration Fostered Village Program at the Class I Special Immigration Office with Immigration Checkpoint Batam has been reasonably effective in enhancing public legal awareness, strengthening inter-agency coordination, and encouraging community participation in immigration supervision and the prevention of trafficking in persons. Nevertheless, its implementation continues to face several challenges, including limited public legal literacy, inadequate human resources, the extensive coverage area, suboptimal inter-agency coordination, and the misuse of information technology by perpetrators to recruit Indonesian migrant workers through non-procedural channels. Therefore, greater efforts are required to increase the intensity of public outreach, expand the coverage of the Immigration Fostered Village Program, strengthen cross-sector collaboration, optimize the use of digital media, and improve the capacity of immigration personnel to enhance the effectiveness of immigration supervision, prevent trafficking in persons, and provide better protection for Indonesian citizens. Abstract

Abstract Immigration supervision is one of the strategic functions in maintaining state sovereignty by monitoring the presence and activities of foreign nationals within the territory of Indonesia. Following the Russia–Ukraine conflict, the increasing mobility of Russian and Ukrainian nationals to Bali has led to a higher potential for immigration violations, including the misuse of residence permits, overstaying, and engaging in employment inconsistent with the purpose of the granted visa. This study aims to analyze the effectiveness of immigration supervision of Russian and Ukrainian nationals following the Russia–Ukraine conflict within the jurisdiction of the Class I Immigration Office TPI Denpasar, as well as to examine the obstacles and efforts to improve the effectiveness of such supervision.This study employed an empirical legal research method using factual and statutory approaches. The data were collected through library research and interviews, and subsequently analyzed qualitatively using an inductive method.The results indicate that the effectiveness of immigration supervision is influenced by the implementation of administrative and field supervision, inter-agency coordination, the utilization of information technology, and community participation. Although immigration supervision has been strengthened through joint operations and coordination within the Foreigner Supervision Team (TIMPORA), its effectiveness continues to face several challenges, including limited human resources, the high mobility of foreign nationals, the misuse of residence permits, suboptimal inter-agency coordination, and low public participation. Efforts to improve the effectiveness of immigration supervision include strengthening the capacity of immigration officers, optimizing the use of information technology, enhancing TIMPORA coordination, implementing intelligence-based supervision, and increasing public awareness through continuous outreach to communities and business operators.
