Time by time was passed, human life has progressed. The transaction in the old sistem using barter, and now has changed to using money. The example one the money for transactions is bilyet giro. Bilyet giro is one of the paper for asking to move the money from sender's bank account to the receiver's bank account. The using of bilyet giro stil have some problem. Blank bilyet giro give some uncomfortable for the people, so we need to give the trust again from the people. Bilyet giro has a law relations by the maker, the receiver, ant the bank that have their account. In the law relations, they have something to do with the rights and obligations. Because of the debtor give the blank bilyet giro, that make some law is working to prove the problem. The law effect from debtor is to make debtor pay the debt to the creditor so they can get what must they have from the transaction with debtor. Bilyet giro maker will get the administrative penalty by the rules Bank Indonesia law number 8/29/Pbi/2006 about the national blacklist of the blank bilyet giro debtor that is the identity of bilyet giro maker will add to the blacklist and can't to use the bilyet giro, so they must to pay the penalty and the compensation just like what in the rule of civil law.

Perlindungan dan jaminan kepastian hukum Ketenagakerjaan mulai mendapatkan tempat setelah keluarnya Undang-undang No 13 Tahun 2003 tentang Ketenagakerjaan dimana posisi Pekerja/buruh dan Pengusaha/Perusahaan mendapatkan posisi yang seimbang, Mekanisme penyelesaian perselisihan hubungan industrial yang diatur Undang-Undang Nomor 2 Tahun 2004 seakan menjadi kontradiktif ketika putusan batal demi hukum dengan kewajiban pengusaha untuk mempekerjakan kembali pekerja yang telah dilakukan PHK sepihak banyak tidak dilaksanakan pengusaha termasuk putusan yang dikeluarkan oleh pengadilan sekalipun. This study aims to find out the right of non-muslim children to the property of their muslim parents. This research is normative legal research that uses a statutory approach and a conceptual approach, and uses primary and secondary legal sources. The technique of collecting legal materials is through literature study. The analysis used in this study uses a qualitative analytical method, namely by interpreting the legal materials that have been processed. In terms of the inheritance of different religions, the parties in it must submit to the religious law adopted by the heir who in this case the heir embraces Islam. Whereas Islamic inheritance law stipulates that a person with a religion other than Islam cannot inherit property from someone who is muslim, and vice versa, a person who is Muslim is not entitled to the inheritance of a person with a religion other than Islam. Children who have different religions with their parents can get a share of their assets from the heir but not as heirs but as people who are given a wasiat wajibah. Meanwhile, when the heir is still alive, non-muslim children still get property from their parents in the form of grants.

Penelitian ini bertujuan untuk mengetahui dan memahami dimana letak kewenangan pemerintah daerah dalam pengawasan tambang minyak. Bentuk penelitian ini menggunakan penelitian hukum normatif dengan menggunakan spesifikasi penelitian menjadi penelitian eksploratif dimana penelitian ini bertujuan untuk memperdalam asas dan asas pengaturan yang terkait dengan aspek pengaturan kewenangan pemerintah pusat dan daerah untuk pengawasan penyidikan dan penyidikan industri perminyakan. . Kewenangan izin pertambangan mineral dan batubara ada di pemerintah pusat dan provinsi. Pemerintah kabupaten/kota tidak berwenang menentukan diberikan atau tidaknya izin pertambangan. Pada prinsipnya, kewenangan penerbitan izin pertambangan ada pada Kementerian ESDM. Pasal 11 (1) Undang-Undang Pemerintah Daerah Nomor 23 Tahun 2014 menyebutkan: Urusan Pemerintahan Serentak Dalam pengertian Pasal 9 (3) yang menjadi kewenangan daerah meliputi urusan pemerintahan wajib dan pemerintahan preferensial. UU Pertambangan dan Pertambangan No. 4 Tahun 2009 tidak hanya memberikan kewenangan kepada pemerintah provinsi tetapi juga pemerintah kabupaten/kota. Pasal 8(1) Undang-Undang Pertambangan Mineral dan Batubara Nomor 4 Tahun 2009 menyebutkan bahwa kewenangan pemerintah kabupaten/kota dalam pengelolaan pertambangan mineral dan batubara berbeda dengan Undang-Undang Nomor 23 Tahun 2014 tentang pemerintahan daerah. Undang-undang ini tidak mengatur kewenangan pemerintah kabupaten/kota untuk menerbitkan Izin Usaha Pertambangan (IUP) dan Izin Usaha Pertambangan Rakyat (IPR).

The house as a place to live has developed not only as one of the primary needs for humans in addition to clothing and food but also as a marker of one's welfare. The need for quality housing can be a symbol that people's lives are also of quality in the sense of being prosperous and prosperous. The process of building a house is not cheap. Departing from this fact, housing developers have emerged to answer the community's need for a house as a place to live but have not been able to provide enough money to build the desired house themselves. However, there are developers who build houses that are not in accordance with the standards and quality expected by consumers. The writing method used in this paper is using the normative legal writing method. In this normative legal writing method, two approaches are used, namely the conceptual approach and the statutory approach. Regarding unlawful acts in the process of buying and selling housing, it can be seen from several aspects, namely the existence of an act, the act is an unlawful act, there is an error on the part of the perpetrator, the emergence of a loss for the victim, between the loss suffered by the victim and the error on the part of the perpetrator has causality. Cindo Residence housing developers in completing the house construction process are not in accordance with the standards and quality expected by consumers which cause harm to the consumer, which is known when the building has been completed and occupied. Both in disputes of unlawful acts and defaults, consumers generally demand compensation for damage, pollution and/or those who suffer losses due to consuming goods and/or utilizing services. Settlement of consumer disputes can be resolved through the courts or through alternative dispute resolution channels.

The purpose of this study is to describe problems related to the importance of obtaining Indonesian citizenship status based on Government Regulation No. 21 of 2022. This research is a normative legal research using a statutory approach and a conceptual approach. The results of this study found that there are still many children resulting from mixed marriages between Indonesian citizens and foreign nationals who do not or are late in choosing citizenship status to become Indonesian citizens to the Minister of Law and Human Rights, where with this Government Regulation children with dual citizenship are given the opportunity return within a period of two years to apply for Indonesian citizenship as of the promulgation of this Government Regulation. Thus, referring to Government Regulation Number 21 of 2022, which can accommodate children who have citizenship problems by providing the opportunity to return to obtaining Indonesian citizenship status within a predetermined period of time. Socialization regarding the new regulations is also needed to disseminate information to the public regarding matters relating to mixed marriages, especially regarding the citizenship status of children. Keywords: child; citizenship; mixed marriage Abstrak Tujuan penelitian ini adalah untuk menggambarkan permasalahan terkait pentingnya memperoleh status kewarganegaraan Indonesia berdasarkan Peraturan Pemerintah Nomor 21 Tahun 2022. Penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian ini menemukan bahwa masih banyak anak hasil perkawinan campuran antara warga negara Indonesia dengan warga negara Asing tidak atau terlambat memilih status kewarganegaraan untuk menjadi Warga Negara Indonesia kepada Menteri Hukum dan Hak Asasi Manusia, di mana dengan adanya Peraturan Pemerintah ini anak berkewarganegaraan ganda diberikan kesempatan kembali dalam jangka waktu dua tahun untuk mengajukan permohonan kewarganegaraan Indonesia sejak Peraturan Pemerintah ini diundangkan. Dengan demikian, mengacu pada Peraturan Pemerintah Nomor 21 Tahun 2022 yaitu dapat mengakomodir anak yang memiliki permasalahan kewarganegaraan dengan memberikan kesempatan kembali untuk memperoleh status kewarganegaraan Indonesia dalam jangka waktu yang telah ditentukan. Sosialisasi mengenai adanya aturan baru juga diperlukan untuk menyebarluaskan informasi kepada masyarakat terkait hal-hal yang berkaitan dengan perkawinan campuran, khususnya terkait status kewarganegaraan anak.

UMKM are a source of income for the Indonesian people which is sufficient to help increase the economy in Indonesia. The economy in Indonesia, which continues to decline due to the post-covid-19 pandemic, has caused many workers to lose their jobs and increase unemployment. Some people choose to have their own business. Therefore, MSMEs are increasingly in demand by the community, including the millennial generation. Of course, competition in the business sector is getting tougher, this is the reason why trademark registration must be done because it provides legal protection to business owners to avoid fraudulent actions such as brand plagiarism or recognition of business ideas. And the socialization of trademark registration must be carried out thoroughly so that the public understands and is aware of the law regarding how to register their trademarks. The East Java Ministry of Law and Human Rights often conducts legal counseling and socialization of brands and packages to districts and cities in East Java. At this writing, the author would like to convey that it is important to register trademarks for businesses such as Micro, Medium and Lower Enterprises in order to get legal protection. Keywords: economic activity, brand, UMKM. Abstrak UMKM adalah sumber penghasilan bagi masyarakat Indonesia yang cukup membantu peningkatan perekonomian di Indonesia. Perekonomian di Indonesia yang terus mengalami penurunan akibat pasca pandemic covid-19 membuat banyaknya pekerja yang kehilangan pekerjaannya dan meningkatnya angka pengangguran. Sebagian masyarakat memilih untuk memiliki usahanya sendiri. Oleh karena itu UMKM semakin banyak diminati masyarakat tidak terkecuali generasi milenial. Tentunya persaingan di bidang usaha semakin ketat, hal ini sebagai alasan mengapa pendaftaran merek harus dilakukan karena untuk memberikan perlindungan hukum kepada para pemilik usaha agar terhindar dari tindakan curang seperti plagiasi merek atau pengakuan ide usaha. Dan sosialisasi pendaftaran merek harus dilakukan secara menyeluruh agar masyarakat paham dan melek hukum terkait bagaimana cara mendaftarkan merek usahanya. Kementerian Hukum dan HAM Jawa Timur sering melakukan penyuluhan hukum dan sosialisasi merek ke Kabupaten dan Kota yang ada di Jawa Timur. Pada penulisan kali ini penulis ingin menyampaikan bahwa pentingnya melakukan pendaftaran merek terhadap usaha misalnya Usaha Mikro Menengah Ke bawah agar mendapat perlindungan hukum. Ease of doing business as a major theme in economic development requires encouragement from various aspects of administrative procedures, one of which is the abolition of the legalization requirements for foreign public documents. The practice of legalizing foreign public documents or public documents to be used abroad, even though they have used an application, still requires a lot of time and money. In addition, another obstacle in the use of public documents is that public documents that have been legalized by institutions or ministries in Indonesia are not automatically accepted, but must go through a re-legislation process in accordance with the formal procedures of the destination country. The Apostille Convention was created to address this problem. With this convention, the formal procedure for legalization will be simplified, in addition to public documents that have been completed with apostille will be accepted by the treaty member countries. This study uses a normative juridical research method with secondary data. Data were analyzed by qualitative analysis method. Abstrak Kemudahan berusaha sebagai sebuah tema besar dalam pembangunan perekonomian membutuhkan dorongan dari berbagai aspek prosedur administrasi, salah satunya adalah penghapusan syarat legalisasi dokumen publik asing. Praktik legalisasi dokumen publik asing atau dokumen publik yang akan digunakan di luar negeri, meskipun telah menggunakan aplikasi tetapi masih membutuhkan banyak waktu dan biaya. Selain itu, kendala lainnya dalam penggunaan dokumen publik adalah bahwa dokumen publik yang telah dilegalisir oleh lembaga atau kementerian di Indonesia tidak serta merta dapat diterima, melainkan harus melalui proses legislasi kembali sesuai dengan prosedur formal dari negara yang dituju. Konvensi Apostille dibentuk untuk mengatasi permasalahan ini. Dengan adanya konvensi ini maka prosedur formal legalisasi akan disederhanakan, selain itu dokumen publik yang telah dilengkapi apostille akan diterima oleh negara-negara anggota perjanjian. Penelitian ini menggunakan metode penelitian yuridis normatif dengan data sekunder. Data dianalisis dengan metode analisis kualitatif. Selanjutnya, analisis juga mencakup berbagai artikel ilmiah tentang apostille untuk menambah wawasan dan pemahaman tentang apostille.

Narcotics crime is a form of law violation that most often occurs in Indonesia. With the increasing number of perpetrators of narcotics crimes, serious efforts are needed to eradicate narcotics crimes from law enforcement officers, namely the Police and the Prosecutor's Office. Not only that, the state also stipulates narcotics regulations in Law (UU) Number 35 of 2009. Narcotics problems, apart from being considered to be damaging the nation's future, cannot be separated from health problems. As one of the pillars of law enforcement in Indonesia, the Prosecutor's Office has an extraordinary task in enforcing the rule of law in Indonesia comprehensively as regulated in Law Number 16 of 2004 concerning the Attorney General's Office of the Republic of Indonesia. This study aims to find out how the Public Prosecutor in determining the indictment against the perpetrators of criminal acts of narcotics abuse starting from the consideration of determining the article used, determining the form of indictment, and the obstacles experienced by the prosecutor. The method used in this research is qualitative. The results of this study indicate that the indictment has an important role in uncovering a criminal event in the trial because it is the scope of examination for the judge. Keywords: Crime, Narcotics, Prosecutors Abstrak Tindak pidana Narkotika merupakan bentuk pelanggaran hukum yang paling sering terjadi di Indonesia. Semakin maraknya pelaku tindak pidana Narkotika, maka diperlukan adanya upaya yang serius terhadap pemberantasan tindak pidana Narkotika dari aparat penegak hukum yakni Kepolisian dan Kejaksaan.. Tidak hanya sampai di situ saja, negara juga menetapkan pengaturan narkotika dalam Undang-Undang (UU) Nomor 35 Tahun 2009. Permasalahan narkotika, selain dianggap dapat merusak masa depan bangsa, juga tidak dapat dipisahkan dengan permasalahan kesehatan. Sebagai salah satu pilar penegak hukum di Indonesia Kejaksaan yang memiliki tugas luar biasa dalam menegakkan supermasi hukum di Indonesia dengan komprehensif sebagaiman diatur dalam Undang-undang Nomor 16 Tahun 2004 tentang Kejaksaan Republik Indonesia. Penelitian ini bertujuan untuk mengetahui bagaimana Jaksa Penuntut Umum dalam menetapkan surat dakwaan terhadap pelaku tindak pidana penyalahgunaan narkotika dimulai dari pertimbangan penetapan pasal yang digunakan, penentuan bentuk dakwaan, serta hambatan yang dialami jaksa. Metode yang digunakan dalam penelitian ini adalah kualitatif. Hasil penelitian ini menunjukan bahwa surat dakwaan memiliki peran penting dalam mengungkap suatu peristiwa pidana dalam persidangan karena merupakan ruang lingkup pemeriksaan bagi hakim.
