Abstract

This study examines the trademark dispute between PT Tatalogam Lestari (owner of the "KASO" mark) and Tedi Hartono (registrant of the "kasomax" mark), adjudicated by the Commercial Court of Central Jakarta (Decision No. 115/Pdt.Sus-Merek/2022). The dispute arose from alleged violations of the first-to-file principle, distinctiveness, and bad faith in trademark registration. Indonesia adopts a first-to-file system under Law No. 20 of 2016 concerning Trademarks and Geographical Indications, granting exclusive rights to the first registrant. This case demonstrates that registering marks similar to existing trademarks may cause consumer confusion and unfair competition.The study aims to analyze the court’s legal considerations in the ruling and the application of trademark principles in dispute resolution. A normative juridical approach was employed, utilizing primary legal sources (statutes, court decisions) and secondary materials (literature, journals).Findings indicate the Commercial Court annulled the registration of "kasomax" due to its fundamental similarity to the "KASO" mark and bad-faith registration. The ruling reinforces the first-to-file principle and provides legal certainty for registered trademark owners. The implications suggest the need for stronger substantive examination by the Directorate General of Intellectual Property (DGIP) and public awareness campaigns to prevent infringing registrations.

Abstract

This study investigates the effectiveness of ICT-based Project-Based Learning (PjBL) in enhancing critical listening skills among fourth-semester students of the English Language Education program at Universitas Harapan Bangsa. In response to the growing demand for 21st-century skills and the integration of digital tools in language learning, the research applies a qualitative method through classroom-based observation, documentation, and interviews. Findings reveal that students not only showed improved comprehension and engagement in listening tasks but also developed higher-order thinking skills, collaboration, and digital literacy. ICT tools such as podcasts, video-based tasks, and interactive platforms were found to be instrumental in facilitating authentic and meaningful learning experiences. The use of PjBL also allowed students to take ownership of their learning, promoting autonomy and self-efficacy. Despite challenges such as varying digital proficiencies and time management issues, the results highlight the potential of ICT-integrated PjBL to transform traditional listening instruction into a more interactive, student-centered process. This study contributes to the body of knowledge on language pedagogy by offering empirical insights into how ICT and project-based methodologies can foster critical listening in higher education settings. Abstract

This study discusses the comparison of the legal force of the Vote Counting Information System (Situng) in the 2019 Election and the Recapitulation Information System (Sirekap) in the 2024 Election and its implications for presidential and vice presidential candidate pairs. The main issues raised are unclear regulations, technical errors in data input, and the legal force of Situng and Sirekap in resolving election disputes. This study uses a normative legal method with a statute approach, case study approach, comparative approach, and conceptual approach. The results of the study show that neither Situng nor Sirekap have binding legal force on the final election results, but Sirekap has a stronger position because it can be used as supporting evidence if the C Result form is not available. However, both information systems are considered unable to fully realize the principles of justice, legal certainty, benefit, transparency, and accountability. And the implications are that the constitutional rights of presidential and vice presidential candidate pairs can be ignored, and public trust in the election results becomes vulnerable.
