Abstract

Visi misi Presiden yang tertuang dalam RPJMN 2020-2024 adalah terwujudnya Indonesia yang maju yang berdaulat, mandiri, dan berkepribadian berlandaskan gotong royong. Visi tersebut diwujudkan melalui salah satu dari 9 isi nawacita yang menjadi misi Presiden dan wakil presiden, yaitu peningkatan kualitas Manusia Indonesia.Hal ini juga sejalan dengan arahan presiden untuk peningkatan pembangunan sumber daya manusia, melalui transformasi SDM aparatur yang salah satunya mendorong percepatan transformasi digital.

Abstract

The spread out of a disease is a form of disaster which include into the category of non-natural disasters. The Ministry of Health has responded by realising various types of guidelines and protocols into form of guidelines, prevention methods, and other technical regulations. This research is a qualitative research with the approach method taken in this research is normative juridical approach through literature study. Qualitative research is a research which produces descriptive data in the shape of speech or writting and the observed of people behavior. The data which is obtained in this study are secondary data which comes from a number of books, articles, journals, mass media and electronics. The writing method uses analytical descriptive which describe and discuss comprehensively to find out the effectiveness of the Government Regulation Number 21 Of 2020 About Large Scale Social Distancing In Order To Acceleration in Resolving Corona Virus Disease (PP PSBB) is legitimated in the community and the government itself. The enactment of PP PSBB has legal consequences that have not been accomodate in order to the side of legal base umbrella it self. Some conditions require more specific technical regulations so that the primary regulation could be run. Thus, it could be stated that the system of regulation and the umbrella law in handling the abnormal conditions is not optimal. There is claim from the central government to the regional government that has to work together in order to to face the covid19. It reflected that there are certain terms and conditions in determining an area for the implementation of PSBB.

Abstract

From its trending phenomenon, climate change adaptation and mitigation becomes mainly discussed in global discourse, including from the fundamental and law perspective. This article aims to elaborate decriptively the fundamentals concept of Climate Change Adaptation and Mitigation. First section, the paper describes the fundamental of climate change concept. Second section, explains the previous researches regarding climate change adaptation and mitigation, and lastly elaborates the regulatory framework and list of the regulation enforcement in Indonesia. In addition, it also provides the historical overview of first enforcement of the Law, Presidential decree, the instructions of Ministry of Environment and Forestry. The History began since the ratification of law products from United Nations Framework Convention on Climate Change (UNFCC) in 1992, Kyoto Protocol, Bali Roadmap and several regulations regarding the Climate change management and control.

Abstract

Abstract, The Constitution has explicitly formulated on article 12 of the Year 1945 Constitution stating that:"The president declares a state of danger, the terms and the consequences of the danger state stipulated by law". In the practice of national organizing, things are not normal in organizing the life of the state, where the existing legal system is unable to accommodate the needs of the state and society so that it requires a separate arrangement to drive the functions of the State in order to run effectively to ensure the fulfillment of basic rights of citizens. One of the problems experienced by all the nations of the world today is the threat from the epidemic of a Covid-19 virus. The central and local governments take the policy by closing the central places of the economy, trade, education and entertainment venues that are based on the economy. Abnormal state condition due to pandemic corona unlocks the country's determination in danger/emergency. This becomes problematic when the concept of state in danger has not become a paradigm in the formation of legislation. Although the Constitution has stipulated that the conditions and consequences of danger are established by law, but there is no legislation that specifically regulates the state's concept stagnation in a state of danger that should be able to follow the development of empirical realities of one of the possibilities of public health emergencies. It is therefore necessary to re-interpretation of the state concept in an emergency to fill the void of legal mind in the face of problems in the country.

Abstract

This qualitative study aims to describe and analyze community participation in the implementation of breastfeeding room service policy in Banda Aceh city using the CLEAR Model. The result shows that: (1) The breastfeeding rooms are not provided in all government offices or public places in Banda Aceh, and most of the rooms do not meet the Ministry of Health's standard; (2) The community gives a positive response and considers that this policy is beneficial. They hope that the implementation of this policy is continued and available in other public places. Public participation bases on the CLEAR model is the availability of sources of information and education such as posters and the direction signs to the breastfeeding room, and the mothers a can access the room comfortably. Furthermore, this research also found that the factors contribute to low access to the room are the habit of the mothers breastfeeding in the public space, and the poor quality of the rooms. Also, there is no specific socialization to the public about the implementation of the policy. Thus, increasing of public socialization regarding this regulation should employ communication, information and education (CIE) methods and fulfilment of breastfeeding room standards in Banda Aceh.

Abstract

The Land and Building Tax of the Forestry sector managed by the DGT is an objective tax whose tax depends on the value of the object. The number of objections to land and building tax disputes in 2017 was 384 or 4% of all objections. Decision of Tax Court Number PUT-107539.18 / 2015 / PP / M.IVB related to the stipulation of Land and Building Tax on Land and Building Tax objects in the form of ecosystem restoration forest. This is interesting to analyze because the main issue of the calculation of the sale value of forest tax objects has an ecosystem restoration function that does not yet have a specific regulation. The method used is normative juridical research with approaches: law, concept, case, and analysis. The research data in the form of primary legal materials are all written regulations and decisions of the Tax Court, secondary legal materials in the form of books, articles, and legal dictionaries. Data is collected by literature study which is done by searching, researching, studying, recording, and interpreting by polyiangulation. The collected data is analyzed qualitatively by recording, studying, and interpreting and then explaining descriptively. The results of the study revealed that the Tax Court Judge in deciding the Land and Building Tax dispute over an object in the form of an ecosystem restoration forest was not bound by written regulations but also considered the judge's beliefs. In addition, it is known that there are no specific regulations governing the valuation of land and building tax objects on forests that have an ecosystem restoration function.

Abstract

Under second term of President Joko Widodo’s administration, Indonesia is about to adopt vivid reform discourse, i.e. to flatten bureaucratic structure through streamlining the echelon system as a response to the change and development. Notwithstanding, it is inevitable that this reform would be of no overarching consequences. This paper attempts to seek the genuine urgencies and consequences of flattening the bureaucratic structure through streamlining the echelon system. Relevant literature following the criteria of systematic review method was extracted and independently reviewed. It is derived that it was the factor of corruption, competitiveness and human resource that urged the bureaucratic structure to flatten. Further, a change in working culture and environment as well as career management of the state apparatus appeared to be the consequences of such reform.

Abstract

Pandemi covid-19 telah membuat banyak perubahan, tidak hanya dari segi ekonomi maupun sosial namun juga merambah kepada tatanan pemerintahan yang saat ini harus menyesuaikan dengan adaptasi kebiasaan baru (new normal), hal ini diikuti dengan adanya berbagai instrumen hukum baru dengan menerbitkan berbagai produk peraturan perundang-undangan sebagai konsekuensi dari sebuah negara hukum. Ditengah krisis Pandemi covid-19 banyak menciptakan tantangan baru di berbagai bidang tak terkecuali ranah birokrasi tidak terlepas dari perubahan. Salah satu kondisi normal baru saat ini terjadinya transformasi birokrasi secara fundamental dari birokrasi yang sebelumnya menggunakan cara-cara manual terus berkembang hingga saat ini menyesuaikan dengan sendirinya menuju transformasi teknologi informasi yang tetap berorientasi pada hasil. Pemanfaatan teknologi informasi membawa perubahan positif secara masif pada budaya dan cara pikir tersendiri bagi Aparatur Sipil Negara (ASN), apalagi mengingat hampir sebagian besar sektor pelayanan merubah pola pelayanan yang saat ini dilakukan secara manual tatap muka bertransformasi melalui teknologi digital. Merespon adaptasi kebiasaan baru Menpan RB dalam hal ini telah mengeluarkan Surat Edaran Menteri Pendayagunaan Aparatur Negara dan Reformasi Birokrasi Nomor 58 Tahun 2020 tentang Sistem Kerja Pegawai Aparatur Sipil Negara dalam Tatanan Normal Baru, salah satu kebijakan tersebut mengatur tentang pelaksanaan penyesuaian sistem kerja work from home (WFH) dan/atau work from office (WFO) bagi ASN untuk memastikan pelayanan publik kepada masyarakat tetap berjalan di tengah pandemi. Seiring dengan kebijakan tersebut LAN RI merespon dengan menyesuaikan metode pembelajaran dalam jaringan (daring) dengan mengeluarkan Surat Edaran Nomor 10/K1/HKM.02.3/2020 tentang Panduan Teknis Penyelenggaraan Pelatihan Dalam Masa Pandemi Corona Virus Disease (covid-19) Digitalisasi birokrasi merupakan kultur baru yang dapat memangkas birokrasi berbelit yang memakan banyak waktu, tenaga, dan biaya. Dengan demikian, menimbulkan tantangan bagi para ASN untuk memberikan pelayanan yang semakin cepat, praktis, mudah, dan sederhana serta responsif. Namun demikian, risiko besar tetap mengintai dari aspek kinerja ASN yang justru sebaliknya yaitu dikarenakan ketidaksiapan Sumber Daya Manusia (SDM) dalam menyambut era digitalisasi tersebut. Presiden Joko Widodo telah menetapkan lima arah pembangunan meliputi: (1) kelanjutan pembangunan infrastruktur, (2) pembangunan sumber daya manusia, (3) transformasi ekonomi, (4) reformasi birokrasi, dan (5) penyederhanaan regulasi. Presiden telah menyampaikan bahwa dalam menghadapi perubahan ini perlu adanya perampingan lembaga-lembaga negara agar tidak terjadinya tumpang tindih. Upaya perampingan tersebut merupakan bentuk penjabaran visi misi Presiden terkait reformasi birokrasi. Selanjutnya, perlu menjadi perhatian bahwa upaya perampingan lembaga pemerintah sebagai suatu langkah untuk memaksimalkan pelayanan kepada masyarakat yang harus disertai kesiapan dan ketahanan infrastruktur digital, guna menjalankan tatanan birokrasi baru bagi ASN pada khususnya, dan masyarakat pada umumnya. Melalui kultur baru birokrasi digital diharapkan dapat mempercepat reformasi birokrasi ditengah pandemi covid-19, sehingga mendorong peningkatan dan pemerataan pelayanan publik bagi seluruh masyarakat.

Abstract

Based on Article 87 Paragraph (4) letter b of the ASN Law and the Constitutional Court Decision Number 87 / PUU-XVI / 2018, civil servants are dishonorably discharged because they are sentenced to imprisonment or imprisonment based on a court decision that has permanent legal force for committing a criminal offense or a criminal act. a criminal offense related to the position. This implies that for the sake of law, officials with authority, namely Civil Service Officers are obliged to issue decisions disrespectfully of civil servants who are proven to have committed acts of corruption based on the inkracht decision. This study is to examine how the responsibility of the Civil Service Officer (PPK) in issuing a dishonorable dismissal decision on civil servants who are involved in corruption based on an inkracht court decision. The results of the study, it is known that the Personnel Development Officer of the institution where the PNS is domiciled receives a delegation from the President to issue a decision to disrespectfully dismiss civil servants who have committed acts of corruption. This decision can be issued from the end of the month the inkracht court decision was issued. This is reinforced by the issuance of a Joint Decree of the Minister of Home Affairs, Minister of Administrative Reform and the Head of the State Civil Service Agency Number 182/6597 / SJ, Number 15 of 2018, and Number 153 / KEP / 2018. Personnel guidance officers who deliberately refuse to issue this decision, may be subject to administrative sanctions under Article 80, Article 81 and Article 82 of Law Number 30 of 2014. At the end of the paper the author concludes the importance of ASN legal compliance to carry out their duties professionally and responsibly, and not to commit acts that are prohibited by law (corruption) so as not to get administrative sanctions from the PPK and have the opportunity to lose their status as ASN.

Abstract

Sustainable government procurement policies have become mandatory but there is no measurement model for policy implementation. This study aims to identify actors, models, and alternative models for sustainable government procurement policies. Qualitative research was conducted with a juridical normative approach through literature study. The results show that actors of sustainable government procurement policies are government procurement policy agencies, nine ministries, and all local governments. Implicitly, a policy model with an institutional approach is used in sustainable government procurement which has weaknesses in the form of a model for measuring the success of the policy that does not exist and communication-coordination-cooperation between institutions is still not optimal. Alternative models can be used in the form of rational and incremental approaches. The implication is that policy actors need to develop a model for measuring the success and achievement indicators of sustainable government procurement.
