Abstract

Many illegal migrants are preferring to enter Indonesia before they go to Australia. In order to tackle the arrival of those illegal migrants, Australian government enforces Third Country's policy and ban the illegal migrants by sending them back to Indonesian water. As sovereign state does Indonesia has an effective policy to handle these issues? This research applies juridical normative approach using primary and secondary data, studying and evaluating such law principles and relevant laws. This research concludes that through Act No.6 Year 2011 on Imigration, Indonesia deals with ineffective and partial by putting illegal migrant as victim rather than smuggler. As the policy considers them as victims, there are no sanctions and deterrent effects. Indonesia shall apply the Principle of State Sovereignty for basic guidance to make policy concerning illegal migrant.

Abstract

In principle, the banking industry is a business activity that is fraught with risk (full risk business). However, if managed properly and carefully will result in a huge advantage, otherwise if poorly managed, will lead to greater risk of loss. Therefore, the bank continues to deal with a variety of risks, especially the rapid development of science and technology and the external environment lead bank risk banking business from day to day more and more complex and should be anticipated as possible.

Abstract

Tax court in Indonesia is part of administrative court that has jurisdiction to hear any tax dispute. It is kind of administrative court as it meets such elements, for example one of the parties of the dispute must be government officer, which is bound to an official act taken within the limits of the official authority. Tax court acts as judicial authority provide tribunals for tax payer or tax insurers to resolve disputes regarding taxation. Therefore it can be used as a means for the citizens as a tax payer or insurer to obtain justice in taxation.

Abstract

Basically, short selling transaction is the practice of selling stock without having first. Short selling is divided into two types of naked shor selling and covered short selling. In naked short selling, securities transactions without assurance from the lender. The practice of naked short selling is banned because it is damaging the market. Whereas the covered short selling is selling transaction that must have a guarantee. Covered short selling is the practice of selling securities that is allowed in Indonesia and supported by Bapepam-LK with provide lending and borrowing facilities by PT. KPEI.  In the lending and borrowing securities mechanism, when the securities is on the borrower or another party, the lender still entitled to receive the rights in this securities. It shows that the transfer of ownership of securities on loan is not happen in full. Moreover there is recall mechanism that lenders can recall the loan any time before maturity date.

Abstract

Apartments which stand on the land of Freehold Title and Building Rights Title or Right to Use Title on the state land have a clear legal position for the status of apartments. In another case, apartments which stand on the land status of Building Rights Title use above the Right of Management which is also based on the founding treaties Build Operate Transfer (BOT) has the potential dispute in the future if establishment of title to land above Right of Management over the BOT agreement ends. Legal consequences occur when the BOT agreement and Building Rights Title use ends is the existence of apartment unit based on the legal context would be removed. Existences of apartment unit rely in inherent land Building Right Title (HGB) or Right to Use Title (HP). Building Right Title (HGB) or Right to Use Title (HP) have durations of use, and when that period expired, Title to Apartment Unit subject to dismiss.Legal protection for owners of Title to Apartment Unit is able to extend Right of Building use above Right of Management

Abstract

Ideas to harmonize the regulation of ‘corporate shares’ (CS) in the corporate law of Indonesia and Singapore discussed in order to start up and embody the ASEAN Single Market. This article focused on different minimum standards and requirements (MS&R) in the transaction CS within two different corporate laws of Indonesia and Singapore. It is necessary to employ a conceptual approach, especially corporate share as a very basic of a company, to have a comparative legal analysis to reach a solution. Furthermore, it is to harmonize such standars and requirements on the CS transaction. It is necessary to use the theory of negative regional economic integration that significantly different with the conservative theory aplied inthe EU. As a result, the different regulation of CS between those two different company law regimes should be simplified by withdrawing their similiarities of MS&R. This may create an avenue to achieve the ASEAN’s single market in 2015. This new standar (model) would ease the process harmonization in which companies of ASEAN Countries can make a cross-ownership of CS by the mergers and acquisitions of transactions that timely make a strong position in the business competition regionally. I conclude that harmonization of MS&R of CS provided in company laws of Indonesia and Singapore would become a cornerstone for the ASEAN Single Market in which obstacle of  joint market has been minimized or even abolished. However, harmonization of MS&R of CS should be in the corridor of sustainable global justice in the ASEAN market competition.Therefore, I recommend that both Indonesia and Singapore should develop a corporate culture in the spirit of the ASEAN Single Market, and review the regulation regarding company law of both countries, especially the CS and legal procedures of the cross-border mergers transaction and acquisition.

Abstract

Based on literature studies, theoretical based for discontinue prosecution in Indonesia is hard to found. However, in develop countries such as US, England or Australia, theoretical based for discontinue prosecution can be identified as first, “realistic prospect of conviction” and second “prosecution on the public interest” theories. These two theories actually can be found in reasoning for SP3, SKPP and article 32 section c Prosecution Act. The primary difference is, in Indonesia, the discontinuity of public prosecution (SP3 and SKPP) is not discretional. In matters when the decision for discontinue the case appears, it put the Public Prosecutor and the Police Officer on dilemmatic position. For example, on the case No.04/Pi.Pralan/2008/PT.SBY and No. 01/Pdt.Praper/2005/PN.Sby, the Police Officers which handle the case still “freeze” the case because they think there is no reasonable prospect of conviction. The same thing happens on the case No.14/Pid.Prap/2010/PN.JktSel.and No: 149/PID/PRAP/2006/PT.DKI, the Public Prosecutor think there is no reasonable prospect of conviction and they think the prosecution is not on the public interest. On these matters, we suggest that there should be comprehensive studies if we putthe discontinuity of prosecution as discretional of power. Furthermore, “reasonable prospect of conviction” or “prosecution on the public interest” should become guidance or theoretical based for discontinue prosecution in Indonesia.

Abstract

Sending e-mail is legal but sending unsolicited e-mail to many e-mail addresses (spamming) is illegal. There are some damages and displeasures affected to internet users caused by spam. Every e-mail every user has the right to use an e-mail as a communication media. It means that they have to use their right proportionally to avoid harassing other users. Activities of using an e-mail are always limited by obligation to respect other people’s rights. Considering this reason, some laws need to be effected to regulate spamming.
