Abstract

This article examines the concept of husband–wife relations in the Qur’an and its relevance to the issue of domestic violence through the approach of thematic Qur’anic exegesis (tafsīr mawḍūʿī). The discussion is grounded in the continuing prevalence of domestic violence, which fundamentally contradicts the Islamic principles of marriage that emphasize tranquility, affection, compassion, and justice. The research aims to analyze Qur’anic verses related to marital relations, interpret their normative messages, and explain their implications for the prevention of domestic violence. Employing a library research method, this study applies a thematic Qur’anic exegesis approach by collecting relevant verses, examining them through the interpretations of classical and contemporary exegetes, and formulating a comprehensive understanding of marital relations according to the Qur’an. The findings demonstrate that husband–wife relations in the Qur’an are founded upon the principles of mawaddah (affectionate love), raḥmah (compassion), mutual consultation, justice, and shared responsibility. The Qur’an positions husbands and wives as complementary partners rather than parties engaged in domination or violence. Consequently, all forms of domestic violence (whether physical, psychological, sexual, or economic) are incompatible with Qur’anic values and the broader objectives of Islamic marriage. This article concludes that a proper understanding of Qur’anic teachings on marital relations can serve as both a theological and ethical foundation for fostering harmonious family life and preventing domestic violence.

Abstract

The enactment of Law No. 4 of 2024 concerning the Welfare of Mothers and Children (UU KIA 2024) marks a new era in family protection in Indonesia; however, its provision of two to five days of paternity leave raises a functional concern. This study aims to evaluate and deconstruct the duration of paternity leave prescribed by Law No. 4 of 2024 through the perspective of substantive justice. Employing a juridical-normative legal research method with an interdisciplinary clinical psychology approach, the data were analyzed using content analysis operationalized through the Qirāʾah Mubādalah (reciprocal reading) interpretive framework. The findings reveal a profound philosophical and practical incongruence between the legally stipulated duration (5 days) and the clinical needs of the postpartum recovery period (40 days). This discrepancy risks increasing paternal stress while isolating mothers within the domestic sphere, thereby increasing their vulnerability to postpartum depression. Structurally, the regulation continues to perpetuate traditional gender bias by positioning fathers as administrative assistants rather than substantive caregiving partners. This study concludes that Law No. 4 of 2024 requires evidence-based policy reform by extending paternity leave to 14–30 days. Furthermore, integrating a leave allowance scheme into the national social security system is necessary to mitigate the financial burden on corporations and ensure inclusive family resilience.

Abstract

This study is motivated by the continuing underrepresentation of female ʿulamāʾ in leadership positions within religious fields, a condition sustained by the deeply entrenched patriarchal culture embedded in religious traditions. It aims to examine the process through which the leadership authority of female ʿulamāʾ is constructed through the interaction of habitus, capital, field, and identity negotiation. Employing a qualitative design with an ethnographic approach, the study focuses on four prominent female ʿulamāʾ. The data were analyzed using Pierre Bourdieu's theory of practice in conjunction with intersectionality theory. The findings demonstrate that the leadership of female ʿulamāʾ is constituted through the dynamic interplay of habitus, capital, and field. The various forms of capital possessed by each female ʿulamāʾ operate differently according to the logic governing their respective fields. However, these forms of capital cannot be converted into leadership authority unless female ʿulamāʾ successfully negotiate the multiple intersecting identities they embody, particularly those related to gender and marital status.

Abstract

Women’s participation in hilal observation has expanded alongside developments in astronomical education and observation technology, yet their legal authority as witnesses remains contested in classical and contemporary Islamic law. This study examines how Hanafi, Maliki, Shafi‘i, and Hanbali fiqh texts construct the evidentiary status of women’s hilal reports and how these constructions may be reconsidered through Marion Holmes Katz’s Textual Study of Gender. Using qualitative library research and comparative textual analysis, eight representative fiqh works are reconstructed and interpreted, then triangulated with contemporary Indonesian hilal practices and astronomical verification. The findings show that the four madhhabs do not apply a single gender rule. Women’s admissibility depends on the classification of the report as khabar, riwayah, or shahadah, as well as on the month, witness requirements, and evidentiary context. Katz’s framework reveals that gender operates relationally through knowledge authority and legal procedure rather than as a uniform indicator of reliability. Contemporary astronomy strengthens verifiable observation but does not automatically replace juridical testimony. The study concludes that a gender-neutral, competency-based evidentiary model can integrate ‘adalah, observational reliability, astronomical literacy, documentation, and institutional legal validation.

Abstract

This article is grounded in the mystical traditions experienced by women—both those who accept and those who reject them—in the Siulak region of Kerinci. The aim of this study is to examine the dimensions of mysticism within the Penurunan Salih tradition in Siulak District, Kerinci, with a focus on the psychological and sociological impacts on women who are chosen by ancestral spirits. Unlike previous studies that tend to describe rituals as cultural heritage, this research highlights the tension between customary authority and women’s individual agency. This study employs a phenomenological approach to explore the subjects’ experiences in depth. Data were collected through participant observation and in-depth interviews with women who became Balian Salih as well as those who had previously refused the call. Analysis was conducted using Pierre Bourdieu’s theory of Symbolic Violence and Marlene Winell’s STR. The findings reveal that the Penurunan Salih tradition often manifests as a form of “supernatural coercion,” leading to spiritual trauma and psychosomatic disorders, ranging from chronic headaches to disturbances of consciousness (insanity). Pressure from traditional structures through the role of the Ninik Mamak and the legitimacy of rituals leaves women with no choice but to accept the role of Balian Salih. Although this tradition is formally integrated with Islamic symbols (syncretism), residual trauma indicates the subordination of women’s bodies as

Abstract

Pre-Islamic Arab society was characterized by a deeply entrenched patriarchal culture that placed women in a subordinate position within family and social structures. One prominent manifestation of this system was the practice of zihār, whereby a husband compared his wife to his mother’s back, rendering the wife in a state of legal ambiguity without rights as a spouse yet unable to remarry. This study analyzes the intertextual relationship between pre-Islamic Arab patriarchal culture, the practice of zihār, and the Qur’anic response in Sūrah al-Mujādilah verses 2–4. Using a qualitative library research method with an intertextual framework drawing on Julia Kristeva’s theory, combined with historical-critical analysis and thematic tafsīr, this research finds that Sūrah al-Mujādilah verses 2–4 functions not merely as a legal ruling but as a socio-historical critique that deconstructs Arab patriarchal structures. The novelty of this study lies in reading the prohibition of zihār as an intertextual response to Jāhiliyyah cultural texts, including Mu‘allaqāt poetry and Safaitic Inscriptions. This research contributes to the development of socio-historical Qur’anic studies and gender scholarship in Islam by demonstrating that divine revelation actively dialogues with and transforms discriminatory cultural practices.
