Abstract

As the largest archipelagic country in the world with cultural pluralism in its people, Indonesia, the 1945 Constitution of the Republic of Indonesia has guaranteed the existence of unique or special regional government units. However, in practice, the implementation of special autonomy has been slow in realizing the welfare of the local community. The focus of this research seeks to answer two problems: First, how is the design of special autonomy arrangements in the 1945 Constitution of the Republic of Indonesia? Second, is the implementation of special autonomy in Indonesia following the ideals of regional government regulation in the 1945 Constitution of the Republic of Indonesia? The method used in this research is normative legal research with data collection techniques in library research. The study results reveal that the 1945 Constitution of the Republic of Indonesia has provided space for regions to organize an asymmetrical government. However, in reality, the implementation of special autonomy in Indonesia is not based on the design of regional diversity awareness in the 1945 Constitution of the Republic of Indonesia. In addition, implementing special autonomy in Indonesia still leaves various problems.

Abstract

This article addresses how to implement the Government of Aceh's role in resolving emergency circumstances resulting from natural and man-made disasters. As a strategy for addressing the post-disaster effects in Aceh, it is essential to implement regulations and policies that anticipate emergency circumstances and disaster emergencies. Aceh has a high risk of natural and man-made disasters, necessitating the active participation of the Aceh government and the entire community in anticipating and mitigating these risks. The Government of Aceh must be able to carry out its responsibilities successfully and efficiently, particularly in emergency situations. This can be achieved through the development of swift, accurate, solution-oriented, and responsive legislation. Decentralization of affairs and authority from the centre to the regions to formulate regulations and policies according to regional interests are supporting factors for the Aceh Government's role in dealing with disaster emergencies, while the absence of regulations that give direct authority to the Aceh Government to compile practical regulations and policies in dealing with emergency situations are inhibiting factors.

Abstract

Islamic law, especially jinayah (Islamic criminal law) is a legal system, which cannot be ignored in a country where the majority of the population is Muslim. Enacting the law for adherents of a religion is basically a form of religious adherence to their religion. For this reason, the prohibition of a religion in carrying out its teachings, including part of a constitutional violation, which is technically protected. As a former Dutch colony, the colonial legal system is the most colorful in the country's system. Thus, the existing legal system is often marginalized as a legal system in the country. The formulation of the problem in this research is why Islamic criminal law has not become a legal system in Muslim-majority countries, and whether the substance of Islamic criminal law is absorbed in the draft criminal law code.In this study using juridical empirime as a methodology, using a  approach to the concept of legal politics and historis process of legislation. The conclusion in this study, that the substance of Islamic criminal law has not become the dominant color as a legal system in a Muslim-majority country, this is due to the lack of strong legal politics that fights for the substance of Islamic criminal law to give its war against the criminal law that will be enforced.

Abstract

Any case arising from society could cause disharmony and inbalencing among the society. Taking the case to formal court, will take time, and spend money. The solution to overcome the number of cases in formal court,  it needs  to set up informal court wellknown “Peradilan Adat”. A lot of cases arising from society in Aceh rural area settled by Aceh Customary Institution Court  which is called Peradilan adat Aceh.  There are eighteen cases under competency of the court that conducted by  justice providers, consist of head of village, Islamic sholars, and other  trusted public figures. Dispute settlement run based on both parties consensus voluntarily. Therefore, the decision is “win win solution”. The nature of decision  (verdict) is final and binding.  Provincial Police institution of Aceh, which is  called POLDA, and Aceh Customay Assembly have an MoU signing  in order to recoqnize and respect the decision of Customary Court of Aceh.

Abstract

Pembangunan infrastruktur membutuhkan dana yang tidak sedikit. Rencana Pembangunan Jangka Menengah Nasional (RPJMN) 2020-2024 mengamanatkan penjajakan mekanisme pembiayaan yang inovatif untuk menutup kesenjangan pendanaan pembangunan infrastruktur sehingga tidak semua pendanaan ditanggung oleh Anggaran Pendapatan dan Belanja Negara (APBN). Opsi pembiayaan inovatif yang dapat dipilih adalah Land Value Capture. Mekanisme ini dilakukan dengan memonetisasi tanah yang dikembangkan oleh pemerintah untuk meningkatkan nilai tanah dan properti dari investasi infrastruktur, dan hasilnya digunakan untuk pembiayaan publik lainnya. Penelitian ini menggunakan penelitian normatif untuk mencari urgensi pembentukan Land Value Capture.
