Abstract

The massive expansion of the nickel mining industry in the Pomalaa area has led to marginalization and exclusion of the Bajo community from marine spaces. Instead of alleviating poverty, the highly hierarchical corporate social responsibility programs actually create pseudo-empowerment practices that perpetuate corporate domination and the material dependency of coastal communities. This research aims to deconstruct these power relations and ecological inequalities while simultaneously reconstructing the design of a participatory, sustainable, multi-stakeholder empowerment model. This research employs a qualitative, critical-paradigm approach with a case study design. Primary data sourced from limited participatory observation and in-depth interviews with Bajo fishermen, activists, and community leaders were interactively analyzed using a discourse deconstruction framework instrument. The results indicated that corporate regulatory manipulation has deprived fishermen of traditional fishing grounds and destroyed ecological carrying capacity. To counter this hegemony, Bajo local wisdom in the form of a traditional marine conservation system (bapongka) and an egalitarian brotherhood principle (sama bajau) is institutionalized as the basis of agency towards an active society. These cultural values are subsequently operationalized into a multi-stakeholder empowerment model that synergizes the roles of the government as a facilitator, the private sector as a contributor, higher education institutions as technology innovation providers, and non-governmental organizations as advocacy mentors. In conclusion, the systemic integration among actors centered on the fishermen subjects is capable of generating an independent community enterprise. In practice, this study recommends that local government authorities undertake juridical interventions to formulate regulations protecting traditional fishing zones, thereby restoring the sovereignty and welfare of the Bajo community.

Abstract

The massive expansion of minimarket franchises in Jayapura City triggers structural inequality, threatening the existence of local business actors, and thus demands a holistic synchronization of business competition law. This research aims to examine the synchronization of spatial planning and minimarket licensing zoning regulations, and to analyze the legal protection of construction through a partnership scheme based on Jayapura Municipal Regulation Number 10 of 2018. Utilising a normative juridical research method with a statutory and conceptual approach, this study examines the legal vagueness in regional regulations and the weakness of supervision of private law instruments. The analysis indicates that zoning enforcement operates suboptimally due to the limited coercive power of administrative sanctions, which corporations frequently view as mere operational risks. In the dimension of partnership protection, the phrase “prioritizing local merchants” in the regional regulation is identified as a vague norm that triggers tokenism and perpetuates the abuse of circumstances (misbruik van omstandigheden) in standard agreement drafts. In conclusion, legal protection for local merchants remains vulnerable due to the lack of integration between public spatial planning compliance and private contractual justice. Therefore, this research recommends the issuance of a Mayoral Regulation to stipulate a quantitative percentage for local product absorption in the People-Owned Stores program, and the establishment of a regional task force to audit and cancel exploitative business agreement clauses.

Abstract

The top-down structural development communication paradigm often leads to communication impasses and fails to accommodate grassroots aspirations. Amidst this bureaucratic paralysis, the kabhanti modero oral tradition among the Muna indigenous community in Southeast Sulawesi Province emerges not merely as an entertainment medium but as a dialogic space that actively responds to development failures. This study aims to examine the mechanisms of social critique encapsulated within kabhanti modero lyrics and to analyze the operationalization of this tradition as an interactional development communication model. This research employed a qualitative case study design, using participatory observation, in-depth interviews with core communicators and customary leaders, and documentation of sacred life-cycle rites. The research results demonstrated that the chanted pantun lyrics serve as symbolic interaction instruments to articulate the community’s real grievances regarding infrastructure failures through polite yet politically coercive metaphors. The operationalization of this critique delivery is executed through a centralized circular formation that dismantles spatial barriers between the lay public and government elites. Furthermore, the existence of a conflict mitigation pact, internal message curation mechanisms, the involvement of customary authorities, and collective validation from the audience provide absolute social legitimacy for demands to improve government performance. This study concludes that kabhanti modero constitutes a tangible social control instrument and a highly effective form of sociological sanction. Therefore, local governments are recommended to integrate this cultural dialogic space into development planning deliberations to minimize elitist information bias.

Abstract

Small-scale restaurants in tourist destinations confront a dual operational burden. Operators must meet international service quality standards despite limited staffing and operational vulnerability. This study aims to comprehensively explore the sociopsychological dynamics of service excellence training implementation on the transformation of waitstaff competence and its contribution to customer loyalty. Applying an exploratory qualitative approach, this research involved 30 waitstaff classified into novice and senior groups across ten restaurants in Bali. Data collection was executed through in-depth interviews, non-participant observation, and the application of a strict marketing variable isolation protocol. The results showed that the training effectively restored understanding of food service procedures as a means to mitigate operational dysfunction. The role-play simulation method proved capable of eliminating cultural awkwardness by integrating standardized language with local warmth. Furthermore, providing limited autonomy successfully accelerated the customer’s emotion de-escalation phase. Nevertheless, the findings revealed an adaptation disparity. Novice waitstaff demonstrated strong adaptability and learning, whereas senior waitstaff were hindered by entrenched work habits and hierarchical ego. Ultimately, this competency enhancement was shown to increase the guest return visit rate on its own. In conclusion, service excellence training is not merely a technical transfer but an essential strategic driving factor for competitive advantage. This study recommends shifting to tactical daily briefings and positioning senior employees as role models to improve customer retention in the local culinary business ecosystem.

Abstract

This research analyzes the implications of the enactment of coercive measure procedural restrictions on the independence of the DGT Investigator under the regime of Law Number 20 of 2025. This normative-doctrinal legal research employs a statute and conceptual approach to evaluate retrospective performance for the 2020 to 2024 period and project the impact of the new Law post-January 2, 2026. The research results indicate that the decline in historical case dossier settlement rates was purely caused by internal technical-cyber constraints, rather than a normative authority weakness. However, the new Criminal Procedure Code unification fundamentally degrades sectoral independence through the revocation of independent arrest and detention authority, centralized Police subordination triggering structural transactional risks, and an absolute competence dispute with the Attorney General’s Office that contradicts the ultimum remedium principle. To overcome this procedural stagnation, the DGT formulated an administrative bypass strategy. This tactic shifts the law enforcement focus to the non-coercive Preliminary Evidence Examination phase through the exploitation of forensic digital evidence and the independent exchange of international beneficial owner information. This research recommends legislative reconstruction to restore equal horizontal institutional relations, affirm absolute competence boundaries, expand the non-conviction-based confiscation mechanism, and accelerate the establishment of specialized tax cyber units in regional areas to guarantee national fiscal resilience.

Abstract

The enforcement of national identity sovereignty through selective immigration policy currently confronts systemic vulnerabilities arising from regulatory disharmony. The phenomenon of foreign nationals exploiting the self-registration system at the Class III Non-TPI Immigration Office of Tanjung Redeb demonstrates that public service applications lack robust validation capabilities due to the absence of real-time interconnection obligations with a population database. This study aims to analyze material legal defects in the population documents of foreign nationals and to evaluate the inter-agency dysfunction in data integration for passport issuance, while simultaneously highlighting the urgency of transforming biometric verification. This normative-empirical legal research employs the statute and case approaches, collecting data through in-depth interviews with two immigration officials, which were then analyzed using doctrinal instruments for State Administrative Law. The research results indicate that the paper-based population documents hold a void ab initio status due to their violation of sovereignty prerequisites. The sectoral synchronization failure forces immigration authorities to execute the law enforcement identification instrument of the Biometric Management System as the primary supervision mechanism. The synergy between the deterrence database and the apparatus’s capacity in formulating the Minutes of Examination successfully thwarted this administrative legal smuggling. Nevertheless, this jurisdictional isolation generates further implications for state administrative authority disputes. This study recommends regulatory harmonization mandating cross-ministerial Application Programming Interface interconnection, in which immigration electronic notifications must be recognized as preliminary evidence for regional population agencies to initiate revocation proceedings for materially defective documents.

Abstract

Conventional population administration services frequently encounter constraints due to the temporal limitations of the working-class community. In response to these challenges, the Dukcapil on the Street innovation emerged as a manifestation of temporary, or pop-up, governance, operating tactically within informal public spaces. This study aims to analyze the spatial-temporal adaptability of street-level bureaucracy, explore the deconstruction of public satisfaction, and identify systemic tensions in the field. Utilizing a single-case study approach, primary data were collected through in-depth interviews with four key informants selected via a purposive criterion technique, integrated with unstructured field observations and thematic analysis. The results demonstrated that an operational time compression of 2.5 hours, facilitated by the parallel processing of four work divisions, successfully generated massive productivity without relying on capital-intensive infrastructure. The spatial relocation of service interactions to recreational areas materialized segmented inclusivity for the active workforce and constructed conditional satisfaction through the proactive role of bureaucrats acting as spatial facilitators. Nevertheless, this innovation provoked systemic tensions, manifesting in the absolute rejection of birth certificate amendment requests due to the rigidity of the central physical archives, alongside temporal exclusion resulting from the forceful system closure at exactly 09:00 Western Indonesia Time. In conclusion, this pop-up governance innovation substantiates the high adaptability of bureaucracy, yet it remains fundamentally constrained by the limitations of structural operational capacity. As an operational follow-up, this study recommends adopting securely encrypted mobile digital archival systems and a queue quota pre-registration system.

Abstract

This in-depth research investigates the anatomy of blind spots within post-admission administrative oversight mechanisms for foreign nationals at the Makassar Immigration Checkpoint and elucidates the causal determinants that trigger the paralysis of early warning systems. The urgency of this study stems from the high rate of overstays, which reflects structural dysfunction in immigration governance within the primary transit territory of Eastern Indonesia. Employing an empirical legal research method with a socio-legal approach, primary data are triangulated through in-depth interviews, field observations, and statistical analysis of violations. The research results uncover a critical discrepancy between digital data registration at the port of entry and continuous field surveillance, resulting in the state losing control over the dynamic nomadic movements of foreign legal subjects. Juridically, this systemic paralysis constitutes a violation of the Principle of Carefulness, triggered by a chronic human resource deficit in the intelligence unit and the nullity of regulatorily mandated cross-sectoral information technology interoperability. Consequently, law enforcement tends to be constrained by reactive patterns and dependent on repressive deportation measures during the repressive phase. This study concludes that a paradigm reorientation towards risk-based surveillance, the transformation of apparatuses into administrative data analysts, and the reinforcement of the legal framework mandating real-time inter-agency data integration are necessary. These policy implications constitute absolute prerequisites for restoring legal authority and guaranteeing state sovereignty through proactive prevention mechanisms in the preventive phase.
