Abstract

This study examines the legal issues arising from the State Administrative Court’s overlapping jurisdiction over actions by Electricity SOE Directors that possess hybrid characteristics as both private and public entities. The core issue lies in the legal uncertainty surrounding the boundaries of the administrative court’s absolute competence in determining the business discretion of Directors in national strategic projects. Such actions are frequently drawn into the realm of administrative disputes through the expansion of the meaning of the State Administrative Decision. This study aims to analyze the legal standing of SOE Directors, dissect the dialectics between the BJR doctrine and the General Principles of Good Administration in land acquisition and permitting, and formulate norm reconstruction through internal procedural standardization. The research method employed is normative legal research, using the statute and conceptual approaches through prescriptive analysis of nine primary legal instruments and twenty-eight secondary legal materials. The results indicate that integrating BJR into the General Principles of Good Administration is imperative to protect managerial discretion from excessive judicial intervention. A crucial finding in this study emphasizes that the identification of the source of power, whether contractual or regulatory, is the key to determining the qualification of a decision as a private legal act to activate the exception in Article 2 point a of Law Number 9 of 2004. The implications of this study recommend standardizing SOE internal procedures in line with Supreme Court Circular Number 2 of 2019. This is essential to ensure that disputes arising from a breach of contract by the authority remain within the exclusive competence of the civil court. This effort is undertaken to achieve legal certainty in accelerating national energy infrastructure.

Abstract

Electricity infrastructure development is a national strategic sector directly intersecting with energy sovereignty and public interest. Therefore, construction contract disputes therein involve an intersection between private law and public law regimes. This research aims to critically analyze the basis of BANI’s legitimacy and the limitations of its authority in resolving government-construction contract disputes in the electricity sector. This is intended to guarantee the protection of energy sovereignty and the principle of legality in government administration. The research method applied is a normative juridical approach using the statute, conceptual, and case approaches, with a prescriptive, deductive syllogism analysis technique. The research results indicate that BANI’s legitimacy is derivative and limited. The arbitration institution lacks the adjudicative authority to review the validity of state administrative decisions or to set aside public electricity safety standards. These findings assert that BANI’s role must be reconstructed to remain within the corridor of purely commercial aspects without exceeding the administrative authority of public officials (ultra vires) in managing national strategic infrastructure. In conclusion, the limitation of arbitration authority is a manifestation of the limited delegation of authority doctrine, necessary to maintain state administration accountability while providing legal certainty for energy investment. This reconstruction makes a theoretical contribution by harmonizing party autonomy in civil law with legal sovereignty in the realms of Constitutional Law and State Administrative Law.

Abstract

The acceleration of digital economic transformation in the national fishery sector offers potential for allocative efficiency by shortening conventional supply chains, yet its implementation often clashes with the reality of stagnant physical infrastructure. This study aims to analyze disintermediation mechanisms arising from online market adoption, evaluate the efficiency of cold chain logistics, and formulate strengthening strategies for the integrative distribution system in Makassar City. Using a qualitative descriptive research design, data were collected via triangulation through field observations at physical distribution nodes in Paotere Fish Auction Market, transaction activity observations on marketplace platforms, and documentation studies, which were then analyzed using the interactive model by Miles et al. The results reveal a sharp logistics paradox. On the one hand, the online market successfully enabled disintermediation, increased price transparency, and severed fishermen’s dependence on traditional intermediaries. However, fundamental vulnerabilities were identified due to the absence of micro-scale cooling facilities and the use of non-standard last-mile delivery fleets. This condition results in accumulated risks of biological quality degradation and hidden operational cost inefficiencies. The study concludes that digital superstructure dominance without an adequate physical infrastructure foundation only yields pseudo-efficiency, threatening business sustainability. As a managerial implication, this study recommends implementing a hybrid logistics ecosystem through a Hub-and-Spoke model, transforming the Fish Auction Market into cold-chain-based fulfillment centers, supported by Public-Private Partnership policy synergy and the social engineering of fishermen’s logistics literacy.

Abstract

Although administratively appearing compliant, this research reveals a tension between formal compliance and empirical reality in the implementation of the MMQ contract, particularly in responding to developer marketing strategies, such as the 0% DP scheme. This study aims to analyze the administrative construction of the contract to accommodate developer promos, evaluate the validity of hishshah formation, and critique the legal implications of early asset ownership transfers. The research method employs a juridical-empirical approach through a case study at the BTN Sharia Depok Branch Office, using triangulation data collection techniques consisting of in-depth interviews, system observation, and critical document review of Financing Approval Letters and Financing Contracts. The results indicate a fundamental distortion in which the “mandatory paid-off receipt” administrative mechanism is used as a formal legitimation tool to bridge the gap between the bank’s Standard Operating Procedures requiring a down payment and the developer’s marketing strategy (gimmick) that eliminates it. This condition causes a legal defect in hishshah formation due to the violation of the cash capital requirement in syirkah, and creates unfair risk distribution consequent to the certificate title transfer practice and aggressive collateral execution clauses. This study concludes that the administrative response to such developer promos can shift contract substance to full debt financing wrapped in a partnership label, thereby recommending stricter technical regulations from relevant authorities to filter third-party promotion schemes incompatible with contract principles.

Abstract

Ecotourism development in Barru Regency currently faces complex challenges stemming from the disparity between abundant natural resource potential and the readiness of regional government institutions. This study aims to identify and analyze the roles of government and non-government actors, while simultaneously dissecting the relationship between local political dynamics and the effectiveness of ecotourism policy in Barru Regency. The research method applied is a qualitative approach with an exploratory case study design, in which primary data were collected through in-depth interviews with key informants from the legislative and executive branches and local communities, using an interactive data analysis model. The results indicate that local political dynamics are the primary determinant of policy effectiveness, as budget politics prioritize large-scale physical infrastructure development over environmental conservation. This condition creates institutional challenges in the form of a regional regulatory vacuum, leading to bureaucratic fragmentation and confusion over authority among technical agencies within the executive branch. Empirical data show a drastic decline in visitation and revenue at government-owned tourism attractions, while the private sector is experiencing massive growth. The weakness of these formal state institutions prompts the emergence of grassroots initiatives from non-government actors at the village level who self-manage governance roles, although these initiatives are threatened by stagnation due to the absence of systemic support. This study concludes that collaborative governance practices in Barru Regency have not yet ideally materialized due to the absence of an inclusive decision-making forum. As a recommendation, the regional government must urgently draft a regional regulation mandating the establishment of a collaborative ecotourism council to synergize the roles of government, village, and private-sector managers into a single sustainable development vision.

Abstract

The existence of local belief adherent groups in Indonesia continues to face challenges of marginalization and modernization. Amidst this vulnerability, the Towani Tolotang indigenous community in Sidenreng Rappang Regency demonstrates strong cultural resilience through the execution of the Sipulung tradition. This study aims to explore and analyze in depth the socio-cultural and economic significance of this communal tradition, which is proven to transcend mere dogmatic worship rituals. This study employed a qualitative, reflexive ethnographic approach. Primary data were collected through participant observation, in-depth interviews, and field notes at the Perrinyameng ancestral tomb site. The data were subsequently validated through source and methodological triangulation. The results show that the Sipulung tradition operates as a structural ecosystem that supports the community’s life sustainability through five main dimensions. First, the spiritual dimension manifests absolute obedience to Dewata Seuwae through the contemplative practice of Molalaleng guarded by the Uwatta figure. Second, the cultural education dimension transmits ancestral values through the habituation of early childhood. Third, the social dimension strengthens mechanical cohesion by regathering the Passompe within an inclusive space. Fourth, the economic dimension deconstructs the idea that ritual expenditure constitutes symbolic capital accumulation driven by the Resopa na temmangingngi hard-work ethos. Fifth, the entertainment dimension through the Massempe’ sport functions as a cultural catharsis. In conclusion, Sipulung is not merely a pilgrimage rite but a resolution instrument guaranteeing minority existence. These findings recommend the need for local government policy intervention to protect civil rights. Furthermore, the establishment of spatial protection for the Perrinyameng area is highly required as a bastion of indigenous community resilience.

Abstract

The fiscal efficiency policy through Presidential Instruction Number 1 of 2025 has narrowed the regional discretionary space and triggered the politician’s dilemma for local legislative members. This study aims to analyze the manifestation of this dilemma and dissect the budget political dynamics, both at the internal factional consolidation stage and the external negotiation stage in the Pinrang Regency DPRD. This study employed a qualitative method with an intrinsic case study approach. Primary data were extracted through in-depth interviews with legislative and executive representatives, party executives, and societal elements. These data were then confronted with the literature using a source triangulation technique. The results reveal that budgetary constraints force council members to formulate electoral defense mechanisms. These mechanisms are executed by prioritizing the allocation of constituency programs to the dominant voter base areas. In the Budget Committee’s external arena, the executive bureaucracy’s defensive maneuvers utilizing technocratic compliance instruments are responded to by the legislature through compromising bargaining tactics. These tactics involve scaling down physical programs to avoid a regional budget ratification deadlock. This study concludes that the uniform budget-cutting policy has tangibly distorted the allocation of resources and transformed the council’s representative instruments into pragmatic transactional commodities. These empirical findings suggest the need for a reorientation in the formulation of an asymmetrical fiscal efficiency policy by the central government. Furthermore, the institutionalisation of a budget-priority protection mechanism at the regional level is highly necessary so that strategic development designs do not become victims of short-term factional negotiations.

Abstract

Historically, the female body has been the object of patriarchal beauty standards that glorify thinness. This research aims to examine how muscular women negotiate and construct their self-concepts through symbolic interactionism on Instagram. This study employs a qualitative, interpretive approach. Primary data collection was conducted through participant observation and the analysis of social media content from six active members of the Celebrity Fitness center in Jakarta. All data were comprehensively analyzed using thematic analysis techniques. The results indicate that muscular women initiated their identity negotiation in the physical space by rejecting conventional beauty standards. This physical capital, integrating masculine strength and feminine softness, was strategically represented in the virtual space. They produced significant symbols through stages of visual curation and verbal discourse to dismantle stereotypes of female physical weakness. This digital representation culminated in a psychological alignment process. The reception of quantitative appreciation through like buttons and qualitative appreciation in comment sections acted as external validation instruments. This social network support triggered an increase in self-esteem and facilitated their achieving an optimal state of psychological congruence. The real self, which had densified, completely aligned with the ideal self projected on the virtual display. This study concludes that digital validation acts as the ultimate instrument perfecting the autonomy and existence of muscular women. Practically, the broader society is urged to cultivate a more inclusive space of tolerance to celebrate the diversity of women’s physical expressions without the shackles of obsolete gender constructs.

Abstract

The demands of the green economy and RSPO standards have compelled a global transformation of palm oil governance. However, an empirical anomaly exists in Paser Regency, where the massive expanse of smallholder plantations contrasts sharply with the low rate of certification adoption among oil palm smallholders. This study aims to evaluate the level of substantive success and unravel the root of systemic constraints in the implementation of RSPO standards for oil palm smallholders using Merilee S. Grindle’s theoretical framework of policy implementation. Adopting a qualitative approach with a descriptive-analytical design, data were gathered through technical triangulation involving in-depth interviews, observations, and document studies, and subsequently analysed by dissecting the variables of policy content and implementation context. The evaluation results demonstrate that the policy instrument has successfully transformed the governance behavior of a minority group of oil palm smallholders through the rationality of premium price incentives. Nevertheless, these achievements have not been replicated on a mass scale due to the administrative pathology of the local government. Local governments have been degraded into passive administrators due to the double burden of national regulations and international standards. This state institutional failure is validated through the paralysis of land legality administrative services, the absence of audit financing subsidies, and the lack of a persistent technical assistance system. This study concludes that the failure of sustainability adoption is purely rooted in the structural weaknesses of public services rather than the cultural rejection of oil palm smallholders. This study recommends affirmative interventions, including bureaucratic simplification of land title processes, specific budget allocations, and the institutionalisation of field assistance, to prevent oil palm smallholders from being eliminated from the global supply chain.

Abstract

Amid the global shift toward more authentic and meaningful tourism, many small island destinations, such as Lae-lae Island in Makassar, face the challenge of brief, superficial visits despite their wealth of intangible cultural heritage. This research aims to develop a systematic travel patterns design model grounded in indigenous storytelling to enrich the visitor experience. Employing a qualitative case study design that involved in-depth interviews, participatory observation, and document analysis, this study first identifies four main narrative repositories on Lae-lae Island. These repositories encompass collective memory, myths of sustenance, maritime spirituality, and the symbolism of communal protection. Based on an analysis of these narrative assets and the existing tourism context, this research generates a concrete intervention model: the Narrative Travel Pattern. This model strategically adapts the dominant stopover travel pattern, transforming it into a curated linear route that connects the primary narrative sites. Key findings indicate that integrating indigenous storytelling into spatial movement not only deepens the quality of the tourist experience within a limited visitation time but also opens a space for empowering the local community as guardians and interpreters of their own culture. The study recommends developing interpretive materials and training local guides as crucial steps in implementation. Ultimately, this model contributes to the cultural tourism literature by offering an applicable framework for transforming intangible heritage into an authentic and sustainable tourism asset.
