Abstract

This study aims at determining the effect of partially and simultaneously motivation and work climate on the performance of employees in the Free Trade Zone and Sabang Free Ports. This research was conducted at the Free Trade Zone and Port of Sabang Free Trade Agencies (BPKS) in August - September 2018. Based on the Slovin formula the number of samples in this study is 57 people. The independent variable consists of work motivation (X1) and work climate (X2), while the dependent variable is employee performance (Y). Data analysis was performed using multiple linear regression analysis. The results showed that motivation partially had a significant effect on the performance of employees at the Free Trade Zone and Sabang Free Port Management Agency with a tvalue of 6.634> ttable 1.670. The work climate partially has a significant effect on the performance of employees at the Free Trade Zone and Sabang Free Port Concession Agency with a tvalue of 2.573> ttable 1.670. Work motivation and work climate simultaneously have a significant effect on the performance of employees at the Free Trade Zone and Sabang Free Port Management Agency with an Fcount of 26.375> Ftable 3.17.

Abstract

The application of legal sanctions against perpetrators of narcotics crimes can be subject to rehabilitation sanctions. The purpose of punishment in narcotics crime as stipulated in Article 127 of Act Number 35 of 2009 must be carried out selectively regarding whether the perpetrator is a user or distributor. The conflict or norm conflict against the Law occurs in Article 127 where in Article 127 paragraph (1) the Judge can convict a narcotics abuser while in paragraph (2) and paragraph (3) it is stated that the Judge must rehabilitate addicts and victims of narcotics abuse. But in fact not all judges provide rehabilitation decisions. As happened in the Purwokert District Court.. The research conducted is normative legal research with the nature of descriptive analysis. This study used secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. Based on the results of the study, it was found that the determination of sanctions against narcotics addicts, whether to impose criminal sanctions or sanction rehabilitation, this determination was in the hands of the judge. in accordance with the provisions of Article 127 and Article 103 of Law Number 35 of 2009. In the Indonesian criminal system, a double track system is known where the criminal system consists of criminal sanctions (sanctions) and sanctions for action (maatregel) so that based on article 54 of the Law Number 35 of 2009 for users and victims of narcotics abuse, medical and social rehabilitation is required.

Abstract

The support of the West Nias Regency DPRD (Regional People's Representative Assembly) secretariat is urgently needed so that the DPRD's performance can run well in order to absorb and carry out the aspirations of the people of West Nias Regency to carry out the Legislation, Budget and oversight functions. This study aims at: (i) finding the role of the West Nias Regency DPRD Secretariat in enhancing the performance of the West Nias Regency DPRD (ii) analyzing the factors that support and hinder the West Nias Regency DPRD Secretariat to improve the performance of the West Nias Regency DPRD. This research is descriptive with a qualitative approach. Research informants: key informants: West Nias DPRD Secretariat and key informants: DPRD members West Nias Regency. Data analysis technique used by the qualitative method Results: the role of the West Nias Regency DPRD Secretariat in the Improvement of the West Nias Regency DPRD shows 82% or between 80% to 100% good performance. Supporting factors are: optimization of available budget, cooperation and solid teamwork, maximizing facilities and infrastructure facilities. Inhibiting factors are lack of coordination and division of tasks is not optimal and scheduling of activities that almost coincides with implementation time especially in the procurement of facilities and infrastructure that supports the smooth administration of offices as well as several other activities in the capacity building program for regional people's representative institutions and limited staff of the DPRD Secretariat

Abstract

Performance is a set of measures regarding how well a job can be done compared with established assessment standards. This study aims at determining the effect of communication and organizational culture partially and simultaneously on the performance of employees of the Medan City Regional Tax and Retribution Management Agency. The population of this study is 329 employees of the Medan City Regional Tax and Retribution Management Agency. Slovin formula was used to determine the number of samples, obtained as many as 181 people. Data collection techniques in this research were questionnaire, interview and documentation study. While the data analysis technique used is the classic assumption test, multiple regression, ttest, Ftest and the coefficient of determination. The results show that there is a significant influence of communication on employee performance. There is a significant influence of work culture on employee performance. There is a significant influence of communication and organizational culture simultaneously on the performance of employees of the Medan City Regional Tax and Retribution Management Agency. The coefficient of determination (R Square) is 0.638, meaning that variations in employee performance can be explained by communication and organizational culture by 63.80%, while the remaining 36.20% is again explained by other factors, such as the work environment, training and other factors which is not explained in this research model.

Abstract

Research on the urgency of regulating sexual gratification as a form of corruption is aimed at identifying whether or nor a gift can be given to attempt the sexual service received by civil servant or state officials categorized as gratuities related to corruption. In addition this study also aims at finding out and analyzing policies on sexual gratification in Law Number 31 of 1999 in conjuction with law number 20 of 2001 concerning eradication of corruption in Indonesia in the futer (ius contituendum) and finding out the urgency of regulating sexual gratification as a form of corruption. Based on research conducted, it can be seen that the provision of sexual service to civil servants or state administrators has fulfilled the elements of Article 12 B of Law Number 20 of 2001 concerning Corruption Crime. Providing gratuities in the form of sex service is against the law that lives in the community. Criminal law policy towards the eradication of sexual gratification in Indonesia can be seen in Law Number 31 of 1999 concerning eradicating Criminal Acts of Corruption in conjuction with Law Number 30 of 2002 concerning the Corruption Eradication Commission. Both of these laws have also been enacted Law Number 7 of 2006 concerning Ratification of the 2003 UN Anti-Corruption Convention. The urgency of regulating sexual gratification as a form corruption is based on the fact that in Indonesia the provison of sex services as a criminal act of corruption has occurred, making it easier to prove the efforts made by the KPK (Corruption Eradication Commission) in cases of sexual gratification by official country
