Indonesian Journal of Pancasila and Global Constitutionalism (ISSN Print: 2830-0629 ISSN Online: 2830-0610) is an open access a double blind peer reviewed journal published by Faculty of Law, Universitas Negeri Semarang and managed by Pancasila and Constitution Studies Center, Center for Legal Drafting and Law Student Debating Community. Pancasila is an important issue in the Indonesian and the global context. This Journal aims to be a forum for academics, researchers, practitioners, and students in the study of Pancasila and Global Constitutionalism, including in the study of the worlds major ideologies. The Journal offers an interdisciplinary space for addressing the foundations, limitations and contestations of the principles and norms of political order and their dynamics over time on a global scale. The Journal publishes cutting-edge peer-reviewed work which refers to and advances global constitutionalism and study of Pancasila as an interdisciplinary field. Submissions are invited from a broad range of disciplines including International Law, Political Science, International Relations, Comparative Constitutional Law, Comparative Politics, Political Theory and Philosophy including the comparative analysis of Pancasila practices and another national ideologies in the global perspective.

Abstract

Indonesia is currently in a state of emergency in law enforcement, especially in cases of corruption. Law enforcement in Indonesia is still quite alarming because the law in Indonesia still views the public and officials, this view is certainly not equal and not in accordance with the values ​​contained in Pancasila. With the inequality of legal equality of corruption, there are many problems ranging from health to the economy. Corruption is an act that is very detrimental in various sectors, especially in its enforcement that is not in accordance with the values ​​of Pancasila which causes enforcement in Indonesia to be very sad. In the discussion of this journal, it focuses more on the values ​​of Pancasila so that law enforcement in Indonesia returns to normal or enforcement in Indonesia can be said to be equivalent which contains the values ​​of Pancasila in it. In taking the material in this journal, we use the library study method which will add insight into how to take the attitude of Pancasila values ​​in law enforcement corruption.

Abstract

This study discusses the relationship that Pancasila has with the way it is used to overcome social problems that exist in Indonesia. This study uses the literature review method which explains that researchers in working only use sources from other research materials. The results obtained from this study are that to overcome social problems in the form of poverty, it is necessary to apply the fifth principle of Pancasila that all Indonesian people have the right to get the same thing and there is equality both at the level of the economy, education, and health. Furthermore, for the problem of war, it can be overcome by reflecting the first precept that every society has the right to choose what it believes in so that usually in its teachings it does not allow war except in special situations such as upholding justice. In the further context, for LGBT, it is necessary to apply the second principle that every human being has manners so that these LGBT actors should be embraced so that they can return to normal and not discriminate.

Abstract

The Archipelagic Insight is one of the important things, not only in strengthening the national character but also in positioning various problems in the eyes of nationalism and Indonesianness. This study aims to analyze the role of archipelago insight in solving various national cultural conflicts. The method used in this study is a literature study, in which the author examines various theories and research results related to the archipelago's insight as a means of solving problems of national cultural conflict. This study finds and emphasizes that with the diversity of ethnicity, race, religion, belief and culture in Indonesia, various potential conflicts always arise. The heterogeneous character of the Indonesian nation becomes a conflict related to culture which is very likely to occur. In addition, in this study, the archipelago insight is considered capable of resolving various potential conflicts, including cultural conflicts, whether through the Pancasila philosophy approach, regional, socio-cultural, or historical aspects.

Abstract

The implementation or application of Pancasila values in this globalization or modern era is still not optimal. In this era of globalization, many foreign cultures have entered Indonesia, especially K-pop culture. K-pop culture (Korean pop) has received a lot of attention, especially young people. The K-pop (Korean pop) music culture originating from South Korea is very popular with young people, both boys and girls. Today's young people, especially women, tend to like this culture. The youth should not be more fond of culture that comes from outside. Because young people are the next generation of the nation who must preserve local culture. Therefore, this attitude does not reflect Pancasila values. It's okay if you want to like culture that comes from outside, but young people who like kpop usually tend to be more fanatical about kpop music culture. This should not happen because if it happens and develops rapidly it is not impossible that young people will prefer this culture over the local music culture. Therefore in this paper it is hoped how important the application of Pancasila values is in dealing with the rapidly developing kpop music culture.

Abstract

Law enforcement in Indonesia has been regulated in the 1945 Constitution paragraph (1) of the 1945 Constitution where everyone is treated equally before the law without any distinction. As stated in the 5th Pancasila precept which reads: "Justice for all Indonesian people". But in reality the implementation of law enforcement in Indonesia is not going well. The law that should act decisively is now the opposite. In Indonesia, the law is used as a tool to act arbitrarily. An official, high-ranking official who has a lot of money will easily avoid legal disturbances even though the person has violated the law. And conversely for people who can not even get a severe punishment. This study aims to analyze the implementation of legal justice in the perspective of Pancasila in Indonesia as a basic framework in the state. This study uses a normative approach and literature study in which the author examines and compares various previous studies related to the topic of justice in the Pancasila perspective, as well as various related theories. This study finds and emphasizes that legal injustice in Indonesia is caused by the old paradigm of law enforcement officials, who still prioritize aspects of legal certainty and have not used aspects of justice and legal benefits. The legal apparatus associated with the court pays more attention to legal procedures, which they should prioritize existing legal justice.

Abstract

Pancasila is the source of all laws in Indonesia, all regulations made in Indonesia are all based on the values contained in Pancasila. Corruption is a criminal act committed by a person or group of people by taking rights that should belong to the state or society for personal purposes. Corruption is also one of the factors that hinders the economy of a country, can also reduce the country's economy and increase the level of poverty. The act of corruption is an act of serious human rights violation, because it deliberately seizes the property rights of others. This criminal act of corruption usually occurs because of the abuse of power, trust, authority, and the weakness of the law in this country.

Abstract

Democracy is a political system that is currently used by almost all nations and countries in the world. The democratic political system is not only used by liberal countries which uphold freedom, but it turns out that the democratic political system is also used by communist-minded countries which uphold togetherness or collectivity. Communist countries call the democracy they use proletarian democracy or people's democracy. In contrast to our country, Indonesia, which adheres to the Pancasila democratic political system, where the values contained in democracy must be based on Pancasila values. In Pancasila democracy, apart from being based on Pancasila values, there are 10 pillars of democracy mandated by the nation's founding fathers (founding fathers). Principles or joints are the main truths which are used as the basis for thoughts, actions and so on. Then in the Pancasila democratic government system there are seven main pillars which form the foundation.

Abstract

Currently, there are many cultures that deviate from the prevailing norms. Lots of people forget the values of Pancasila that already exist. The existence of western culture makes our nation forget the culture that we have ourselves. Some of them are even more proud when using the culture of other nations. As a result, the culture that we have is eroded and gradually lost by the times. It's not a bad thing if we know other cultures, but we must not forget the culture of our own country. But today, they actually forget the identity of their own country, the prevailing paradigm is gradually disappearing. Paradigm is a person's perspective that can influence a person's way of thinking (cognitive), behaving (affective) and behaving (conative). Paradigm itself is very influential on a person's behavior in implementing Pancasila values. If the values in Pancasila are practiced properly, of course we will not lose our own national identity. The existence of Pancasila is also a guideline for upholding noble human values. Pancasila itself is essentially humanistic because Pancasila is based on the position of human nature or what is commonly called human rights. As stated in the five precepts, Pancasila always puts human rights first. This is in accordance with what is stated in the second precept, namely Just and Civilized Humanity. Thus, socio-cultural development must uphold human values and human dignity in order to produce cultured and civilized human beings.

Abstract

The implementation of the ethics of pluralism as an effort to revitalize Pancasila values is motivated by problems arising from the nation itself, such as demonstrations that end in chaos, customs, ethnicity, religion, an area that is so vast that the logical consequence of these diverse orientations must be accepted and respected. If these symptoms are not addressed immediately, they could pose a danger of national disintegration. Thus, the ethics of pluralism is very important to teach good manners in an attitude of being willing to accept opinions in deliberations and consensus as the embodiment of democracy. Where the spirit of mutual cooperation and mutual respect for differences is applied in everyday life.

Abstract

Since the Amendment of the 1945 Constitution, the development of state institutions has exercised state power by rearranging existing institutions, forming new institutions, and even independent state institutions. The presence of these institutions can strengthen Indonesia's position as a democracy and a modern rule of law. However, in its development, these independent state institutions began to arise various problems that triggered public distrust of these institutions. Therefore, it is necessary to re-establish these independent institutions to realize a democratic and constitutional system of government.
