Jurnal Hukum dan Peradilan (JHP) is published by the Research Center for Law and Judiciary of the Supreme Court of the Republic of Indonesia. JHP aimed to be a peer-reviewed platform and an authoritative source of information on legal and judiciary studies. The scope of JHP is analytical, objective, empirical, and contributive literature on the dynamics and development of legal studies, specifically in Indonesia. JHP welcomes scientific papers on a range of topics from research studies, judicial decisions, theoretical studies, literature reviews, philosophical and critical consultations that are analytical, objective, and systematic. However, from a wide range of topics that researchers can choose from, JHP puts more attention to the papers focusing on the sociology of law, living law, legal philosophy, history of national law, customary law, literature studies, international law, interdisciplinary, and empirical studies. Jurnal Hukum dan Peradilan (JHP) is a media dedicated to judicial personnel, academician, practitioners, and law expertise in actualizing the idea of research, development, and analysis of law and judiciary. Abstract

The purpose of this study seeks to uncover the meaning of Law No. 19 of 2003 and Article 33 of the 1945 Constitution of the Republic of Indonesia, and identify the essence of the roles and functions of SOEs in implementing the economic constitution. The study of SOEs in the realm of constitutional economics is seen as very important as a reflection of the rapid change in national and global economic development. The findings of the study lead to the philosophical understanding of economic constitution for the Republic of Indonesia by the role of state companies in national economic development. The theoretical description of the results of this study contributes to the knowledge of political economy and political democracy. The benefits practically have implications for the practice of public management about the governance of state enterprises, as well as corporate management for SOEs or other state-owned companies.

Abstract

The number of violations of children’s rights in the form of exploitation and violence against children is increasing in Indonesia. The increase is due to the lack of understanding of children’s rights from related parties. Repositioning children’s rights is needed because children need a specific right and specific protection under a specific human rights framework, so that they do not lose power when establishing relationships with adults; where at this point, children are very vulnerable to treatment discriminatory. The repositioning of children’s rights is carried out by making a protection and enforcement of human rights as guaranteed constitutional rights, which is based on the understanding that human rights are human rights in toto and not merely as an individual’s legal rights in their capacity as legal subjects that are legally listed in the applicable law. The failure of the government to carry out this obligation is violation by omission.

Abstract

The Law Number 11 of 2020 concerning Job Creation amended 79 laws, including Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. Far from being comprehensive, the Job Creation Law amended the system of law enforcement regarding business competition that had been in place for over twenty years. With a normative method, this research aims to discuss the legal implications of the effectuation of the Job Creation Law regarding the enforcement of the law concerning business competition. This research reveals that Law 11/2020 could lead to a better legal certainty and adequacy of law enforcement concerning business competition in Indonesia in the time to come.

Abstract

According to the constitution, the state concept in constitutional practice can be divided into two opposite poles, namely welfare and liberal state. They have different characteristics in which the first concept (welfare state) requires a strong and extensive state functions to regulate an economic justice, on the contrary the second concept (liberal state) relies on the free market economy which state’s role should be marginalized. Sosio-legal research is used in this article. Based on the Article 33 of Indonesian post constitutional amendment of 1945, Indonesia embraced the concept of welfare state. Yet, the practice sociologically tends to embrace a liberal state that is not suitable with the welfare of the people. There are challenges, in the context of liberal state, faced by Indonesia, such as applying the capitalist economic system. We may fight the capitalist economic system by two legal policy, namely: first one, we may re-create the role of state functions as a controller and regulator of the economy. The second one, we may increase the state income through taxes along with the higher social spending to achieve the social welfare and economic justice.Keywords: welfare state, the constitution of 1945, legal policy

Abstract

The existence of corporation affects the state economy, the society where the corporation stands and the society where the business run. Not only the positive effect but also the negative effect. The corporation was build for some mission and the way it reaches the mission were different one another. It is possible that one or more corporation was build in some way that prohibited by law. For that reason, there is a corporation is involved in various criminal acts or as a means to commit the crimes. Therefore, special attention needs to arrange to snare corporations to take responsibility for an act involving a corporation or as a tool in a criminal offense.Keywords: criminal responsibility, corporation.

Abstract

Indonesian administrative courts’ absolute jurisdiction are limited to the administrative decisions. It leads the courts as a special administrative court, even a “very special court”, because such definition of administrative decisions laid down on Law on Administrative Court is more narrow compared to the definition of administrative decision as laid down on the General Administrative Law Act of the Netherlands as it source. Most court decisions on the courts’ absolute jurisdiction vary in interpretations that make them unpredictable. They cause uncertainty and inconsistency in the application of administrative courts’ absolute jurisdiction. Furthermore, they create confusion to the society looking for appropriate forum dealing with administrative acts and bafflement to the administrations executing courts’ decisions. The concept offered to the expansion of Indonesian administrative courts’ absolute jurisdiction are based on the method and determination of administrative disputes. Method used is general method, while determination used is subjective and objective determinations. Subjective determination includes external and internal disputes, while objective determination includes all administrative acts in the field of public laws covered the legal and factual acts causing material or immaterial damages. Abstract

Protection of victims of crime is part of the protection of human rights as a whole. The protection that provided was the responsibility of the state that has been manifested in a criminal law policy. The ultimate goal of the criminal law policy is the social defence to achieve the overriding goal of social welfare. Criminal law policy is basically also an integral part of social policy. Criminal Law Policy in Indonesia contained in implementation of the criminal policies through the establishment of statue such as the Penal Code, Criminal Procedure Code, and other organic laws which governing the criminal provisions in it. Criminal Law Policy was emerged from political law which integrated into the criminal policies that embodied in laws governing the criminal provisions. This essay is trying to discuss how criminal law policy in Indonesia that has been implemented, and how the criminal law policy in providing the protection of victims of crime through the criminal justice system in Indonesia. Currently, the criminal law policy regarding the protection of victims of crime has been regulated. But the provisions have not fully provides protection to victims of crime. It can be seen in Act No. 8 of 1981 on the Code of Criminal Procedure Act which gave more protection to the suspect than to the protection of victims. Furthermore, Law No. 13 of 2006 on the Protection of Witnesses and Victims provide better protect witnesses than victims. This is due to the Act appears to provide protection to witnesses incorruption cases. Keywords: the criminal law policy, the criminal justice system, protection of victims of crime.

Abstract

Pengadilan Hubungan Industrial (PHI) dibentuk berdasarkan Undang-Undang No. 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial. Ratio legis-nya adalah mewujudkan kepastian hukum dan keadilan melalui asas peradilan cepat, tepat, adil dan murah. Eksistensi PHI menimbulkan masalah, baik kemampuan pengetahuan pekerja/buruh tentang hukum formil maupun hukum ketenagakerjaan materil, proses lama, dan substansi hukum belum memadai. Tinjauan ini urgen dilakukan untuk identifikasi upaya yang dapat dilakukan agar ratio legis eksistensi PHI terwujud. Metode yang digunakan adalah penelitian hukum normatif dengan didasarkan pada pengkajian hukum positif, yaitu UU No. 2 Tahun 2004. Pendekatan yang digunakan adalah perundang-undangan untuk mengkaji asas-asas peradilan. Hasil tinjauan ini mengidentifikasi beberapa kelemahan, baik dari segi struktur hukum, substansi dan budaya hukum. Upaya untuk mengatasinya, yakni dengan membentuk PHI di setiap Pengadilan Negeri Kabupaten/Kota. Revisi UU No. 2 Tahun 2004 yakni : pengaturan yang memperluas pengertian subjek hukum pekerja/buruh dan pengusaha; lembaga konsiliasi dan arbitrase dipertimbangkan keberadaannya; pengaturan upaya hukum kasasi yang nilai gugatannya di bawah Rp.150 juta dihapus; pengaturan pailit dikategorikan sebagai keadaan mendesak dalam pemeriksaan acara cepat sinkron dengan ketentuan UU No. 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang; pengaturan khusus mengenai eksekusi putusan PHI dan pengaturan tidak memperkenankan upaya hukum PK dalam proses eksekusi. Kepastian hukum batas waktu proses administrasi perkara hingga pelaksanaan putusan. Optimalisasi pemanfaaatan sarana Informasi Teknologi (IT) dalam proses administrasi perkara, khususnya pemanggilan “delegasi”.The Industrial Relations Court (IRC) is instituted based on Law No. 2 of 2004 on Settlement of Industrial Relations Disputes. The ratio legis is to realize legal certainty and justice through the principle of fast, precise, fair and cheap judicial process. The existence of the IRC poses some problems with respect to the knowledge competence of workers/laborers in formal law and material employment law, as well as the lengthy process and insufficient legal substance. A review on this matter is urgently needed to identify the efforts that can be made so that the ratio legis for the existence of IRC can be established. The method used is a normative legal research method based on the study of positive law, namely Law No. 2 of 2004. The approach is using legislation to examine the principles of judicial process. The results of this review have identified several weaknesses in terms of legal structure, legal substance and legal culture. An effort to overcome them is by instituting an IRC in every District/Municipal Court. The revisions made to Law No. 2 of 2004 include: a regulation that broadens the definition of the legal subjects workers/laborers and employers; consideration of the existence of conciliation and arbitration institutions; revocation of the regulation on the appeal to the highest court for lawsuits below Rp 150 million in value; a regulation on bankruptcy to be categorized as an urgent situation in examinations by fast proceedings, consistent with the provisions of Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations; a specific regulation on the execution of IRC decisions and a regulation that does not allow the legal remedy of judicial review in the execution process; legal certainty with respect to the limit on the time frame from the case administration process up to the execution of the decision; optimization of the use of Information Technology (IT) facilities in the case administration process, especially in summoning the “delegates”.

Abstract

Sex education in Indonesia still taboos to talk in an educational context; however, sexual abuse, free sex, and abortion are increasing more and more. This situation more likely will get in an emergency when criminal code bill article 414 about showing contraception tools to children is applied because it is considered cut off sexual education teaching and against HIV/AIDS and family planning campaign.  This article focuses on analyzing criminal code bill article 414 toward sex education in Indonesia and discussing possible solutions for including sex education in the school curriculum. Several critics addressed in criminal code article 414, and several solutions were given in this article for including sex education in the Indonesian curriculum. There is some limitation occurred toward this article, especially, the literature which addressed this issue is limited. In addition, it seems the experts are not discussing about this issue regularly.
