Abstract

Abstract. This study aims to analyze and examine the causes of political parties to systemic corruption and efforts to save them from corruption. Political parties are important actors in democracy in a country. Democracy manifests in the form of election, the main actor of the election is a political party. If the main actor of corruption is confirmed, democracy and elections will fall. The result is a bad stigma in political parties: democracy yes political party no. Based on the research result that the cause of political party of corruption: First, the placement of political party as an important agent in state structure of Indonesia Post-amendment of 1945 Constitution, but it is not balanced with recruitment model of political party cadre that meritokratic, integrity and, responsibility to the public. Secondly, financing for running the organization of political parties is very expensive, especially if the political parties are projected to win the seats of DPR / D, governor/regent/mayor and president. Third, the choice of model of legislative election system in 2009 and 2014 based on Law Number 10 Year 2008 and Law Number 12 the Year 2012 on General Election of DPR, DPD, and DPRD (Indonesian Legislative Election) members are the most open-based voting proportional system. The recommendations for reforms to save political parties from corruption through party system and election system aspects are (1) to improve the recruitment model of political party cadre; (2) making alternative for financing model of political party organization; (3) tightening the requirements of political parties into election participants; (4) eliciting election costs by returning to open proportional systems with sequence numbers, and (5) designing alternative mixed-model electoral systems.Keywords: Arrangements, models, political parties, general elections and political corruptionAbstrakPenelitian ini bertujuan untuk menganalisis dan mengkaji tentang penyebab partai politik (parpol) melakukan korupsi sistemik dan upaya menyelamatkannya dari korupsi. Parpol adalah aktor penting dalam demokrasi di sebuah negara. Demokrasi terwujud dalam bentuk pemilu, aktor utama pemilu adalah parpol. Jika aktor utamanya korupsi dipastikan demokrasi dan pemilunya terpuruk. Akibatnya muncul stigma buruk pada parpol: demokrasi yes parpol no. Penelitian ini merupakan penelitian hukum empirisis (sosiologis) yang bersifat diskriptif-eksplanatoris. Karena penelitian ini adalah penelitian kualitatif, maka cara memperoleh data dilakukan dengan studi pustaka dan observasi. Teori yang digunakan adalah teori korupsi politik, teori sistem kepartaian dan teori sistem pemilu. Berdasarkan hasil penelitian bahwa penyebab parpol korupsi: Pertama, ditempatkannya parpol sebagai agen penting bernegara dalam struktur ketatanegaraan Indonesia Pascaamandemen UUD 1945, namun tidak diimbangi dengan model rekruitmen kader parpol yang meritokratis, berintegritas dan tanggungjawab pada publik. Kedua, pembiayaan menjalankan roda organisasi parpol sangat mahal, apalagi jika parpol diproyeksikan untuk meraih kursi DPR/D, gubernur/bupati/walikota dan presiden. Ketiga, pilihan model sistem pemilu legislatif tahun 2009 dan 2014 berdasarkan UU No.10/2008 dan UU No.12/2012 Tentang Pemilu Anggota DPR, DPD dan DPRD adalah sistem proporsional terbuka berbasis suara terbanyak. Adapun rekomendasi untuk reformasi menyelamatkan parpol dari korupsi melalui aspek sistem kepartaian dan sistem pemilu adalah, (1) memperbaiki model rekruitmen kader parpol; (2) membuat alternatif model pembiayaan organisasi parpol; (3) memperketat syarat parpol menjadi peserta pemilu; (4) mempermurah biaya pemilu dengan kembali ke sistem proporsional terbuka dengan nomor urut, dan (5) merancang alternatif sistem pemilu model campuran.Kata Kunci: Pengaturan, model, parpol, pemilu dan korupsi politik

Abstract

This article aims to analyze the authority of the Consumer Dispute Resolution Agency (BPSK) as Quasi-Judicial in handling consumer disputes as mandated in Article 49 paragraph (1) of Law No. 8 of 1999. This research is a normative legal study that is prescriptive and technical/applied. The research approach uses the Act approach. This legal research material uses primary legal materials and secondary legal materials. The technique of collecting legal materials through library research is then analyzed using qualitative methods. Supervision of the default clause stipulated in the credit agreement is the authority of BPSK; since 2013, the Supreme Court has consistently dismissed consumer disputes for credit agreements positioned as ordinary agreements, stating the parties to the dispute should take their case to the general Judiciary, as well as correcting BPSK's authority. This not only does not imply the principle of lex specialis derogate lex religious but also does not implement efficiency theory that ultimately harms consumers.

Abstract

According to the constitution, the state concept in constitutional practice can be divided into two opposite poles, namely welfare and liberal state. They have different characteristics in which the first concept (welfare state) requires a strong and extensive state functions to regulate an economic justice, on the contrary the second concept (liberal state) relies on the free market economy which state’s role should be marginalized. Sosio-legal research is used in this article. Based on the Article 33 of Indonesian post constitutional amendment of 1945, Indonesia embraced the concept of welfare state. Yet, the practice sociologically tends to embrace a liberal state that is not suitable with the welfare of the people. There are challenges, in the context of liberal state, faced by Indonesia, such as applying the capitalist economic system. We may fight the capitalist economic system by two legal policy, namely: first one, we may re-create the role of state functions as a controller and regulator of the economy. The second one, we may increase the state income through taxes along with the higher social spending to achieve the social welfare and economic justice.Keywords: welfare state, the constitution of 1945, legal policy

Abstract

This research aimed to examine democracy development using e-participation through the e-aspiration system applied in public services to realize the smart city in Magelang City. Magelang City Government has released a special mobile application called Magelang Cerdas. The ease of public services provided by the Magelang Cerdas application has created various features that promote e-participation. This refers to online public participation by utilizing information and communication technology and the smart city concept. The smart city is related to information and communication technology used in the social field. It could be realized by opening public participation in ensuring the democratic rights of every citizen through the e-aspiration. The goal was to capture people’s aspirations to increase their participation in influencing Magelang City development. This modern day the government should provide financial support for the technological developments. Therefore, public services should be provided through conventional and digital-based delivery, such as e-government, which reflects the principles of good governance. Digital-based services could fulfil people’s rights and obligations as citizens. As a result, the people would directly realize digital government according in the modern era. The ease of access in participation would also help the government follow the direction and needs of the people. In implementing the smart city concept, Therefore, this research examined the factors supporting and strengthening public participation in the smart city concept on the Good Gonvernance perspective.

Abstract

After the Constitutional Court Decision Number 91/PUU-XVIII/2020 which mandates amendments to Law Number 11 of 2020 on Job Creation, it has consequences for the government to make improvements to the said law within a period of two years from the issuance of the decree. In Law Number 11 of 2020 on Job Creation, there are inconsistencies in the regulation of the form of legal products used for stipulation, norms for detailed spatial planning as a licensing instrument, and the existence of formal aspects that were ruled out at the time of its formation, causing polemics in the community. This article discusses how to implement spatial planning arrangements in the regions and how ideal harmonization spatial planning arrangements in order to optimize regional development. The research method to answer these problems is normative legal research that uses primary legal materials and secondary legal materials complemented by field research. The results of the study show that first, the spatial planning arrangements contained in Law Number 11 of 2020 concerning Job Creation cannot be implemented optimally, especially in terms of fostering and supervising the use of regional space. Second, it is necessary to improve the substance of the material as a material aspect in the form of setting detailed spatial plans with the suitability of space utilization activities and the stipulation of regional regulations by the central government. and improvement of formal aspects to minimize polemics in the community. Abstract

This study aims to determine and explain the role of the Kebumen Regency Regional Government in protecting children's rights and to analyze the implementation of Kebumen Regency Regional Regulation Number 3 of 2013 concerning the Implementation of Child Protection. The research method used is normative-empirical legal research with a statutory approach and conceptual approach. The types of data collected are secondary data and primary data, then the data is analyzed using qualitative methods. The results show that the implementation of child protection by the Community and Village Empowerment and Women's Empowerment and Child Protection Office of Kebumen Regency as a regional apparatus that assists the regional head in child protection affairs is in accordance with Kebumen Regency Regional Regulation Number 3 of 2013 concerning the Implementation of Child Protection. This is evidenced by the implementation of prevention efforts such as socialization, initiation of child-friendly schools, child-friendly health centers, women-friendly and child-caring villages (DRPPA), establishment of village child protection groups (KPAD/KPAK), establishment of district, sub-district and village child forums. For efforts to deal with victims as well as efforts to restore victims and social reintegration are carried out by the P2TP2A Kartika Team as the organizer of the function of protection and integrated services for victims of gender-based violence and children at the district level, the Kartika PPT Team which is the organizer of the function of protection and integrated services for children at the sub-district level, and the provision of a safe house as a temporary residence to provide protection to victims in accordance with the specified operational standards or fixed procedures. In addition, in the implementation of child protection in accordance with Kebumen Regency Regional Regulation No. 3 of 2013 concerning the Implementation of Child Protection, there are still obstacles that must be overcome.

Abstract

This article analyzes the functional degradation of fiduciary creditors' preferential rights after Constitutional Court Decision Number 18/PUU-XVII/2019. The study argues that the decision did not abolish fiduciary creditors' preferential rights, but transformed their practical realization from direct parate execution into conditional parate execution. Using normative legal research with statutory, case, and conceptual approaches, supported by documented socio-legal cases, this article examines the relationship between Article 15, Article 27, and Article 29 of the Fiduciary Security Law and the Constitutional Court's interpretation of default and voluntary surrender. The findings show that before the decision, fiduciary certificates and parate execution strengthened the economic value of preferential rights, but also enabled unilateral repossession practices. After the decision, debtor protection increased, yet disputed default or refusal to surrender the collateral creates procedural similarities with ordinary debt-collection disputes and produces economic consequences for creditors through higher transaction costs, longer recovery time, depreciation risks, and weaker recovery certainty.

Abstract

This research analyzes and examines the effectiveness of the authority of Komnas HAM in resolving cases of gross human rights violations in Indonesia. This research is a prescriptive normative legal research that aims to analyze the effectiveness of the authority of Komnas HAM in solving the problem of gross human rights violations and provide solutions to these problems. This research uses data types in the form of primary legal materials and secondary legal materials. Data collection is done through library research to find secondary data using primary, secondary, and tertiary legal materials. The author uses a statute-limitation approach, case concept, and history. The results show that Komnas HAM as an institution that is not given the authority to resolve the problem of gross human rights violations in the field of investigation does not cause obstruction in the settlement of cases of gross human rights violations in Indonesia, which is caused by the weak legitimacy of the settlement.

Abstract

Kebijakan ambang batas presiden telah menimbulkan respons yang beragam dari masyarakat. Beberapa menganggapnya sebagai ancaman terhadap hak politik warga jika diterapkan sehingga kebijakan ini seringkali diujikan konstitusionalitasnya. Studi ini bertujuan untuk menilai konstitusionalitas ambang batas presiden terkait dengan hak untuk dipilih dan memilih dalam pemilihan presiden dan wakil presiden, serta untuk menganalisis pertimbangan hakim dalam putusan Mahkamah Konstitusi nomor 4/PUU-XXI/2023. Metode penelitian yang digunakan adalah normatif dengan pendekatan perundang-undangan. Data sekunder dari bahan hukum primer dan sekunder digunakan pada penelitian ini. Hasilnya menunjukkan bahwa kebijakan ambang batas dapat menghambat hak politik warga dan mempersempit peluang bagi partai politik baru dan partai politik kecil untuk mencalonkan presiden atau wakil presiden. Selain itu, kebijakan ini membatasi pilihan calon presiden dan wakil presiden bagi warga. Meskipun kontroversial, Mahkamah Konstitusi tidak menganggap kebijakan ini tidak konstitusional karena kebijakan ini merupakan kebijakan hukum terbuka.

Abstract

The non-procedural dismissal of Constitutional Court Justice (CCJ) Aswanto by the House of Representatives demonstrates a serious threat to judicial independence and reveals fundamental problems in the system of judicial recruitment. This study employs normative legal research. The issues examined concern how a CCJ can be dismissed non-procedurally during an active term and replaced through an equally flawed mechanism, as well as how weaknesses in the recruitment system and ethical oversight contribute to such practices. This research applies a normative, case-based, and conseptual approach. The Constitutional Court Law, and the cases surrounding the dismissal of Aswanto and the appointment of Guntur Hamzah, including the decision of the Honorary Council of the Constitutional Court (MKMK) which confirmed a violation of integrity values. The findings indicate that Aswanto dismissal lacked a solid legal basis, weakened judicial independence, and potentially violated the principle of legal certainty. The appointment of the replacement justice was also procedurally defective and adversely affected the legitimacy and independence of the Constitutional Court (MK). Accordingly, the root problem lies in the misinterpretation of the Constitutional Court Law, necessitating a reconstruction of the judicial selection mechanism and the strengthening of ethical oversight of CCJ.
