Abstract

This research raises issues related to the protection of the right to state freedom for Indonesian citizens according to Indonesian national law. Specifically, this research discusses the history of the arrival of the Sikhs and the use of Kirpan in the public space as one of the teachings of the Sikh Religion which is mandatory for Sikhs to follow wherever and whenever. The regulation on the use of Kirpan is still unclear and ambiguous, so there is no legal certainty that protects Sikhs. Sikhs who wish to own and use a Kirpan are required to obtain a permit with the competent authority according to predetermined administrative requirements. However, this only applies to Sikhs who are over 17 years old, while Sikhs who are not yet 17 years old cannot obtain this permit. This has resulted in Sikhs who are under 17 years of age not receiving legal protection in exercising their religious rights. With this legal vacuum, the implementation of human rights in Indonesia is imperfect and not in accordance with Pancasila and the 1945 Constitution of the Republic of Indonesia. This research was conducted using normative juridical methods through literature studies and seeking expert opinion. This study uses a historical approach and a conceptual approach regarding the entry of the Sikh Religion and its teachings. This research is based on primary legal materials in the form of laws and regulations, international regulations, and judge's decisions, as well as secondary legal materials in the form of books, journals, and theses which contain previous research. The legal materials were obtained through library research. The type of analysis used is qualitative, namely by interpreting or interpreting the legal material obtained. The method of interpretation used is the method of grammatical interpretation and the method of historical interpretation. The results of this study state that the Indonesian government must make a law and regulation on the regulation of the use of weapons as a symbol of a religion such as Kirpan without any magical or heritage elements. This is for the sake of implementing religious freedom for Indonesian citizens in Indonesia

Abstract

Regional developments in global competition have demanded efforts to increase competitiveness through avoiding the occurrence of a high cost economy that has been complained about so far, due to the slow government bureaucracy which always demands greater costs than the service bureaucracy itself, for example through licensing facilities, to create efficiency for optimal resource utilization, in the context of building the birth of a perfect market mechanism. Market failure can be avoided by formulating licensing norms. Increasing regional competitiveness and absorption of regional income in the investment sector through the implementation of the Online Single Submission Risk Based Approach (OSS RBA) System Policy for Micro, Small and Medium Enterprises (MSMEs), for this reason, every business activity has a direct impact on modifying the policy format model, including institutional structure, and related to business service platforms, for the Central and Regional Governments. At the level of local policies, this is not an easy problem, in an effort to accommodate these interests, in the era of global competition. The effectiveness of the implementation of the RBA OSS System Policy by Regional Governments, as well as how to overcome obstacles to the policy are very interesting to analyze, regarding MSME Actors who experience limited conditions, in terms of capital, mastery of technology and market share. The method used to analyze is doctrinal (normative juridical), on the approach of the concept of law as written law in the form of statutory texts, which are built by local government regulations. The research findings state that the Regional Government, that Micro, Small and Medium Enterprises still need assistance to register permits, in terms of the RBA OSS System Policy in the mission of optimizing the policy, massive socialization must be carried out to the community, especially MSME actors, to increase information on the importance of this policy. In the end, the business actors in question no longer make mistakes in relation to determining the choice of categorization of Micro Small and Non-Small Micro Enterprises. This policy model is directly very influential in efforts to improve the efficiency of public services, and avoid the high cost economy that occurs.

Abstract

This paper discusses Indonesia's hedging policies towards China, especially in the South China Sea issue. In line with a free and active foreign policy principle, Indonesia seeks a middle way by establishing cooperation with the United States and China, two major powers with different interests in the South China Sea issue. This research is qualitative research using a case study approach. In this study, I carried out two data collection techniques, namely interviews and literature studies. The political elite decides to hedge within a government, so it is motivated more internally than externally. Hedging is a tactic that demands a low commitment to a country that does not represent friend or foe. However, in line with the increasing competition between the two, Indonesia's hedging strategy may fail due to external pressure to join one side. Therefore, in maximizing the hedging strategy, Indonesia seems to need to increase its defense capabilities to increase its bargaining position and deter threats from external parties

Abstract

Since the global outbreak of coronavirus, the existence of print media has been displaced by online media which the public can easily access any information from their smartphones. However, with this change the credibility of online media is often questioned because of the rampant fake news circulating, where one of the reasons is accessibility that everyone could become a writer. On the other hand, the editing process is considered not as strict as the printed media, so that it has a stigma that this news is just faster than the others but without any appropriate confirmation of facts. Thus this systematic literature review study will discuss the effect of changing print media to digital media and its influence on user media literacy in criticizing news The results obtained show that there are still many people, especially the younger generation, who cannot distinguish fake news from the accurate one. In conclusion critical media literacy is needed so that journalism in the future does not experience setbacks.
