Abstract

In his book, The Limits of Law, Anthony Allots stated that regulation is no more that a communication system based on Wittgenstein’s phrase: the language game. Regulations always ask the same questions: who’s the actor of communication? For whom the regulations been imposed? How did its communication method? What were communication obstacles which disturbed the communication process? Speaking about press regulations, which cutting-off and narrowing the freedom of press in Indonesia as imposed by KUH Pidana, it was clear enough that such regulation’s function mainly part of repressive acts, not preventive purposes.

Abstract

Biiaya besar eksploitasi limbah berbahaya dan standar persyaratan yang ketat dari negara pengimpor telah menyebabkan praktik pengiriman ilegal limbah berbahaya lintas batas serta penyelundupan limbah berbahaya. Artikel ini membahas isu-isu hukum dan kebijakan terkait pengiriman ilegal dan pembuangan limbah berbahaya. Dalam beberapa tahun terakhir, Indonesia telah menjadi negara yang ditargetkan untuk praktek-praktek ilegal. Dalam upaya untuk melindungi lingkungan, Indonesia telah mengadopsi perundang-undangan nasional tentang larangan impor limbah ilegal dan pembuangan limbah. Beberapa hal penting yang diatur dalam undang-undang ini adalah hak untuk menolak atas pembuangan dan pengiriman limbah berbahaya serta kriminalisasilalu atas perbuatan tersebut..

Abstract

Sejak manusia membentuk masyarakat maka terdapatlah hubungan antara masyarakat dengan sumber daya alamnya. Di Indonesia, hubungan antara masyarakat adat dengan sumber daya alam dimulai dari adanya hubungan antara masyarakat dengan tanah bersama. Munculnya perdebatan atau bahkan adanya ketegangan-ketegangan baik dalam ranah akademik maupun dalam pola relasi antara masyarakat dengan Negara yang selalu tak dapat dielakan adalah ketika membicarakan tentang hak-hak masyarakat adat dalam pengelolaan sumber daya alam. Hal ini terjadi karena beberapa hal misalnya menyangkut tentang asset yang kemudian berimplikasi secara ekonomi.Demikianpun juga ketegangan ini muncul karena seringkali posisi Negara secara serta merta mengambil alih pengelolaan sumber daya alam dengan dalil untuk kesejahteraan masyarakat tanpa diikuti dengan adanya relasi sosial dan hukum yang berprisip kepada saling menguntungkan dan jarang sekali memperhartikan aspek kearifan lokal yang hidup ditengah-tengah masyarakat. Penelitian ini dilakukan dengan menggunakan metode pendekatan yuridis normatif dan metode penilitian ini bersifat diskriptif analisis. Hak masyarakat adat Ciomas dalam pengelolaan sumber daya alam yaitu diterapkan dalam hal daerah yang disebut dengan Leuweung Larangan,Leuweung Tutupan,Kawasan Baladahan. Since humans form a society there is a relationship berween society an human resources. In Indonesia the relationship between indigenous peoples with natural resourses ranging from the relationship between society the community, the land together. The emergence of debate or ever the existence of tensions both in the academic domain and in the pattern of relations between communities and countries that can always be avoided is whe discussing talking avout the rights of indigenous peoples in the managing of natural resourses.This happens because of some things, for example, about assets that then have economic implications, as well as this tensions arise because often state positions instantly take over the management of natural resources under the pretext for the welfare of the community without the presence of a principled social and legal relationship to mutual benefit and rarely pay attention to the aspect of local wisdom living in the community. This research is done by using normative juridical approach and this research method is descriptive analysis. The rights of indigenous community of ciomas in the framework of the management of natural resources are applied in terms of areas called forhouses of forests, cover forest, bald area.

Abstract

This paper is derived from the results of research that seeks to elevate the values of Sundanese cultural wisdom in environment conservation efforts by building a model of environmental law with religious empowerment-based cosmic Watershed (DAS) based on the conception of Sundanese culture. This model emphasizes deemed necessary because the relationship between justice and ecological balance and social justice, equality and better accommodate a balance between social welfare and environmental harmony.It is also illustrated how human interaction with the environment with the objective picture of rural communities in implementing value if Ciomas ancestral cultural values in environment conservation efforts and how to implement the values of the Sundanese cultural wisdom in the formulation development of environmental law in Indonesia to be more characteristic of Indonesia. Keywords: Environmental; Sundanese Culture; Cosmic Religious.

Abstract

This thesis discusses the responsibilities of PPAT, which the party uses a fake identity and signature based on an example of a case on the DKI Jakarta High Court Decision Number 412 / PDT / 2018 / PT.DKI. The main problem in this research is about the PPAT's responsibility if there is a fake identity and signature of the actor in the deed he makes and what is the position of the authentic deed. This research is a type of normative research with a prescriptive type of research. The results showed that PPAT can be held accountable because it is not careful in carrying out its duties. PPAT responsibilities can be in the form of administrative, civil, and even criminal areas. The status of the authentic deed made by PPAT which contains false information contains legal flaws because it does not meet the validity requirements of an objective element agreement, namely related to a lawful cause so that the sale and purchase certificate becomes null and void by law.

Abstract

The city of Tomohon is famous for its extreme market that sells various animal meats that are not commonly consumed in some areas. The official name of the market is Tomohon City Faith Market. A number of animals whose meat is sold in this market include cats, dogs, bats, forest rats, wild boars, cattle pigs, snakes, etc. In this case, it is quite interesting to note that cats and dogs are not livestock that can be consumed, but wild animals and/or pets that should be human friends. The main problem in this study is the slaughtering method carried out by a number of Tomohon Market traders against cats and dogs which are considered very inhumane and against religious rules and laws. This study aims to determine the form of legal protection for wild animals that are abused and traded in the Tomohon Market, North Sulawesi. This research uses a descriptive empirical juridical method. The data sources used are primary, secondary, and tertiary data. The results of this study indicate that traders do not treat cats and dogs as they should in the Law and Animal Welfare, and many residents of North Sulawesi still consume these animals. It can be concluded that the trade in cat and dog meat is not only bad for animals, it is also bad for human health.

Abstract

This Governor Regulation does not yet provide a transition period for business actors in shopping centers and markets, as well as managers in supermarkets to ensure a transition from using single-use plastic packaging bags to more environmentally friendly packaging bags. There are no social sanctions for violators, this regulation only regulates administrative sanctions for business managers and actors who do not comply, such as reprimands, writing, forced money, license suspension, and license revocation. There is no follow-up to publishing which is subject to sanctions, such as including the names of managers or business actors who violate the website of DKI Jakarta or the mass media. This mechanism cannot work if the public does not know which business managers or actors violate it. The price of Eco-friendly Shopping Bags is not affordable so it is ineffective. The lack of replacements for plastic bags at affordable prices has actually led to the rampant smuggling of plastic bags.

Abstract

In an insurance agreement, both the policyholder (the insured) or the insurance company (the insurer) have their respective rights and obligations which are contained in the insurance policy. The policyholder himself has the main obligation, namely to pay the premiums to the insurance company in accordance with the amount and time of payment specified in the insurance policy. If the policy holder is negligent in carrying out his obligations, it will cause his insurance policy status to enter into a lapse state. When the insurance policy goes into a lapse state, the policyholder has the potential to lose the rights that he should have received from the insurance program he participated in. This happened to Molly Situwanda as the beneficiary of her husband's life insurance policy, Astiang. This life insurance policy was issued by the Panin Dai-Ichi Life Life Insurance Company in 2010. In 2016, on December 28, 2016, to be precise, premium payments for Astiang's life insurance policy were no longer made by him, which resulted in the policy being entered into a lapse. However, at that time the investment / unit value was able to cover the premium costs up to October 15, 2018. After that date there were no more premium payments made by policyholders, which resulted in Astiang's life insurance policy going into lapse status or being inactive.
