Abstract

Todays globalization has changed the lifestyle of Indonesian Muslim women, especially in college. Islamic values have been many abandoned by them. For example, we can see the ethics in dress and wear of hijab that has been far from Islamic sharia. As a speech says "Hijabi but naked". Many muslimah who use hijab but the beauty of body can still be seen by others. As if the use of hijab just follow the trend. The most feared thing is when the concept arises that the hijab is not an obligation for muslimah. To uncover this, as an educator, researchers feel obligated to bring back the muslimah students in accordance with the teachings of our prophet, Muhammad SAW. So this article designed the English materials about how to dress a muslimah based on Sunnah. This is development research, but focused on the design stage. The study resulted in the design of a valid English material after validated by the expert.

Abstract

Indonesia currently has only one criminal law, Kitab Undang-Undang Hukum Pidana (KUHP), which was enacted and inherited from our colonial government. There has been an effort to amend this law but up until now the amendment of this law is not enacted yet. In this law, there are only two types of sexual violence which have legal protection: rape and sexual molestation (pencabulan), while in the current reality, based on the reported cases to partners of Komnas Perempuan from 2001-2011, there are 15 types of sexual violence; and the number of sexual violence cases has been increasing. As a result, it is difficult for victims of the 15 types of sexual violence to have legal protection. This shows the existing hole in the lex generalis KUHP, which needs to be filled in by lex specialis law which specifically addresses sexual violence. Based on the need for legal protection for victims of various types of sexual violence and to protect women’s human rights, Komnas Perempuan and her partners have drafted the Elimination of Sexual Violence Bill since 2014. This Bill has become one of the priorities of the national legislation program since 2016, after the incidence of a gang rape to a school age child in Bengkulu. However, up until the end of September 2019, this Bill was not enacted yet. In addition, there has been currently opposition to this Bill from the conservative group, accusing that this Bill legalizes zina (extra marital sexual relationship) and LGBT.  This paper aims at elaborating the background, aims, contents and challenges to the enactment of the Elimination of Sexual Violence Bill. I will argue that this Bill offers both procedural and substantive justice for women and the marginalized groups, the majority victims of sexual violence.

Abstract

Customary land is claimed as a safekeeping of history that must be maintained, local wisdom is considered as a code of conduct, and forests and traditional land as a dependent space for communal living. Meanwhile, the pace of expansion of palm oil plantations by the private sector supported by the state through permit schemes has created resource conflicts in customary law areas that threaten the existence of Tau Taa Wana's cultural heritage. This threat to cultural heritage has pushed the indigenous women of Wana Posangke to carry out resistance movements to protect and maintain communal cultural identity. This means that expansion activities that threaten the existence of cultural heritage encourage the desire to protect and maintain cultural heritage.

This normative legal study was carried out by analysing of the decision of Padang Religious Court Number 0783/Pdt.G/2017/PA.Pdg and Number 0266/Pdt.G/2018/PA.Pdg as well as other secondary legal materials such as laws and regulations, Jurisprudence and other related books. The results showed that the husband's homosexual behavior was unknown to the wife since before marriage but they found it after a long time living the marriage life. Wives found their husbands having sexual relations or the husband himself confessed his actions. Based on the legislation, the wife as a disadvantaged person might file for divorce on the grounds that the husband behaves homosexually even though the regulation could only justify by mentioning a constant dispute. In addition, it was impossible for a marriage to be built and be able to achieve its goals when the husband was not only homosexual but also bisexual. Homosexuality itself in Islamic law was part of a heinous act which was severely punished by the culprit.

Abstract

This article discusses the neglect of matrilineal tradition by Pariaman society during the colonial era (1846-1922), based on a study of autobiography written by Me’ Saleh gala Datoe’ Oerang Kajo Basa. The book entitled Tjoerito Parasaian Me’ Saleh is a family historical note of successful trader in Pariaman. The society in Pariaman is known as heterogeneous in terms of ethnicity, cultures, and religion, in contrast to darek society that is known as homogeneous in the mentioned fields. The heterogeneity of the Pariaman society then forms a social relational pattern and it is a different form compared to the darek society. The autobiography illustrates that the cultural characteristics of Pariaman society in the beginning was formed by their interaction with foreign people from Aceh, Nias, Bugis, India, China, Madura, Arab, and European countries. Since then they became an open minded people and easy to adapt with new influences. This condition resulted some matrilineal tradition applied in darek was not implemented and obeyed in rantau.Â
