Abstract

Pretrial proceedings are a supervisory mechanism within the criminal justice system that aims to protect the rights of suspects from arbitrary actions by law enforcement officials. However, in practice, issues often arise regarding the limits of the pretrial judge's authority, particularly regarding the existence of a dictum or order (condemnatoir) to terminate an investigation. The research problem formulation in this study is whether the legal considerations of the pretrial judge in the Bengkulu District Court (PN) Decision Number 09/Pid.Pra/2024/PN.Bgl which terminated the investigation are in accordance with the provisions of the Criminal Procedure Code (KUHAP). The research method used is normative juridical with a statutory regulatory approach and case studies, through an analysis of the KUHAP and the Constitutional Court Decision Number 21/PUU-XII/2014. The results of the study indicate that the pretrial judge's authority should be limited to testing the validity of the investigator's actions, not taking over the authority to terminate the investigation, which is normatively attributed to the investigator. This decision substantively protects the suspect's rights, but is not fully in line with the principles of legality and legal certainty.

Abstract

The principle of fiduciary duty constitutes a fundamental obligation that must be upheld by the Board of Directors in managing company, as stipulated in Article 97 paragraphs (2) and (3) of Law Number 40 of 2007 concerning Limited Liability Companies. Directors may be held liable if they are proven to have acted negligently or unlawfully in performing their duties. The problem formulation in this article concerns the liability of the Board of Directors PT Sri Rejeki Isman Tbk, which suffered significant losses due to the misuse of company funds, with focus on the application the doctrine of piercing the corporate veil. This study employs normative legal research method with approach based on legal principles, utilizing secondary data consisting of primary, secondary, and tertiary legal materials, which analyzed qualitatively and concluded deductively. The results and conculicions indicate that the Board of Directors may be held personally liable due to indications of fiduciary duty violations, including the misuse of company funds for personal interests and disregard for the company’s interests. These findings affirm that the doctrine of piercing the corporate veil may be applied to overcome limited liability protection and impose personal liability on the Directors for the losses suffered the company.

Abstract

This study conducts a comparative analysis of the legal aspects and practices of halal food labeling in Indonesia and Pakistan, with the world's largest Muslim demographic (248.22 million out of Indonesia's 284.97 million population as of 2024). The problem statement is how food product labeling is regulated in Indonesia and Pakistan and how food labeling regulations are implemented and enforced in both countries. The research method applied was normative legal research. The results show that Indonesia is strong normatively (das sollen) through the integration of religion and law, but weak in execution (das sein) due to complex coordination and cases such as Ayam Goreng Widuran; Pakistan excels in consistency of sanctions (90% urban compliance) through PHA audits. The rechtsvergleichung discussion highlights the efficiency of Pakistan's single model versus Indonesia's hybrid model, with similarities in non-commercial consumer protection. The conclusion recommends reforms in Indonesia: integrated authorities, strict sanctions, and digitization to align das sollen-das sein and increase global halal competitiveness.

Abstract

The principle of popular sovereignty is the normative basis for the implementation of constitutional review of laws in Indonesia. In this regard, the Constitutional Court (MK) has a strategic role in ensuring that every piece of legislation is in line with the will of the people as mandated by the 1945 Constitution. The research question is: how does the MK position the principle of popular sovereignty as a basis for legal considerations in MK Decision Number 176/PUU-XXII/2024 and what are the implications for the practice of constitutional review? This research uses a normative legal research method, is descriptive in nature, uses secondary data obtained through literature studies, analyses data qualitatively, and draws conclusions deductively. The results of the study and conclusions show that the Constitutional Court not only conducts textual testing of norms against the 1945 Constitution, but also prioritises interpretations based on substantive democratic values, particularly in the protection of political rights and people's representation. This approach strengthens the function of judicial review as an instrument for safeguarding people's sovereignty, but at the same time raises debates about the limits of the judicial role and legislative authority.

Abstract

Disputes over trademark ownership often arise from business development, particularly in culinary businesses that are inherited or managed by more than one party. One example that has generated legal debate concerns the ownership of the trademarks Ayam Goreng Suharti and Ayam Goreng Ny. Suharti. Both trademarks use the same identifying element, namely the name “Suharti,” causing public confusion and raising questions regarding the lawful trademark owner under statutory regulations, as both trademarks are registered. This study examines the ownership of the two trademarks based on Law Number 20 of 2016 on Trademarks and Geographical Indications. The research employs a legal research method with a statutory approach and qualitative analysis. The results show that trademark ownership depends on the first to file principle. Accordingly, the party entitled to use the name “Suharti” as a trademark is Suharti and Bambang Sachlan Pratohardjo, who registered the “Suharti” trademark in 1992, while the “Ny. Suharti” trademark was registered in 2021. Under Law Number 20 of 2016, only the trademark registered first is accepted and protected. Divorce or the dissolution of a business partnership does not justify the registration of trademarks that fail to meet legal requirements.

Abstract

Indonesia bears a constitutional responsibility to ensure access to nutritious food as part of mandatory basic public services under Law No. 23 of 2014 on Regional Government. In practice, the implementation of the Free Nutritious Meal Program (MBG) on Bogor City has shown significant vulnerability to failures in food standardization, as evidenced by a mass food poisoning incident affecting 223 students on May 2025. This study examines the implementation of local government legal obligations and the factor hindering their effectiveness, particularly regulatory gaps. The research employs normative legal methods using statutory and case-based approaches, analyzed through descriptive-prescriptive techniques. The findings indicate that legal protection provided by the local government through the mayor and relevant local regulations governing food standardization. The study concludes that efforts to ensure food standardization in the MBG program are not yet optimal, highlighting the need for strengthened local policies, improved institutional coordination, and effective use of mayoral regulatory authority to achive sustainable legal protection

Abstract

The provision of Green Open Spaces (RTH) is an obligation of local governments as part of fulfilling the community's right to a good and healthy environment. Bogor city, as one of the cities with a high population density, faces serious challenges in maintaining a balance between urban development and environmental sustainability. The research question is: how does the Bogor City Government manage green open spaces from a good governance perspective? This study employs a normative juridical method, combining a regulatory and conceptual approach. It is descriptive in nature, utilizing secondary data that is then analyzed qualitatively, and conclusions are drawn deductively. The results of the discussion and conclusion indicate that, normatively, the Bogor City Government has an adequate legal framework for green space management; however, its implementation still faces obstacles, including limited land, weak supervision, and suboptimal community involvement. From a good governance perspective, green space management in Bogor city still needs to be strengthened in terms of public participation and accountability so that sustainable development goals can be optimally achieved.

Abstract

In the Indonesian economic system, there is a Debt Payment Obligation Deferral (PKPU) mechanism to prevent a company from becoming insolvent with regard to its assets. The PKPU mechanism involves a settlement agreement proposed by the debtor, which must be approved by the creditors. Once approved by the court, the result is a homologated settlement agreement. The problem formulation is how to regulate creditors who are late in registering their receivables in the PKPU process in Indonesia. The research method used is descriptive and normative, using secondary data supported by interviews. The results of the discussion and conclusion show that Law 37 of 2004 regulates late registration, but only for a period of two days of delay in Article 278 paragraph (3). Creditors who experience a delay of more than two days can file an appeal, which will then be assessed by the court based on the principles of justice and legal certainty. Although Law No. 37 of 2004 does not explicitly regulate creditors who are late beyond this period.

Abstract

Legal protection for Fixed-Term Employment Agreement (PKWT) workers is often vulnerable, especially in cases of unilateral Termination of Employment (PHK). This study aims to examine the legal protection for PKWT workers subject to unilateral PHK in Decision Number 361 K/Pdt.Sus-PHI/2024. The legal problem stems from the dispute between Aprianti Amir and KKB Selindo, where termination occurred citing failure to meet work targets. This research was conducted using the Normative Legal Research method, which is Descriptive Analytical, sourced from secondary data analyzed qualitatively so that conclusions can be drawn deductively. The result is normative protection is governed by the obligation to pay PKWT compensation (Article 17 GR 35/2021) and contract remainder indemnity (Article 62 Law 13/2003) if the termination is not due to the worker's fault. The PHI granted full rights, but the Supreme Court (MA) at the cassation level classified the inability to meet targets as "worker's fault," thus eliminating the right to contract remainder indemnity. Based on the research results, the conclusion that can be drawn is that legal protection for PKWT workers is limited. The MA's inconsistent interpretation of "worker's fault" creates legal uncertainty and reduces the protection guaranteed by regulations

Abstract

The presence of street vendors in the touristy locations of Bukittinggi City creates a contradiction between maintaining public order and supporting their economic life for local people. The management of street vendor impacts is a key function of the local government in controlling and regulating informal vending activities in public areas. This research examines the role of the Local Government in regulating street vendors in Bukittinggi Tourism Area based on Perda (Regional Regulation) Number 2 of 2024 concerning Public Order and Safety. This study is based on a normative legal methodology with statutory and conceptual methods. The results of this study demonstrate that the regulation serves as a legal foundation for policy-making, location designating by the Mayor, and its enforcement through administrative sanctions issued by regional police. But its application is not universal, mainly because the guidance, supervision, and integrated management are damaged. Thus, a broader and more durable approach is needed to reconcile public order and social justice.
