Abstract

Perkembangan praktik pemasaran, khususnya pada sektor produk elektronik, mendorong pelaku usaha menerapkan berbagai strategi untuk meningkatkan nilai transaksi, salah satunya melalui metode upselling. Strategi ini bertujuan mengarahkan konsumen untuk memilih produk dengan harga, kualitas, atau fitur yang lebih tinggi. Namun, dalam praktiknya, upselling kerap dilakukan tanpa transparansi informasi sehingga berpotensi merugikan konsumen dan melanggar ketentuan hukum. Penelitian ini bertujuan mengkaji secara normatif potensi pelanggaran Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen dalam penerapan metode upselling pada penjualan produk elektronik. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan konseptual melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa upselling pada prinsipnya diperbolehkan sepanjang dilakukan secara jujur dan transparan, sedangkan praktik yang menyesatkan, memaksa, atau tanpa informasi yang jelas berpotensi melanggar hak konsumen dan ketentuan UUPK. Oleh karena itu, diperlukan pengawasan yang efektif untuk menjamin perlindungan hukum bagi konsumen.

Abstract

The dispute over the determination of forest areas and the principle of state control rights is a public law issue related to the legitimacy of government actions and their compliance with Article 33 paragraph (3) of the 1945 Constitution. The determination of forest areas in Sukawangi Village arose due to the issuance of a Decree of the Minister of Foresty which triggered a tenurial conflict. The formulation of the problem in this study is how the mechanism for determining forest areas based on Law Number 41 of 1999 and Government Regulation Number 23 of 2021 and how to resolve forest area disputes based on the principle of state control rights through social forestry policies. Using empirical juridical research methods, data were collected through document studies and field observations. The results of the study indicate that the determination of forest areas in Sukawangi Village does not fulfill the principle of justice as stipulated in Article 2 letter c of Law 41/1999, the principle of participation and openness based on Article 68 paragraph (2) of Law 41/1999 in conjunction with Article 96 of Government Regulation No. 23/2021, and the principle of legal protection because the community is not involved in  determination process.

Abstract

Legal certainty regarding employment status serves as a fundamental element in protecting workers' rights. The problem of this study aims to analyze the disparity in legal protection concerning the determination of employment status between Indonesia and the Philippines through a comparative study of two contradictory court decisions. This research employs a normative juridical method with case and comparative approaches. The findings reveal a significant legal paradox. In Indonesia, Decision Number 56/Pdt.Sus-PHI/2024/PN Smg affirms a rigid legal formalism that causes atypical workers (golf caddies) to lose their substantive rights despite decades of service, due to the administrative non-fulfillment of the wage element. Conversely, in the Philippines, the ruling in Paolo Landayan Aragones v. Alltech Biotechnology Corporation applies the doctrine of perfection of contract, providing progressive legal protection to prospective employees from the moment of job offer acceptance, even before physical work commences. This study concludes that a reconstruction of Indonesian labor law is necessary to shift from a formal-procedural approach to one that is more responsive to material facts of economic subordination to achieve social justice

Abstract

Legal review of perpetrators of rape crimes with victims with disabilities in Court Decision Number 67/Pid.Sus/2025/PN.Lbb. The legal issues addressed are the conformity of imposed sanctions with Article 15 paragraph (1) letter h of Law Number 12 of 2022. The research employs a normative approach with descriptive characteristics through case study analysis, examining primary legal materials including statutory regulations and court decisions, along with secondary legal materials. Research findings indicate that the sanctions imposed in the decision have not fully complied with the provisions for sentencing enhancement as regulated in Law Number 12 of 2022, as the judge only applied Article 285 of the Criminal Code without considering special enhancement for victims with disabilities. In conclusion, the application of sanctions has not been optimal in providing legal protection for persons with disabilities and does not fully reflect comprehensive punishment objectives. Judicial prudence is required in considering victim vulnerability aspects to impose fair and proportional sanctions

Abstract

Import surges in international trade have the potential to cause serious injury to domestic industries, thereby requiring states to adopt lawful legal instruments to provide protection. One such instrument is the trade safeguard measure, which is regulated under the framework of the General Agreement on Tariffs and Trade (GATT) 1994 and the Agreement on Safeguards. This study aims to analyze the similarities and differences in the regulation of import safeguard mechanisms in Indonesia and Vietnam. The research employs a normative legal method with a comparative law approach through the analysis of statutory regulations and legal literature. The findings indicate that both countries adopt safeguard provisions based on international trade law. however, they differ in legislative structure, institutional design, and procedural mechanisms of implementation. In conclusion, these regulatory differences reflect variations in policy orientation and levels of legal certainty in each country, despite operating within the same international trade law framework.

Abstract

The principles of Good Corporate Governance and fiduciary duty constitute the fundamental basis for the management of company by the Board of Directors, as stipulated in Article 97 paragraphs (2) and (3) of Law Number 40 of 2007 on concerning Limited Liability Companies. This study focuses on accountability of the Board of Directors of PT Pertamina Patra Niaga in the case of crude oil and refined product governance, which resulted in losses to the company and were classified as state losses, particularly in relation to the failure to implement Good Corporate Governance principles. The research employs a normative legal research with a principles-based approach, utilizing secondary data analyzed qualitatively through deductive reasoning. The findings and conclusions indicate potential violations of fiduciary duty in the form of negligence in the principle of prudence, weak transparency, and inadequate internal supervision, thereby exposing the Board of Directors to possible personal liability and the loss of managerial discretion protection. These findings emphasize that the implementation of Good Corporate Governance principles serves as a key parameter in determining the scope of authority and responsibility of the Board of Directors.

Abstract

Corruption in Indonesia continues to occur systematically, including bribery involving state officials as recipients of bribes. The use of articles on bribery, particularly Article 5 paragraph 2 and Article 12 letter b, still causes legal uncertainty. The problem formulation in this study is: What are the provisions on recipients of bribes in criminal acts of corruption, particularly in Law Number 20 of 2001? A normative method was used in this study, which was descriptive in nature, using secondary data and primary data to support the secondary data. Data analysis was conducted qualitatively. The results of the discussion and conclusions of this study are to illustrate that Article 5 paragraph (2) and Article 12 letter b both regulate the acceptance of bribes, but have fundamental differences in the elements and characteristics of the offense. The difference lies mainly in the form of the offense, where Article 5 paragraph (2) requires intent, while Article 12 letter b uses reasonable suspicion or knowledge with a heavier criminal penalty. The similarity in the core of the offense and the difference in the elements of the offense have the potential to cause misinterpretation, so a careful understanding of each article is necessary.

Abstract

The Rail Clinic Program is an implementation of Corporate Social Responsibility (CSR) by PT Kereta Api Indonesia (Persero), which aims to provide free health services to communities living around railway lines. The issue is how to organize the Rail Clinic program as a form of CSR implementation by state-owned enterprises in the railway sector in Indonesia. The research method used is a normative, descriptive type of research with a legal approach, using primary, secondary, and tertiary legal materials that are analyzed qualitatively. The results and conclusion of the analysis of the implementation of the Rail Clinic Program are based on PT. KAI's internal regulations as outlined in the SOP with reference to Article 87 E of Law Number 1 of 2025, as well as sectoral regulations in the field of railways. This program has been implemented effectively by involving community participation and providing direct benefits for improving the welfare of communities around the railroad tracks, although health services are still incomplete and not supported by comprehensive health facilities. As a suggestion, the Rail Clinic Program should be optimized to provide better health services to the community.

Abstract

Confidentiality agreements in employment relationships often give rise to default disputes, especially when their clauses are considered to limit workers' rights. The formulation of the problem to be discussed is the consistency of the legal considerations of the panel of judges in resolving the dispute of the breach of confidentiality agreement, through the analysis of Decision Number 168/Pdt.G/2024/PN Jkt.Sel and Decision Number 155/Pdt.G/2024/PN Jkt.Sel. The research method used is normative legal research with an analytical descriptive nature, using secondary data in the form of laws and regulations, court decisions, and legal literature. The results of the study show that there are differences in legal interpretation, where one decision integrates civil law, labor law, and constitutional norms, while the other decision only focuses on the legal requirements of the agreement according to the Civil Code. The study's conclusions show that these differences reflect court inconsistencies that have the potential to reduce legal certainty and justice.

Abstract

Illegal fishing practices by foreign fishing vessels, especially Vietnamese-flagged vessels, still frequently occur in Indonesia's Exclusive Economic Zone (EEZ) in the North Natuna Sea. This phenomenon not only causes economic losses but also constitutes a violation of Indonesia's sovereign rights as regulated in the 1982 United Nations Convention on the Law of the Sea (UNCLOS). The problem aims to how law enforcement against foreign vessels conducting illegal fishing in Indonesia's EEZ and analyze the resolution of illegal fishing cases carried out by Vietnamese fishing vessels based on the provisions of UNCLOS 1982. The research method used is normative legal research with a statutory and conceptual approach, through a literature study of primary and secondary legal materials. The results and conclusion of the study indicate that Indonesia has a strong legal basis to conduct supervision, inspection, arrest, and legal action against foreign vessels in the EEZ based on Article 56 and Article 73 of UNCLOS 1982 and national laws and regulations. Illegal fishing cases are resolved through national legal mechanisms, while still respecting sanctions against foreign crews and supported by diplomatic efforts and bilateral cooperation. This law enforcement reflects Indonesia's efforts to protect its sovereign rights while respecting principles of international maritime law.
