Abstract

The COVID-19 pandemic has implications for the postponement of the Simultaneous Pilkades in Indonesia. It's interesting to examine more deeply how the Simultaneous Pilkades policy arrangements during the COVID-19 Pandemic are viewed from the aspect of legal certainty and the legal consequences of postponing the Pilkades during the COVID-19 Pandemic. The research method uses a normative juridical approach with the statute approach and case approach. Legal materials (primary, secondary ,tertiary) were collected through literature study and analyzed in depth using content analysis. Research shows that prior to the pandemic in the laws and regulations the rules regarding the postponement of Simultaneous Pilkades due to force majeure had not been regulated. The authority of the Ministry of Home Affairs to determine the postponement of the Simultaneous Pilkades also has multiple interpretations. The government's policy of issuing the Mendagri Circular is also inaccurate and does not provide legal certainty, the circular is not classified as a statutory regulation. The presence of Permendagri No.72 of 2020 provides legal certainty, the substance clearly regulates the authority of the Regent/Mayor to postpone the Simultaneous Pilkades. The legal consequence of postponing the Pilkades during the Pandemic Period is that many villages will be led by an Acting Village Head. In the future, the provisions regarding the postponement of Simultaneous Village Head Elections due to force majeure are clearly regulated in the legislation and in carrying out tasks by the Acting Village Head must be carried out with full responsibility, because the Acting has the same duties, authorities, obligations and rights as the definitive Village Head. Abstrak Pandemi COVID-19 berimplikasi pada penundaan Pilkades Serentak di Indonesia. Namun pengaturan ihwal penundaan Pilkades Serentak dalam peraturan perundang-undangan ternyata kurang jelas. Menarik untuk mengkaji lebih dalam bagaimana pengaturan kebijakan Pilkades Serentak di masa Pandemi COVID-19 ditinjau dari aspek kepastian hukum dan akibat hukum dari adanya penundaan Pilkades di masa Pandemi COVID-19. Metode penelitian menggunakan yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Bahan-bahan hukum (primer, sekunder, tersier) dikumpulkan melalui studi kepustakaan dan dianalisa secara mendalam menggunakan metode analisis konten. Penelitian menunjukan bahwa sebelum pandemi dalam peraturan perundang-undangan (UU, PP, Permendagri) aturan mengenai penundaan Pilkades Serentak karena force majeur (bencana non alam) belum diatur. Kewenangan Kemendagri menetapkan penundaan Pilkades Serentak juga multitafsir. Kebijakan pemerintah mengeluarkan Surat Edaran Menteri Dalam Negeri juga kurang tepat dan tidak memberikan kepastian hukum, surat edaran bukan dikelompokkan sebagai sebuah peraturan perundang-undangan. Akhirnya kehadiran Permendagri No. 72 Tahun 2020 memberikan kepastian hukum, subtansinya mengatur secara jelas kewenangan Bupati/Walikota menunda Pilkades Serentak karena situasi darurat COVID-19 serta mekanisme dan teknis pelaksanaan Pilkades Serentak dalam situasi darurat COVID-19. Akibat hukum dari penundaan Pilkades di Masa Pandemi adalah banyak desa yang akan dipimpin oleh seorang Penjabat Kepala Desa. Kedepan ketentuan mengenai penundaan Pilkades Serentak karena force majeur diatur secara jelas dalam peraturan perundangan-undangan dan dalam pelaksanaan tugas oleh Penjabat Kepala Desa harus dilakukan dengan penuh tanggung jawab, karena Penjabat memiliki tugas, wewenang, kewajiban dan hak yang sama seperti Kepala Desa definitif.

Abstract

Abstract The purpose of this paper was  to analyze the extent to which the law provides for legal protection for children involved in online prostitution  by using the media of chat applications.  The research method used is a normative legal research method with a statutory approach.  The results showed that for child offenders, provisions in Law No. 11/2012 concerning the Juvenile Criminal Justice System apply. Meanwhile, criminal acts that ensnare perpetrators such as pimps and also service users must also be subject to pidana in accordance with Law Number 17 of 2016 which stipulates the threat of punishment more severe than the Criminal Code.  The participation of the community, relevant institutions and also the government must be more active in following up on this case of online prostitution, the government must strictly revoke applications circulating in the virtual world and set penalties for perpetrators involved in this criminal act. Abstrak Tujuan dari penulisan ini menganalisis sejauh mana undang-undang mengatur tentang perlindungan hukum bagi anak yang terlibat dalam prostitusi online dengan mengunakan media aplikasi chatting. Metode penelitian yang digunakan adalah metode penelitian hukum normative dengan pendekatan peraturan perundang-undangan. Hasil penelitian menunjukan bahwa untuk pelaku anak, berlaku ketentuan di UU No. 11/2012 tentang Sistem Peradilan Pidana Anak. Sedangkan tindak pidana yang menjerat pelaku seperti mucikari dan juga pengguna jasa juga harus dikenakan pidana sesuai dengan Undang-Undang Nomor 17 tahun 2016 yang menetapkan ancaman hukuman lebih berat dibanding Kitab Undang-undang Hukum Pidana. Peran serta masyarakat, lembaga-lembaga terkait dan juga pemerintah haruslah lebih aktif dalam menindaklanjuti kasus ini prostitusi online, pemerintah harus tegas mencabut aplikasi yang beredar didunia maya dan menetapkan hukuman bagi para pelaku yang terlibat dalam tindak pidana ini.

Abstract

Article 1 of Law no. 1 of 1974 states that "marriage is physically and mentally between a man and a woman as husband and wife to form a happy family and based on the Almighty God". However, many problems in the household result in divorce, which causes various problems. One of the problems that occur as a result of divorce is child custody. One example is case decision number 1618/Pdt.G/2020/PA.Smp. This study aims to determine the basic considerations related to child custody following case decision number 1618/Pdt.G/2020/PA.Smp. In addition, it also aims to determine the obstacles in executing child care (Hadhanah) in the decision of the Sumenep Religious Court Number 1618/Pdt.G/2020/PA.Smp. This research is sociological juridical research using a statute approach and a case approach. Results Based on research and discussion, it is known that the Panel of Judges, in deciding this case, used Article 105 of the Compilation of Islamic Law, namely regarding the maintenance of children who are still not mumayyiz and also used the basis of legal considerations that are theoretically appropriate in terms of the principles that are the main reference in providing in the decision, the rules of Islamic law, as well as the provisions of the applicable laws and regulations.

Abstract

Legal protection for children who are victims of sexual crimes is a manifestation of the obligations given by the State specifically. One of these protections is the protection of the confidentiality of the identity of children who are victims of sexual crimes. This embodiment aims to prevent children from negative treatment from any party that can adversely affect their growth and development of children. It has been explained in the provisions of law No. 11 of 2012 concerning the Juvenile Criminal Justice System Articlen19 paragraph (1). However, there are still many identities of children in conflict with the law that are not kept secret in case decisions are published on the Supreme Court Decision Directory Site. Therefore, the researchers raised two problem formulations. First, how to protect the identity of child victims of sexual crimes according to the laws and regulations. Second, how to protect the identity of child victims of sexual crimes according to the Malang District Court Class IA. The research method used a sociological juridical approach to collect literature study materials and interviews. Conclusions and suggestions from writing this final project, namely Article 19 of Law Numbern11 ofn2012 concerning the Criminal Justice System regarding the identity of children who are victims of sexual crimes whose identities are published if there are parties who violate the law that has set them up. Strict sanctions.

Abstract

Currently, there are many types of investment and trading in Indonesia, one of which is the Binomo application. The public does not know whether the Binomo application is included in the legal or illegal investment category, and the public does not know what happens if a loss occurs. The problems raised by the author are to determine investments based on the perspective of civil law and determine the factors that cause people to be interested in illegal investment applications. The research method uses normative juridical, using library research, among others, researching favorable legal provisions and legal principles, books, or other documents related to the research being researched. Based on the research results, the Binomo application is part of the platform that provides securities transaction services and financial assets that do not have permission from the OJK and Bappeti, and binary options such as Bonomo are gambling. Some factors that make people tempted by this are low literacy, economic difficulties, and the number of people trapped by testimonials from people who have joined first. The public needs awareness regarding literacy that discusses investments from the government, Bappeti, and OJK, which are legal in Indonesia. Clear regulations are needed regarding applications from the Play Store, which should explain the details of the application, both from regulations and the system run by the application.

Abstract

A notary is a public official who has the authority to make an authentic deed, which is specifically licensed by the government to sign a document. As a notary, it is necessary to adhere to the guidelines, authority, and code of ethics when carrying out their duties, so that there is no violation of the code of ethics in carrying out their profession. The problems raised in this study are to find out how the process of revocation of a position in a notary is in the right way in accordance with the regulations of Law Number 30 of 2004, the position of a notary, and to find out and examine how to resolve the Administrative Court Decision Number: 235/G/2019/ PTUN.KT. The research method used in this research is normative juridical, namely research with literature studies using primary legal data and secondary legal materials. Based on the results of the study that in carrying out their duties, Notaries must obey and obey the professional code of ethics and be used as guidelines in carrying out their duties, namely the Law on Notary Positions No. 2 of 2014 concerning amendments to Law No. 30 of 2004 concerning Notary Positions. If a notary commits a violation of the code of ethics that is a serious violation, it can be proposed to give sanctions by being dismissed from his position in a dishonorable manner by the Minister at the suggestion of the Central Supervisory Council. Regarding the issuance of a ministerial decree, it is also necessary to apply the General Principles of Good Governance so that there is no cancellation of a disputed object decision because it does not issue the precautionary principle and the need to act according to the principle of accuracy in making a decision. So if there is an annulment of a decision made by the Minister of Law and Human Rights on a State Administrative Decision, it is necessary to have the responsibility to restore and restore the dignity of the Notary whose position is revoked.

Abstract

The Illegal logging is an organized illegal timber use activity. This crime is usually carried out by more than two people in a certain time for the purpose of destroying forests and selling wood products illegally. In Decision No.39/Pid.B/2015/PN.Sit the defendant Asyiani was dropped by a criminal witness of illegal logging thanks to a special criminal offense. Where the defendant has carried out illegal logging on Perhutani's land. The problem with this research is What is the basis for the judge's consideration in Decision No.39/Pid.B/2015/PN.Sit regarding the crime of illegal logging and How due to the law of Decision No.39/Pid.B/2015/PN.Sit about the crime of illegal logging is reviewed from the justice aspect. The research methods used are normative legal methods that use primary legal materials, secondary legal materials, tertiary legal materials and data analysis. The results of the study show less precisely the judge's consideration in the case against the defendant and the legal consequences reviewed from the aspect of pancasila justice were less appropriate because the defendant was given a probation sentence in which the criminal act of illegal logging was one special crime. The author's advice needs to be done with fair funding according to the crime committed by the defendant and this problem can be resolved by deliberation

Abstract

Crime of decency cannot be measured by age or characteristics because anyone can do it, including children. Actions that can be categorized as violating decency include intercourse. The crime of sexual intercourse is regulated in the Criminal Code articles 286-288 and regulated in the Child Protection Law Article 81. Sexual intercourse with children at the Batu Police is still some cases. This study aims to determine a series of investigators' actions to find and collect evidence of cases of sexual intercourse with children as perpetrators by the Batu City Police. The research method used is juridical sociology by looking at the law as human behavior in life. Batu City Police research location. From the results of this study, it can be concluded that a series of investigators' actions in investigating cases of sexual intercourse with children as perpetrators at the Batu City Police in general can be said to have not been maximized, there are still obstacles in practice such as (1) the time period from the report to the investigation stage cannot be ascertained, (2) there are obstacles in the examination of victims, some victims are reluctant to provide information, (3) the examination of witnesses becomes an obstacle because the crime of sexual intercourse is carried out in places that are rarely or known to witnesses, (4) examination of child suspects in practice the police have not used the familial method, (5) the arrests made by the investigators of the Batu City Resort Police were judged not to be in accordance with the provisions of the SPPA Law Article 30 paragraph (4) and strengthened by Perkap No. 8 of 2009 Article 21 letter d, (6) in the Bapas examination there was an error in the case file provided by the police and in the collection there were still obstacles, (7) lack of knowledge about the importance of the post-mortem this could have an impact on the results of the investigation.

Abstract

Abstract The purpose of this study is to determine the legality of the constitutional court as a party and at the same time as an adjudicator in disputes over the authority of state institutions. The research method used is the normative legal research method. The results showed that the 1945 Constitution never allocated the authority to test executive legal products in the form of Perppu to the Constitutional Court but to the DPR which is commonly known as legislative review. However, the Constitutional Court through decision No. 138/PUU-VII/2009 has added its authority, namely adding Perppu as the object of the litical test of the judicial review law. The consequence of the addition of the authority to test the Perppu is of course likely to cause a conflict of authority between the Constitutional Court versus the DPR. The problem is that the authority to torture and adjudicate legal conflicts between state institutions according to the 1945 Constitution must be carried out through the courts of the Constitutional Court. Therefore, the juridical problem that arises is whether there is legality or constitutionality of the Constitutional Court to try cases concerning its own interests, while on the other hand there is a doctrine of nemo judex idoneus in propria causa which means that judges are not fit to try themselves because of a conflict of interest or conflict of interest. Abstrak Tujuan dari penelitian ini adalah untuk mengetahui legalitas mahkamah konstitusi sebagai salah satu pihak dan sekaligus sebagai ajudikator dalam sengketa kewenangan lembaga negara. Metode penelitian yang digunakan adalah metode penelitian hukum normatif. Hasil penelitian menunjukkan bahwa UUD1945 tidak pernah mengalokasikan kewenangan untuk menguji produk-produk hukum eksekutif dalam bentuk Perppu kepada Mahkamah Konstitusi melainkan kepada DPR yang biasa dikenal dengan judicial review legislatif. Namun, Mahkamah Konstitusi melalui putusan No. 138/PUU-VII/2009 telah menambah kewenangannya, yaitu penambahan Perppu sebagai objek uji litical test uu judicial review. Konsekuensi dari penambahan kewenangan untuk menguji Perppu tentu saja kemungkinan akan menimbulkan konflik kewenangan antara Mahkamah Konstitusi versus DPR. Masalahnya, kewenangan penyiksaan dan mengadili konflik hukum antar lembaga negara menurut UUD 1945 harus dilakukan melalui pengadilan Mahkamah Konstitusi. Oleh karena itu, permasalahan yuridis yang muncul adalah apakah ada legalitas atau konstitusionalitas Mahkamah Konstitusi untuk mengadili perkara-perkara yang menyangkut kepentingannya sendiri, sedangkan di sisi lain terdapat doktrin nemo judex idoneus dalam propria causa yang artinya hakim tidak layak untuk mengadili diri sendiri karena adanya benturan kepentingan atau benturan kepentingan.
