Abstract

The provisions in the Omnibus Law of the Job Creation Law Number 11 of 2020 regulates one of them regarding land. This land regulates the authority of the state in regulating the designation, use and management of land which is manifested by the Government Regulation Number 64 of 2021 concerning the Land Bank Agency. The Land Bank Agency has the authority to prepare master plans, help provide ease of Business Licensing/approval, carry out land acquisition, and determine service rates. In practice, Land Banks generally have advantages and disadvantages that have an impact on national land law. This study uses a normative juridical method with a statutory approach and a conceptual approach, and legal materials are analyzed using a deductive method. This study aims to describe and explain the Land Bank regulation in the Job Creation Act and the Government Regulation concerning the Land Bank Agency and the implications for the national land law. The result of this research is the arrangements related to the land bank need to be amended to reinforce its authority as land management, especially overlapping authorities with the National Land Agency. It is also necessary to have clear, comprehensive and just legal instruments in which every activity carried out must meet the elements of openness and community participation to prevent abuse of authority from the Land Bank Agency. Abstract

The notary's responsibility for the notary's deed based on electronic transactions, including the protection of electronic information confidentiality relating to network networks in the electronic exchange of information.The notary's role in proving criminal matters against the deed he performs is limited to acting as an expert witness to justify what was seen or witnessed and what was not seen or witnessed. what was conveyed at the time the deed was drawn up The status of a notary deed in the form of a digital or cybernotary is covered by Article 187 of the Criminal Procedure Code, which governs the type of evidence. Since the Electronic System in a multiplication speaker produces information that can no longer be separated from him. To put it another way, their presence should be equivalent to or identical to written proof, such as a document, a forged deed, or an authentic deed. The power of digital proof of a Notary deed can be equated to that of an authentic deed if its authenticity is objectively assured, it can justify who the legal subject is responsible, and the electronic system is guaranteed to function properly (accredited). Abstract

One of the advances in the digital economy today is the adaptation of technology in the financial sector, also known as Financial Technology (Fintech). This financial technology will shift the conventional financial industry by reason of the high demands of society. One of the fintech products is the provision of information technology-based lending and borrowing services (Peer to Peer or P2P Lending). The flow of fintech shifts the trading transaction system, which was originally paper-based, to a non-paper-based (digital) transaction system. The parties involved themselves in economic transactions which were originally bound using conventional contracts, turned into electronic contracts. Legal issues arise regarding the legal validity of conventional contracts which are translated into electronic form. Therefore, it is necessary to study the validity of this electronic contract further as the basis for the engagement between the two parties that enter into an information-based lending and borrowing service.

Abstract

Transfer of land rights is more often carried out through buying and selling. In this research, the sale and purchase in question is the sale and purchase of land, with the aim that the buyer can use the land legally. Since the enactment of Law Number 5 of 1960 concerning Basic Agrarian Regulations (UUPA), the sale and purchase of land is further regulated in Government Regulation Number 24 of 1997 concerning Land Registration, which regulates that the sale and purchase of land must be proven by a deed made. on the land before the PPAT. However, buying and selling land without a PPAT deed or an authorized official is still carried out. The objectives to be achieved in this research are as follows: to determine the legal strength of the transfer of land rights with payment receipts in accordance with applicable legal provisions, namely from the perspective of agrarian law. to find out the form of dispute resolution resulting from buying and selling land with receipts. This type of article writing uses normative juridical, with a statutory approach, conceptual approach, and case approach. The results of the research explain that the receipt is categorized as a private deed which does not have binding legal force so that the buyer does not get legal certainty regarding his land. Conclusion Land dispute resolution can be resolved through litigation and non-litigation. Body land can be used in handling/resolving land disputes in accordance with its authority and applicable regulations, namely Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 21 of 2020 concerning Handling and Settlement of Land Cases, Presidential Regulation Number 48 of 2020 concerning the National Land Agency KEYWORDS: Legal Certainly, Transfer of Land Rights, Buying and Selling

Abstract

A notary of social institutions are in indonesia, of the needs arising from desires evidence any law keperdataan among mereka.akta authentic can result in dispute, so we needed evidence any written in the form of photocopies minuta and testimony a notary certificate. A notary can be checked as the officials who makes a covenant. Investigators, the public prosecutor and the judge called a notary and received a photocopy of certificate minuta. The legal status of the notary is as the manager of a mandate from the minister of justice and human rights in giving approval or rejection to be examined by a notary, investigators prosecutors and judges in the judiciary and the copy of deed minuta used as evidence a related reports of one party. The legal status is a situation when a party considered eligible to apply for dispute resolution. Abstract

Tanggung Jawab Sosial Perusahaan atau yang biasa dikenal dengan TJSL merupakan suatu kewajiban yang berbentuk program bagi perusahaan dengan maksud agar memiliki daya guna bagi masyarakat disekitarnya. Namun, kerapkali dalam implementasinya TJSL tidak dilaksanakan sesuai dengan kaidah yang sebenarnya. TJSL seringkali digunakan hanya sebagai alat pelengkap dari pemerintah agar perusahaan terhindar dari sanksi. Untuk mengantisipasi hal ini, pemerintah membuat regulasi yang mengatur tentang TJSL dalam pasal 74 Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas. Namun tampaknya banyak kelemahan yang masih dimiliki oleh peraturan tersebut. Terbukti dengan implementasi TJSL yang belum berjalan dengan maksimal. Maka oleh karena itu, diperlukan rekonstruksi peraturan TJSL di indonesia untuk memperbaiki implementasi program TJSL di indonesia.

Abstract

Bondowoso Regency Land Office is carrying out Complete Systematic Registration (PTSL) activities with 12 (Twelve) villages in Bondowoso Regency, one of which is in Mangli Wetan Village, Tapen District with the target of Land Rights Certificates (SHAT) and PBT (Map of Fields). Land) in the amount of 1600 (One Thousand and Six Hundred) plots of land which must be completed in 2022 (Two Thousand Twenty Two). Mangli Wetan Village is one example that indigenous peoples still maintain customary land law in Mangli Wetan Village with a large amount of uncertified land and land that has been transferred before the Village Head and crossed out in the Village registration book (Letter C). The research method used is socio-legal, by conducting research directly in society, to find out and understand the legal problems that occur and to deal with applicable laws and regulations. This study aims to determine the government's strategic program carried out by the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency through Complete Systematic Land Registration (PTSL), especially for lands recorded in the Village Registration Book (Letter C) whose rights have not been certified in Mangli Village. Wetan, Tapen District, Bondowoso Regency. The research method used is socio-legal, by conducting research directly in the community, to find out and understand the legal problems that occur and are faced with applicable laws and regulations. The belief in the existence of customary law that arises has become the foundation and stronghold for indigenous peoples to prevent disputes for the people in Mangli Wetan Village. Therefore, appreciation is needed for indigenous peoples in Mangli Wetan Village, Tapen District, Bondowoso Regency. KEYWORDS: Legal Certainly, Adat’s Society, PTSL Program.

Abstract

Perseroan Terbatas merupakan badan usaha yang berbadan hukum, sehingga Perseroan Terbatas termasuk dalam subjek pajak. Pengaturan terkait pajak dalam Perseroan Terbatas sudah ditetapkan dan sesuai dengan kententuan peraturan yang ada. Pajak Perseroan Terbatas dihitung dari jumlah pendapatan yang diperoleh Perseroan Terbatas tersebut dalam satu tahun operasi. Pengenaan pajak dalam usaha Perseroan Terbatas harus dilaksanakan dalam perolehan dan juga pendapatan Perseroan Terbatas terdapat Pajak yang harus dikeluarkan yang merupakan termasuk dalam kepentingan Perseroan Terbatas tersebut juga. Kewajiban perpajakan bagi perusahaan yang telah dinyatakan pailit telah diatur dalam ketentuan Peraturan Perundang-undangan, berdasarkan pada Pasal 32 Ayat (1) Undang-Undang Nomor 6 Tahun 1983 tentang Ketentuan Umum dan Tata Cara Perpajakan. Perseroan Terbatas yang dinyatakan Pailit dalam kepengurusannya telah dihentikan, maka dengan sendirinya Perseroan Terbatas tersebut tidak lagi dapat melakukan kegiatan usaha untuk dapat menghasilkan sebuah keuntungan yang menjadi sumber kewajiban pajak dari Perseroan tersebut. Perseroan sebagai badan hukum tidak lagi dapat dibebani pajak, terkecuali tetap membayar pajak yang masih terutang sebelum dinyatakan pailit.

Abstract

Dalam kehidupan masyarakat adanya hubungan pihak satu dengan pihak lainnya yang akan menyangkut antara hak dan kewajiban yang dimana hal itu akan banyak menimbulkan berbagai pelanggaran yang terjadi salah satunya peristiwa hukum. Notaris adalah pejabat umum yang diangkat oleh pemerintah untuk membantu masyarakat dalam hal perjanjian, satu satunya yang berwenang akta otentik. Tugas Notaris tidak hanya membuat akta otentik akan tetapi juga mendaftar dan mengesahkan surat dibawah tangan atau disebut Pada aspek pembuktian dipengadilan surat dibawah tangan yang telah diwaarmeking tidak mempunyai kekuatan pembuktian yang sempurna karena terletak pada tandatangan yang jika diakui, maka akta tersebut akan menjadi alat bukti yang sempurna seperti akta otentik.

Abstract

A medical record is a document made by a hospital containing the identity, examination, treatment, and medical actions taken against confidential patients. Medical records are medical secrets that can be shown or disclosed in certain situations, one of which is a pandemic situation. In the event of an outbreak of infectious disease, namely the COVID-19 pandemic situation, medical records belonging to COVID-19 patients can be used by doctors, hospitals, and researchers to identify and analyze the causes as well as be useful for the government to determine policy and regulatory directions to suppress virus transmission. Based on the Minister of Health Regulation on Medical Secrets which regulates the opening of medical records in a pandemic situation, there is a blurring of norms regarding legal certainty and procedures for opening medical records in a pandemic situation. To identify and analyze these problems, the researcher uses a normative legal research method with a conceptual approach and legislation. The results obtained that the opening of medical records of COVID-19 patients in a pandemic situation may only be opened to certain parties such as local government officials, hospital heads, and related parties who play a role in reducing the number of virus transmissions. In addition, the information in the medical record shown is only information related to epidemic control, so the patient's personal confidential information is maintained.
