Abstract

This study analyzes the integration of Restorative Justice principles within Indonesia's new Criminal Code (KUHP). The enactment of Indonesia's new Criminal Code (KUHP) represents a significant advancement in accommodating Restorative Justice principles. This approach prioritizes social harmony, offender rehabilitation, and victim rights as alternative resolutions. This normative legal study utilizes primary, secondary, and tertiary legal materials. The study finds that the new KUHP integrates Restorative Justice through provisions such as Article 51, which redefines the purpose of sentencing to emphasize offender education and rehabilitation aligned with ethical values, and Article 52, which reinforces the importance of human dignity. Furthermore, Article 132 supports extra-judicial resolutions by nullifying prosecutorial authority when such resolutions are achieved. Thus, the incorporation of Restorative Justice in the new KUHP lays a crucial foundation for a more equitable, inclusive, and humane criminal justice system.

Abstract

Intellectual Property Rights (IPR) in the international trade law system are regulated through several international agreements, including the provisions of Trade-Related Aspects of Intellectual Property Rights (TRIPS) and the General Agreement on Tariffs and Trade (GATT). The main objectives of international trade law are to maintain stability in global trade, prevent domestic policies that harm other countries, create a conducive and favorable trade climate for economic growth, and improve the standard of living of people globally. This research uses normative legal methods with statutory and conceptual approaches. This study focuses on the Tobacco Plain Packaging Act (TPPA) policy enacted by Australia. This policy is based on the Framework Convention on Tobacco Control (FCTC) issued by the World Health Organization (WHO) to reduce tobacco consumption. However, this policy conflicts with TRIPS principles related to IPR protection, particularly trademarks. The TPPA restricts the use of trademarks on tobacco packaging, by setting standards by prohibiting the inclusion of trademarks or other marks on tobacco product packaging, using standardized fonts, and requiring the use of uniform packaging for all tobacco products sold in Australia, by specifying color, shape, size, and layout. This is considered to be contrary to TRIPS principles, which protect trademark rights as part of non-discriminatory international trade. Nonetheless, under GATT Article 20 on General Exceptions, Australia's TPPA policy is considered legitimate as it aims to protect human life or health in formulating national laws in the public interest.

Abstract

The fulfillment of the rights of persons with disabilities in accessing employment is a significant issue in global legal and policy discourse. Despite various international instruments, such as the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD), calling for equal access to employment, the implementation of these rights still faces a gap between ideal legal norms (das sollen) and the reality of implementation (das sein). In Indonesia, although laws like Law No. 8/2016 guarantee the right of persons with disabilities to access employment, various barriers such as discrimination, limited accessibility, and low awareness of inclusion remain prevalent. This article analyzes this issue through the lens of two major thinkers in legal philosophy: H.L.A. Hart, who emphasizes the importance of primary and secondary rules and the role of the rule of recognition, and Lawrence Friedman, who highlights the role of legal structure, legal substance, and legal culture. By integrating these normative-analytical and sociological perspectives, this article provides a comprehensive framework that considers aspects of legal rules, institutional structures, and legal culture to understand the challenges in fulfilling the rights of persons with disabilities in the employment sector, particularly in Indonesia. Through this approach, this article offers policy recommendations focusing on strengthening the rule of recognition, clarifying legal norms, reforming institutional structures, and transforming legal culture to bridge the gap between das sollen and das sein, particularly in the context of developing countries like Indonesia, with the ultimate goal of achieving more effective inclusion in the labor market.

Abstract

This article examines how Finland and Germany integrate the principles of economic democracy within their legal frameworks to address unemployment challenges in the digital era. Digitalisation and globalisation have intensified unemployment as a multidimensional issue, linked to justice, inclusiveness, and human rights. The study explores legal mechanisms employed by these nations to uphold economic democracy and mitigate unemployment. Finland’s universal welfare model prioritises inclusiveness through comprehensive social support, while Germany’s social market economy achieves a balance between market flexibility and contribution-based protections. Both countries tackle digital challenges, including automation and unequal access to technology, by strengthening labour rights, promoting workforce education and retraining, and enhancing social protections. This comparative legal analysis highlights how robust legal systems can address the socio-economic impacts of digitalisation and provide a model for inclusive economic policies.

Abstract

Perkembangan zaman memberikan dampak signifikan terhadap berbagai aspek kehidupan, termasuk hukum waris Islam. Pergeseran paradigma sosial yang terjadi menyebabkan ketidaksesuaian antara hukum waris Islam yang tradisional dengan kondisi sosial saat ini, sehingga memerlukan inovasi dalam konsep waris Islam. Artikel ini mengkaji peran ijtihad progresif berbasis gender dalam putusan Mahkamah Agung terkait hukum waris Islam, dengan merujuk pada pemikiran Fazlur Rahman dan M. Hasbi Ash-Shidieqy. Menggunakan pendekatan deskriptif kualitatif, penelitian ini menggambarkan bagaimana ijtihad tersebut tercermin dalam keputusan Mahkamah Agung. Hasil penelitian menunjukkan kesamaan dalam analisis konteks antara pemikiran Rahman dan Hasbi, yang menekankan pentingnya pendekatan kontekstual dalam perumusan hukum Islam. Metodologi ini menghasilkan pembagian harta waris yang lebih adil antara laki-laki dan perempuan, dengan mempertimbangkan dinamika sosial saat ini, sehingga lebih relevan dan dapat diterima oleh masyarakat.
