Abstract

Adapun yang menjadi pokok permasalahannya adalah bagaimana cyberbullying yang terjadi di kalangan mahasiswa Fakultas Syari’ah dan Hukum UINSU, bagaimana analisis cyberbullying menurut hukum pidana Islam dan hukum positif. Artikel ini merupakan penelitian lapangan (field research) dengan mentode wawancara dan dokumentasi. Hasil penelitian mengenai cyberbullying yang terjadi di kalangan mahasiswa Fakultas Syari’ah dan Hukum UINSU memenuhi unsur-unsur yang diatur dalam cyberbullying. Dalam hukum pidana Islam sanksi terhadap pelaku cyberbullying adalah ta’zir yang hukumannya tidak ditentukan dalam Al-Qur’an dan Hadits, namun hukuman tersebut ditentukan oleh Hakim. Ketentuan larangan tentang cyberbullying dalam hukum positif diatur dalam Undang-Undang Nomor 19 Tahun 2016 Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik pasal 27 ayat 1,2,3,4 serta pasal 29 sanksi pidana atas perbuatan tersebut diatur dalam pasal 45 ayat 1,2,3,4 dan pasal 45 B artinya, untuk menentukan sanksi yang diterima bagi pelaku cyberbullying dilihat dari unsur-unsur perbuatan dan juga akibat yang ditimbulkan.

Abstract

Hibah merupakan pemberian yang dilakukan secara sukarela atau tanpa adanya paksaan dari siapapun dalam mendekatkan diri kepada Allah SWT tanpa mengharap balasan apa pun. [1]Karena itu, banyak dalil atau nash yang menganjurkannya. Dalam pelaksanaannya banyak hibah yang di tarik atau diambil kembali oleh pihak pemberi hibah dengan berbagai alasan, misalnya si penerima hibah tidak mendaftarkan ataupun membuat surat pembuktian pada saat peristiwa penghibahan itu terjadi dalam jangka yang cukup lama. Hal ini di ketahui setelah hibah terlaksana dan kedua pelaku pemberi dan penerima sudah meninggal dunia. Sebagai perumusan masalah yaitu apa saja faktor - faktor penyebab Hibah ditarik kembali oleh ahli waris dalam tinjauan hukum pada pasal 1668 KUHPer dan 212 KHI kasus kec. Delitua kab. Deli serdang ? Penarikan hibah di atur dalam ketentuan pasal 1688, yang mana dalam ketentuan pasal ini kemungkinan untuk mencabut atau menarik kembali atas sesuatu hibah yang di berikan kepada orang lain ada dengan di antaranya : (1) Karena syarat-syarat resmi untuk penghibahan tidak dipenuhi. (2) Jika orang yang diberi hibah telah bersalah melakukan atau membantu melakukan kejahatan yang bertujuan membunuh atau kejahatan lain terhadap penghibah. (3) Apabila penerima hibah menolak memberi nafkah atau tunjangan kepada penghibah, setelah penghibah jatuh miskin, Sedangkan ketentua dalam Pasal 212 Kompilasi Hukum Islam dengan sangat tegas menyatakan bahwa hibah tidak dapat ditarik kembali kecuali hibah orang tua kepada anaknya. Setelah melihat dari ke dua ketentua hukum tersebut dapat di simpulkan bahwa hal ini dengan pandangan KUH Perdata yang dalam pasal 1688 KUH Perdata bahwa hibah dapat di cabut kembali kecuali jika karena terjadi tiga hal sebagaimana telah disebut sebelumnya. Yang dimana ketentuan ini berbeda dengan ketentuan pasal 212 KHI menyatakan bahwa penghibahan tidak boleh ditarik melainkan penghibahan orang tua terhadap anknya. Oleh karena itu ketentuan hukum yang tertuang di dalam KUH Perdata pada pasal1688 lebih layak untuk di aplikasikan karena selaras/sejalan dengan ketentuan di negara kita yang cukup beragam cultural agama dan budaya serta tidak keseluruhan yang beragam islam. Walaupun islam lebih banyak populasinya dari pada agama lain akan tetapi negara kita bukanlah negara khalifah, sehingga menurut peneliti jika diterapkan di Indonesia peneliti lebih condong ke KUH Perdata . Di karenakan tujuannya untuk menjunjung tinggi Bhineka Tunggal Ika bagi sesama manusia dan menolak dari kefanatikan terhadap satu ketentuan. Adapun larangan penarikan hibah ini bisa di pastikan akan membawa kebahagian setiap umat Islam dan menghindari terjadinya perpecahan atau permusuhan. Akan tetapi ketika jika pembuktian dari peristiwa itu kurang maka lebih baik condong pada ketentua KUH Perdata yang sebelumnya peneliti paparkan diatas.Kata Kunci: Hibah, Penarikan Hibah, KUH Perdata, dan KHI

Abstract

General crime is defined as an act that violates legal regulations for which a person can be punished. Crime will exist if someone violates the law, either directly or indirectly, or in the form of negligence which can result in punishment. According to Article 28 G paragraph (1) of the 1945 Constitution, criminal acts violate a person's human right to feel safe. The author will review the problems that arise, namely: how to resolve brawls from the perspective of positive crime and Islamic crime. This research uses a normative juridical approach. The approach taken is based on primary legal sources and considers theories, concepts, legal principles and legal regulations that are relevant to this study. This approach is also called a bibliographic approach by studying books, statutory regulations and other documents related to the research. Because most brawlers themselves are children or teenagers whose age is not yet legally competent according to criminal law. The imposition of criminal penalties for children or teenagers is regulated in Article 59 paragraph (2) letter b of Law Number 35 of 2014 concerning Child Protection, that a child who is in conflict with the law is given special legal protection, namely: a) Humane treatment by paying attention to needs. according to his age. b) Separation from adults. c) Providing effective legal and other assistance. d) Implementation of recreational activities. e) Freedom from torture, punishment or other cruel, inhumane and degrading treatment. f) Avoidance of the death penalty and/or life imprisonment. g) Avoidance of arrest, detention or imprisonment, except as a last resort and for the shortest time. h) Providing justice before a juvenile court that is objective, impartial and in a trial that is closed to the public. i) Avoidance of publication of his identity. j) Providing assistance from parents/guardians and people trusted by the child. k) Providing social advocacy. l) Giving personal life. m) Providing accessibility, especially for children with disabilities. n) Providing education. o) Provision of health services. p) Granting other rights in accordance with statutory provisions. Public crimes are defined as acts that violate legal regulations so that a person can be punished.

Abstract

Domestic violence is a form of criminal act that can be subject to sanctions in the form of imprisonment or imprisonment as well as the impact it has on the victim. Domestic violence can be committed by one family member against another family member. Talking about violence is no longer taboo. The motive for domestic violence is often caused by disharmony in family relationships, economic problems, poor communication and so on. These various forms of violence have negative impacts on the victims, including psychological, mental and physical impacts carried out directly or indirectly by the perpetrators of domestic violence. The impacts caused by violence not only have an impact in the short term but also in the long term.

Abstract

This paper discusses the concept of Ta’zir Crimes in Islamic criminal law, which refers to criminal acts whose punishment is not clearly determined in the Qur’an and Hadith. Ta’zir crimes are different from hudud and qisas, where the punishment for violation is not expressly determined by the sharia, but rather left to the judge or authorized ruler based on the public interest and the principle of justice. This paper explains the definition, legal basis, types of ta’zir crimes and the various punishments that can be applied in this context. The legal basis for ta’zir crimes is taken from various sources, including verses of the Qur’an and the hadith of the Prophet that emhasize the importance of preventing crime and maintaining the public interest. The types of ta’zir crimes are explained based on the studied of Fuqaha who classify them into several catagories, depending on their nature and impact on society. In addition, this paper also describes the various types of punishments that can be imposed in ta’zir crimes, ranging from corporal punishment such as flogging and imprisonment to punishmentrelated to freedom and property. The overall discussion in this paper aims to provide a comprehensive understanding of the flexibility and relevance of ta’zir crimes in the context of enforcing Islamic law, as well as how sharia principles are applied in determining educative and preventive punishment.

Abstract

Drug abuse is one of the most serious challenges in modern society, affecting not only individuals who consume drugs but also families, especially children. In Indonesia, Law No. 35/2014 on Narcotics provides a strong legal basis to protect children abandoned by parents who are drug abusers. This study aims to analyze the legal protection provided by Law No. 35/2014 to children who are victims of this situation. Law No. 35/2014 states that children have the right to protection from all forms of violence, neglect and exploitation, including in the context of parents involved in drug abuse. The law stipulates that the government is responsible for providing protection, care and rehabilitation for children affected by drug abuse, and emphasizes that parental drug abuse cannot be used as an excuse to abandon a child. In addition, Law No. 35/2014 also provides a foundation for efforts to prevent drug abuse among adolescents and children, through education and socialization about the dangers of drugs and rehabilitation for drug addicts. Nevertheless, the implementation of this legal protection still faces various challenges. Lack of awareness of children's rights and access to adequate social services are often barriers to providing effective protection for children affected by their parents' drug abuse. Therefore, greater efforts are needed from the government, non-governmental organizations, and society as a whole to improve awareness, access to services, and legal protection for children in this situation.

Abstract

Criminal law in Islam is an integral part of the Islamic legal system that regulates the behavior of individuals in society. The concept of criminal liability is an important aspect of this legal system, which includes various rules and principles governing how individuals are held accountable for criminal acts committed. This research aims to explain the concept of criminal liability in Islamic criminal law, focusing on the main principles related to law enforcement and punishment. The research method used is a normative juridical approach, which involves the study of Islamic legal doctrine, analysis of Islamic legal texts, and comparison with other criminal law systems. The results show that in Islamic criminal law, criminal responsibility does not only include aspects of punishment for criminal acts, but also considers aspects of guidance and rehabilitation. Principles such as ta'zir, hudud, and qisas become the foundation for criminal liability in Islamic criminal law, with the aim of maintaining justice, order, and security in society. The conclusion of this research is that the concept of criminal liability in Islamic criminal law has great relevance in the context of law enforcement and social justice. However, the protection of human rights and the principles of justice must also be upheld in the application of Islamic criminal law. Therefore, further research and interfaith dialog are important to deepen the understanding of the concept of criminal responsibility in Islamic criminal law and its application in the contemporary context.

Abstract

In this journal, the author discusses the impact of divorce on children according to a review of Islamic law, Divorce is a break in the marital bond between the two parties, namely husband and wife due to the occurrence of a fractured family relationship disharmony on the basis of an internal factor or an external factor that occurs. As in the case of divorce, which often ends at the court, the divorce that occurs will of course also have legal consequences for husband and wife, children and joint property. In the family, religion and education are very important so that life in the household can be harmonious and there are fewer divorce cases, and can provide understanding so that parents who want to divorce can find out in more detail or better understand what impacts can happen to children, not only the impact but the law in divorce is also discussed in this journal, not a few are currently experiencing divorce and most of them already have children and in this problem will be studied using research methods with a qualitative approach, namely a research process and understanding based on methodology that investigates a social phenomenon and human problem.

Abstract

Immoral crime is one type of crime, especially when you see the object of being molested, namely a minor. Children are the source of implementing development in the future. As a future generation, it is necessary for children to do things that are detrimental to the child's personal self, especially if these actions are very disturbing for his future. In immoral crimes, many of the victims are minors, therefore parents must pay attention to the growth and development of a child and know the rights and obligations as parents and provide knowledge to children about the rights and obligations of a child in the family and in society. In committing a crime, the perpetrators of the crime will receive sanctions or punishments. We can find out how the process and trial procedures in cases of immoral crimes are and what are the obstacles in the examination process. In this case the punishment received must be in accordance with the crime committed.

Abstract

Human trafficking is a transnational crime that can be said to be rampant and is a form of violence against children and women, even a criminal act that is aften committed across national borders. The criminal act of human trafficking is a number of things that are the driving factors are the economy which is below the poverty line, family, environment, and ,education, especially children and women who are most vulnerable. This form of legal protection for children as victims of criminal acts of human trafficking provides legal assistance to children with the aim of protecting children’s right as victims of human trafficking can be fulfilled in the criminal justice process by demanding compensation rights that can be seen from the humanitarian aspect and the child’s human rights. The Indonesia government has also made efforts to prevent and overcome the problem of human trafficking in several ways, such as the establishment of law number 23 of 2002 concerning amendemen to law number 35 of 2014 concerning child protection, as well as law number 21 of 2007 concerning human trafficking.
