Abstract

Perkembangan digitalisasi keuangan publik telah mengubah tata kelola pembiayaan negara, termasuk pengelolaan instrumen Panda Bond, yang kini tidak lagi sekadar berfungsi sebagai instrumen utang, tetapi juga sebagai bagian dari ekosistem digital financial governance. Penelitian ini bertujuan menganalisis bagaimana konsep Digital Constitutionalism dapat menjadi kerangka normatif dalam tata kelola Panda Bond di Indonesia, serta mengkaji penerapan prinsip transparansi, akuntabilitas, dan perlindungan hak konstitusional dalam pengelolaan instrumen tersebut. Metode penelitian ini mengunakan penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan perbandingan. Bahan hukum diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan, doktrin hukum, serta literatur ilmiah mengenai Digital Constitutionalism, tata kelola keuangan digital, dan Panda Bond. Hasil penelitian menunjukkan bahwa digitalisasi seluruh siklus pengelolaan Panda Bond, mulai dari penerbitan, registrasi, penyelesaian transaksi, hingga pelaporan, menimbulkan implikasi konstitusional yang memerlukan penguatan prinsip rule of law di ruang digital. Konsep Digital Constitutionalism memberikan landasan normatif untuk memastikan bahwa tata kelola Panda Bond memenuhi prinsip transparansi, akuntabilitas, perlindungan data, partisipasi publik, dan penghormatan terhadap hak konstitusional warga negara. Penelitian ini menawarkan model Constitutional Digital Public Debt Governance sebagai konstruksi hukum baru yang mengintegrasikan prinsip-prinsip konstitusional ke dalam tata kelola digital pembiayaan negara. Model tersebut diharapkan menjadi dasar pengembangan regulasi pembiayaan negara berbasis teknologi yang adaptif, akuntabel, dan selaras dengan nilai-nilai konstitusi Indonesia.

Abstract

This research examines the legal framework governing the protection of traditional culinary heritage in the context of sustainable gastronomy tourism development in Indonesia, with the aim of proposing a comprehensive normative model that integrates intellectual property law, cultural heritage law, and sustainable tourism governance. A normative juridical methodology is employed, encompassing three complementary approaches: statutory analysis, conceptual analysis, and comparative legal analysis across four jurisdictions (Indonesia, EU, Republic of Korea, and Peru). Existing legal instruments including Law No. 28/2014 on Copyright, Law No. 20/2016 on Trademarks and Geographical Indications, Law No. 5/2017 on Cultural Advancement, the UNESCO Convention (2003), and the WIPO Treaty on Traditional Knowledge (2024) constitute foundational but incomplete protective mechanisms. Four principal legal challenges are identified: definitional ambiguity, registration barriers, enforcement deficits, and the tension between protection and accessibility. A five-pillar normative framework is proposed, encompassing legislative consolidation, institutional capacity development, enforcement strengthening, benefit-sharing mechanisms, and international diplomatic engagement, providing a policy roadmap for Indonesia to achieve world-class protection of its traditional culinary heritage.

Abstract

This study aims to analyze the effect of work motivation, work communication, and work environment on the performance of traffic police officers (Satlantas Polresta Banyuwangi) with work discipline as an intervening variable. The background of this study is based on the inconsistency of employee performance, particularly in aspects of discipline, communication, and coordination that are not yet optimal. This research uses a quantitative approach with data collection through questionnaires. The population consists of all members of Satlantas Polresta Banyuwangi, with a census sampling technique. Data analysis was conducted using Structural Equation Modeling (SEM) based on Partial Least Squares (PLS) with WarpPLS 8.0 software.The results show that work motivation and work environment have a positive and significant effect on work discipline and employee performance. Work communication affects work discipline but does not have a significant effect on performance. Work discipline significantly affects performance and is able to mediate the effect of work motivation and work environment on performance, but it does not mediate the effect of work communication on performance. The implication of this study indicates that improving employee performance can be achieved by strengthening work motivation, improving the work environment, and enhancing work discipline as a key factor

Abstract

The implementation of the Business Judgment Rule (BJR) in Indonesian State-Owned Enterprise (SOE) banking remains a significant legal issue due to the overlap between corporate law and anti-corruption law. Business decisions resulting in Non-Performing Loans (NPLs) are frequently interpreted as state financial losses, creating legal uncertainty and exposing directors to criminal liability despite acting in good faith. This study aims to examine the criminal liability of SOE bank directors in credit decision-making and to evaluate the effectiveness of the Business Judgment Rule in distinguishing legitimate business risks from criminal conduct. This research employs a normative legal (doctrinal) approach using statutory, comparative, and case study approaches. Primary legal materials include the Anti-Corruption Law, the Limited Liability Company Law, Law No. 1 of 2025 on State-Owned Enterprises, Financial Services Authority regulations, and relevant Constitutional Court and Supreme Court decisions. The findings indicate that the Business Judgment Rule has a strong legal foundation under Article 97 of the Limited Liability Company Law, Law No. 1 of 2025 on SOEs, and Constitutional Court Decision No. 62/PUU-IX/2013, which recognizes the separation of SOE assets from state assets. However, its implementation remains constrained by inconsistent judicial interpretation and the expansive application of anti-corruption provisions. Comparative analysis with the United States demonstrates that explicit recognition of BJR as a safe harbor provides greater legal certainty for corporate directors. Therefore, harmonization between corporate and criminal law, together with the explicit codification of the Business Judgment Rule within Indonesia’s anti-corruption legal framework, is essential to strengthen legal certainty, protect directors acting in good faith, and promote sound corporate governance in State-Owned Enterprises.

Abstract

The enactment of Law Number 1 of 2023 concerning the Criminal Code marks a paradigm shift in criminal law in Indonesia, no longer oriented toward retributive punishment but instead prioritizing a restorative approach through the principle of restorative justice. This change has implications for criminal law enforcement practices, particularly within the police service, which serves as the gateway to the criminal justice system. The application of restorative justice within the police is seen as an effort to provide a more humane and effective resolution of criminal cases, oriented toward restoring social relations between perpetrators, victims, and the community. However, its implementation still faces various normative and practical obstacles that have the potential to create legal uncertainty. This study aims to analyze the regulations and legal basis for the application of restorative justice principles in police services following the enactment of the 2023 Criminal Code and to examine the legal implications of its application on the effectiveness of criminal law enforcement in the North Sumatra Regional Police. The research method used is normative juridical, supported by empirical data through legislative, conceptual, and case approaches. Data was obtained through literature review, document review, and interviews with law enforcement officials regarding the implementation of restorative justice. The results indicate that normatively, the application of restorative justice has gained legal legitimacy through the 2023 Criminal Code, the Republic of Indonesia National Police Regulation Number 8 of 2021, and internal police policies. The implementation of restorative justice at the North Sumatra Regional Police has been applied to certain crimes through mediation and reconciliation between perpetrators and victims. However, in practice, obstacles remain, including the lack of uniform standard operating procedures, reliance on investigator discretion, and weak oversight. Therefore, regulatory strengthening, policy harmonization between law enforcement agencies, and increased police capacity are needed to realize a fair, effective, and accountable implementation of restorative justice.

Abstract

Detention is a form of coercive measure in the criminal justice process that limits a person's right to personal liberty, so its implementation must be based on the principles of legal certainty, limitation of authority, and protection of human rights. The formation of Law Number 20 of 2025 concerning the Criminal Procedure Code is part of the reform of the criminal justice system in Indonesia that aims to strengthen the protection of suspects' rights and create a more objective, proportional, and accountable detention mechanism. However, the application of subjective conditions for detention still has the potential to give rise to multiple interpretations and opens up wide discretion for investigators. This study aims to analyze the legal certainty of detention by investigators based on Law Number 20 of 2025, specifically regarding the regulation of detention conditions and limitations on the authority of coercive measures, as well as examine the concept of subjective conditions for detention from the perspective of due process of law and human rights protection. This study uses a normative legal research method with a statutory, conceptual, and case approach, which is analyzed qualitatively based on primary, secondary, and tertiary legal materials. The research results show that Law Number 20 of 2025 brings significant changes through the formulation of more objective and measurable detention indicators. This reformulation strengthens the principle of legal certainty and limits the authority of law enforcement officers in the use of coercive measures. Furthermore, this new regulation aligns with the principles of due process of law and human rights protection, as detention must be based on objectively verifiable facts and circumstances. However, its effective implementation still requires technical guidelines, effective oversight, and increased professionalism of law enforcement officers to prevent abuse of authority in criminal justice practices.

Abstract

Turkey represents a distinctive model of state-controlled secularism, in which religion is not institutionally separated from the state but is administered through the Diyanet İşleri Başkanlığı (Presidency of Religious Affairs). This study examines how state–religion power relations have shaped religious authority, socio-religious practices, and patterns of resistance from the Kemalist period to the Justice and Development Party (AKP) era. Employing a qualitative library research design, this study analyzes a purposively selected corpus of state policy documents, official Diyanet publications, peer-reviewed journal articles, scholarly books, and historical studies published primarily between 2011 and 2025, supplemented by seminal theoretical works. The data were examined using qualitative content analysis and interpreted through Michel Foucault's concepts of power, governmentality, and pastoral power. The findings indicate that state control over religious institutions encouraged the standardization of Sunni religious authority through Diyanet while limiting the institutional recognition of non-mainstream religious communities, particularly the Alevi community and several Sufi orders. The study further demonstrates that the transition from the secular-Kemalist establishment to the AKP government did not diminish state intervention in religious affairs but rather reoriented Diyanet from safeguarding republican secularism toward expanding Islamic-conservative religious discourse in the public sphere, thereby generating new forms of negotiation and resistance among secular and minority religious groups. This article contributes to the literature by offering a Foucauldian interpretation of Turkish secularism as a dynamic form of state-managed religious governance, highlighting the continuity and transformation of state power across different political regimes rather than a simple transition from secularism to religiosity.

Abstract

The increasing number of children actively using the internet nowadays raises concerns about their involvement in cyberbullying. However, the limited research on elementary school-aged children subjects poses an obstacle to implementing various actions such as prevention or intervention. The purpose of this research is to explore the prevalence and characteristics of cyberbullying in one of the elementary schools in Pekanbaru. This study employed a quantitative design by collecting data through distributing questionnaires. Involving 148 students from one of the elementary schools in Pekanbaru (M = 11 years, SD = 0.87). In data processing, the researcher used descriptive statistics. The results of this study indicate that approximately 46.7% (N=69) of students reported being victims of one or more forms of cyberbullying behavior, 29.7% (N=44) engaged in one or more forms of cyberbullying behavior, and 50.7% (N=75) witnessed one or more forms of cyberbullying behavior among their peers in the past six months. This study provides information on the prevalence, forms of behavior, roles, and patterns of internet use related to cyberbullying among students. Empirical evidence suggests considering preventive efforts in grades below grade VI, with the aim of preventing cyberbullying behavior before it becomes more frequent.

Abstract

Artikel ini bertujuan  menganalisis penyelesaian perkara melalui keadilan restoratif melalui integrasi dengan hukum adat (living law) pada tingkat penyelidikan dan penyidikan di kepolisian. Metode yang digunakan adalah pendekatan kualitatif, bertujuan untuk memahami secara mendalam mengenai proses integrasi penyelesaian tindak pidana  melalui  keadilan restoratif dengan hukum adat. Disamping itu, penelitian ini   menggunakan pendekatan normatif, yang mengkaji secara komprehensif terhadap literatur, peraturan perundang-undangan dan kebijakan yang relevan di Kabupaten gunung Mas. Data yang digunakan adalah  data sekunder berupa perundangan dan data lainnya yang berkaitan dengan penulisan, serta data primer melalui wawancara, studi dokumen, dan observasi dengan melibatkan penyidik, korban, pelaku,  tokoh adat dan masyarakat. Analisis data dilakukan dengan membandingkan temuan antarsumber data (triangulasi),  pengecekan ulang dengan informan (member checking), serta memastikan konsistensi antara data empiris dengan teori dan peraturan perundang-undangan yang relevan. Penyelesaian perkara dengan melakukan integrasi keadilan restoratif dengan hukum adat mengalami peningkatan dari tahun 2022 sampai dengan tahun 2024 sebanyak 63 kasus. integrasi konsep keadilan restoratif dalam penyelesaian tindak pidana melalui hukum adat merupakan bentuk adaptasi penegakan hukum terhadap nilai sosial yang hidup dalam Masyarakat. Namun demikian, pelaksanaannya masih menghadapi beberapa kendala, antara lain belum adanya standar operasional prosedur yang secara khusus mengatur mekanisme koordinasi antara kepolisian dan lembaga adat, keterbatasan pemahaman penyidik terhadap dinamika hukum adat, serta perlunya mekanisme dokumentasi dan pelaporan yang lebih sistematis. Oleh karena itu, diperlukan peraturan khusus, agar penyelesaian keadilan restoratif dengan hukum yang hidup dalam masyarakat menjadi putusan yang dibenarkan oleh hukum. Di samping itu, diperlukan petunjuk teknis di kepolisian tentang tata cara penyelesaian keadilan restoratif dengan mendasari penyelesaian melalui  hukum yang hidup dalam masyarakat / adat.

Abstract

Pencabutan sertipikat hak atas tanah terlantar oleh pemerintah yang didasarkan pada Peraturan Pemerintah No. 20 Tahun 2021 jo. Undang-Undang No. 6 Tahun 2023 tentang Cipta Kerja kerap menimbulkan sengketa kepemilikan di masyarakat. Penelitian ini bertujuan menganalisis legalitas pencabutan sertipikat tanah terlantar dan mengidentifikasi faktor penyebab munculnya sengketa menggunakan pisau analisis Teori Keadilan, Teori Kepastian Hukum, dan Teori Pelanggaran Hak Asasi Manusia. Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa meskipun pencabutan telah memiliki dasar hukum, kelemahan dalam mekanisme penetapan tanah terlantar menyebabkan pelanggaran terhadap asas kepastian hukum Gustav Radbruch, tidak terpenuhinya keadilan prosedural John Rawls, serta terjadinya pelanggaran hak milik sebagai bagian dari Hak Asas Manusia. Oleh karena itu, diperlukan rekonstruksi norma yang menjamin keseimbangan antara fungsi sosial tanah dengan perlindungan hak asasi manusia.
