Abstract

The Gofood service or feature in the Gojek applications is a transaction service or buying and selling of food between customers and restaurans or sellers through drivers on the Gojek application. Online services provided by the Gojek application are online buying and selling transactions with the Gofood system where there are two types of contracts carried out in one transaction, namely transactions with wakalah contracts and transactions with ijarah contracts. In this study, the authors use qualitative research or field research by collecting information directly from the object of research through interviews and documents. The data sources in this study are Gojek drivers and customers of the Gojek application, service feature. The results of this study indicate that the implementation of al-uqud al-murakkabah fulfills. In this study, the formulation of the problem is: what is the mechanism for implementing Al-Uqud Al-Murakkabah in online transactions with the Gofood system and how is the mechanism for implementing Al-Uqud Al-Murakkabah in online transactions with the Gofood system in the perspective of muamalah fiqh. the pillars and conditions in the wakalah and ijarah contracts in the perspective of Muamalah fiqh.

Abstract

KSPPS BMT Bahtera Pekalongan is one of the Islamic Microfinance Institutions that is in great demand by the public. One product that is attractive and in great demand is ultra-micro financing, because this financing is affordable by the general public. The micro-ultra financing product contained in BMT Bahtera Pekalongan is interesting to study regarding whether this product is in accordance with the principles contained in the DSN Fatwa, considering that the DSN Fatwa is one of the legal bases that guides Islamic Financial Institutions in the operation of their products, therefore all products offered by Islamic Financial Institutions must adhere to the relevant DSN Fatwa. This research is an empirical legal research with qualitative descriptive data presentation. The results of the analysis show that the practice of ultra micro financing in KSPPS BMT Bahtera Pekalongan is in accordance with the provisions contained in the DSN-MUI Fatwa No. 119 of 2018 concerning ultra micro financing. The suitability of ultra-micro financing practices carried out by KSPPS BMT Bahtera Pekalongan is mandatory, because the DSN fatwa on ultra-micro financing is binding on Islamic financial institutions that have ultra-micro financing products, including KSPPS BMT Bahtera Pekalongan.

Abstract

The increase in civil cases that entered in the Court, prompting the MA to issue PERMA No. 1, 2016, on mediation procedures in court. The success of mediation in resolving cases in court is also found in the Pekalongan District Court, the Pekalongan District Court which has 2 (two) jurisdictions, namely Pekalongan City and Pekalongan Regency with data sources on the number of lawsuits from 2019 to December this is 46 (forty) six) cases, specifically cases with register number 13/Pdt.G/2019.PN.Pkl can be resolved through a mediation process without having to go through a long trial. This type of research is used libraryresearch with perprobleman this research 1) the mediation process and the obstacles faced in resolving civil disputes in the District Court Class IB Pekalongan City (Verdict No. 13 / Pdt.G / 2019 / PN.Pkl) 2) Juridical review of mediation practices conducted in resolving civil disputes in the District Court Class IB Pekalongan (Verdict No.13 / P Dt. G/2019/PN.Pkl). Teknik data collection used is library materials according to object studies. As for analyzing the data obtained, the author uses content analysis techniques. The results showed that: The Mediation Process that took place in the Pekalongan City Court Class 1B in decision No. 13 / Pdt.G / 2019 / PN.Pkl has been done well. In mediation conducted by mediators successfully help the parties to the dispute resolve the problem through mediation by agreeing to make peace with evidence of a deed of peace.

Abstract

Loss of Financing at KSPPS BMT Bahtera Pekalongan since 2021 has counted 75 customers with problems. Some Efforts have been made to deal with problematic financing at KSPPS BMT Bahtera Pekalongan. However, many customers are still experiencing financing problems. Therefore, the authors are interested in studying the Problem Financing Resolution Strategy. The approach used in this research is a qualitative approach, namely research procedures that produce descriptive data in the form of case studies, the type of research is in the form of case studies. The results of this study are the problematic financing factors, namely the presence of internal and external factors. There are 2 factors that cause financing. The first factor is the lack of good understanding of the customer's business and internal factors, namely the lack of customer financial evaluations and others. The second factor, namely the external factor of the negligence of members to pay installments or procrastination, the natural factors that are currently happening, namely the Covid-19 disaster and others. The strategy for resolving non-performing financing is notification by telephone or cellphone, giving billing letters, rescheduling, extending the term, extending the installment period, re-conditioning, rearranging, confiscation of guarantees and executing guarantees, and the last strategy is not to do anything. cooperation with problematic members for the long term, and must be careful in selecting prospective members of the BMT.

Abstract

This journal examines the implementation of contracts used in buying and selling using kreweng money in Minggon Jatinan, the urban forest of Rajawali Batang, Central Java. This study aimed to analyze the consumer's muamalah by exchanging kreweng money and between consumers and food sellers. In addition, this research also provides an overview of the right way to make transactions at tourist attractions. As well as explaining the law of transactions using kreweng in buying and selling food. The research method used in this study is a field research method with descriptive analysis, namely the discussion obtained by collecting data from interviews and library sources about buying and selling contracts which are then compared with the maslahah theory. From the results of this study, the authors describe that there are two contracts in the transaction in minggon jatinan, in this buying and selling transaction, consumers use kreweng money as a medium of exchange. Kreweng money when converted to rupiah has a value of Rp. 2,000.00. The way to get it is by exchanging rupiah with kreweng money that the officer has provided on the spot.

Abstract

This article discusses Ibn Taimiyah’s thoughts on equal wages and their relevance to Law Number 13 of 2003 concerning Manpower. Ibnu Taimiyah argues that in economic transactions, there must be justice, all contracts must be based on the ability of all parties to agree, including in terms of workers' wages. According to Ibn Taimiyah's view, the concept of equal wages is when wages between workers and employers are determined from bargaining between the two parties. In Law Number 13 of 2003 concerning Manpower, the provisions regarding wages are discussed in articles 88 and 89, and it is stated that every worker has the right to receive wages for a decent life. This study describes Islamic economic thought according to Ibnu Taimiyah about equal wages and how it is relevant to wages in the provisions of Law Number 13 of 2003 concerning Manpower. The method used is a qualitative research method. The data obtained are presented and described into a relevant analysis to conclude from the exposure of the two concepts. The analysis results show that the concepts of equal wages and wages in Law Number 13 of 2003 concerning Manpower both determine wages for workers. In the concept of equal pay, if wages are not specified in the contract, the wages allocated are commensurate through clear wage standards or the usual wages for the job. Entering Law Number 13 of 2003, the existing wages can be equated with the minimum wage as regulated in Article 88.

Abstract

The importance of halal food for Muslims, therefore paying full attention to food from animal sources that will be consumed is important. Especially in the process of slaughtering and processing it. The slaughter of chickens in a chicken slaughter house is in accordance with Islamic Syari’ah because it has fulfilled the pillars and conditions for slaughtering.The method used in this research is field research. The data sources used are primary data and secondary data. Throught a qualitative approach by means of a deduktive method. Then from these facts are analyzed according to related theories and consclusion can be drawn.”Based on the analysis that has been done, it can be concluded that the practice of slaughtering chickens is appropriate. However, for the aplication of Halal certification to the relevant institutions, to obtain certification to guarantee the halalness of chicken meat products must be completed first in accordance with the act.”

Abstract

Lately, in Indonesia, food and beverage products are rife that use scary names. In Pekalongan itself there are also restaurants or home products that use scary names, including: Mie Setan Geprek; Satan's Botok and Devil's Claw Mbak Ilma. Therefore, it is important to know how to use these names in the perspective of Islamic law. This research is an empirical legal research using a sociology of law approach. The results of this study indicate that in positive law there are no rules that prohibit the use of scary words for food labels, so it is okay to use scary words on food product labels. However, according to Islamic business ethics and MUI Fatwa Number 4 of 2003 concerning Standardization of Halal Fatwa, food product labels should not use the word scary because it is not in accordance with Islamic law. The importance of food products using names that are in accordance with Islamic ethics is also in line with the enactment of Law Number 33 of 2014 concerning Halal Product Guarantee where food products must have a halal certificate, while one of the requirements to be certified halal is to meet the criteria set by MUI considering BPJH cooperate with MUI in issuing decisions to determine halal products.
