Primagraha Law Review mainly focuses on theoretical as well as practical aspects of law. This journal is a media for national (and international) legal scholars, academicians and legal practitioners to voice their legal opinions or publish their research. Articles to be published comprises of legal scientific articles, legal research reports, book reports or analytical essays on legal practice as well as legal thinking written by academicians or legal practitioners. These may include but are not limited to various fields such as civil law, criminal law, constitutional and administrative law, air and space law, customary institution law, religious jurisprudence law, international regime law, legal pluralism governance, and another section related to contemporary issues in legal scholarship. Primagraha Law Review is taken by adapting the name of the university which focuses on the field of law. This journal is published by Faculty of Law, Primagraha University twice a year (March and September).

Abstract

Investment is the allocation of capital or resources with the aim of gaining profits in the future. Foreign investment is often considered the primary driver of economic development as it can increase the amount of capital available for development, create jobs, and introduce new technologies and management skills. In Indonesia, investment activities are regulated under Law Number 25 of 2007 concerning Investment and Law Number 6 of 2023 concerning Job Creation, widely known as the Omnibus Law, which also regulates investment. Despite having various regulations, the protection mechanisms are often debated, especially when conflicts arise between foreign investors and the government or local parties. Therefore, it is important to study how legal protection and dispute resolution related to foreign investment in Indonesia are addressed. The research method used in this study is normative with a comparative, legislative, and analytical approach. The types of data used in this research are primary and secondary data, where primary data consist of legislation, while secondary data consist of published documents that are not in official form, including legal textbooks, legal journals, legal papers, and so forth. The data analysis technique is qualitative and presented descriptively by explaining, describing, and illustrating issues closely related to the topic, then drawing conclusions based on analysis using deductive logic in line with prescriptive discipline. The results of the study show that both Law Number 6 of 2023 and Law Number 25 of 2007 provide legal protection to foreign investors, although the focus and approach used to provide such protection differ.

Abstract

The current phenomenon of climate change is a significant global issue, particularly affecting coastal regions like the Caribbean. The impacts of climate change disrupt stability across various sectors of human life. Consequently, many individuals are compelled to flee their home countries, leading to the emergence of term used to describe those who relocate due to climate-related challenges in their homeland. The purpose of this study is to assess the legal protections available for climate refugees, with a specific focus on the Caribbean, in light of global climate change and the challenges faced both currently and in the future. The research employs a normative legal methodology, which seeks to identify legal rules, doctrines, and principles to address the legal issues at hand, ultimately generating new arguments, theories, or legal concepts in response to these challenges. This research approach incorporates both a legislative and a conceptual framework. The legal materials utilized in this study include primary legal sources, secondary legal sources, and non-legal materials, gathered through literature review techniques. The findings and conclusions of this study aim to advocate for legal protections for climate refugees in the Caribbean, despite the absence of a clearly defined convention governing this issue. The efforts to provide legal protection can be categorized into three aspects: first, human rights; second, the role of states or international organizations; and third, international regulations.

Abstract

With  the  Covid-19  pandemic  that  has  hit  all  of  Indonesia,  it  has  caused  losses  that  have  had  a  huge  impact  on  people's  lives.  This  of  course  not  only  has  an  impact  on  the  central  government  but  also  has  an  impact  on  regional  governments  because  each  region  has  its  own  responsibility  to  protect  and  serve  the  community.  in  the  region,  in  this  way  the  regional  government  also  gets  a  very  pronounced  impact,  especially  in  the  Original  Regional  Income  (PAD)  sector.  Original  Regional  Income  itself  is  very  important  for  regional  governments  because  Original  Regional  Income  itself  is  one  of  the  sources  of  regional  government  financing  and  regional  development,  In  ithe  future,  Regional  Original  Income  will  be  used  to  finance  expenditure  from  the  regional  government  itself  and  for  development  costs  for  the  region  itself,  for  example  the  development  of  tourist  areas,  government  programs  that  benefit  the  community  and  the  regional  government  itself,  and  so  on.  In  the  explanation  above,  of  course,  in  implementing  this  regional  program,  there  are  of  course  obstacles.  With  the  obstacles  that  arise,  they  must  be  resolved  and  there  must  be  a  solution  that  might  or  could  be  implemented  in  other  regions  and  be  beneficial  for  other  regions  in  terms  of  the  Agrarian  Regional  Program.

Abstract

Activities in exchanging information and sharing knowledge through internet network-based facilities are one part of Digital Literacy. However, these information exchange activities are sometimes vulnerable to leakage of confidential information. One of them is related to the case of uploading state documents containing confidential information on the SCRIBD website. In this article written using normative legal research methodology, primary legal sources from legislation regarding the operation of electronic systems and secondary legal materials in the form of books and articles on informatics law are used. The resulting conclusion is that regulations in Indonesia need to be updated in an effort to hold electronic system operators legally accountable for uploading documents that are prohibited by statutory regulations.
