Abstract

ABSTRACTLaw enforcement against delicta jure gentium perpetrators can be done by using the direct enforcement system, indirect enforcement system, and hybrid model mechanisms. In addition, there is another mechanism known as transitional justice. The transitional justice process opens opportunities for perpetrators of delicta jure gentium to be granted amnesty or forgiveness. This is inversely proportional to the Rome statute which does not recognize amnesty for the various international crimes that have occurred. Transitional Justice has been carried out in the Apharteid case in South Africa, the Furundzija ICTY case and the Cavollo case in Argentina. In Indonesia, the Transitional Justice mechanism is expected to be able to resolve various crimes that have occurred in the past, one of which is the G30S. This study uses a normative method through library research. The purpose of this study is to examine whether the provision of amnesty has a strong foundation in international criminal law enforcement and how the apartheid case in Uruguay compares to the case of G30S in Indonesia. The results of the research show that amnesty can only be carried out through revealing the truth for the sake of national reconciliation, and the crimes committed have political motives. It is important for the victim or the victim's family to forgive, and giving compensation and rehabilitation for the victim or the victim's family.Keywords; Transitional justice, amnesty, international crime.ABSTRAKPenegakan hukum terhadap pelaku delicta jure gentium dapat dilakukan dengan menggunakan mekanisme direct enforcement system, indirect enforcement system, dan hybrid model. Disamping itu, terdapat mekanisme lain yang dikenal dengan istilah transitional justice. Proses transitional justice membuka peluang para pelaku delicta jure gentium diberikan amnesty atau pengampunan. Hal itu berbanding terbalik dengan statuta roma yang tidak mengenal pemberian amnesty terhadap berbagai kejahatan internasional yang telah terjadi. Transitional Justice pernah dilakukan pada kasus apharteid di Afrika Selatan, kasus Furundzija ICTY dan kasus Cavollo di Argentina. Di Indonesia, mekanisme Transitional Justice diharapkan dapat menyelesaikan berbagai Kejahatan yang pernah terjadi di masa lalu, salah satunya adalah G30S.  Penelitian ini menggunakan metode normative melalui penelitian kepustakaan. Tujuan dari penelitian ini adalah untuk mengkaji apakah pemberian amnesty memiliki landasan yang kuat dalam penegakan hukum pidana internasioal dan bagaimana perbandingan kasus apartheid, Uruguay dengan kasus Gerakan 30 September di Indonesia. Hasil penelitian menunjukkan bahwa pemberian amnesty hanya dapat dilakukan melalui pengungkapan kebenaran demi rekonsiliasi nasional, serta kejahatan yang dilakukan memiliki motif politik. Selain itu penting adanya pemaafan oleh korban atau keluarga korban, dan dilakukan ganti rugi dan rehabilitasi bagi korban atau keluarga korban.Kata Kunci; Keadilan Transisional, Amnesti, Kejahatan Internasional.

Abstract

Law enforcement against international crimes has its own system that is different from the national law enforcement system, as discussed in the previous paper related to the investigation of international criminal cases, it shows that there are fundamental differences, such as the initial process of investigation and law enforcement officials to the judicial system. In this paper, the author will focus on the discussion of the mechanism for the preliminary examination (Pre-Trial) in the International Criminal Court and the pretrial mechanism in the Indonesian criminal justice system. This study uses a normative juridical approach, which is a research conducted using a statutory or written regulation approach. The results show that the pre-trial chamber institution as regulated in the 1998 Rome Statute is very important to be adopted by the Indonesian government in the draft Law Code. Criminal Events. This is considering the advantages of implementing the pre-trial chamber system as an effort to supervise the actions of investigators and public prosecutors in handling a case.Keywords: International Criminal Law, Law Enforcement, Pre-Trial

Abstract

                                                        ABSTRACT:Terrorism is a threat for any country and an international crime that must be fought by every country, but a country is not allowed to fight terrorism in the territory of another country, because it is contrary to the principle of non-intervention, which stresses the principle of the sovereign equality of every country. But in fact, the United States has committed military attacks against Afghanistan which resulted in many civilian casualties, Afghans people died, and they didn’t include the thousands of people who had to flee to the surrounding countries. This research aimed to examine and analyze the principle of non-intervention on the regulations according to the international law and its relations with action of the United States to combat the terrorism in Afghanistan. The Research in this thesis conducted in normative legal research. The results showed that the regulation on non-intervention principle governed by international law was regulation in general legal principles, the UN Charter, and UN General Assembly Resolution No. 2131 and 2625. It was also known that the US intervention into Afghanistan are carried out by humanitarian reasons, self defence and to catch and prosecute the perpetrators of terrorism is an act that violates the principle of non-intervention in international law. It happened because there is no evidence of crimes against humanity in Afghanistan. United States also intervened without permission from the government of Afghanistan and didn’t coordinate with the UN Security Council. In fact, because of such action would lead to the view that the purpose of the United States was not only to fight against the perpetrators of terrorism, but also to change the form of government of Afghanistan.Keywords: Non-Intervention, International Crime, TerrorismABSTRAK:Terorisme merupakan ancaman terhadap negara dan kejahatan internasional yang wajib di perangi oleh setiap negara, akan tetapi suatu negara tidak diperkenankan untuk memerangi terorisme di wilayah negara lain, karena bertentangan dengan prinsip non intervensi yang sangat menekankan asas kesetaraan kedaulatan bagi setiap negara. Namun pada kenyataannya, Amerika Serikat telah melakukan tindakan serangan militer terhadap Afghanistan yang mengakibatkan banyaknya korban sipil, dan belum termasuk ribuan penduduk yang harus mengungsi ke negara sekitar. Tujuan dari penelitian ini adalah untuk mengkaji dan menganalisis pengaturan prinsip non intervensi menurut hukum internasional dan kaitannya dengan tindakan Amerika Serikat dalam memerangi terorisme di Afghanistan. Metode penelitian yang dilakukan adalah penelitian hukum normatif, dengan teknik pengumpulan data melalui studi pustaka dan dokumen terhadap bahan hukum primer maupun sekunder. Hasil penelitian menunjukkan bahwa prinsip non intervensi diatur dalam prinsip hukum umum, Piagam PBB, serta Resolusi Majelis Umum PBB Nomor 2131 dan 2625. Diketahui bahwa tindakan Amerika Serikat terhadap Afghanistan yang dilakukan dengan alasan kemanusiaan, pembelaan diri dan menangkap serta mengadili para pelaku terorisme adalah pelanggaran terhadap prinsip non intervensi dalam hukum internasional, Hal ini karena tidak ditemukan bukti terjadinya kejahatan kemanusiaan di Afghanistan. Amerika juga melakukan intervensi tanpa izin dari pemerintah Afghanistan dan tidak berkoordinasi terlebih dahulu dengan Dewan Keamanan PBB. Bahkan, akibat dari tindakan tersebut justru menimbulkan pandangan bahwa tujuan Amerika Serikat yang sebenarnya tidak hanya memerangi para pelaku terorisme, tetapi juga mengubah bentuk pemerintahan Afghanistan.Kata Kunci: Non-Intervensi, Kejahatan Internasional, Terorisme

Abstract

ABSTRACTAnother incident of sea pollution due to black oil waste occurred in early March 2022. The waves hit Bintan Beach during the north wind season which brought waste allegedly dumped by foreign ships in Indonesian border waters. In the village of Malang Meeting, Bintan Province, the coastline was damaged by pollution from black oil, which leads into the South China Sea. The problems that will be reviewed in writing are how the legal arrangements for this case are based on the applicable law of the sea convention and what are the law enforcement procedures for marine pollution. This study uses normative legal research methods, namely research conducted by examining secondary data and using statutory and conceptual approaches. From the results of this research, it can be concluded that the events that occurred on Bintan Beach violated the provisions of Article 192-237 UNCLOS 1982 and also that there were law enforcement procedures that could be carried out by seeking evidence, prosecution, and financial fines against perpetrators of marine pollution.Keywords; Bintan; UNCLOS 1982; Marine Pollution.ABSTRAKKejadian pencemaran laut lainnya akibat limbah minyak hitam terjadi pada awal Maret 2022. Pantai Bintan dihempas ombak saat musim angin utara yang membawa limbah yang diduga dibuang oleh kapal asing di perairan perbatasan Indonesia. Di Desa Malang Rapat, Provinsi Bintan, garis pantainya rusak akibat pencemaran dari minyak hitam, yang mengarah ke Laut Cina Selatan. Permasalahan yang akan diulas dalam penulisan yaitu bagaimana pengaturan hukum terhadap kasus tersebut berdasarkan konvensi hukum laut yang berlaku dan bagaimana prosedur penegakan hukum dari adanya pencemaran laut. Penelitian ini menggunakan metode penelitian hukum normatif, yaitu penelitian yang dilakukan dengan cara meneliti data sekunder dan menggunakan pendekatan perundang-undangan beserta konseptual. Dari hasil penelitian ini nantinya akan dapat disimpulkan peristiwa yang terjadi di Pantai Bintan tersebut telah melanggar ketentuan pada pasal 192-237 UNCLOS 1982 dan juga adanya prosedur penegakkan hukum yang dapat dilakukan dengan mencari bukti, penuntutan, dan juga denda keuanngan terhadap pelaku pencemaran laut.Kata Kunci; Bintan; UNCLOS 1982; Pencemaran Laut.

Abstract

Terrorism is used to intimidate the civilian population, influence government policies, and influence the organization of the state by means of kidnappings and killings. The terminology of terrorism itself is actually nothing new, until now terrorism remains an actual thing and continues to grow. Its development is in line with the development of human thought, science and technology and the development of high human movement between countries. These acts of terrorism are a global issue that affects the political policies of all countries in the world, making it a starting point for the perception to fight terrorism as an international enemy. In the War on Terror, the U.S. government is committing an "armed attack" against Afghanistan, with the aim of "self-defense" under article 51 of the U.N. Charter. The war on terror has raised new problems in International Humanitarian Law. The purpose of the study was to determine the status of terrorists in war on terror and understand the relevance of International Humanitarian Law in the context of the Global War on Terror imposed by the United States.Keywords: Humanitarian Law, Terrorism, War on Terror

Abstract

ABSTRACT:This study investigates the effect of double standards in international law on conflict resolution in Ukraine and Palestine. Through a comparison of conflicts in the two countries, this study finds that double standards in international law affect conflict resolution in Ukraine and Palestine differently. There is evidence of a double standard in international law related to the different interests of the major powers in the conflict in the two countries. The impact of this double standard affects the effectiveness of efforts to resolve the conflict in Ukraine and Palestine, with conflict resolution in Ukraine being achieved more quickly than in Palestine. Therefore, this research suggests the need for consistency and equality in the application of international law in dealing with conflicts, and seeking peace negotiations involving all parties involved in the conflict in order to achieve a sustainable resolution.Keywords: Double Standards, Conflict Resolution, Parties Involved.
