Abstract

ABSTRACT Articles 2 and 5 of CEDAW stipulate the obligation of the state to establish related arrangements for the elimination of all forms of discrimination against women. Indonesia has an obligation to establish regulations and protect victims in cases of marital rape. This is because the Criminal Code does not regulate marital rape. Marital rape is regulated in Law No. 23 of 2004 concerning the Elimination of Domestic Violence, but the law still creates many perceptions. This paper is a juridical study of the implementation of Article 2 and Article 5 of the Convention on The Elimination of All Forms of Discrimination against Women (CEDAW) by the Government of Indonesia in relation to Marital Rape. The research method used is a normative legal research method. The normative legal research method is a legal research method that focuses on library research. Normative legal research focuses on analyzing data such as legislation, legal theory, as well as legal research scientific works.Keywords; Woman; Marital Rape; CEDAW.ABSTRAKPasal 2 dan Pasal 5 CEDAW mengatur kewajiban negara untuk membentuk pengaturan terkait terhadap penghapusan segala bentuk diskrimansi terhadap perempuan. Indonesia memiliki kewajiban untuk membentuk peraturan-peraturan dan melindungi korban – korban dalam kasus marital rape. Hal tersebut dikarenakan KUHP belum mengatur terkait marital rape. Marital rape diatur dalam Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga, akan tetapi undang-undang tersebut masih menimbulkan banyak persepsi. Tulisan ini merupakan penelitian yang menelaah secara yuridis mengenai implementasi Pasal 2 dan Pasal 5 Convention on The Elimination of All Forms of Discrimination against Women (CEDAW) Oleh Pemerintah Indonesia Terkait dengan Marital Rape. Metode penelitian yang digunakan adalah metode penelitian hukum normatif. Metode penelitian hukum normatif merupakan metode penelitian hukum berfokus pada penelitian kepustakaan. Penelitian hukum normatif fokus pada pengkajian data seperti peraturan perundang-undangan, teori hukum, dan juga karya ilmiah penelitian hukum.Kata Kunci; Perempuan; Marital rape; CEDAW.

Abstract

Terorisme adalah serangan yang tersistematis atau penggunaan kekerasan, baik untuk melawan otoritas yang sah dengan maksud mengkomunikasikan pesan politik kepada kelompok yang lebih besar dari kelompok korban dengan menimbulkan ketakutan dan dengan demikian mengubah perilaku kelompok yang lebih besar. Yang menjadi persoalan adalah bahwa masalah terrorisme ini sudah menjadi masalah yang melewati lintas negara. Persoalan yang akan dibahas dalam penelitian ini adalah bagaimana hukum humaniter internasional mengatur mengenai tindakan bom bunuh diri dan bagaimana penegakan hukumnya dimata hukum humaniter internasional. Dalam penelitian ini, penulis menggunakan pendekatan masalah hukum normatif dengan tipe penelitian deskriptif analisis. Kemudian data yang diperoleh untuk penelitian ini merupakan data sekunder yang berasal dari sumber kepustakaan, jurnal, artikel, berita, dan situs-situs online. Hasil dari penelitian ini menunjukan bahwa Konvensi Jenewa 1949 beserta protokol tambahannya melarang dengan jelas aksi terrorisme ini namun penegakkan hukummya masih cukup sulit mengingat status dari kelompok  terrorisme yang masih diperdebatkan dalam hukum humaniter internasional.

Abstract

The purpose of this study is explicitly to analyze Indonesia's strategic role in the development of International Law in the ASEAN Community and to understand Indonesia's contribution since the beginning of the formation and development of ASEAN, Indonesia when analyzed its role is significant because during the ASEAN leadership in certain years (1976, 2003, 2011 and 2023) this is very fundamental, where Indonesia's strategic efforts to continue to strengthen ASEAN as a unity in the Southeast Asian region that is growing rapidly, inclusive and sustainable, that the ASEAN Community has the capacity to resolve problems between member countries through the mechanism of International Law. Normative research methods are used to analyze the various strategies used in Indonesia's interactions as a country and part of the ASEAN community. Indonesia sees the opportunities in the ASEAN region as a space that can support Indonesian cooperation. Indonesia's success in including maritime issues in the ASEAN agenda is also an initial step that will help pave the way for Indonesia to realize its vision of the World Maritime Axis. Indonesia's significant role certainly promotes stability and security in the ASEAN Southeast Asia Region and it is important to remember Indonesia's commitment to the principles of International Law and peaceful resolution of disputes.

Abstract

The rise of conflicts and crimes that threaten the sovereignty of the Republic of Indonesia is increasingly disturbing the defense and security of Indonesia. The weakening of the strength of the Indonesian National Army after the military embargo by the United States, France, and Germany made Indonesia feel the need to conduct military cooperation with other countries to improve the defense equipment and the quality of the Indonesian National Army as a means of National Defense. Russia, which is increasingly advancing in technology and military fields, has always sought the attention and support of developing countries in re-realizing its "superpower". This was used by Indonesia to re-establish "friendly" relations with Russia which had been tenuous during the new order in power in Indonesia. The purpose of writing this article is to find out what steps have been taken by both countries in conducting military cooperation, understand and explore various conflicts that could be a threat to the integrity and sovereignty of the Republic of Indonesia.  Furthermore, it also wants to know, understand, and describe how it affects various efforts to improve defense and security in Indonesia. The method used in this study is a descriptive research method. This research uses the library method (library research), the source of data for this research is entirely based on library research, books about literature. This research is based entirely on library research, books on foreign policy, the Indonesian Ministry of Foreign Affairs and other writings related to this research.  this research. The results of this study are: to improve the defense equipment and the quality of the Indonesian National Army in order to maintain and improve defense and security in Indonesia, the Indonesian government conducted military cooperation with Russia which was implemented into two forms of cooperation; Defense Cooperation and Military Technical Cooperation. The Indonesian-Russian government commission on Military Engineering cooperation has produced a memorandum of Understanding (MoU) on the commitment to procure the main tools of the Indonesian National Armed Forces weapons systems from Russia and in a visit to Moscow in December 2006
